This is so frustrating. I hate my lawyer.
My husband paid the processing fees on April 8 so we could have submitted the paperwork since the 9th (that's when they showed paid online). First we had to wait for the lawyer to come back from vacation, then wait for him to make the appointment to fill our the paperwork. My husband and mother in law went to his office last Monday to fill out the paperwork but the lawyer forgot to sign it and decided to go out of town again until tomorrow, which means that he won't sign it until Monday so by the looks of it they'll be sending in the papers on Tuesday, 20 days later!
So I guess a June interview is no longer an option

don't lose faith, I'm sure your approvals are coming soon.

Well, after the case was received by NVN my husband and I received and email from NVC asking us to pay the 2 bills. We didn't have to fill out the choice of agent form because we have a lawyer. We paid the bills online on Thursday and they already show paid. After the bills show paid online you could download the ds 230 and i 864 fill them out and then mail them to NVC with all the documents.
We haven't sent the DS 230 or I 864 yet because out lawyer decided to take a vacation and doesn't come back until Wed, his secretary never knows what she's doing. This is probably going to delay the process but my husband doesn't want to do this without a lawyer since I have my voluntary departure issue.
Thank you and please let me knowHi Ivy 88, I just recieved an email with my approval and we are doing CR1 like you guys but I'm a littler confused with all this process and since we are a little behind you guys maybe you can help me with what you have done so far. I'm pretty much filling out all this paper work but don't understand much of what I should do next!! I know I have to wait until NVC recieves our case because we got approved on April 10th! do you mind helping us a bit?
Thank you!

Hello everyone, I have a question about the ds 230.
I was given voluntary departure after my assylum case was denied and left within the time they gave me. I was never illegal in the U.C
I have a question about the 230 on question 30 h it says:
"An alien who was previously ordered removed within the last 5 years or ordered removed a second time within the last 20 years; who was previously unlawfully present and ordered removed within the last 10 years or ordered removed a second time within the last 20 years; who was convicted of an aggravated felony and ordered removed; who was previously unlawfully present in the United States for more than 180 days but less than one year who voluntarily departed within the last 3 years; or who was unlawfully present for more than one year or an aggregate of one year within the last 10 years"
Would I have to check yes on that one? Even though I wasn't ordered to be deported
I also looked at the 212 waiver to see if I have to fill it out and I found this under the heading that says Persons Permitted to Reapply for Admission Without Filing This Application. Persons who voluntarily departed from the United States without expense to the U.S. Government and without an order of removal or deportation having been entered.
So does that mean that I don't have to fill it out?
Thank you

woohooo!!! I got my case number yesterday and NVC sent me the email with the fees today!! We can't pay it today though because my hubby doesn't get paid until tomorrow but at least things are moving
-
regular mail.. don't you also have to pay the fees too?
yes I have to pay the fees first, I'm just asking in advance so that when my husband gets them we know what to do
-
Once NVC emails us the forms do we send them back to them through email or through regular mail?
-
Thank you, I'm just really worried about this whole process. I miss my husband so much I just want this to be over with

I found this too
" • Removal (Including Deportation) under a Formal Order . An alien who was deported or removed following a deportation or removal hearing before an immigration judge requires consent to reapply within 10 years of the date of removal. If the alien was actually arrested and deported, the file will usually contain a Warrant of Deportation/Removal ( Form I-205 ). Generally, if a warrant was not issued and executed, consent to reapply is not required: however, in the case of an alien who departed after the voluntary departure period set forth in the decision of the immigration judge, the file may not contain an executed Warrant of Deportation/Removal. Nevertheless, because the judge's deportation order became effective the day after the expiration of voluntary departure authorization, the alien's departure after the date is a deportation pursuant to 8 CFR 241.1(f) , and the alien does require consent to reapply. Occasionally, an alien who departed the U.S. under voluntary departure will believe that such departure constituted a deportation, and will file a Form I-212. If the relating A- file does not contain an executed Warrant of Deportation or an indication that departure was effected after the voluntary departure date granted in an alternate order of deportation, the Form I-212 is not necessary."

I must be driving you crazy with all my questions but I really trust all of your information. I'm the beneficiary, and I used to live in the U.S but I had to leave because I got a voluntary departure letter. I left the U.S within the time frame immigration gave me to leave. I was reading the documents needed for the ds-230 on the website and it says that if you were deported you would need to fill out form I-212. Here is what it says on the website:
"Applicants who have previously been deported or removed at government expense from the United States must obtain Form I-212, Permission to Reapply after Deportation, from the U.S. Citizenship and Immigration Service, or from a U.S. Embassy or Consulate, and follow the instructions included on that form."
From what I understand I wouldn't need to fill out a I 212 because I left within the time they gave me to leave and I didn't leave at government expense from the United States. What do you think?

NVC received my 129 and 130 March 30 and the 129 was sent to the embassy already but every time I call about the 130 they tell me that they have it but it's not on the system. Do you think they're going to hold off on the 130 since they already sent the 129 to the embassy?
-
My case was approved March 22 and I called about two days ago and that the 129 ws sent to the embassy and the 130 was there but not in the system yet. I called today and the 130 is still not on the system

Hello everyone, I am trying to get everything ready for NVC and I was wondering if we need to send evidence of bona fide marriage with the DS-230, like pictures, or emails.
Thank you

I would like to pay these fees online once they become available but I was looking at the NVC website that I found and I can't find where I would pay for these fees, can someone please tell me how to pay the fees online? And also is there somewhere where I could register my NVC case number so I that I could see updates online and receive updates on my email like on the immigration website?
Thank you
In your AOS package from NVC has IIN, which will allow you to pay bills online @
www.immigrantvisas.state.gov
Click the links “fee collection”, “online payment” and “online fee payment“.
You cannot register at NVC like at USCIS web site. Only source for updates are AVR or talking to NVC or wait for their e-mails.
Thank you!

Hello, I know that for form ds-230 I have to send a copy of my passport's biographic page (I'm the beneficiary), is that the page that has my picture, name and date of birth? Do I only have to send a copy of the biographic page or is it a copy of the whole passport, even the blank pages?
Thank you

Hello, I read somewhere that if I have a lawyer I don't have to fill out ds 3032 because the lawyer is automatically assigned, is this true?
-
so do I just ignore everything the embassy sends me about the k3 and just answer CR1? Won't I get in trouble for abandoning that visa? Sorry for asking so many questions I just want to make sure I'm understanding everything.
-
We filed the 129 and 130 in January and they both got approved March 22. I just called NVC and they told me that they already received the 130 but it hasn't been processed yet and that the 129 was sent to the embassy in Colombia yesterday. We don't want to continue with the K3 visa, we decided we want to proceed with the CR1. Since the 129 was already sent to the embassy, won't the k3 visa be done before the CR1? What can we do so that the CR1 will be done before the K3 so that I could get CR1 instead?

Hello everyone!
We got approved the 22nd and our application still hasn't arrived at NVC. We've been calling everyday and nothing yet. How long does it usually take to get there?
Medical Exam
in IR-1 / CR-1 Spouse Visa Process & Procedures
Posted
Hello, can anyone please tell me how the medical exam works?
I already have some of the vaccines they ask for but I don't know if I have records of them.
Does the doctor go by what you tell him you have or do you have to take proof that you already have those vaccines? And if I'm missing some of the vaccines, do I get them right there at the medical exam or do I have to go back to get them? And can the medical exam be done anywhere in the country or does it have to be in the city where the embassy is located?
Sorry I know it's a lot of questions, but I don't know how it works.
Thank you
