  1. I recently received my tax transcripts and I also have my tax returns. I noticed for total income per the I-864 you can not show any deferred amounts like 401K contributions. I thought it was strange that the gov is looking at your ability to support someone else but does not take into account money you could use for this purpose. It does not effect me but I was wondering if there was a way to include this?

    I would think you could include it as any other asset,, Ie, Stocks, bonds, property, cash. etc.

  2. hi everyone i called nvc today and they told me they recieved my packet that i sent to them. they told me that they will email me. does anyone know what the next step will be when i recieve the email? thanks everyone for your help

    Main things,,, get ds-3032 and ds-230 downloaded, signed by beneficiary and sent to you asap. And work on i-864 requirements (Ie.. tax transcripts ordered)

    Also for CR1 you need the original NSO Marriage cert and NSO Birth Cert, NBI Clearance and photocopy of Bio Page from Beneficiary plus US Style passport PIC.

    Those are the main time saving steps.

  3. Hello all,

    I have heard that some people get a letter from there Congressman on behalf for their spouse. What exactly does the letter have to say are what do i even need to ask for. My sister is good friend with a lady that works for our congressman and i was hoping that i could maybe get a letter written but im not even sure what the process is. If anyone has ever had this done i would love for ya to share info with me. Thank you very much and good luck to everyone getting your loved ones home.

    Unless there is some extenuating issue. I would reserve that for any problems.... cause,, if all is straight forward it will have no effect on the timeline.

    I hope all is well and everyone is making progress with their visa journey. Our K1 was approved two months ago and interview is scheduled in Manila on 8/25/2009. I will visit my fiance for the 3rd time within the last 1.5 yr and we're thinking if we both should attend the interview. Please let us know if it is advisable to attend interview together.

    Our CR1 was approved in May and we will have our interview on 8/17. I am planning to attend the interview. I think it can only help. I read elsewhere you will be allowed into the embassy, but, may or may not be able to participate in the interview. Depends on the Consular Officer. And if you are there they could interview you seperately if they want... And compare answers.

    I am thinking to go into the embassy and give her my passport to take into the interview with her,,, as additional proof of a continued bonafide marriage. I read that here on VJ too. Sounds like good advise. At that point they can decide whether or not to involve me.

  5. Just watch out on the weight of your bags. Airlines allow only certain weight for your bag, then if it is too heavy you will have to pay extra. And it is quite a bit!!!

    Check with the airline you will fly. I think the US airlines allow 75 lbs, that's like 35 kgs.

    Really,,, check with the airlines,,, many are going to a new standard of 50lbs... I got a decent status on the airlines,, so, never have to pay. But, I see irrate customers all of the time that are shocked due to the unexpected costs.

    Also, remember, you can take a small bag on board with you and a personal item like a purse or laptop bag.. I usually take a 20" rollerboard (hold 5 days of clothes) and a laptop backpack onboard the plane and check nothing.

    They can't lose what I don't give them :)

  6. Hi everyone. Ok, so about 2 weeks we received NOA2 for both I-130 and I-129. My wife (currently in Russia as I am in the US) emailed the NVC with our case number to request me to be her agent. Just yesterday she received the email response saying they accept the terms of her assigning me as her agent. Then today, in the postal mail, she got a packet that has documents and that she is to interview for her K3 visa on August 17 at 8am in Moscow.

    Here's the deal -- neither one of us wanted the K3 visa, we wanted to wait for the K1 visa. So what should I do? Do I need to call the NVC and tell them we want to pursue the K1 visa only? Or do we simply ignore the interview appointment for the K3? I am assuming we have to call someone, yes? Did our I-130 status get cancelled?

    You mean... You want to pursue the I-130 CR1 (immigrant Visa) the K1 is a fiancee visa. You might want to call the embassy and reschedule the K3 interview for Sept. and then finish the NVC process for the CR1. Once that is completed request the K3 interview date be converted to the CR1. At least this way both petitions remain viable. I think I read somewhere here about cancelling the K3 could cause an issue with the CR1... I am sure others will chime in on this for you.

    I figure best to keep all options open.

  7. My case is fairly complex and I did it without a lawyer and no RFEs.

    It will take a minimum of 2 weeks to get married in the Philippines due to the 10 day waiting period.

    There is quite a few benefits to getting married in the PI... A couple are... First, your fiancee can invite her friends and relatives...

    Second, She will not have to put her life on hold for a promise,,, that can be a long time,,, and there is no guarantee that you

    will marry her,,, even after she travels to the USA...

    So,,, I know in my situation is was the right one.. To marry in the PI and file for the I-130 CR1.

    Costs are about $1100.00

  8. Can anyone recommend a good insurance company that will insure a non-citizen that has not been here for at least a year? Specifically maternity insurance. I've already looked online, and only found places that want to sell us some 137.50 a month "up to 80% paid" policy. However, it doesn't sound very good and they wont let me see the policy before I buy it. (big hint there) I missed putting her on my health insurance because it was so costly. We were just going to find an individual plan for her. However, that is starting to look impossible.

