  1. I am so sorry for your situation as I truly understand what you are going through. (See the About Me tab of my profile)

    I guess I should consider myself fortunate the embassy did not take our $585 for something we were not eligible for... and yet, the fact that they told us to file another petition as husband and wife and we WOULD be eligible for a waiver chaps my hide!

    They SHOULD know who is and who is NOT eligible for a waiver.

    I believe the waiver laws need to change!!

    If the true purpose of a waiver is to weigh the crime committed by the intending immigrant to the hardship faced by the US citizen then that weight should be able to be determined for ANY crime as long as the immigrant is not a threat to national security. imo.

To play Devil's advocate a bit here - If you met this man at home in New York, you had known him for two months, you were able to see him every day, etc... - ask yourself honestly, would you be planning to get married? Would you be even thinking about it yet? There are MANY factors involved here, and the transition to a new country is not easy for anyone - Your fiance will not be able to work for 6-8 months after he arrives, or even start looking for work - He won't be able to drive, he won't have any friends here at first, there will be many aspects of life in the US that he just doesn't get at first - These are all huge challenges to get through - even something as simple as the difference in food - in order to make it through all of this as a couple, you need to have a truly strong foundation - one that takes time to build.

    We all know how hard the distance is, but it takes time to develop a solid enough relationship to survive the struggles of this process - If you love each other, that love isn't going anywhere - Why not get things sorted out here first - find a place to live, ensure that your income is enough to support you both, visit a few times, deal with your family, etc... - before thinking of filing?

Also, get the receipt# from your fiance' and do a status inquiry online stating the urgency of getting the form and give them your contact info as well... that is what helped us.. turned out they had sent our non-impediment via Currier, but the Currier went to the Post Office and when no one was there to recieve it they sent it back to RGD :wacko:

    He needs them to call him when the Currier has the doc and let him know the name of the Currier...

  4. It would be easier to list the number of people who HAVEN'T had trouble getting their docs on time from RGD :rolleyes:

    It's a mess, and there have been many complaints.

    One boardie was there the morning OF her fiance's interview demanding the Non-Impediment... and hmmmm low and behold they got it that day!!

    I say be the squeekiest damn wheel you can be!

    Our Non-Impediment took 5 months ~ smh!

    For (Town, City) I put his City

    For State I put his Parish

    For Zip Code I put Jamaica

    One of the members actually got an RFE for not putting a zip code! um, Jamaica noh have zip codes! :bonk:

    I think the problem there was that she left the field blank.

    Always put None or N/A if there is none, or if it is not applicable. :thumbs:

  7. Lexi, this is how it goes, if he doesn't know how to get a PC in Jamaica, then he should be asking around in the yard, down the street on the corner, or the taxi driver. Every Youth or General in Jamaicaa KNOWS where and how to attain a PC, if they don't they know whom to ask in the community.

    ladies, stop doing everything for them, they know the process and where to go.

Ummmmmmmmm.................. less than 3 years has nothing to do with immigration - the standard is being convicted of a crime that COULD have resulted in a sentence of more than 1 year - literally 366 days - whether served or not. If your fiance has a conviction and jail time, you had better sort that out well before the interview.....

    Yes the expungement can happen, but it takes a long time, whether he is eligible depends on the severity of the crime and the amount of time since it happened... and you must get it done before ever setting foot in the embassy.

  9. Thanks for all the info JAPrincess! We are jsut trying to wait until he has birth cert in hand which fingers crossed should be next week (hopefully) Then we will turn in DS230 pt 1. Our priority expiration on NOA 2 says 11/22/11. Does that mean he has to be in USA by then or just have the interview date set before then?

    He will want to have his interview before then, if you don't have everything together you can e-mail the embassy and explain the situation and they can extend the expiration date of the NOA2 :thumbs:

  10. Oh wow! The plot thickens! You think you will make it over here before you deliver? What part of Florida does your hubby live in? Me and my fiance want to move to Florida once he gets here (to help me with the moving!) I think he will like the weather and Florida the best and I have always wanted to live there. I was thinkn Orlando area. I know alot of Jamaicans live in Florida, but I'm not sure what part. I want him to feel comfortable over here. You know? Plus he is a lifeguard so I figure he will have the best job opportunity in FL.

    What a coincidence you work at a Courthouse. I do believe his offence was in St. Ann though. Can you pull anything from there? How long does it take to get a certified court record? I think I am going to have him get it even if it isn't needed. Just in case. It was for No insurance. How much does the certified court record cost as well? We got in a major fight about it last night bcus I told him to go get it today but he said he will on Monday cuz the lines are so long. I was like i dont care how long the lines are!!!! Any info you can give me on the court stuff would be greatly appreciated.

    He will have to get the police certificate first @ Duke St. in Kingston. Once he gets that, if there is anything on it (and I am thinking an insurance ticket would not be :unsure: ) then he will go upstairs @ Duke St. and will request a white slip, mi cyaan remember what it name, and take it to the local court house for the court records.

    Praying things pick up for you. Remember the K1 has an expire date, so you don't want to wait too long to turn in the Ds230 (F)

  11. Hey guys, I want to know after you did your interviews. What happened next... as in did you have to send off anything off to DHL and how long did it take for you to receive your visa after?

    You don't have to send off anything. They will have you go to the DHL counter at the embassy and will take your passport. They will give you a tracking number so you can check the status on-line, and either deliver your passport and visa or you can pick it up.

    As Sus said, it could take a week to a month or more...

  12. I've have a friend who has a girl from China visiting him on a tourist visa.She is currently married to a man in Japan, and has dual Chinese-Japanese Citizenship. She attended college in the US over 20 years ago and has a degree in Finance. Somehow, she also has a SS Card and said she did work in the US when she was a student. Complicated enough yet?

    She says she is in the process of getting a Divorce from her Japanese Husband and wants to know how she can get a permanent resident card(Green Card),so she can stay in America and work. The friend she is staying with wants to marry her, but they are trying to find a way(of Course)to shorten the process on keeping her in the US. SO, after she does get a final Divorce decree, what is their best plan. Get married when she is her on her Tourist Visa, then apply for an AOS, or have her leave the country and have him apply for a Fiance Visa. Their plan before talking to me was for them to apply for a Fiance Visa While she is here in The US, and then have her go back to Hong Kong for the interview,in 8 months or so. She has a 10 year Tourist Visa, which she can spend 6 months here, then they were planning on her going into Canada and coming back into the US for another 6 months, until the time of her interview.

    Does any of this sound familiar? People always try to find some way around the Immigration Rules, and it never works out.My suggestion to them was get married, then apply for an AOS. Immigration may let her stay in the US. I know of at least 2 members of my Ex-wifes family that did that.Or they may make her go back to Hong Kong while the AOS is being processed. I'm sure her tourist visa will be instantly cancelled if they apply for a Fiance Visa.

    So any suggestions? I gave him this website, so he will be able to see your responses.Thanks Bill

    Oh, As for my current marriage, everything is going great. She arrived her March 5, Married May 6, Pregancy confirmed on June 3,AOS approved August 1,waiting now for green card. So my life is going good,that is why my friend was asking for advise. But I definitely don't have all the answers. Bill

    I would tell your friend to think long and hard about this :(

    Aside from the red flags mentioned by the above posters, the way the part in bold is worded it seems she is looking to immigrate, and is not inlove with your friend :blink:

    At the very least I would suggest to your friend that he be patient, have her go home and get DIVORCED first, and continue a relationship with her. If things progress they can marry on her next visit, apply for a CR1 and have her return to China to await her interview.
