  1. My lost greencard expires in 2011. Can I not file for a card replacement and just wait for the time that I can apply for removal of condition? When I apply for a job, what document can I show to the employer to prove that I am legal to work since my greencard is lost?

    You'll need to file an I-90 LINK; $370.

    I would not advise you to wait until ROC to get a new/10-year card. You are required to have proof of immigration status - not just for work-related purposes.

    I do know about the employment part though...

    You don't have to show a green card and an employer can't insist on it if you can meet the I9 eligibility through other documents. (google I9 handbook and download it - its a free pdf if you want the exact specifications of what employers can accept.)

    Do you have a driver license/state id & a social security card that DOES NOT say `only valid for work with DHS permission.'?

    If so on the I9 employment eligibility form - you will need your alien number for the first section. Then driver license/state id will satisfy column B (proof of identity.) Then your social security card will satisfy column C (proof of work eligibility) - providing you got it changed after you got your green card so that they could remove the restrictions.

    that's another problem, I haven't changed my SS card yet. I have been very busy working since I got my gc but I know it's not an excuse. So my SS card still says "valid only with DHS work authorization" on it. I know I'm really stupid for procrastinating things. Do you think I can remove the restriction on my SS card by showing to the SSA the welcome letter I got from USCIS as proof that they did send me a gc?

  3. I'm posting this for my sister because I'm already done with I-485. So she received her welcome notice about a week before I received mine. I got my gc in the mail 3 days after that. As you know, the welcome notice says that the gc should be sent within 3 weeks. 3 weeks passed and gc still didn't show up in the mailbox so she called the USCIS hotline number. A few days letter she received a letter from the USCIS informing her that they sent the gc to her on April 6, and that if it went to a wrong address or was not delivered it would have been returned to them. So the USCIS assumes that the gc was lost in mail and that she should file for the replacement of the card which costs a big amount.

    Before my sister takes out hundreds from her (or her husband's wallet) for the application for card replacement fee, what do you guys suggest that she should do first? Especially those who had been in the same situation before? I feel that there are some alternatives, like go to the post office maybe and address this issue to them? Because if she applies for the replacement of the card, then the USCIS sends it again to her address, what if the same thing happens again? Know what i mean? Anyways, her address is a P.O. box (she lives in a small town in Wyoming) but apparently she never had a problem receiving notices from the USCIS because she even got the welcome address already. And the whole I-485 process even took only 3 months for her, without interview 'cause her case was transferred to CSC.

    One question though, the category on my card says CF1. Is that what it's supposed to be? Coz i have no clue what that category means. If someone can explain that to me, I'd appreciate it.

    Mine says CF1 too, it means: "The beneficiary gains legal immigrant status (CF-1) in the U.S. upon CIS approval".

    valid marriage contract after entering as a fiance or fiancee of a

    U.S. citizen - conditional.

    CR1

  6. I don't really understand how CSC processes the applications transferred to their office. I've read September filers or November filers not getting approvals yet. But my sister who filed in January, her case was transferred in February, and last week she received the welcome letter in the mail. So the AOS process took only like 3 months for her. I'm happy for my sissy but at the same time jealous coz im still waiting for my own approval :P

Our 2007 IRS transcript says MFJ. This really confuses me and gives me problem when filing for our 2008 tax return. The software asks if we filed our 2007 return as MFJ or no and I'm not sure what to answer.

    Since you have the 2007 transcript - what does it say under/next-to your name? (Where SS/ITIN # would go)...

    It just says Spouse SSN: (no number follows)

    I was married in November 2008. Since it's that time of year, I preparing to file income taxes.

    I read some of the previous posts, and the responses varied the gamut of filing married filing jointly or separately or just single. I still have some questions or doubts about how and what to file since my wife and her child are still in Colombia. She had no U.S. income and no SSN or TIN, Taxpayer Identification Number.

    I know if I file married filing jointly, I have to obtain a Taxpayer Identification Number for my wife. My understanding is that it's not worth it to file separately.

    Also, a friend of mine (who was in the same situation) filed married filing jointly last year, and the IRS dunned him for his error. He claimed that he had to file married filing separately. H+R Block did his taxes but didn't accept responsibility for the error. I'm not 100% clear on what the IRS claimed was his error, but I think it was for filing jointly.

    Do you think we're eligible to file married filing jointly for 2008 income tax even though she's not in the U.S.?

    I married Rin in October 2006. She arrived in USA April 2007. I filed "married filing jointly" for TY 2006. When you submit your 1040, it has to be submitted concurrently with an ITIN request (W-7). The 1040 and W-7 get mailed together to an address in Texas. They assign an ITIN and forward it to the tax revenue department to process your return. Took us an extra three months to get our refund, but worth it over filling MFS. (FYI - you will not be able to file electronically)

    You will need proof of foreign status.