    Might try to get her added to your insurance for a qualifying event, marriage, or she lost coverage elsewhere (you have 30 days)... Open enrollment (when does your company do this?) if you can get her enrolled before the baby is due,,,, they might have to cover,,, cause, I understand pregnancy is not subject to the preexisting condition clause... But, might want to verify that.

  9. I just read about this. What is this?

    I have been waiting 5 months for Vermont to do their thing then after this is done I figure another 2-3 for her to get the medical and the interview and the visa. My next step was once that visa is in hand I'm putting her in a seat on the next flight to LAX. (love you baby)

    Now I read that she needs to do a CFO? What's that? I gather it's some kind of seminar for foreign living seems a bit redundant since she's going to live with a foreigner but when in Rome, right? Anyway, what is this? How long does it take? Can she do that now while we are waiting around? Thanks for any feedback.

    Takes one day,,, there is more information around here on it.. Bascially,,, I think it is a seminar,, for fiancees and spouses to know what their rights

    are and who to contact in the event of abuse...

  10. i was just wondering if u can bring/use gadgets like cellphone,ipod,camera on the plane and during take off?

    You can use a cell phone and other devices mentioned over 10,000 feet,,, but, only if you can disable the communications mode...

    And normally u can use the cell phone as soon as you land,,, but, they will tell you when,,, and when in doubt just ask.

  11. Thank you for the prompt response. I am already married to her, and did not do enough research on this issue prior to filing the I-130. I have seen many arguments that by now filing the I-129F, it may hender the process. I guess my specific question is what the time line is in California for stand alone I-130/K3 as opposed to doing it as a finance visa or K1. That everyone for their input and suggestions.

    Take a look at our timeline... It can be relatively fast (134 days I130 to Interview date). I would suggest filing the K3,,, You can decide later which one to pursue.

    I have seen cases where the CR1 was lost and in my case,,, the K3 was lost between the CSC and NVC.... 8 weeks and counting.

  12. You're fine. Not to worry. The biggest thing at the interview for us was under what name I wanted my green card, generally they go with whatever name is listed in the passport.

    My situation,,, I used married name on everything,,, except passport copy to NVC was maiden name... When they processed the DS-230 they changed the name on the file to maiden name... And, since married name now on passport... Will be changed to married name at the interview time when visa is issued.

  13. I agree mostly with the others,,, With the rare exception that one of the petitions gets lost between the Service Center and the NVC...

    Which happened to my K3, and I have read another case where the CR1 got lost... So I had no choice in the matter. The K3 has been

    lost for 58 days and counting. But, the CR1 arrived at the NVC in a few days (i pursued that option) and now the interview has been

    scheduled. The entire process was 132 days from I-130 submission to the scheduled Interview date.

    In short, I filed for both, cause the I-129F for the K3 costs nothing other then a bit of time.

    This is from the cover letter I sent for the K3 Visa petition...

    Contents of I-129F package:

    □ Copy of I-797C, Notice of Action (From submission of I130)

    □ Filing Fee – Note: No Fee Required for I129F/K3 where the underlying I-130 petition is currently pending.

    □ I-I29F petition filed by USC, petitioner on behalf of ALIEN, beneficiary

    □ I-129F addendum (additional information in support of I-129F)

    □ Copy of Birth Certificate of USC

    □ Copy of Birth Certificate of ALIEN

    but marriage licenses, i think (not sure), must be obtained from where one resides... so that when the marriage ban is put up the locality will be informed.

    once you have your marriage license, you can marry anywhere within the Philippine Territory.

    JUST ONE ADVICE: Do not skip the marriage ban (10 days) for obtaining the license. You would get tons of grief for this later on.

    Yeah I think that is the case. The marriage license request is posted publically for 10 days (As was in our case),,,

    Then after that a licence was issued. There was no restriction on where the marriage could occur.

  15. I got the same message from the AVR, no email no letter in the mail nothing. The operator also said it was probably just them finishing the AOS and not having started the IV package yet. If it is a real RFE the operator should be able to see what's missing. I think you've got nothing to worry about. My case was completed about a week after the false RFE.

    Same here RFE... AOS finished and ds-230 not entered into the system yet. The RFE is autogenerated. Mine cleared up after the DS-230 was entered.

  16. hi there! i just want to ask if we could bring and used either GLOBE/SMART sim and activated it as a roaming sim? if we already in the US? any idea?

    If it is a pre-paid plan. Possibly if they have an agreement with a US Carrier. Would most likely be cheaper to get a sim card from T-Mobile for about $10

    and then do pre-paid card $100... Will cost you 10 cents per minute... And the minutes are good for a year.

  17. Check their bank account, if the money have been taken out then call NVC and ask to speak to a supervisor.

    This happened to me too,,, cause, I paid the IV bill before the AVR system said, it was generated. Once, I talked

    to the supervisor... It took about 10 days to get resolved. However, it does appear that they continued to process

    the DS-230 paperwork.

    When you go to SLMCEC for medical examination, you must bring your passport and one photo (size: 2” x 2”).

    Also, bring your appointment letter or NOA#2.

    The medical examination fee is US$213.35 for adults (15 years of age or older) and US$185.35 for children (14 years of age or younger). Repeat X-rays will cost US$7 each. Fees must be paid only in Philippine pesos at the prevailing exchange rate.
