  1. Well, just googling the Hanoi embassy, you can see that the req's are the original birth certificate and marriage certificate *only* if the couple is married. Since you submitted the I-129F I think it would be a good idea to plead your case the the CO rather than get married just to put your name on the birth certificate (and thus the I-129F goes down the drain...). I'm sure the embassy probably recognizes that this is an issue. You should be prepared for a DNA test.

    I think there's a way to do this without getting married. That will be the best choice right now, I'll do some research on this. Thank you

  2. A few months after i files the I-129F, my fiance in Vietnam gave birth to my baby boy. It has been one month since the baby was born. I already booked an appointment for Consular Report of Birth in 2 months. My fiance going to get a Vietnamese birth certificate for my son. The question is, both of the child parent's name can be on his birth certificate. Should i put mine on there too or i shouldn't? I am thinking it's better to put my name on it. Therefore, on the appointment date, they will see that my name is on the child birth certificate as a father. That will be one of the biggest evidence that i am the father. Which will give me more chances that i don't have to take a DNA test. What do you guys think, please help

    ps. i have other evidence such as pictures of my fiance and i were together before , during and after she was pregnant. Will all of the stuff i've mentioned good enough not to take a DNA test?

    You have to put ur name on it as the father of the child at the bc..and it doesnt matter even if the baby is looks like U..if u dnt have enough evidence the baby will ended for a DNA testing...or it depends....hopefully not cuz DNA test is so expensive plus waste of time...

    my baby had DNA testing and it cost $754 in AZ..father first in the laboratory in Az then from the lab in Arizona they send the kit to the saint lukes philippines and test my baby and then send the kit back to the AZ,US....

    I am very confused and frustrated right now. My I-129F case is currently pending, and i have to get a marriage certificate in order to put my name on the child's Vietnamese birth cer. If i get a marriage cer., that means im married. That will blow my I-129f case.

  3. Get your fiance to contact the appropriate department and see how long she has to register the birth ... You may have enough time before your next visit ... I know we have a little time in Oz cant say what the deal is in other countries .. I had a quick google but I couldnt find anything but your fiance would have a better idea who to contact ...

    It's up to the CO whether you have to have a DNA test or not. Baby some of your features helps a lot!

    the baby looks like me, if they see that, for sure they will not require me to take the DNA test right?

    another question, i want to name my baby boy Justin, should i put Justin on the Vietnamese birth certificate along with his vietnamese name also? or i should add it in at the CBRA's appointment?

But it wasn't hard at all. We were in the same high school together at the time. One day we were arguing during lunch time, and the counselor saw us. He saw that she was crying so he invited her into his office to talk. She then told him about that incident which happened a month before that day. Next thing i know, i had to go to court and admitted that i slapped her. I even told the judge that she slapped me first, but he doesn't cared. I got charged with Mnor Battery, so i did community service, probabtion and more to closed that case. Hell i had to paid for the biggest mistake in my life. Another mistake was to let my sister filed the I-129F without in informing me about this section, and how important it is. I don't think she knows how important it was since she passed her background check easily because she never dealt with the police or court before. However, i am praying that i will get an RFE requesting court records instead of a denial.

    Now it's clear the correct answer was yes, instead of no. Chances are, if anything, you'll get an RFE. I'd be prepared with a copy of the records. IMBRA is all about informing the beneficiary, not about denying petitions.

    Isn't the query into the background of the Petitioner at the NVC stage?

    If recollection serves me I believe that is correct.

    If so, at that point the petition is already approved. If a discrepancy is discovered regards the criminal background of the petitioner, I think it is more likely the petition would be returned to the Service Center.

    Name checks on the petitioner are performed at the service center, at NVC and potentially ordered by the Consulate. Since IMBRA went into effect, USCIS service centers are required to verify whether the yes or no questions about criminal convictions have been answered accurately and whether applicable records have been supplied, as part of petition adjudication. We've seen more than one RFE for people who either answered incorrectly or failed to answer.

    Approval without an RFE, is also a possibility in the OP's case. While we now have enough information to know the correct answer was yes and the court records should have been supplied, we cannot be sure of either what the adjudicator will see or decide based on what they see.

    i got my NOA1 since 9-9-2008 and still havent heard anything from them, not even a touch. I've seen so many people who filed their I-129F got their approval long time ago.

  12. It would take an Ouija board to predict what you will or will not get.

    As for checking "no" on a question filed with USCIS that is or should have been "yes", and it shows up, you likely won't just get a simple RFE.

    From the I129F - just above where you sign your name:

    you may be fined up to $10,000 or imprisoned up to five years, or both, for knowingly and willfully falsifying or concealing a material fact or using any false document in submitting this petition.

    Only you know the specific details of the conviction and if your particular case is applicable to the list on the I-129F. Either way, I wish you luck. Advise any and all applicants, as has been done thousands of times on this site - NEVER lie or conceal information on applications.

    actually my sister did the whole application for me. She has been through a successful process of bringing her fiance over here. I thought since she has been through it, that i wouldnt be worry. Now i came on here reading more and more about this everyday, i've realized what a mistake that was to let my sister filed it. Now i could get a denial because of her, she checked No and didn't even specifically told me all the details. God this is so stressful

The lady told me that the charge that i pleaded guilty to is called TRUTH, its not called Convicted because i was still a juvenile. Its only called Convicted if im an adult which is 18 and up. In the paperwork i filed for my k1 asked if i ever been convicted of a crime, i checked No. So did i do it right? is it going to be a denial for my k1? what do you think going to happen? i am so worried please help

    The questions on the I-129F regarding convictions are very specific. Be sure you understand the questions and you'll be able to answer accurately. If you must answer yes, follow the instructions for providing court records.

    I said nothing about what the lady told you. Start by carefully reading what I wrote again. Then carefully read the applicable questions on the I-129F. Note that only specific categories of crimes are asked about. If you have not been convicted of any of those crimes specifically mentioned, answer no. If the correct answer is yes, then provide the records. If you don't understand the questions or parts of the questions, try to tell us what you do or don't understand, so we can help you. If we can't help you understand the questions, you'll need to consult an immigration attorney.

    Since you the US citizen father your fiance can file for a CRBA and get the baby it's US citizenship.

    yes i booked an appointment already at the end of May. They said i have to bring the baby along, so im going to be there for both of them on that day.

    Yes, i'm Vietnamese, i am only 26 , and my fiance is 23. We didn't even get our NOA2 yet, i got the NOA1 9-9-08 and still waiting :crying:
