  1. As Inky mentioned, the photo is US passport size. When you go to any photo studio (in the Philippines), just say that it is US Passport size and they will know what to do.

    As for the pictures together, we put them in a clear plastic and wrote the information about the photo (date taken, where)at the back of each.

  2. NBI did announce a change in the way they are processing NBI Clearance now. In their Press Release, they even mentioned that they would not be processing anything until the new system is up. I think they had just resumed operations early July and may have backlogs that is why it would take them longer to process now.

    This is the link to their news NBI news but it did not mention how the new system will cahnge the length of processing.

  3. The AOS, EAD and AP process is simple enough that you can do them on your own just by following the instructions provided by the USCIS on the forms. Also, if you have questions about things, VJ is a good site for you coz you can get answers from people who have experienced the process and the moral support is there too. If your situation is not complicated, doing it on your own is the best way.

  4. Questions that I remembered from my interview that wasn't mentioned on the other post:

    1. What is your fiance's job?

    2. How long has he been in the company? (I answered an estimate)

    3. In what website did you meet? (Since I mentioned that we met in a gaming website's forum)

    4. How many times has he visited you?

    5. Did he meet your family during his visit?

    6. How did your family react to him?

    Then some questions were based on the evidence I brought like the pics and e-mail printouts and chat logs. These were trivial questions and is more like just having a friendly conversation with the CO. This was after the "formal" questions.

    1. (Pointing at my fiance's picture) Is he the lucky one? :yes:

    2. Where was this picture taken?

    3. (On the email printout) Who is kitten? (I explained that kitten is one of his terms of endearment for me because of our age gap)

    Then right after those questions, the CO said "Well, he should be happy now that you're getting your Visa" and he congratulated me and said Best Wishes. :)

  5. Hi guys I spoke to mango tours agent this morning regarding the booking and travel tax, the agent told me that if I pay in cash(not cheque or credit card) we can avail the first time immigrant promo I will pay $700.00 including travel tax, and she said I will pay only 750Ph for Terminal Fee,

    That's nice but be sure that they indicate that the travel tax is already paid with the ticket in their receipt so you don't have to pay for the tax twice. Coz sometimes, some people in the airport would try to make you pay even if you've already done that. So just to be sure, ask the travel agency to specify clearly that the tax has already been paid.

  6. We will be sending ours before the end of this month. Still waiting for some documents to add to our evidences.

    I am worried though because our Lease Agreement does not include my name. The reason behind this is that he did not renew it and the rent agreement is now on month to month basis because we're looking into buying our own house. The problem though is that we are still far from closing the mortgage deal and that's the document we are waiting for.

    We figured we will just send all our documents anyway before August ends whether we have the housing contract or not and just expect an RFE. This way there will be plenty of time to re-send anything. Do you think this is a good idea?

  7. My then-fiance (now husband) filed the I-129f right after his first visit. It got approved. Although, he visited me again for Christmas, USCIS did not learn of the 2nd visit until my interview at the embassy. That said, as long as you send in strong proofs that you met each other during the specified period, then the petition is most likely to be approved.

    I also would like to say that the CO was so surprised that my fiance visited me again after a very short period of time and even joked about it. So I guess they do understand the "troubles" that go with travelling (e.g. financial constraints, work schedules, etc.). And for as long as you and your fiancee could show that you have a good relationship despite the distance, you would have a good chance of Visa approval.

  8. Not sure what you mean by that, my whole fam was given 10 yr tourist visas just last March 2011 when they came to attend my wedding. My mom is visiting me again in a month and probably 1-2x a year for the next 10 years with the same visa. My tourist visa which they cancelled when I got my k1 was also good for 10 years. I got that visa last 2005.

    That's what the US Embassy website said and you can check on the link I gave. It might, however, be a MISINTERPRETATION on my part as to the way they stated it. It could be that All Mutiple-entry visa issued before March 31, 2004 would be invalidated and they would just have to re-apply for it and it's just the Visa with Indefinite Validity that they are no longer issuing.

    That is why I gave the link so they can read further and be able to see their options. :yes::)

  9. Annulment is the only legal route they can take at this point. It might be a long and expensive process but definitely worth the Peace of Mind. Besides, they won't be able to get married in the Philippines without Katie's Certificate of No Marriage from the NSO and when Katie applies for that, her previous marriage is gonna come up and she won't be issued the CENOMAR.

    There might be other legal options IF Katie is already a US Citizen because the Philippines would recognize divorce if one party to the marriage is a citizen of another country where divorce is legal. The following is quoted from Wikipedia:

    Philippine law, in general, does not provide for divorce inside the Philippines. The only exception is with respect to Muslims, who are allowed to divorce in certain circumstances. For those not of the Muslim faith, the law only allows annulment of marriages. Article 26 of the Family Code of the Philippines does provide that

    Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.[11]

    This would seem to apply only if the spouse obtaining the foreign divorce is an alien.[according to whom?] However, the Supreme Court of the Philippines declared in the case of RP vs. Orbecidio

    [..] we are unanimous in our holding that Paragraph 2 of Article 26 of the Family Code (E.O. No. 209, as amended by E.O. No. 227), should be interpreted to allow a Filipino citizen, who has been divorced by a spouse who had acquired foreign citizenship and remarried, also to remarry.[12]

    If you bought your ticket in the Philippines, it is most likely that the price already includes the travel tax but you have to check your receipt. If your husband bought the ticket in the US (like my then fiance, now husband did) you would have pay the travel tax. I paid PhP1,620 but this was 2 years ago. So maybe just prepare PhP2,000 to be sure. I learned about the travel tax during my CFO seminar so I guess they are more updated on the amount.

