  1. I am gathering evidence of my relationship to my fiance. I had a few questions.

Is it ok to just give her copies of receipts, ticket stubs, etc for the embassy or does she need originals?

Also I am having problems printing chat transcripts. I go to history and click one but it only prints the first page. I can save it and open it. But when I do that it looks like it is in notebook and looks like something I could have just typed up.

Should I copy whole transcripts or is just the first page of one a month fine? How many do you recommend and how many pages?

Also I hardly have any emails and don't have any letters because we chat and talk on the phone everyday. There was no need. Is this bad or does it matter?

    Thank you.

"There was no need." YES THERE IS AND WAS!

You still have time to get GOOD phone records. Both of you send each other once aweek snail mails. Do some screen prints.

Get her all the originals of EVERYTHING you can. You shouldn't need them and she might!

Do about 3 complete chats a month. Shoot each other some more emails.

Sorry, you might have misunderstood. I have plenty of phone and chat records. I just don't have many emails and I don't have any letters. How much of each evidence should I turn in? Just a sample page of a chat per month or a whole chat?

  3. Did her parents filed for any papers for her. She would have acquired the US citizenship since her mom is a US citizen. She should have a dual citizenship until she reached 18 years old.

At her age, she should have chosen whether she would be a Filipino citizen or a US citizen. Have you talked to an immigration attorney?

If both her parents are US Citizens....doesnt that make her a US Citizen???

Why are you only addressing the mother...how about her father??

    \

If she was born on a US Military base, there is most likely a couselors report of a US Ciitizen born abroad. Or the father was serving in the military. Every kid I grew up with who were born in Germany for instance, were US Citizens because there parents were there...(father in the military). Johm McCain as an example.l

I would check it out...save yourself a bunch of money.

Only her mom was a US citizen. It was her mom that was born on the base. Her mom's parents were both US citizens. Her dad is from the Philippines.

Thank you for the advice. What if she never chose either Filipino or American citizenship? Is it too late for her to do it. I know that she was registered at the US embassy at birth.

  4. GREAT News for Us today.... My Fiancee had her interview today and passed! She said it went smooth and everyone from the pre-screener, to the consular were extremely nice and friendly. I guess Santa was good to them over the holidays.

Now we are just waiting for the VISA.... I hope by the end of the week we will have it.

    Congrats!

What questions did they ask her?

  6. Her mother was born on a naval base in the Philippines. She was born a US citizen. Both of her mother's parents were American citizens. I don't think her mother meets the requirements of living in America after the age 14 though. My fiance doesn't know much about her mom.

The mother's and father's address is listed in the Philippines. The mother's nationality says American.

This is a very confusing situation.

  7. Document Verification is no longer need.

Is this at all related to becoming "Documentarily Qualified"? http://manila.usembassy.gov/wwwh3238.html The Importance of Becoming “Documentarily Qualified”

OK, I understand that after the notice of approval is received (NOA2) the case goes to the NVC and then on to the embassy. I assume the reference to becoming Documentarily Qualified happens before the NOA2 is issued?

I just don't understand this from the link above:

All case processing for Manila, including appointment scheduling, is generally done at the National Visa Center (NVC) in the U.S. An applicant’s case number does not determine his or her position in the scheduling queue. Once a case is current, the applicant’s place in the scheduling queue will be determined by the date all the necessary, completed documents are received at NVC. Then the case becomes “documentarily qualified.”

We believe the waiting time for an appointment date is approximately three (3) to five (5) months from the date the case is “documentarily qualified.” As soon as an appointment date does become available, NVC will forward the case to Embassy Manila. NVC will also send the petitioner and/or the authorized agent/representative an appointment package.

I don't believe it takes 3-5 months to schedule the interview after the NOA2 does it??

I also am not clear of when the interview date is given. Does the beneficiary submit all forms and documents (Birth cert, CENOMAR, DS-156, DS-156K, DS-157, I-134) to the embassy before the interview? And then an interview date is given? And additional documents, such as proof of ongoing relationship are brought to the appointment only?

