  1. Thanks for the info. I guess my brother in law would have been around 55 by the time he was approved. I would have let them stay with me but education wise he would have been stuck working in restaurants and market places. He is a hard worker but I didn't see him getting ahead much here than if he would have stayed in Vietnam. I love my wife's family and we plan to live there 3-6 months a year after I retire so hopefully I can help him get ahead there.

  2. Not sure what she wan't to study at this point she is still very young.

     

    I remember I was going through hell when my wife got denied and eventually I brought her over. She is going through that same hell because she didn't file for her brother and it's my fault. I tried to justify my actions because I reacted on instinct to all the negative stuff. I believe now it would have worked out and I made the wrong choice and I will have to live with that for the rest of my life.

  3. We only have 1 University where I live so she would go to the University of Mary. It's a Christian school but that wont matter you don't need to be Christian to go to school there. My wife would pay for her college since my niece is poor and only has the money we send her family every year. I know if she wanted to be a nurse she could get sponsored here easy because there is a nursing shortage. I'm not sure what she would want to do though she is about 8 years old.

     

    My wife wanted to sponsor her brothers family about 7 or 8 years ago and I was worried about the financial responsibility so I told her we couldn't do it. She has a brother and sister that immigrated to Australia that are living off the government and 1 brother already in the USA for 40 years but he is only able to find part time work. The brother from Vietnam she wanted to sponsor doesn't have a job or speak English he only went a few years to school I think he made it to the 2nd grade. He is 50 now so if we would have sponsored him when my wife wanted to he would be coming over at 55 years old. Now if we sponsored him he would be 63 so my wife doesn't want to do it anymore. She is very depressed because her friends keep asking her why she didn't and she tells them I was against it. I now have regrets about this decision as we could have gotten the ball rolling back then and we could have always canceled it later if we didn't want to do it. I think if we can bring her niece over most of it will be forgiven. Also I have never heard of somebody sponsoring there family members where they had the governments coming after them for reimbursement of benefits and neither has my wife.

  4. I'm hoping some of my friends are still here. I need some advice my wife wants to bring her niece over here to live if that is possible? I was thinking of a school or work visa when she turns 18 but not sure that will be very likely. I think my wife's ultimate goal is that she meet's somebody here and gets married so she can stay here.

    My wife has an appointment for citizenship on august 21st. One of the things it says to bring

    An original Internal Revenue Service (IRS) Form 1722 listing tax information for the past three years (call IRS toll free at 1-800-829-1040), or copies of the income tax forms you filed for the past three years.

    I can't find my last 3 years of taxes since I had to do an amended tax return I called the IRS at the number listed. I asked for Form 1722 the guy was dumfounded and told me he never heard of it and put me on hold. Came back and told me that was an old form and that he would send me my transcripts because that was what they sent to others that have requested tax information for immigration. So he sent me the transcripts.

    I then called USCIS to see if that information would work and was rushed off the phone by somebody that told me to go on the web and set an appointment online and drive 400 miles to ask somebody if that was the correct information. I tried to make the appointment online and was told that my office wasn't accepting appointments at this time. I called back the USCIS a 2nd time and was basically told to keep checking the website to see when an appointment becomes available.

    Does anybody know if transcripts will work in place of a 1722? also when I opened them with a letter opener 2 of them got cut half ways will they still accept it?

    It list for her First name as Tran L on the front then on the back list Tran then her middle name separate as Le. The front only has a spot for the Surname and Given name but not the middle name.

    We are mailing out Monday and live in North Dakota from what I heard it takes about 3 months from the time we mail out to the time she takes the test.

    Without Visa Journey we would have never made it this far. Thanks again.

  7. I have a few questions that I couldn’t find the answers to anywhere.

    You have to send in 2 passport type photos with your N-400. It says to lightly print your name on the back with pencil. Since my wife is doing the name change on the N-400 should she use here soon to be new name and put that on the back of the photo or her current name?

