  1. Well it was 1900$ for the ticket. I had an open date I could leave anytime from the 12th to the 20th and come back on the 30th of December but the price was over 3,500. So now I am leaving on the 14th and coming back on the 28th.

    I traveled United before but there tickets are around 7k right now so I had to use Northwest and go to Minniapolis then Chicago Then take Korean Airlines to Korea then to Ho Chi Minh

    I have never been on Northwest or Korean airlines but the food on the Unitied Planes doesnt agree with me so I hope if the other ones serve food its alot better.

  3. Just got off the phone with DoS.. it appears that HCMC is dragging thier feet in a major way.. They have had my case based on DHL records since 10/26.. but they have not entered the fact that they have it, into the system.. so until that happens I cant send DS230 etc... I asked her about your case and Dougs.. She said for you guys to call her and she can tell you what is in the system to avoid the time lag on emails from the consulate... 202-663-1225.. then press1, 5, and then 0... that will get you through to her or another CSR that has access to the same computer system that HCMC uses... She can see if pkt 4 was sent, pkt 3 was sent and even see if the interview has been scheduled and what date... a 3 or 4 minute call can give you a little peace of mind, but I am of the same mindset that you are in that they are dragging the feet at the moment.. possibly to lighten the load during the holidays...

    I called the number and they still have my visa at the NVC it has not been forward to the council yet so I think I will get my interview sometime in January she told me to call back next week.

    I was just on cheap tickets for flights between dec 19th and Jan 2nd and they dropped from 6,700 to a range of 3,000 to 4,300. There are now 5 carriors instead of 2 carriors so that might have had something to do with it.

  4. Does anybody have a good idea when my wife might get her interview??

    I filed a CR1 the NVC got my wifes paperwork on November 4th it was a DS paper and her clean papers. I had sent my papers in weeks before (I485 ect) and those were already processed before they got my wife's paper. They tell you to allow 4 to 6 weeks for processing but from what I have seen on here it is more like 2 weeks. I would like to avoid christmas time as I cannot afford the 6,700 to fly at that time.

    The CO cannot revoke only suggest to revoke however case law would indicate the CO is wrong for denying for that reason and uphold the law. Thus the visa will be issues regardless of the CO. The CO can only delay by denying however you can appeal successfully here in a court of law and the visa would be issued without the Consulates consent.

    I do agree the best approch is to show them how close you are because even though you will get the visa you might lose several years of time spent with your soul mate.

My wife and I have had a joint bank account in Vietnam since Feb of 2009 we also have a connecting account between wellsfargo and vietnam income bank where I can transfer her money from my computer. She also has access to my credit cards and pin numbers I couldn't get her name on the title to my house yet until she moves here. I would not have done if for a K1 that looks really bad like you are trying to manufacture evedence because you have a weak case.

    For a K1 you only have to prove intent to marry not closeness of relationship. The consulate might not always follow that logic but as you can see here by case law you can appeal it very successfully.

    Section 214(d) of the Act states that CIS shall approve the Form I-129F when a petitioner submits evidence to establish that he/she and the beneficiary have met within the two-year period preceding the filing of the Form 1129F, have a bonafide intention to marry and are legally able and willing to marry within 90 days of the beneficiary's arrival in the United States. The Department of State's interview of the beneficiary raised questions regarding the level of intimacy between the petitioner and the beneficiary at the time of the latter's consular interview. However, the approval of a Form I-129F does not depend on the level of closeness between the two parties, and the AAO finds the director to have erred in imposing it. While § 214(d) of the Act requires the petitioner to establish that he and the beneficiary have a bonafide intention to marry, this language is not synonymous with a requirement that the petitioner establish the closeness of their relationship. The AAO has found nothing in the record to indicate the petitioner and beneficiary do not intend to marry within 90 days of the beneficiary's arrival in the United States.

    I should also add if you get the chance to appeal most cases will expire before you can appeal

  8. My fiancee got rejected and the petition is "administratively closed" and being sent back the USICS in California.

    My question to you all here is how long does it take to reach me? and any one here in the same boat

    I went to speak to an Immg lawyer and reccomended that I should withdraw the petition and start a new one.

    I'm wondering what to do next.

    Contact Mr. Ellis do not withdraw that would be the worst thing you could do. I am in the same boat my wife was denied the K1 we didn't withdraw and it expired. I went there to marry here filed a CR1 and now we are waiting on an interview date. Everycase is different for me this was my best option for you it might be something different thats why I would recomend Mr Ellis. The other attorny you were talking to is not that familure with the consluate in VIetname and Mr Ellis is.

    What were the reason they for your denial? Was it non bonafide if so what was the basis?

  9. I think it will depend on the CO one person posted his denial for the Dam Hoi and it stated they should have had one with at least 200 people. Personally I think with most CO that no Dam Hoi will hurt you, a small Dam Hoi will not hurt you but will not help you, a big Dam Hoi will help you. If you do it in a decent resteraunt expect to spend between 150$-200$ per table and you want to have at least 10 to 15 tables of 12 people each. I think we had 22 tables but we had a table and a half not filled. Make sure you take many pictures of each table or the many guests. If any of your family shows up for it that will be a big plus.

    I guess I shouldnt say they didn't know anything but there response seemed like the didn't know what I was talking about. First I didn't say I was a VIetnamise resident but when they replied they said it was for Vietnamise resident. Second the link they gave me didn't work. The only thing I can think is it is for my wife after she gets her visa here maybe she can apply for it.