    IRS has streamlined the number of documents the agency will accept as proof of identity to obtain an ITIN. There are now 13 acceptable documents.

    An original, or a certified or notarized copy, of an UNEXPIRED passport is the only document that is accepted for both identity and foreign status. If you do not have a passport, you must provide a combination of current documents that contain expiration dates - we accept documents issued within 12 months of the application if no expiration date is normally available. The documents must also show your name and photograph, and support your claim of foreign status.

    IRS will accept certified or notarized copies of a combination (two or more) of the following documents, in lieu of a passport:

    • National identification card (must show photo, name, current address, date of birth, and expiration date)
    • U.S. driver's license
    • Civil birth certificate
    • Foreign driver's license
    • U.S. state identification card
    • Foreign voter's registration card
    • U.S. military identification card
    • Foreign military identification card
    • Visa
    • U.S. Citizenship and Immigration Services (USCIS) photo identification

    We took Rin's passport and our marriage certificate to the US embassy in Bangkok. They knew exactly what we needed and gave us a form (basically a notarized document) stating that we were married and that she agreed to be treated as a resident (for tax purposes). Read Pub 519 for making this declaration.

    Our situation is pretty much the same except that my W-7 application was denied due to insufficient documents. We filed our 2007 tax return as married filing jointly and the w-7 was submitted along with it. We later got a note that the W-7 was rejected. So what was the status of our 2007 tax return? was it still considered married filing jointly or what?

  9. My husband and I filed our 2007 tax return last year as married filing jointly. Since I didn't have SSN, I applied for W-7 with it. About 6 weeks later, we received a note that my W7 (ITIN) was rejected. So was our return still considered married filing jointly?

    What were the reasons for rejection?

  10. We e-filed our 2008 tax return using turbo tax on Saturday and received a notice from them thru e-mail that it was rejected. This was IRS's reason for rejecting: The amount entered for the spouse's prior year adjusted gross income (AGI) does not match what the IRS has in its records.

    I checked both the copy of our return and the IRS transcript for 2007, it's exactly the same AGI amount that I entered. And the reason of rejection confuses me because my husband and I filed the 2007 return jointly (although I didn't have SSN or ITIN yet that time) but I wasn't making any income that time so why does it say amount entered for the spouse's prior year does not match? when we were answering the turbo tax interview, it didnt even ask for my 2007 AGI. we just had to put one AGI for both me and my husband and needless to say it was my husband's 2007 AGI.

    Im thinking that maybe our 2007 tax return wasn't considered married filing jointly since I didn't have SSN or ITIN when we filed jointly. but that's what it says on the IRS transcript, married filing jointly. Anyone experienced the same problem? (rejected due to "wrong" AGI?) Please help tax experts!

    Q: What Are the Disadvantages of Using the VWP?

    A: If you are admitted to the United States under the VWP, you may not change or extend your non-immigrant status. If your admission is denied, you have no right to administrative or judicial review, except as noted above. Likewise, if you are found to have violated the terms of your admission, you also forfeit the right to contest a removal order and to enter under the VWP ever again. Therefore, before using the VWP, you should carefully consider your options.

    just a minor dose of reality. Be happy about your interview but don't be naive. Remember all u got was the interview. Old d was just sending out a word of caution. If I were u I would appreciate it and take it as it is. No need to be defensive.

    I agree, just take Old D's reply as a word of warning instead of taking it as an offense.

    Is everybody getting interviews now? or does some people dont have to do an interview?

    I was planning to travel in May but I am concerned my interview would be set for that

    day.

    Is it very risky to travel with the AP? I remember mimigrant was saying is high risk

    and do I need to have a passport with my new name?

  13. I received a notice today that my case was transfered to CSC. Doesn't this sound weird to you guys? Coz if you look at my timeline, it seems pretty late for my application to get transferred. Don't transfers happen early in the process? By now, I should be getting the interview notice instead, right? And if my case was to be transferred, shoudn't they have done that in January or February? I'm not complaining, I just think it's unusual. :unsure:

    I did, and as expected, the CSR couldn't provide the information I needed and just said "your application is still within the processing time."

    Could you share the phone number with me that you called? I'm going to call tomorrow to inquire about my AP, no touch since Jan. 1 and EAD already received.

    just the USCIS hotline 1-800-375-5283. I'm not sure if that's the number that Diazy meant, I don't know of any other number that we can call for follow-up or inquiries.