    On the form it asks for the name as it appears on her Resident card. On the front of the card it’s got her First Name then a space then Middle Initial as the given name and her Surname as her last name. Hover on the back of the card where it has those 3 lines of numbers and names it’s got her name as follows

    Last Name<<First Name without the middle initial<<Full Middle Name

    So would I put on the form her name as it appears on the back because that it is in the correct format?

  8. Got a letter from DOHS today requesting more info

    One thing they pointed out was Date of Marriage

    Please verify the correct date of your marriage. You have indicated on your From I-751 that you were married on February 28, 2009 and on you Form G-325A you indicated that you were married on April 13, 2009.

    We had our ceremony on 02/29/2009 and we celebrate our wedding on that day. However I believe we got the license later 04/13/2009 so that was the date put on G-325A. However 3 years later I did the I-751 and when they asked for Date of Marriage I put 02/29/2012 because that is the day we celebrate it. It think if I send in more proof and an explanation it should be ok.

    Anybody else have this happen?

  9. I was dissapointed to see that Texas Barbecue has closed not sure where I will be able to get an American buerger now. When we were in Nha Trang I ate at a place called Texas and the owner looked alot like the owner at Texas Barbecue in HCM so maybe he relocated. Does anybody know of a good buerger place??

  10. First trip back to Vietnam after Tran got the US Green Card. Her 2 year will expire on feb 19th but we should have the 10 year in the mail before we get back. Lunar New Year was ok watched the fireworks and tonight we rented a bus to go to Dalat and Nha Trang. Will be back in Ho Chi Minh by Sunday.

    Learned how to play Mah Johng with Trans family lost about 4,000 VND learning how to play but that is like a 25 cents US money. Hope to see some VJ people around town.

  11. My Wife sister lives in Australia she has been living there many years but doesn’t speak very good English. She would like to bring her brother over from Vietnam to help take care of her. She does not have a job and spent what little savings she had on an attorney to bring her niece over but the attorney failed.

    My wife had informed me that one of their neighbors in Vietnam has a son that lived in Australia that got help from a free attorney and social worker in Australia that helped them in the immigration process. She asked her neighbor for this information but the neighbor would not help her.

    My wife has asked me to help her sister many times but being in America it is hard for me to find any information. If somebody could point me in the right direction is all I’m asking.

  12. Wow, I didn't think that the Saigonistas believed that Viet Nam even extended North of Dalat! :P

    Most people from Saigon are baffled about why I want to live or visit Da Nang, as if that city doesn't have any running water or electricity. Unfortunetly the people from Hanoi HAVE discovered Da Nang, as they are busy building their gazdillion VND beach cottages and golf courses along all the shorelines (and locking out the locals who can no longer swim, run, or fish on much of the coast :angry: ).

    We went to Da Nang and Dalat for our honeymoon. My wife wanted to go to Bancock but now she has decided to go to Da Nang again. Her borther and sister are coming up from Australia and she has not seen them for 25 years so this is the only time we can go. If they want to do an interview we will have to reschedule it for when we get back. Her friend from Japan didn't even have an interview they got there 10 year visa in the mail 6 weeks after they sent for it. So I am hoping this will be the same case.

  13. She has the CR1 2 year green card but it expires on 02/19/2012. Will there be any trouble coming back on 02/12/2012 1 week before it expires?

    I have been told the 10 year green cards are taking about 6 weeks to get but I cannot send for it until 11/19/2011 so that will be cutting it close to when we leave.

  14. I once again need to call upon the wisdom of the Visa Journey elders and friends :whistle:

    My wife and I are planning a trip to Vietnam in January and coming back in February. My wife's Vietnamese passport has expired and we just got it renewed so she should not need a separate visa going to Vietnam and she can use her CR1 visa to get back in the country. We will be back 1 week before her anniversary date so that shouldn't be a problem.

