We've not been yet, but a friend of mine went in August for her natz biometrics - she was under the impression that they do not take walk ups there. This is the Nashville, TN office.
What about doing a walk-in in a city other than the one where your residence is ?
Anyone knows anything about that?
Thanks a lot!
PS: We travel so much for my husband's job it's impossible for us to be in the state where our mailing address is...

Thank you for your quick reply.
The valid reason is that we live in hotels, every week a different one, because my husband is a performer and the show travels every week, city to city, state to state or even country to country.
So imagine if we had to give our current address
( I explained this at my POE and they said: just give a family member's address)
I heard that come cases don't get an interview. How are those selected? Randomly?
Thanks again and good luck to all of you
Well that certainly makes sense (glad I didn't make any judgments...).
There is no apparent reason/pattern as to if an interview is scheduled or not - somewhat random. When you get the biometrics appointment notice - look up a local ASC (Application Support Center) and bring the original notice (and I.D) to them and see if they will allow you to do a walk-in (there is no real reason they would not allow you to do so, they don't really ask question, it is simply photo and fingerprints and out the door in 15 minutes or so).
If you're lucky - you may not get an interview - if you do - you may have to make some arrangements then.
I have one more question, if we do get an interview, then say we are in another country at that time, can we ask for them to postpone it ? Same with the biometrics appt? That would not be advisable - best to, if possible, not be in another country.
Ok I will defenitely do that. Thanks so much!
For the country, unfortunately that is not up to us... I will let them know how complicated our case is and hope that they will understand!
Thank you!

The Interview (if one) and biometrics will take place at the local USCIS office (or ASC for biometrics) where you guys live - that is, where you've told USCIS you live.
Without making judgments - I fail to come up with a valid reason why you guys would not list the actual address where you live (but that is your deal). At any rate - they'll schedule things for the local offices on your forms.
(Biometrics appointments seem to be being scheduled within about a month or so of submitting the I-485.)
Thank you for your quick reply.

Once you get transferred to CSC (most K1s do) then expect no interview and just wait for your approval via mail.
Good luck!
Thank you for your fast reply. I appreciate how helpful everyone is on this site!

Hi everyone,
I have a few questions.
My case is a bit special, because my husband's job makes him travel a lot. So the address that is on file for us, is just his family's address, but he doesn't actually live there.Nor do I.
Anyway, long story short, for the biometrics appointment, does it HAVE to happen in the state where we supposedly * reside*? Or could I ask to have my appointment wherever we are at at that particular time? If so, who would I have to contact?
Also, when is that supposed to happen? I have sent the AOS package at the end of August, and so far, the only things they did was cash the check. We didn't receive any mail at his family's address.
Also, for the actual interview, again, does it have to be in the state where we * reside* or can we ask to have it elsewhere? ( in the US of course)
And when is the interview happening? Do we have a way to find that out?
This is very important for us, since we are flying all the time and need to know well ahead of time what is happening next and where we're supposed to go...
I appreciate any kind of help on this!
Thanks a LOT!

Hello everyone,
USCIS in Chicago received my AOS package today!
Best of luck to all of you!
Take care!
Oh one more thing, I see on some people's posts, that cases are being transferred to CSC? What does it mean, and how do they select whose cases are transferred there?
Thanks a lot!
Take care!

hi again,
Where can I find my A# and what is it?
Thanks a lot!

I should be getting the marriage certificate within 2 days, so a copy of that will be enough?!
Copy is fine - if you get asked to an interview, bring the original then.
The reason I am asking, is because I want to start working and get AP as soon as possible, but as I understand, if you file for those separetly, you need to pay around 600 dollars whereas if you apply for them at the same time as you apply for AOS, then it is included in the price ( around 1000 dollars).
You are correct - don't file the EAD and/or AP before filing the I-485 (otherwise you'll pay the additional fees - plus your EAD card would expire when your i-94 does).
Thanks guys,
Doing what I can to get the marriage certificate mailed to me as soon as possible so I can start that process.
Take care!

Rather than an official copy of the marriage certificate, you need a copy of the official marriage certificate (I know they sound the same but they're not). If you have the marriage certificate in your hands now - just make a copy of it for the AOS.
If you have nothing, you'll need to wait until you get it, then make a copy of it to send with the AOS.
Hi thank you for your early reply.

Hi Everybody,
I want to apply for my AOS and I see that I need an official copy of marriage certificate to do so.
I got married last week and to get that copy,I need to apply for it and it will take around 2 weeks, if not more, to get it.
Is there anything else I can put in the AOS package instead of that?
Thanks a lot!

Hi everyone,
I would like to know if a K-1 visa holder is allowed to study before applying for AOS. ( before and after marriage)
I would think so because it's not work but I want to make sure that I don't need to apply for anything.
Thanks a bunch,
Take care!