  12. That's not what I am asking. I want the visa. I am a U.S. citizen. I am just asking about THE COST OF THE VISA, which is different on every single website I check.

    I've also read about Visa on arrival and wonder if that is acceptable or not.

    I have never seen them ever post a fee for the visa Ive always had to call to get it. I just got mine and it was 85$

    The C1 visa I didn't remember getting a visa letter also so I'm a little confused. I filled out the forms the same however the first 2 times I got my visa stamped I didn't request it expedited.

    I got it back a few days ago from the embassy and it has a red circular stamp on it with an intiall but it doesn't have the rectangle purple stamp on the front of it.

    On mine, The purple rectangle is what they stamp on it when it is "used" .. usually single entry visas will get that when you enter... multiple entry wont get it usually... the red circle is the consular seal making it official...

    Yeah it looks just like the other visa's but it doesnt have the used stamp. I was wondering what the difference was between the C1 and C2 was or if I shoudl be concered. Last time they stamped it in Ho Chi Minh when I came there and when I think they also stamped that used one on there. But when I googled C2 it said something about having to get stamp at the consulate and a C1 is gettnig the stamp at the airport like I have done before so I guess I am just a little worried is all.

  15. I got my Passport back a few days ago and the Visa shows as a Catagory C2 where as my others were a C1. Does this mean I have to stop by the consulate in NY or San Franciso before I leave for Vietnam and have it stamped? If this is true then it is a major inconvience since I would have to travel 2,000 miles to do this. I didn't even get a visa approval letter and it was 85$

    We did not pass our first interview for a K1 visa and our case was sent back to the USCIS. After almost one year our case has been re-affirmed and we have received once again Packet 3 from the HCMC. I was wondering if anyone can shed some light on what the chances are of passing a second interview once your case has been re-affirmed. Does it get easier or will we expect the same treatment as we received in our first interview.

    I'd expect and hope you get the same treatment. I'm assuming you know why you were denied the first time round? Use this knowledge to assist you 2nd time round. I don't see any reason why things would easier for you. What reason you do expect special treatment?

    Special treatment on a Ho Chi Minh interview would still be 4 to 5 times harder than the interviews they are given in Great Britian.

  17. She is sending her clean paper to show she has no criminal record and all the other paperwork you send in after you get the case number. I am sending the I-864 and my pay stubs and copys of a bank statement along with the last 3 years tax returns

    Whoa whoa whoa!!! You need to wait till the 3032 is generated and the AOS bill is paid and shows paid before you start sending stuff in to NVC!!! If you send anything before, it will NOT be accepted!!! I would however suggest that you have the benificerary fill out the 230, send all the required original documents to you and have everything ready to go... But do not send anything to NVC before they are ready to accept it!!! :guides:

    Here is a formula I did for another post that tells the sequence

    I posted this in another post.... might be of use in keeping things straight!

    For anyone confused the formula is this

    Petitioner = Get NVC # + receive AOS fee bill + pay 70$ online + wait to show paid + print cover sheet + send 854 AOS with all documents and case # written on each page

    Benificerary = Get NVC# + receive 3032 + send 3032+ 3032 accepted + IV fee bill available to be paid + pay and wait to show paid + print IV cover sheet + mail 230 package with all original/certified documents

    ======= wait for case complete + wait for interview to be scheduled

    Yeah I paid the 400 and the 70 online it shows paid I went to the next step and printed out my cover sheet and emailed the coversheet to my wife. She is getting the paperwork done there once she has it complete she is going to mail me her paperwork and I will mail them to the NVC either with my I-864 or by themselves if I send the I-864 now. I was just wondering speed wise would our case be completed at the NVC sooner and we will get our interview date sooner if I send my info in first if not I will send them both at the same time.

  18. I have my paperwork in order the I-864 should I send that in now or should I wait until my wife gives me her paperwork and send them in together? I assume we wont get our interview date from the NVC until they get all the paperwork but I was thinking if I send mine in now that might go threw it early and it will save a few days so we might get the itnerview sooner.

  19. The sordid thing is that i met my fiancee on a porn site, Streammate. She used to chat with guys and do private shows. We have decided to marry. We have made up our minds, so i am not asking for advice about that. Question is, should we lie on the K1 application and when she goes to her interview? We could make it vague, but what if they ask detailed questions during the interview? We did not break any laws and it was not a marriage broker site. We have good evidence for the relationship.

    Anyone else met this way, pls PM me.

    If she was trying to get a visa from Ho Chi Minh or some place like that the CO would deny your visa. I would make it clear what she did for a living on the paperwork when you filed the CO cannot deny for anything the USCIS was aware of when they approved your visa. That doesn't mean they can't find a different reason to deny.

    I received the recorded message that "Case was completed on Oct. 2, 2009. Please allow eight weeks for further instructions..."

    When does the NVC schedule the interview appointment date before or after the package is sent?

    Who (NVC or Embassy) sends the letter?

    Any idea where the 8 weeks comes from? I don't see that as a processing time based on the immigration time trends...

    I did the online payment and status is paid is it ok to do the I-864 or do I have to wait for an email or letter from the NVC to send it in?

  21. I have a full time job and a part time job that I listed on my I-130 should I list both in box 22 of the I-864? I know what my current salary is at my full time job but since my hours vary at my part time job I don't know what my salary is going to be be.

    I logged into the NVC to pay my bill but I am not sure where to go to check on my case status it still says my payment is pending.

    Any help is apprciated. Thanks
