  1. Do you not file your US taxes cause you are a stay at home mom? Perhaps I'm confused about the income requirement, but if you, the USC, does not meet the income requirement then you need to have a joint sponser from the US that does meet it. So, do you have any family in the US or a friend that could joint sponser for you?

    I believe the reason you can't use your husband's income is he is the alien... as you are applying for him to come to the US to be with you, you have to prove that you or another person can sponsor/co-sponser him.

    Someone correct me if I'm wrong... I'm still learning too! :)

    For the first year and a half I wasn't able to work, first due to visa issues then because I had recently had my daughter. I did work for about 8 months but it never amounted to anything that would require me to file taxes, I had to leave my job though because we had to move closer to my husbands work. I've been told I can back-file regardless of if I did not have any income, but it still won't help, there's no way I can find a job paying what they require.

    The problem I have is that I don't understand the income requirements..it sounds to me as though if I were to ask my parents to co-sponsor my husband, it could only be either my mother or my father, not both, and they would not take into account both their incomes, just the one I choose as a co-sponsor, while considering every single person in the house a part of the 'household', as well as the three of us...that seems like a ridiculous hurdle to have to jump...my parents don't support my brother, but he does live with them, so he's counted as a household member. They *both* work to make the money they need...I don't know of anyone in my family who alone could make up 125% of the poverty level for several family members.

    It looks like it will be impossible to get my husband over if the requirement is as it seems, which is well, stupid. I am married to this man and we have child together, so why is it so hard to live in the same country together? :(

    You can have more than one joint-sponsor. And people in their household are not counted as dependents if they are not listed on the joint-sponsor's income tax.

    You and your daughter would not be claimed either, just your husband.

    Your mother and father could I believe each do an application. And from what I understand, they do not each need to seperately reach the 125% guidelines but combined.

    It sounds like it's not impossible to get him here with people willing and able to co-sponsor but don't get in a big hurry.

    And it never hurts too call USCIS and ask specific questions. They can guide you in most situations better than we can. The NVC was quite helpful to me also when my case reached that point. It's a confusing and crazy process, so calm down and don't give up so easy.

    They know specifically what you need and the rules, and they will tell you. And if you get conflicting info from them you have to keep calling until you get a satisfactory answer.

    But I'm sure someone will correct me if I'm wrong.

    so i have 2 questions

    1- can i send it from here (Egypt) to USCIS or send it to my family to send it to USCIS.

    2- do i have to send copy of his passport to USCIS.

    Since we are not answering your 2 questions to your satisfaction, the best thing to do is call USCIS and ask them. They will tell you what is okay for you to do and what you will need.

    Since we are not answering your 2 questions to your satisfaction, the best thing to do is call USCIS and ask them. They will tell you what is okay for you to do and what you will need.

    However, I do think the answer to your two questions is yes. Yes, you can send your application from Egypt and yes you will need to include a copy of his passport with the application to USCIS.

  3. If we are told that our sponsors do not have enough income to support us and we are advised to have a joint sponsor then would that joint sponsor have to pa affidavit of support processing fee??

    our case is at US embassy in islamabad, pakistan.

    they said they will issue visas only when they will recieve I-864 from a joint sponsor

    does the joint sponsor have to pay the I-864 processing fee??

    or does it need processing from the nvc or we can send it directly to the embassy after obtaining from the joint sponsor?

    please help

    In my case I called NVC and asked them if there was any more fees required for the joint-sponsor's affadavit and they said, "No".

    My affadavit and the joint-sponsor's were mailed at the same time because we knew that we would need one.

  4. Hi guys,

    I'm getting ready to send an application from Egypt for a visa for my husband. Im in Egypt and I was wondering if I, or my family, could send them the application to NVC directly, or if i HAVE to send it through the embassy in cairo. If we go through the embassy they will need a photocopy of both passports to schedule the appointment. We cant get his passport yet cause there has been delay. So i was wondering if theres a way i can send it to America without going through the embassy. It will save alot of time if we can, and I really want to get back to my family so if theres a faster way to do it let me know.

    It's been a long time since I did it but I think your going to need a copy of his passport to send with the application to America as well. So, it sounds like you need that passport no matter what you decide to do. However, like I said it has been a long time since I mailed mine, almost 3 years, so I could be mistaken.

    Hopefully a person who has done the application more recently will enlighten you.

    we already called and the supevisor who talked to us and she said that we cant verify the sound to give u the case

    number and they didnt sent any NOA and when i told her that there is misspelling in the name of mother in the

    marriage contract she said ok fix it and resend it

    without telling me where or if they have my packet even

    Why is the spelling so important. I wouldn't bother myself. My spelling of my husband's aame got changed form one passport to the next during this process. And immigration did nohting but change the spelling to the new way on all our correspondence. If it's not even the husband or wife's name on the contract why bother. My contract has a more than one translation mistake but Immigration didn't seem to care.

