Hi guys, Just found spelling mistake in my marriage certificate. We have our religious marriage certificate and i found spelling mistake in my father in lows name. does it gonna be problem in the immigration's document? I have one from religious ceremony and one Registered by Indian gov. okay now problem is Indian gov. certificate shows rite spelling of my father in low and religious one has a problem. i am going back next week WOooooowiiiii lol and I'll apply for I-130 petition soon. hope to have speedy process.
If you are a hindu or your registered marriage certificate was from a civil marriage, then you don't even have to show your religious marriage certificate. But if you belong to other faith you may have to show your religious marriage certificate during your interview, you won't need your religious marriage certificate otherwise.
So can i make affidavit from lawyer showing my father in lows name spelled incorrect? I got married to her under Muslim religious law and we registered our marriage at Indian Gov. registration of marriage. We have 2 certificates now one from Indian Gov and one from Religious person. So can i send both certificates for I-130 or just one?
hey @ Trinket your profile photo looks like you are Indian and your husband is white person, is it? my wife is Indian and I am an American. So can u tell me if ur husband applied for I-130 petition from India of some US? and yes you are telling me not to send religious certificate so is it okay for me not to send? My husband used a check from his bank. Sorry I don't know the technical term for it. But we did pay by check.
Money transfers - I know a lot of people who show records of that. It's normal for the husband to support the wife. But it's not necessary.
Ceremony - No, I'm sure they'd understand if your parents couldn't afford to go there if that was the case. You could show package receipts from your folks to you or your wife though, if they've sent you anything. Our parents weren't there in our civil wedding. But we send one another stuff all the time and we call too.
BC and passport copy - Yes.
CR1 - The speed depends on the service center and also on how fast you gather the docs. After you send the I-130, go read the NVC Shortcut (the link is around). Soem can fly through the whole thing in less than 1 month, whereas on average it takes many more months. So my advice is, read that shortcut, get advice from everyone here, keep reading and pray. Also, double check the forms MANY times.

I was so worried about it. me and my wife still calling my parents 5 times a week, so ill have phone bills from India including numbers and time. Yeah thats true i need to read and pray. i hope we will have speedy service center. I m living in Utah so what do you think which service center will be handling our case? Thank you guys.

Send 2 photos of each of you. The full name of the person whose picture it is must be written clearly on the back of each photo.
Make sure the marriage certificate is in English, or if not, it's translated by a certified translator. (Should be taken to the Ministry of Foreign Affairs for authentication, I believe. The translator should take care of it.)
Photocopy of the ID page of your passport.
Copy of your birth certificate. (This and passport copy are used to establish citizenship. If you're a Legal Permanent Resident or LPR, show proof of it.)
Regarding bank transfers. What you want to show them at this point are records of money transfers to your wife and/or her family. If you have proof of joint lease of a house, or a joint bank account, that will help. You can make affidavits by friends and family if you feel you want more proofs of a bona fide marriage.

Regarding to bank Transfers, I didn't send my wife money yet, We just got married on 18th of January and we are still together so there is no chance of transferring money to her. I just have receipt from ATM which shows i withdrew money in India, Receipt Not gonna show whom i give it money to though so just wanna make sure if its all rite to send them? We had small ceremony over here so are they gonna ask anything about our ceremony too?? i mean why its just 20 people in the ceremony? and My parents weren't there, it was just me, my wife, and her family and relatives that's it. I m nervous about it now, There was no one from my side to attend ceremony. Hey please explain it to me nicely, Hey how long is it Gonna take for CR1? i heard its easy for spouse if you are citizen, So it means process will be fast ,is it??