Thanks in advance for any replies.

Yes, it takes at least three months after NOA2 to get the interview appointment. Probably longer. She will receive detailed instructions on what to submit, and when.

Really, I was hoping it would only be about a month. That stinks. She will have to arrange for the interview the 1st second she can. She can do it the moment we get the NOA2 correct?

  8. Sorry, one more thing....should I give her the originals of the phone bills, receipts, etc or do you recommend copies?

You mate having a copy of the packet is mainly for reference. Studying the G325A for info like your fathers name. Things related to your education, employment, if applicable exwifes name and when divorced etc.

Have her check out the entire packet and go over things together. COs get questions from there!

    Give her originals of EVERYTHING!

Ok cool. So she doesn't have to bring it to the embassy. Very good. Thank you so much!

  9. I have noticed in many places it says to make a copy of the packet sent to the USCIS. I had some questions about this.

Does my fiance need to have this with her during her trip to the embassy? If so, why does she need it if it is being sent overseas anyway? Just for reference?

Do I need copies of our proof of our relationship to be included in this complete copy?

It seems redundant for her to have the complete packet and then for me to recopy proof and have her bring two sets of proof.

Currently I have a copy for her but is it alright for me to separate the proof from the copy and put it in a separate folder for her or is there some reason the packet has to be exactly like the one I sent to USCIS?

It would seem a lot easier and less confusing for her if the proof was in a separate folder that she could just give to the embassy.

    Thank you

  10. I think the others that responded, misunderstood your concern. Your concern is that although you are not married, in you emails you refer to each other as husband and wife and she signs, Mrs (your last name). This is defininitely NOT GOOD but she may be able to explain it at the interview.

Yeah but she only says that in the emails but at the same time not all of the emails does she use my last name. But everything she signed like the letter of intent to marry she signed using her first and last name and it was notarized at the US consulat in Osaka. The same with her G-325a and everything else she signed only the emails is where she will use my last name. I was just worried that they may think because of the email and only the emails that we are married. I was only divorce offically for 2 days when I got to japan and the divorce did not have time to be processed through the system to be able to get a divorce.

I would suggest she stop referring to you as her husband or to herself as Mrs. ... and that you submit no more evidence that does so, then prepare both an explanation and apology for any confusion. They'll understand it is explained as some silly thing people in love do and you in fact are NOT husband and wife.

My fiance called me husband in some of the emails I sent for evidence also. I see that it is bad but why is this a bad thing? Just curious

  11. I don't think it's a problem my dad is an American Citizen it's never be an issue to me when I had my interviewed. Just relax don't stress yourself.

Thanks a lot guys. I am just trying to prepare for everything and probably am looking into things too much.

My fiance's mom is a US citizen (but I don't think she met the requirements so that her daughter (my fiance) could become one)

Her mom abandoned her when she was 7 and she doesn't know her whereabouts or even talk to her.

I am worried that her Visa could be denied because of the following.

"Claim to U.S. citizenship: Under United States law, persons born outside the U.S. may have a claim to U.S. citizenship if either parent was born or naturalized in the United States, or either parent was a U.S. citizen at the time of the individual’s birth. U.S. immigration law prevents the issuance of visas to applicants who have a claim to U.S. citizenship. Beneficiaries of visa petitions who believe they may have a claim to U.S. citizenship should therefore check with the American Citizen Services (ACS) Branch of the Embassy before applying for a visa. The Child Citizenship Act of 2000 also provides guidance on claims to U.S. citizenship."

I am worried that her visa may be denied because of this. Her mom didn't live in the US long enough for my fiance to be a US citizen so she could be screwed over either way. We already filed for the K-1. Any advice?

Does she have a Philippine birth certificate or a CRBA (consular Report of Birth Abroad) from the Embassy in Manila?

    Also what is her age?