  11. Well, it was a simple performance and approval process at USEM today, and by bebeko was APPROVED!! Yeah, after all these months.... So happy to have completed another step.

    However... we planned for her to go there now, so that her visa will be good until early Feb, when I will arrive back in the US myself (late Jan or early Feb). But the CO told her that her visa will only be good until 14 Jan!! Why only 5 months? This is a huge problem for us, since I cannot leave here until at least 21 Jan. Any idea why this happened?

    Congrats! The Visa is valid for 5 months but she is allowed to stay in the US for another 90 days after she entered. So make her enter the US, maybe in December and then she will have 90 days more to stay legally but you have to be sure to marry within that 90 days. When she enters the US, the Visa automatically expires and the Immigration Officer at the POE will stamp her passport with another "expiration" date.

  12. The US Embassy used to issue Multiple Entry B1/B2 Visas to eligible applicants (e.g. Businessmen who travel to the US regularly, etc.) but they are not doing this anymore since March 31, 2004. This is according to the website of the US Embassy in Manila. Your wife would have to apply for a new visa (or renew her visa) everytime she needs to enter the US with you.

    I receive good news through my email and it stated my I-129F - Petition for FIANCE visa is approve. So now what? What should I do now or what should my FIANCE in the philippines do?

    Congrats to you and your fiance for completing the first step in your K1 visa journey. The next step would need lots of patience as it is the waiting period. Your petition will now be transferred to NVC where it will be processed and assigned a reference number (I don't quite remember but I think this is the MNL number) then sent to the US Embassy in Manila. The US Embassy will then send your fiance a notification advising him to schedule an interview. The letter would have instructions so you need not worry too much about it. Then while waiting for an interview, your fiance should have his medical examination done.

    Oh! and don't forget to prepare all the necessary documents for his interview.

They focus on the Petitioner's Financial capability to support a potential wife and future family and then they focus on the Petitionee's Background to see if there would be Red Flags along the way. And then they focus on the Petitioner and the Petitionee's relationship during the interview process. That's just what I have observed in my case and may not be true for all.

    You don't need SSN for applying for AOS. I applied for SSN AFTER I have received my EAD card and then the IO just put in my SSN during the interview for AOS.

    and there has being a query where i have been hearing from other people...

    some have said that you have to have had your menstruation cycle BEFORE the medical and other say AFTER your cycle.

    so which is it?

    Before or After the period both work but NOT DURING her period. She just have to take note of when was the last time she had her period because they ask this during the physical exam and if she has it regularly. They won't finish the physical exam if she has her period during the medical and they would ask her to go back after her period is over. Like what happened in my case, I was able to go through almost the whole thing when my period suddenly started that day probably because of stress and my being irregular. So the doctor just wrote a note that I should be back after my period is over to finish the rest of the medical exam.

  17. The National Statistic Office (NSO) issues a Certificate of No Marriage (CENOMAR) in their "tamper-proof" paper. She needs to secure this before her interview with the embassy because she needs to submit this document. Note that the embassy requires the CENOMAR to be at most 6 months old. So it is advisable that she secure a copy near her interview date. The NSO processes request for this document for at least 10 working days.

  18. your fiancee would have to go to NSO and get a Certificate of No Marriage for her interview at the embassy. But there is no DELBROS anymore because I heard that it delayed some processing in the embassy and so they just removed it fairly recently. I was lucky that during my interview, the DELBROS thing has been removed already.

  19. i have the unfortunate experience of having my menstruation start on the day of my medical exam because i am irregular too. but they let me proceed to do the othe steps like blood tests, x-ray, vaccine screening and other stuff. the only thing they didn't make me do was the physical exam where you have to disrobe for the doctor. they told me to go back for it after my period is done. so she can go for the medical exam and she would just have to tell them at a certain step that she has her period and they would tell her where to go next and they would just put a remark on her paper that the only step she hasn't went through is the physical exam.

  20. The reason they ask for the last menstruation period is to make sure that you're not pregnant because one of the vaccines they would have to administer is not good for pregnancy. They would even tell you to make sure not to get pregnant within a month after the vaccination. Also, they would have to provide a shield for you during the x-ray if you're pregnant.

    If the last menstrual period has been too long before the medical examination, they would just do a pregnancy test. They would ask though when was the last sexual contact.

    If her menstruation comes on the day of the medical (just like mine did), she can still go through the other steps but they would tell her to go back for the physical examination when her period is over.