i prepared for I-130 Now, List of my documents are below, Ill be going back to my USA next month and ill apply for Petition I130. Just wanna check if i have rite documents or not and please suggest me if i need something to put.
1. I-130 form filled out.
2. G-325A filled out for me and her.
3. Marriage certificate from religious leader Certified by Indian court.
4. registered Of marriage in Indian court certificate.
5. Affidavit from Her uncle notarized by court of India.
6.check for the fee of I-130.
7. One passport size photo of each of us attached with blank sheet.
8. Receipts for gifts bought for her.
9.Airline itinerary from India to America and America to India.
10. phone bills from my wife calling me and my parents.
11. emails copy
Okay one more question guys, Should i send them a copy of my ATM withdraw In India on a bank Statement? I was wondering if i make affidavit from my parents and one friend giving witness In USA? hey Guys please help me out, ill be applying at the end of the February. Thank you

If you've been living together long enough to have bills or other mail in both your names, that could be something good to include. DCF is different in different countries, so I am not sure what they'll be looking for exactly in this case. I wouldn't overwhelm them with paper though.
Immigration proceedings are pretty bad things like getting deporting. I can't remember - is there a separate area to say whether you've applied for a US visa before?
Thank you, Yes i sent my wife some gifts form USA, she has Receipt of that and we went to some restaurant together, i bought her some stuff by my credit card. Is it good to send them my credit card account details? i think it will be the best to show them

Marriage cert is proof of marriage.
When marriage is shortly before filing there is not much needed to provide.
One big warning about DCF filing.
US Citizen MUST provide evidence that maintained US Domicile. US Domicile is a requirement in order to sponsor an immigrant, US citizen petitioner must provide an I-864 for the interview, and the I-864 requires domicile, and past year's IRS return.

Yeah i know about that but anything else which we can attach for the strong proof? Like my and my wife's joint bank account or i withdraw money from the ATM for my wife? Can we send them ATM receipt for we withdrawing money for each other? I need advice please and we filled out the form I-130 one section says Information about alien relative and list husband/wife and all children of your relative. my wife is only related to me and i put my name over there because i am her husband, she doesnt have kids, is it rite?
on the G325 A it says "applicant be sure to put your name and alien registration number in the box outlined by heavy border" is it supposed to be my name?
and one other question says "has your relative ever been under immigration proceedings?" should we put yes since we applied for fiance visa and they denied it? we also appealed it but they dismissed it. do we have to include anything there for that reason? it seems like it doesnt apply becuase it says your options below it and they dont list that there.

Me and my wife is preparing for the CR1, We got married now and almost done with all the paper work. We have affidavit from Court as marriage proof from one of the relative. Do we still need anything else like join account or anything else to show for marriage proof? what else we can send as strong proof of our marriage? we fill out the form G25A by Handwriting, is it okay to fill out by black ink or typing? Please give me answer soon and please suggest me how to fill out the I-130 carefully. thank you

There are residency restrictions on DCF in India. I believe the minimum is 6 months. I haven't been able to confirm when that 6 months timing starts however - if it's from the marriage date or the date you establish residency. To establish residency based on marriage in India you will need to go to the FRRO office and have your visa status changed from a tourist visa to an X visa.
Try to have your fiance find out exactly what is needed for the X visa to be processed. I want to say I've read cases where you need to prove you were able to marry [easy enough if you've been divorced and have a divorce decree but if you've never been married people have gone to their embassy and notarized/sealed affidavits proclaiming the single status before hand].
as far as i can tell from other sections of this forum they said it was three months. is it really worth waiting three months in india to go there and apply when it may only take 6 months to get it from usa?

i am in india and am planning to marry my fiance soon. can we apply for I-130 from new delhi via direct consular processing in order to make the process faster? i am only here on tourist visa. i dont have a residence here. is it still possible to apply from new delhi directly?

I applied for K1 for my fiance in India. it was denied last month. now i want to marry her and apply for K3 visa. can we apply within 2 years after K1 denial? Reason they denied the K1 because we didn't meet in person and we did not sign the application
, I heard their is a family unity wavier, are we eligible for it? And if we can Apply for K3 then should we have to apply I-130 from India or USA? Please reply soon. thank you
You can probably get a waiver for a K3 but if you just file the I-130 and go the CR1 visa route, there would be no need for any waiver because you would file no I-129F.
what is the process for CR1? should we apply for an I-130 where we get married or can my fiance apply from USA?
