Thanks for your replies. Yes the assylum case took forever to get resolved I was surprised too as I had heard that it wouldn't take so long. I have been with my husband for a little over two years and we even went to high school together so we have plenty of evidence that it is a bonafide marriage since we've known each other for so long. I'm just scared they might not even give us a chance to prove it.

I first came to the U.S as a tourist about ten years ago with my mom and then we filed for Assylum. Our Assylum case was denied on Nov 25 and they gave us voluntary departure. Me and my husband had been saving to get married towards the end of the year but decided to do it earlier to speed things up. We've been together for over 2 yrs now and we want to make sure we do everything right so that I won't have to leave again. Im leaving the country before the 60 days are up because I don't want to break any laws and get the 10 yr ban.
My question is, has anyone here gone through this process after they have been issued voluntary departure or a deportation order? Will immigration automatically deny the petition or wil they at least give us a chance to prove is a bona fide marriage?

we should all keep in touch and keep updating each other on how things are panning out. Any one thought about taking the K 3 route as well?
well we sent it by courier and we re in hawaii... do you have a link where to check which service centre please? and yes we shall keep in touch!!
I can't look for the link now because I'm at work but I'm pretty sure Hawaii is under the California Service Center. Maybe someone could correct me if I'm wrong...

I sent mine last friday, Jan 02. My lawyer sent it to the Vermont Service Center.
how do you know the service centre? we sent it to the chicago locbox that there is written on the I-130 form by courier
Well they sort it by the States, and if your state is under Vermont service, then you are stuck with them.
Yea unfortunately Florida is under Vermont service . Hopefully they'll approve it fast

Thanks for your reply.
Yes I know I just started the process and I have long way to go, but I really want to have all the documents ready so that I could just mail them as soon as they ask for them. I want to try to make the process as short as possible, even though I know is going to be long anyways.

I know that I'm supposed to get the Migratory Letter and Police Certificate from the DAS office, but does it have to be the one in Bogota. I'm going to be living in Barranquilla until the process in complete and I know there's a DAS office in Barranquilla where my grandma got her Police certificate about 3 yrs ago, can I get the Migratory Letter and Police Certificate at the office they have in Barranquilla? Also, how long are these two documents valid for? I'm trying to get all the documents I need so that i could have everything ready for when my i-130 gets approved.
Thank you in advance.

Thank you for clarifying that. I have certified copies of both the marriage certificate and divorce decree. I got them both from the agency. Can I use the certified copies for the process and the interview?
-
Do you know if at any point of the Cr1 process I'm going to need the original marriage certificate and my original divorce decree (im the beneficiary). I have certified copies of both but my husband thinks he lost the originals. Do I need the originals for the interview or can I just take the certified copies?

I spoke to my lawyer's assistant today about my I-130 petition, she told me to fax her my birth certificate because se didn't include it with the petition (im the beneficiary). She said she was going to mail it in today and that there wouldn't be any problems. I checked the Uscis website for the I-130 instructions and it doesn't say you need to send in the beneficiary's birth certificate. Do any of you know if my birth certificate is needed now? And if it isn't at what point of the process will it be needed? Also if it is needed now will there be any problems with my petition because we're sending the birth certificate in a separate package?
Thank you

I just checked the processing times for the Vermont Service Center which is where I think they sent my petition. It says Feb, 2008 as of september 30, 2008, but on the top it says it was posted Nov. 2008. Does that mean that the processing time is abot 7 months (which is from Feb. to Sep) or 9 months (from Feb. to Nov). The 2 different dates have me a little confused.

Hello everyone. I Know there's four different service centers where you could send the i-130 petition, and I noticed that the one in California seems to have the fastest processing time. I was wondering if I could send the petition to whichever service center I want or if it depends on the state your located or something else.

Im the beneficiary. He asked me for a copy of mine and a copy of my husbands too.
-
Yes I know, I was very upset when I found out. He made a copy of my passport and I think he sent it in.

I just sent in my I-130 application on friday, jan 02, but I think my lawyer's assistant didn't include the copy of my birth certificate. In case they didn't include it, what should I do? Should I send it separetely? And will this delay the process?

Thanks for the quick reply. I was reading about the different immigrant visas that are offered for spouses and I came accross the CR1. Is that the visa that I would be getting if I go though the recidency process in Colombia? (I haven't been married for over two years)
-
Hi everyone, I recently married a U.S citizen and we just sent in the I-130 about two days ago. We were planning on doing Consular Processing, where the entire residency process would be done in Colombia. After reading some of the posts I'm a little confused. Is DCF and consular processing the same thing? If they're not, then what is the difference?
My husband will not be living with me in Colombia, he will staying in the States while I finish the process in Colombia.
Any help would be appreciated, thank you.
