Hi everyone,
Thanks for all your replies.
I have real good news, my brother in law went to the ASC office where I was supposed to have the appointment and told them what happened.
They just took the original letter, gave him a copy and said: ok you will receive a letter with a new appoinment within 2 to 4 weeks. The case has not been abandoned, it is just delayed by a bit. You can tell her she is rescheduled. Thank you have a good day.

So if this happens to anyone, do not worry, it can be fixed
I think the earlier the better ( my appointment was for Sept 30 and it is October 3d). Just act fast

Check recent posts by July or May filers. I can't remember which. But one person had a similar problem and got a denial letter but eventually got it resolved.

right now,,,,,,open your MS word and start writing a letter to the service center that you was suppose to be at
and miss, than mail to them. Next, if you havent already, someone mentioned to setting up an appointment though infor pass.....do it and keep the appointment.
This all need to be done ASAP........if you dont, you will have to pay (lot of money) to get reopened.
Ok I am waiting to hear from my brother in law to see what they say. I told him to tell them I am ready to fly there ASAP if I need to. I would do anything.
I am gonna write that letter right now.
I set up an infopass appointment on Monday 8AM , I will go there . It's not the original city I was supposed to go to, but I hope that won't matter.
My God it is so complicated when you travel so much .

Just curious, why didn't you get your letter til today? What date was the postmark?
Because like I said, all the mail is going to my brother in law and he only opened it today and scanned it to me
:( We're always travelling cause my husband works in a show,so that's the only way we can get mail ( we change every week...) The date is September 3d

That might be a tough one....all you can do is explain yourself....you surely cannot use the excuse that you are using a relative's mailing address...that's a red flag lol... don't you guys have a set US address?

No we do not have a set address. I told them about our situation when I entered the US and even before, when I filed for K1... They said: Use a relative's adress.
So we did. I sent my brother in law today to the office I was supposed to and have him explain what happened. Pray for me that they will listen and not abandon my case

I am really panicking, cause I missed my biometrics appointment.
I had called USCIS many time asking them when I would receive it and they told me to wait... Of course I had no idea that the letter was already at my brother in law's...
My mail arrives at my brother in law's address cause we are travelling every week and therefor don't have a fixed address...
So now I don't know what to do
It says on the letter that he scanned me today: If you don't make it on the scheduled appointment, your case will be considered abandonned
I have not abandonned anything, I just have a very stupid brother in law that I can't trust apparently , that gives me my mail WAY too late...

Any idea of what I could do?

when did the mail arrive at your brother in law's house? i hope all goes well with your biometrics. maybe you can look for a timestamp at the post office if they delivered your mail late.
He got it a while ago. He only opened it yesterday. I sent him to the office where i was supposed to go ( It's in Colorado, and I am in Pennsylvania right now) and explain to them that he ###### up, he didn't open the mail and transfer it to me. There is no need to lie and say that he didn't receive it. He simply didn't open it on time...
I am praying that they will listen to him and that the person he will talk to knows the show my husband works for and understands that we live a very special life, which makes us not be able to get our mail ourselves.
Please pray with me that they will listen to him and not abandon my case

I am a teacher and it's not preferable that I take off unless absolutely necessary. The week prior to our appointment date, I had a day free of teaching, so I took my wife down to the office for an early appointment. The lady behind the counter commented how we had come early and technically were not allowed to, but she was feeling generous that day and let my wife go.
I've read on VJ about people missing the appointment and just going the next day or so. My recommendation to you is to get into the office ASAP. Be sure to have your ID e.g. passport, appointment letter and marriage certificate (if your married name is different than your maiden name).

I made an infopass for Monday 8AM. The thing is I am not in the state my mailing adress is at, so I cannot go to that particular office. But If I warn USCIS on Monday that i have not abandonned the case and that I would like to have it rescheduled, do you think they will understand?
My appointment was Wednesday. And I knew about it yesterday. I wish it wasn't the week-end and I could talk to someone and tell them : PLEASE DONT CONSIDER MY CASE ABANDONNED!!
WHat is really weird though is that I called USCIS many many times about that letter and they always told me to wait... but those things happen, sometimes the mail doesn't get where it's supposed to or at the time it's supposed to... and then what? They consider you abandonned it?
Please pray for me that they will wait before considering my case abandonned