This is really none of my business but since you laid it out there, how can you not afford health insurance but can afford to go away on a $6,000 trip for 7 months and have money to file for divorce? How will the rent get paid while you're gone? These are things I'd be worried about but that's just me. Plus I have kids so I guess I think about things like having a roof over my head all the time. *sigh* To be free to just roam about the world would really be wonderful!!!!! Can I live vicariously through you?

    I was thinking the same but afraid to say anything.

  7. i need help with the I-134. we have a cosponser so i'm not worried about showing 125% but i was told i still have to fill this out. i am recieving ssi because i'm not able to work at the moment. i have been taking some classes so i can get a job that i am able to do and that will support me. so question is where and what do i put down as income. im afraid they will think he will become a public charge. also i do have a house but i dont have any equalty built up and since we have a cosponser its not needed so thats the only things that could possibly even be put down :( please help he will have his interview sooon

    and i am freaking out here

    I guess I can't be very helpful because we had to fill out the other affadavit of support I 864. But I called and asked the NVC what I should do about this. I also have SSI and am in school. They told me that I should fill in the questions about my income as 0 because it is not needed and would just make more work for them and possibly cause delays. They went completely on the co-sponsor's information and proof. Best thing to do is call them if you are unsure.

    I don't know if you are at the NVC stage or still at USCIS since my case was somewhat different. But NVC was very helpful to me on some questions. And so was USCIS come to think of it. If you don't get a clear answer the first time keep trying. It is very unlikely to get the same operator if you call back soon, and you could possibly get a more helpful and friendly person than the first time.

    But now I'm really scared, they said his case is in AP. I hope too God that does not mean we will be waiting for months. I really don't understand AP. And why did they keep his passport if it will be a long time. God we've been going through this ####### for 3 years. I am longing for it to end, so we can finally be together.

    I hope that i'm just worried for nothing? Can anyone give me a little encouragement, that they might actually only take a couple of weeks like they said they would? Please! His interview was only Jan. 4.

    If they said they didn't need it I certainly wouldn't send it to them. AP is almost always a given for an Arab, so don't be too stressed. The wait time does vary, but the fact that they kept the passport gives you the sign that they don't think that it will be very long of an AP. So just hang in there just a little longer.

    Thank you so much for the encouragemet. I thought it was a good sign too. My husband was so happy he was on cloud 9. I tried to tell him without bursting his bubble it could be longer than they said it would be. But now he's discouraged too cuz the CO origianlly said in about a week and now it's been longer.

    But when he called them, they told him it iwould be 10 working days at least and possibly up to 2 months. I guess it was just 10 working days today, nimus weekends and 2 holidays. God I hope it's not 2 months or more! I want good news this week!

I've watched some of my friends really fall for a person (guys and girls) who they met online only to find that person to be a "serial dater". I think people present themselves differently online than they do in person. I'm not AT ALL saying that true relationships can't be formed online, but it IS difficult."

    I just wanted to comment that I found meeting my SO online was a huge advantage in my case. We talked for hours on end and got to know each other very well. That had never happened to me before when entering into a relationship with a man.

    I had never fell in love with a man's personality and the type of person he happened to be inside, and had never connected intellectually before with anyone in my life before him. But, I must admit, I never had "dated" online, or seriously considered it. I just met him by accident and it blossomed from there. Was like a miracle to me, and very sweet memories our first times online. So much fun and so unique to anything I've ever experienced before.

    Makes me wonder what was going through my head with alll my prior relationships. Because now I know what a real one feels like.

Hello everybody .... i have a question ... i had my interview 13 jan 2009 and this went very well and the consule say im approved and my case look good but they can't print my visa till i get tax copies of the fedral tax returns ( form 1040 ) and the most recet income tax from :- sponsor or joint sponsor ... my wife already dont make 125 % but her income is good as a child support and AV but i dont know why they ask me to get joint sponsor or tax return 2008 so scared and confuesd cuz her tax will come less than last year but her income at all is good and enough to sponsor me i need advice plz ... and if we want to send tax form 1040 this will be include w-2 or we can send without w2 .. thank u

    So did they say you need a joint-sponsor? I do not think they will accept her child support as income.

    I believe it has to be earned income or assets. What is AV?

    We had to have a joint-sponsor too Didn't you say in a previous post that she earned $41,000? That should be plenty of income unless she has a lot of dependents besides you and unless she is counting income they do not consider.

  12. I think a fax is fine - this is not an "official document". It is you stating why you didn't file.

    You could mention all three years.

  14. My husband had his interview in Cairo on January 4 and his Visa was approved. YAY! Ww are very happy about that but we are confused about something.

    However, one of the officers, an Egyptian lady told him that I need to send them a letter saying I was not working and that I didn't file income taxes. I am currently a student on disability and we had to have a co-sponsor. But he also spoke to two other officers and at the end of the interview they said Congratulations, you will have your visa in about a week, and they kept his passport.

    I really don't understand why they want the letter. I asked NVC about all that before we sent in the Affadavit of Supports, and they told me the less information I send the better, since they are going only by the co-sponsor's information. They said it would be less confusing and faster for our case and that it was not needed.

    Any input would be appreciated.