    We plan on going to Thailand for 1 week in the middle of our stay. Should I get a multiple entry visa for Vietnam? I don’t think I need a visa for to go to Thailand however to get back into Vietnam I would need one. She told me the travel agency in Vietnam would take care of it but I am not too sure of that.

    Has anybody tried that before?

  15. If she qualifies on just her income, then you wouldn't be liable based on the I-864. But, assuming that your assets are jointly held, there is exposure there. If you execute an I-864A to be a joint sponsor then you would have an obligation as a sponsor as well.

    As this plan comes together a lot of thought needs to go into it so that your in-laws understand that they are going to have to work to support themselves. For example: without paying into the Social Security system they cannot receive any benefits.

    The good thing is that there is plenty of time for everyone to discuss the realities of their move here. Right now the wait is shown at 11 years. And that's after petition approval. Your wife is 2 years away from citizenship. So a minimum of 13/14 years until they could be arriving in the US.

    My plan is to bring over the daughter since we are paying for her schooling and then she can sponsor her parents.

    I have a house but I didnt put it in her name yet. I wont sign to sponsor 3 people thats just to many and I am getting to old. My wife makes about 8K a year but she is going full time so she will make about 20K a year so that should be enough to sponsor the daughter.

    If you are a joint sponsor with your wife then yes, you will have responsibility. An I-864 will need to be executed for them just as with your wife's adjustment of status.

    As you know there is a long time before that will happen. She can't petition until she becomes a USC citizen. And then it's at least a 10 year wait.

    Woudln't I be an automatic co sponsor since she is my wife? IF for some reason she were to leave me I would be responible for half of her debt anyways I think that would also include this.

    She has been here 1 year and it might be 2 more before she is a citizen. Her brother and his wife are in there 40's and there daughter is 4 years old.

    With my retirement I will have enough money for me and my wife but not enough to pay health insurance and take care of 3 more people. I just want to be able to have a happy life with my wife and travel not both of us working 2 jobs until were in our 80's.

  18. Bryon, this is misleading data.

    First, the OP is filing K-1 and this data shows I-130 dates, not I-129F dates. The processing times for these two different types of visas (fiance(e) and spouse) last year were completely different. K-1 visa processing times to NOA2 were flat all last year until about August.

    Second, this is data for a particular period of time. What happened last year was based upon a host of complex inter-related variables, about most of which we do not know. This year, the times might be the same, shorter or longer. Nobody knows.

    And Third, The OP asked about time to interview. Looking at the data for the last 6 months, one might assess that the time to interview would be around 7 months, factoring in time to NOA2, time to NVC, time to Consulate and wait time for interview.

    Scott's estimate of 6-9 months is a good one for people to use when petitioning for a fiance(e) in Vietnam. Our experience was on the long side - 9 months - because we were stuck in AP at NVC for 52 days; most go through NVC in a few days. But those are the things that can happen, so petitioners are wise to plan for a broad range of possible durations.

    I agree with your first point I did pull CR1 not K1 force of habbit. The information I gave about CR1 is accurate I assure you.

  19. If I remember correctly last year the Vermont slowed down first then the CA center slowed down after Vermont shipped them alot of there work. If you look at the two pics I uploaded from VJ you will see the NO1 that were filed in March were all approved in about a 3 week period. The other pick where they were submitted in April had a 4 to 5 month wait time.

    So if you get your NOA1 in by March it should cut your interview time down by about 3 to 4 months after march expect a longer wait time.

  20. Thanks everyone for your positive support. I am feeling better about this now, though I still feel a bit stressed by the whole process.

    I'm flying out tomorrow and will arrive this Friday evening. I'll be checking in here from time to time and let everyone know how things are going.

  21. Not sure if you guys remember 2009 when early filers were getting there NOA2 in 3 to 4 weeks and most people that filed after april when the HB1 visa'####### the USCIS had to wait a long time. I waited 4 months and 10 days I could have shaved 3 months on my wait time if I would have filed early. Instead of 8 months I would have only had to wait 5 months.
