  1. Hi all,

    I'm the beneficiary, I just found out last week I'm pregnant. My husband is not very happy for few reasons.

    He thinks if we get stuck at NVC stage as it has happened to other people, then pregnancy would not be good for our situation. He does not want to be away from the baby, he wants to share first emotions with me, too.

    Another reason is the medical test for the interview. They will find out I'm pregnant. Could the medical prevent me getting a visa somehow?

    I just wanna hear different opinions here and personal experience.

    We have almost the same timeline at the NVC as you do. And my wife is about 12 weeks pregnant. So I understand your feelings,,, However, what a better sign

    of a committed relationship then a baby. As far as you husband not being happy,, might be the same as me, A bit worried about being apert during the pregnancy,

    concerned about you not being able to travel,, if the visa is not approved in a timely manner,, and for me and my wife, it was not in the plan. We wanted to spend

    a bit more time for her, to get here and her career established (she is a nurse). Life is that way sometimes. I take the pregnancy as a lucky (although unplanned)

    event in our lives, maybe, the luck will continue with a speedy visa. Good luck!!!

    Obama's move follows an investigation by IG Gerald Walpin finding misuse of federal grants by a nonprofit education group led by Sacramento Mayor Kevin Johnson, who is an Obama supporter and former NBA basketball star.

    I had seen that too,,, I hope there is more to the firing other then,,, Obama's friend being the subject of corruption.

    I am not a supporter of Obama in several areas... But,,, I will give the man his due,, when deserved. He is our president.

    I just hope he will start to support America first. We had had enough apologists... Move forward!!!

    We have received the NOA1 for the I-130 and we are planning to file I-129f for K3 and we need to file another G-325A. Yesterday, our HOUSE NUMBER in Pampanga just changed. Will it be fine to retain the OLD number from the previous residence history then just enter the NEW house number for filling up the I-129F form and the new G-325A for the I-129f package?

    Miight just want to wait to change the address when it gets to the NVC... First, they are easier to get ahold of,,, And second, they seem to actually have some ability to review and make changes... The CSC people.. always, seem to just read a script and provide no assistance.

  4. Do you have to married for more than 2 years for the CR-1?

    K3 is a NON-immigrant visa with a path to AOS for people married to US citizens. Upon entry, you will still have to file for AOS. Currently, there are no advantages to the K3, but it was created to decrease the time spent apart when it took a long time for CR-1/IR-1 visas to be processed, and is now obsolete (or so I read).

    IR-1 visas are "Immediate Relative" visas, available for couples who have been married for more than 2 years. If you have not been married for at least 2 years, you can get a CR-1 "Conditional Resident" visa, which is the same, except you have to file to remove conditions when you have been married for 2 years. The advantages over a K3 visa are that you do not have to adjust status, you enter the country as a US resident and do not have to apply to adjust status.

    Also K-3 is almost $1000 more expensive to CR-1/IR-1

    Beneficiary on CR-1/IR-1 visa can start working as soon as they arrive in US, where as its not the case with K-3.

    Read the guides and you should fly through CR-1. That's the best choice right now. A lot of people got delayed last year because they filed for K-3 rather than sticking with stand alone i-130.

    You file the I-130 which is for an immigrant visa for a immediate relative. Depending how long you have been married... 2 years or longer the beneficiary will be issued a IR1 visa, If you have been married less then 2 years (as in my case) you will receive a CR1 visa.

    Before the IR1/CR1 Immigrant Visa used to take much longer then the K3,, But, these days the processing time is

    about the same.

    My personal opinion is to file for both (as there is not an additional filing fee for the I-129F K3).

    Because in my case.. My K3 paperwork was lost between the CSC - Califormna Service Center and the NVC - National Visa Center. But,, my IR1/CR1 is still being processed in an efficient manner.

Hello everyone ..Being newbie here in this site makes me feel im belong..maybe because i know i am one of the people here in a situation of waiting for the time to be with their man or woman of their life..Anybody here can give me at least an idea which takes longer in processing between k3 and CR1..we told our attorney to process a k3 for us..though he filed it in two ways..as k3 and CR1..now we are approved in our I-130 and 129f remains pending until now..instead to be happy..we have questions in our mind now if this will be good or this will makes us wait longer than we expected..we got a notice from NVC telling us to pursue the CR1 now...we cant do nothing but follow.. so thats the path of our papers now......pleassssssseee i need to be enlightened because day by day its getting harder for me and for my loving husband waiting to be in each others arms..any idea would help..Thanks..Godbless... :innocent:

    I may be a newbie on VJ but, certainly not on the process. I would suggest that you always pursue a K3 in conjunciton with the I-130. The reason for this,,, Is inept government workers. My case is a perfect example. the I-130 and K3 were both approved on the same date. However, the I-129f K3 has been lost somewhere between CSC and the NVC. And neither one will take responsibility for this. So,, I still have one horse in the race. For me I am glad the I-130 is moving forward at a good pace.

I just found out last night that my fiancee's visa will be denied because she used to work at a go go bar, I have been informed that if I withdraw the current petition, I can file a new one that will reflect on the situation better. We don't need judgement, just advice. We are both good people, she did what she had to in order to feed her baby after the father beat her nearly to death and left them in the street. I don't know what to do now, there is so much at stake here.

    If that's her background, there is a possibility that she fits a certain profile for visa fraud, she might be using you to get to the US.

    BTW, who informed you? Is this info from someone you know?

    Background is not always an indicator of future behavior. I know of two sisters. One worked the bar and bar-fined out. The other was a counter girl and virgin (I knew the bar owner). Both got married to Americans. The bar-girl is still happily married and has a family. The "Good Girl" has been divorced more then once for cheating on her husbands. And, has lost custody of her kids from more then one marriage. May not be typical,, but, this story is true.

    I agree with most of the responses,,, about getting a lawyer to review... Keep in mind that working in a go go bar does not necessarily fall under moral turpitude (all kinds of girls in there).

    If she has never been arrested, and has no NBI records... Ask a lawyer. They will best know how to proceed.

    We are in the same situation you are. We made a copy of her current passport for the Bio-page copy needed for the DS-230. I think they just want to make sure she has a passport. Then she applied for a new passport (needed NSO marriage certificate) to support name change. She will have her new passport on 6/18. I will submit the new bio-page then,, and use the new passport for processing in Manila. If I run into any issues,,, I will send you an EMail.

  10. IGNORANCE OF THE LAW DOES NOT PRECLUDE YOU FROM ENFORCEMENT!!!!!

    Ok... Someone in the Philippine LCR made a mistake letting you apply for and receive a marriage certificate. That may come back to haunt you. Good news is you can apply for the I-130 and I-129f k3... With the LCR copy of the marriage certificate

    In my case I had to wait 15 days after the local LCR forwarded theit copy of the marriage certificate to the regional office before I could get the NSO copy.

    You will need the NSO copy once the NVC requests the DS-230 and supporting documentation or the Embassy requests it processing the I-129f k3.

    My thoughts are if you get the NSO copy... You will probably never have a problem. If you have the opportunity to return to Manila. I would suggest you get the Legal Capacity to Contract Marriage Certificate in case anyone asks for it.

    That is my two cents... Maybe only worth only one though... GOOD LUCK!!!