    As a US Citizen, you are required to file an income tax return every year no matter where you are living or working in the world.

    If you did not meet the threshold where you are required to file a return, then you must submit a letter explaining why you didnt file a return. That is what they are looking for.

    I did not file an income tax return for taxable year 2007 as I was not required to file as my income was 14.98 which is below the threshold....blah blah blah

    I don't think your required to file if you did not work, or you did not earn at least $5,000 in one year.

    But anyway I called DOS and they said we do not need a letter because it is not in their system that the embassy requested it.

    They said their system would state that we need the letter before a visa can be issued if we did. However, I don't really trust them, so I will call back again and in the meantime I will wait for the email from the embassy.

    And perhaps my husband, can try and navigate their phone system again. The number I have to call will not give case specific information.

Paid closest attention of the pics of me with his family. However, we've been married almost 3 years and I and my daughter lived there with him for several months. So, I guess that was enough to convince of a bonafide relationship.

And he tried to cal them but got so lost and upset in voice mail he forgot to ask about the letter and only ask about when he will receive the visa because it has now been a little more than a week. So I'm going to email them and ask about it, even thought there respnonses are slow in coming and I don't think they really read your email, just send a standard answer, "You are in AP."

    And I'm confused as to how much detail to give them when and if I do have to send the letter. Do I list exactly when I stopped working? When was the last tax return filed and how much I earned that year? And for how many years would I cover? And then again what about this year. I will probably file although the income I earned was not from work, it was a stipend for education that is taxed?

    I'm afraid to go into details that will raise more questions just as NVC said it would, and delay the visa. And I'm afraid not to go into details in fear they will think I'm trying to hide something, I'm not. Just not sure what they want and if I even need to do it since they kept his paasport?

    Any input would be appreciated.

  16. hi VJ`S ppl i need your help with sending my papers to NVC do i have to send all the originals thing or just a copy because its sounds weired to me just IF lost any of them papers like the marriage one for example if there is any other ideas out there share it with me please

    Yes, NVC wants originals and you will get them back at your interview. As far as getting lost, it's a chance you have to take, I know it's a lot of time and expense but they can be replaced. Send them to NVC via Federal Express or some service like that to help insure against them being lost.

    Also you or your wife can call them after a reasonalbe amount of time after mailing, and they will tel you if they have been received and accepted. I'd say give them at least 7-10 days after the mail service says they will receive the package because they don't always get looked at the day they are received.

  17. We were CR1 and Ahmed had to pay $400 plus the DHL fee. Not sure it would be the same for you though. I emailed the consulate before the appt to make sure and they did get back to me. May want to give it a shot if you have time. But always be prepared, like everyone else said. Never trust Cairo.

    I wonder why he had to pay $400. We already paid that amount months ago. Did you pay it twice. I was told it covered all his fees but guess I better be checking with the embassy. Oh, and out of curiosity why it take you so long to get from I130 approval and your interview date.? I was trying to read your timeline and I was curious, did you have problems?   18. Hi just wondering from those of you with experience, my husband goes for his interview in a few days. His Visa is the IR1 and we were wondering if he will need to pay any fees and how much he will need to have on him.

    We understood all fees for this type of Visa had been paid previously? But we do not want him to go unprepared with less money than he will need.

  19. ok.. not scheduled for jan... anybody has been scheduled yet?

    case completed on nov 26.. waiting for interview.

    Our case was finished on Aug 26 and it took them 3 months to schedule, the interview is for Jan.4, so if the trend keeps up at the same pace I'm sorry to say you may have to wait a few more months.

  20. Yes email the embassy and tell them to send u the information for the physical examination thru the email. and explain that u lost the app. letter and see if they will suggest sending u another one. Wishing u all the best . stay positive n have faith; everything will b ok.

  21. Thank you so much Nawal, I have been doing what you have suggested. I have called NVC 4 times in the last 2 days, and emailed the embassy 4 or 5 times with case number in the body and subject line.

    The last time I talked to NVC they said that it is now coded in the computer system to send me the lettervia email. And that I should receive it within 48 hours. I do hope that's true.

    It's just hard to relax and wait because this is so important. Why can't they just send it and stop being so illusive or obstinate or whatever. Maybe that's just how I feel because I'm suffering with the waitng.

    My husband is also planning to call the embassy tomorrow and see if they can give him a confirmation letter or what we should do, so hopefully with all these things going on, one of them will solve the problem and soon, before I go nuts.

    I'm still kicking myself for losing it but the only thing that I can figure out is that it got thrown away with some classwork I have trying to complete for end of semester finals. I have been working feverishly trying to get a mountain of work and studying done. Either that, or my daughter and her friend accidentally threw it out while helping me clean one day.

    One more possibility is that I have put it away for safekeeping while in the middle of all that's going on and have forgotten. It's is so, something I would do. If so, I will find it as soon as I receive the copy in my hands. I am still searching off an on as I come up with a new place I may have placed it. Goes to show I'm not much of a multi-tasker in stressfull situations.

    Anyway, sorry for the book but thanks for your support and kind words.