She has a Philippine birth certificate and is 19

  13. I am trying to cram too much into my brain and have been reading conflicting things:

#1 I read somewhere that DOCUMENT VERIFICATION is no longer needed.

When I look at the K-1 Visa guide it says you need it

#2 My finance has to fill out DS-156, DS-156K, DS-157. DS-156 has to been done electronically? Can she print copies after it is done? I am worried whether or not she can find a place that will open this form. My computer won't even do it and it is better than the ones in the Internet Cafes over there.

#3 Packet 4 is only available online? The links in the guide don't take me to packet 4. Where is it located?

#4 Also when she schedules an interview do they give her a date or can she choose a soon one? If they give her a date how far away is the interview from when she call to schedule it. We would like it ASAP.

#5 Does she absolutely need the letter that the USE sends her? She no longer lives at her address and we do not want to mess with changing it. Her sister still lives there but does she have to be present to accept it?

    Thank you very much

  14. I was looking over the DS-156 and saw a question that says does any of the following have US Citizenship? My finance's mom has US Citizenship but she abandoned my finance when she was young and they do not talk. Is this going to hurt my fiance's chances of being approved?

    Thank you

what is d citizenship of ur fiance now?

She is a citizen of the Philippines. Her mom registered her at the US embassy at birth but I don't think her mom lived in the US for the required amount of time. Even if she did, they never speak.

i dont think it will affect the petition. d two of u r involved of the application... not her mom or whoever. don't worry.

pls. put a timeline... it will help d others to give u some info.

Thank you for your help...how to I make the timeline visible on my posts

  16. Also, does she have to fill out the electronic version or can she just print out the DS-156 NONIMMIGRANT VISA APPLICATION, the DS-157 SUPPLEMENTAL NONIMMIGRANT VISA APPLICATION, and the DS-156K NONIMMIGRANT FIANCE(E) VISA APPLICATION?

I can't even open the electronic form because of my browser so I know she won't be able to at an Internet Cafe.

  18. I keep reading that the fiance needs a medical exam before the interview. How soon can this be done? Is there any rule against doing it before receiving the NOA2 just to get it done? If so what is the absolute earliest it can be done? Thanks

  19. Under the part that says

"I own real estate valued at: With mortgages or other encumbrances thereon amounting to"

What does this mean? Do I put the value of the real estate?

Lets say the house was purchased for $90,000

It is up for sale at $109,000

    I still owe $75,000

what do I put? I am very confused

Do I need to prove how much it is worth?

Also under the personal property section do I just guess or do I need proof of the value that I put?

    Thank you

The value would be 109 and the encumbrance 75. A dictionary will help you through the process.

Please note that if your income is sufficient you may simply leave blank all questions about assets. Further, the I-134 comes later and should be as current as possible at interview time.

Also, I hear the USCIS is picky about how the forms are filed out. If I leave the asset and property lines blank do I put "N/A", leave it blank, or "None"? Thank you

  20. Thanks for help. Do I need to send this Police Certificate to my fiancee before filing the petition or I have to provide this to Embassy at the time of interview. I have lived in three cities since I tured 16 so getting ceritficates from all three cities will take some time. So shall we ask for the police certificate or can we file the petition and get the police certificate after that.

The certificate needs to be provided at the interview at the embassy. Depending on how long it takes to get one depends on when you should apply for it. The are usually, for immigration purposes, valid for one year.

As I said before you don't need one for each city, just for the country. Say you lived in three cities in one country (for over 12months) you will only need one certificate, a certificate for that country. However if you have lived in three different countries for over a year each, other than your country of residence, you will need three certificates.

So if my fiance has only been in the country of her birth (Philippines) does she even need a police certificate?

Yep you need a recent appraisal!

I don't make a lot but I make enough. ($40,000) So maybe I shouldn't list my house if I have to get an appraisal. Anything I list I probably need documentation for? I will just list my salary then like another poster mentioned. It shouldn't be a problem at all.