Just wait until Monday. Go and explain what happened. It is just for a couple days. The only thing is that you do not have the original. When i was doing AOS back in 2006 they also wrote in the letter that I could go every certain day (depends on the ASC) to have your biometrics taken until certain day until they really considered abandoned. I remember I could not go for mine because was during some vacations we planned for a long time, and as soon as we came back the following week they took my biometrics and I never had a problem during my AOS. Did you check your letter to see if says anything like that?
It doesn't say anything like that... I'm sending my brother in law today with the letter to the office I was supposed to go to and explain what happened and why he is the one getting our mail.
When I look on the site from USCIS, my case is not written as abandonned, it is as "initial review" and I got my AP approved yesterday...
I SO hope that they will wait a few days and that when I will explain them what happened, they will understand.
I know I don't have the original. but then again, there is no way I can have it sent to me, it's the week-end... So I'll go in my infopass on Monday and hope that either they will agree to have my biometrics rescheduled or even taken in that city? Who knows...
I just hope they haven't abandonned my case, I worked so hard on this

PS: do you know if they record the calls when you call USCIS? Cause I called them many times about that letter worrying that it may have gotten lost in the mail...And they said: wait 30 days past the receipt date,and then we can further help you...

All you said was that you were living out of state. Ultimately it's up to you to make sure you get all of your notices, even if that means checking in daily to ask "did I get any letters" or checking your status online. It's not up to USCIS, or your brother in law, to make sure you get notices. That's how USCIS will see it, anyway. But I bet you already know that.
I think your best bet is to go to the infopass appointment and explain what happened. I don't know this for sure, but I have to wonder if anyone at the place that is 3.5 hours from you would have the authority to decide whether or not it was still ok to take your biometrics.
I asked him everyday... twice a day... I checked my status online everyday too . And they never said when they sent the biometrics appointment letter. I called and called again... but they said: wait. I didn't have any other choice to get my mail, trust me I would have if I could
So you think infopass appointment? Anyway, USCIS only reopens on Monday right? So it's not like they would make any decision during the week-end... Am I right?
I got my infopass appointment on Monday at 8 AM ( the earliest time possible)...

I am in such a small town right now, there is no ASC opened on Saturday. The closest one is 3 1/2 hours away... and I would have to take a taxi that would cost me nearly 300 dollars.
Do you think it's worth it or I can just wait til Monday for my infopass ?
I SO don't want them to consider my case abandonned.

ASC you mean USCIS?
ASC = Application Support Center. You go to such a place for biometrics, among other things.

for the AP i guess they take less than 3 months unless the applicant got the RFE.

Hello everyone,
I would like to get my driver's license from California, I now have an international driver's license I got in my home country.
I called the motor vehicle commission to ask them what kind of proof I would need to bring, and they said a visa or so. I explained my status ( married to an american citizen, I94 expiring at the end of the month) and they said that I would need to wait til I have my green card in hand to apply for a US driver's licence/ state ID.
Does anyone of you have experience with this? Anyone had the same problem, and was able to bring other proofs of legal stay?

i didnt apply for driver licence but i got the state ID, i brought my passport ,marriage certificate, proof of address, social security card, NOA and all letters received from USCIS,they gave me a form i filled it and took a picture, they gave me a pass for the next day (for them to check my NOAs )

hello all August Fliers~ I have been posting my update because its pretty UNUSUAL and does not follow through the normal progress of AOS. Hubby received our AOS I 485 Interview Letter TODAY in the mail, dated Sept 11, 2009. Interview is for: October 16, 2009 8:00 AM in Los Angeles USCIS Office. ~ I mean our online status remains pending, last touched 09/04.
This is our story~~~ of course i'm ELATED that this is our final stage of approval before obtaining a PR/Green Card
... but also feel like wow... the sequence is off here ~~
Just wanted to share my story ~~ i know the timeline is different for everyone!

In most cases this is a GOOD THING. You could get your temp Green Card without an interview.
Unfortunately it also could be like Rosie and I (david) but your ages are not that far apart (LAUGHING).
The worst for you is that CSC does the same thing to you the did to us and send it back to your Local Office.
Ours has move to Lee Summit MO 3 time and CSC 2 times all since May 15th 2009 (this year).
Never get stressed out .. everything is fixable if you stay within the rules.
God will watch over us.

So she is here in the US on a student visa, and she has been engaged to a US citizen for 2 years. They really want to get married, and want to do it the right way.
