  1. Ok, so my fiancee and I will be having our interview very soon, and she had brought to my attention that her Birth Certificate had a late registration. She was born in the Philippines in 1987, and was registered late in 1998, 11 years later. Her Baptismal Certificate is also this way, and she was worried that this might pose a problem. So to those who have experience/knowledge, do you think this could cause a problem? If so, what can we do about it?

    Someone with your country & Consulate's experience can give you more info, but in the Dominican Republic this can cause nothing more than a delay after the interview sending the file into AP or AR (same thing), they need to verify her identity further.

  2. What are you worried about? If this is your reaction so far you're going to have a tough time ahead of you.

    Relax!

    You're doing wonderful NOA2 in 47 days and your case is headed to the consulate!

    Call to verify the consulate received the hardcopy, then follow the procedures for the consulate to get your interview date.

    The interview will be your real critical moment, proving a legitimate relationship and that one continues.

    I called my fiancee Shawnie in Houston today. She went out to the mailbox and there it was - NOA2, visa approval! We got the email on September 10th saying that an 'Amended Notice' had been mailed, and it finally arrived today, dated September 18th! Anyway, onto the next chapter. Roll on interview day!

    Update your timeline, you didn't receive an RFE, your NOA2 date was 9/10/2009 like mine

    leave your RFE date blank.

    Call NVC at 603-334-0700,

    1 for English, 2 for K-1 visas,

    talk to a representative give them your EAC #, they will ask for beneficiary and petitioner's names and dates of birth, then ask them for your embassy case number, when they received the file and when the file went out to the consulate.

    Mine was received by NVC 9/15 sent to DR on the 17th and I have my SDO # (SDO is for Dominican Republic)

    Hey how are you? Nothing yet, I checked the mailbox again today.

    I have searched everywhere on the internet. The only time I see an I-797 amended notice is for a reprint of an original approval form I-797.

    So I think we are both approved, but we can't party yet. Anyway that's my hunch.

  5. The USC´s birth certificate is a requirement of the AOS´s Affidavit of Support, so I´d request one asap anyway.

    Let me jump in here and ask this question. K-1 and then eventually the AOS application, is the the PETITIONER'S (not the beneficiary) birth certificate required anywhere in the AOS process? The petitioner has a valid passport and certificate of naturalization but no birth certificate and chances of getting it are slim.

  6. You're approved, start celebrating. I might be approved but can't be sure yet!

    A strange week at VSC. They seem to be processing a lot of petitions before the fiscal year ending 9/30/2009.

    I've seen petitions as far up as the first week of June being approved.

    On September 10th they sent me an email: We mailed you an amended notice.

    I call USCIS and they tell me the same, except they add it was form I797

    I posted about this yesterday. Search under "amended notice".

    I have a hunch on all of this.

    I think in the rush to get cases out, some cases have not been issued a NOA2 yet they have been approved.

    There is another member here with an IDENTICAL time line as mine, VSC processing who has an identical situation as me.

    I've searched the internet for hours, very rare scenario. The only time an I797 with amended notice has been issued is when it's a duplicate NOA2, hence my suspicion that I might be approved.

    Anyone have any thoughts?

  7. I think strange things are going on at VSC.

    Maybe they are rushing cases out.

    I got an amended notice, and one other member here got the same, and we both have the same NOA1 dates and notice dates 9/10/2009.

    What do you mean by amended notice?

    Ours just says:

    Application Type: I129F, PETITION FOR FIANCE(E)

    Current Status: Approval notice sent.

    On September 10, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

    Mine says:

    Amended notice mailed

    Strange

  9. Are you wearing your wedding rings? Do your finders have a mark from wearing them?

    Everything else looks fine from here.

    About the pics, someone else might be more helpful who is familiar with your USCIS local office.

    In Newark, NJ it seems to depend on the interviewer. Couples that I know have taken lots of pictures of themselves with friends and family over a period of time from the marriage to interview date.

  10. I'm confused, I'm not familiar with the I-130, as I'm in the middle of a K-1, not there yet.

    Isn't the I-130 filed out and signed by? The petitioner? Aren't you the beneficiary?

    Your children would only be listed if and only if they had been petitioned for, you where not going to bring them and therefore your wife didn't petition for them. Am I wrong on this? So if this is so, how could you have lied? You didn't sign the petition your wife did?

    Correct me on this, what am I missing?

  11. He's literally in no man's land. Nothing he can do.

    Two choices,

    1) Stay and wait for an amnesty IF one ever comes in the next few years, then proceed.

    2) Find an attorney, and a competent and honest one, if he finds an idiot of an attorney he will never see the USA again.

    I have dozens of tax clients who are either married or living with someone in this situation or ARE in this situation.

    They are stuck as stuck can be, they should have never done what they did, but did it anyway.

    Ignorance is a wonderful thing, as long as you're under it's wing.

  12. Don't worry about it. My future brother in law got a home visit last month, it was on a Saturday, he was approved this Tuesday. It seems that recently they are stepping up home visits, I've heard of many more in the NYC/NJ area. From what you've reported you should be fine, they might have seemed upset because there WAS evidence of a relationship and someone sent them out for nothing.