Thank you.
Very sorry if this question has been asked...I am getting married in a month and have been here for almost 2 weeks so I am filing for my SSN.
On question 3 of the SSN application form it asks: citizenship: US citizen----- Legal alien allowed to work----Legal alien NOT allowed to work ( need document from US federal state or local government agency that explains why I need a SSN)----other
What do I check?
No, I think this is the first time this has be ask today. LOL
If applying based on K-1 status and using the I-94 as evidence you want to check "Legal alien allowed to work."

Does anyone know?

You cannot work in the US until you have an EAD - employment authorization document. K-1s are considered employment authorized so they can get a SSN since some states require that for getting married, but a K-1 still requires an EAD. An EAD is granted based upon your current immigration status so if you apply for one on the basis of your K-1 entry to the US and the 90 day I-94, then it can only be issued for as long as the I-94 is valid - 90 days. However, it takes about 90 days to process an EAD so you spend hundreds of dollars for a document that expires almost as soon as it is issued. When you get married, you apply for AOS (Adjustment of Status) and that EAD will be based on the AOS and will be valid for one year or until the AOS is approved - whichever is shorter. So, you will have some holiday time on your hands as you cannot work in the US even as an independent without the EAD.
Thank you very much; this clarifies things a lot!
-
Wow congratz for your approval, second, sucks that they didn't give your SO days off from work, but hey that means he has job security.
1.Yes you MUST apply for a SScard before 90 days, they recomend not even wait to apply 10 days before your I-94 expires. You will need it for: Health insurance, opening a bank acct, in some states to apply for marriage licence.
2&3. EAD and AP applications are sent with AOS paperwork so you don't have to pay extra to get them.
AOS application is sent once you have marriage certificate and other docs, read the guides.
Hi thank you;
I have read the guides but it still confuses me sometimes.
What about me working as an independent...? Anyone knows?
Thanks a lot.

Hi guys,
First of all thank you so much for your help during those last few months.
I passed my interview 2 days ago; and I couldn't have done it without your help. So THANK YOU .
Second of all; now it's time to plan and I am very confused.
We were supposed to get married in July; but because my fiance's employer won't grand him days off for his wedding; we had to push the date 1 month later.
So that makes me wonder about the papers.
Can I still apply ;
1. For my SSN
2. For my employment authorization
3. For Advance parole
BEFORE getting married. Cause I will be in the States for about a month before our wedding.
I was counting on us getting married in July but I guess not... and I would love to still have all those papers at the time I was planning on.
Also; another question. If I work as an independent, do I still need to wait for the EAD to start working ? I guess so, but I wanna make sure. And you guys know everything.
Thank you so much,
Take care.

What about the * date submitted*? On question 10 also.
Is it the date we sent out the I129F ? Or the date the petitioner is filing the I134 form?
Thanks!
Does anyone know?
Thanks!
I used the I-129F date.
The date you sent it or the date they received it?
Thanks so much!

on the new I-134 they have changed the language of one of the questions which is:
10. I have submitted a visa petition to USCIS on behalf of the following person:
Should I write down the benefitionary of the K-1 visa?
Yes, your fiancees name and add "with this affidavit"
What about the * date submitted*? On question 10 also.

HI everyone.
Ok so I got the 2006 and 2007 transcripts for his tax returns.
The IRS was unable to fax us the 2008 one though, cause it will only be ready by June 1st.
I have a letter from them, that explains that.
I do have his W2's for 2008.
Do you think this will be an issue?
Thanks a lot everyone!
It says the latest Federal Income Tax. When is your interview? If ever u can still get it by June 1st then try of getting tax returns of 2008.
My interview is on May 20... so 10 days before they would be ready.

I would shoot the consulate an email just to make sure it is their routine practice
Yes, and then let us know the results.
Hi everyone,
Well I got an answer back from the embassy, and they said that they don't do it automatically...!
So to extend it, my fiance has to write a letter that states that he still wants me to go through with the visa application!
I don't know if it is the case for all embassies, but it is for Belgium!
Take care!

have them scanned to .pdf and e-mailed to you... of have them faxed to you.
Yeah but I'm not even 100% sure that the company has a copy...
What then?
Ummm.. it is the TAXPAYER's responsibility to maintain copies of there filed returns
And most reliable tax preparers would give the taxpayer an extra copy for their files.
Where did that copy go???
The company's accountant filed it for him...
I HOPE they have a copy. But it's Sunday so can't find out today...
Driver's license and state ID , California.
in Adjustment of Status Case Filing and Progress Reports
Posted
Hello everyone,
I would like to get my driver's license from California, I now have an international driver's license I got in my home country.
I called the motor vehicle commission to ask them what kind of proof I would need to bring, and they said a visa or so. I explained my status ( married to an american citizen, I94 expiring at the end of the month) and they said that I would need to wait til I have my green card in hand to apply for a US driver's licence/ state ID.
Does anyone of you have experience with this? Anyone had the same problem, and was able to bring other proofs of legal stay?
Thanks a lot!
Take care!
