  1. my wife is petitoner and we are doing DCF and she is in india from last 3 months and she wasnt working. that means she is unemployed.. but she did pay taxes in 2007...so should we show her unemployed in current job status..well we are just worried this wont reject our application....or we just show her job which she was doing earlier in US...and put that income...if we show her unemployed then we have to show her income $0 too right..?? im confused pls help me..

    my situation is my wife is ptioner and iam benificary and ...she is unemployed since 22 july2008....she came to india to meet me on 23rd august 2008 and stayed here 3 months to complete the DCF procedure. so now we are cnfused that shes been unemployed so what should we fill in her job description and her annual income.. but she did paid taxes in 2007. In 2006 she did not paid taxes . beacause she didnt earn the taxable income and in 2005 she was student so she didnt pay taxes in 2005 too.....does she has to submit the W2s from 2007 job.???.. coz shes been unemployed.

    I own property here in India. So based on that is it possible to get residensy in India? I own that property since last 5 years. I am not sure what other details they need if it is based on owning the property...

    THATS GOOD THAT U OWN PROPERTY IN INDIA..ALL U HAVE TO DO IS TO GO TO FRRO OFFICE AND APPLY FOR YOUR RESIDENT PERMIT..THEN TAKE THAT TO EMBASSY AND YOU ARE DONE.

  4. 1. Your wife is the "Petitioner" and has to fill out an I-864 even though it will show zero income.

    2. Although she did not have income for 2006, she must either file or show reasonable cause why she would be exempt from filing.

    3. Your uncle alone can not sponsor you for an IR-1 or CR-1 visa. Again, your wife is the petitioner.

    4. Your uncle must sign his own I-864, it is a legal document, and your signing on his behalf would be fraudulent.

    BUT SHE PAID TAXES IN 2007 SHOULD I MENTION THAT/?? THERE PLS HELP ME..

  5. Thanks for your reply. Could you please let me know whether your wife had to work for full three months? I was wondering if they would allow based on a stay of three months and work for about months or so, or if one had to work for three months too in India. Also I was wondering if they would allow if the person keeps the job in US and simultaneously works in India too in the three months duration. I am the petitioner in my case. Thanks for your help.

    Basically they ask your wife to work in india for 3 months.. your wifes need the employer letter that she is working in this company.. They gonna see that she is paying taxes in india and they gonna see her bank accounts too..which actual proves the residency status of india. she cannot continue with her US job

    In my case it was different ..my wife didnt work and didnt had any bank accounts ..beacause we were already married in US....In your case..its imp. that she has to work and pay taxes.....

    OR

    she rents any property in india or she owns any property in india..that also proves the residency status in INDIA...

    IM CONFUSED PLEASE HELP ME....WE ARE DOING DCF PROCESS ...MY WIFE LEFT INDIA TO AMERICA TODAY 3RD DECEMBER 08. SHE STAYED IN INDIA FOR 3 MONTHS TO QUALIFY FOR DCF. WE APPLIED OUR PETITION ON 24TH NOVEMBER 08 AND WE GOT PACKET 3.5 BY HAND. NOW I NEED THE HELP WITH I 864. EMBASSY TOLD US TO SUBMIT TWO I 864. ONE IS FROM MY WIFE AND ANOTHER FROM UNCLE . SINCE MY WIFE WAS IN INDIA AND SHE WAS UNEMPLOYED. AND MY UNCLE IS SPONSORING ME. IAM CONFUSED ABOUT:

    1. MY WIFE IS UNEMPLYOED AND HOW WE CAN SHOW HER INCOME IN I 864 WHAT SHOULD WE WRITE IN #23 ABOUT HER ANNUAL INCOME ?SHE HAS $0 INCOME.

    2.and she did not file taxes in 2006?? what should we do about that?

    3. if my uncle alone is sponsoring me so what coloumn should i mark #1?? is it d or e?

    4. my uncle gave me the inforrmation about preapring I864 and iam preapring I864 on behalf of him so is it compulsory that he has to sign it or I can do it??

  7. she applied from Local supridentdent police office(SSP) she just got in 5 minutes. and for that she has to stay in your country for 3 months or whatever the requirement is and she has to pay taxes and geta simple job...then the embassy ppl prove it residency

    You can get it from FRRO office too

    but make sure when u doing this process your wife shouldnt be on trousit visa.

    Hope your application process is going on smoothly. For applying through DCF could you please let me know how long you stayed in India. I read before that in Delhi they were accepting some cases with a stay of 3 months. Did they ask you any specific questions about the duration of your stay in India?

    well my wife is petioner and iam benificiary...so she stayed here 3 months and she got her residency here.

    well my case went like this in US embassy when we went to file I 130

    we went to embassy waited in line for 6 hours and they finally called us. My wife told them that we need the seprate room to discuss our case. And they took us in seprate room and saw all our documents. Since we are already married in US and we have a daughtrer there which is 2yrs (actually not my daughter its from my wifes ex-Boyfriend) so CO saw our daughter birth certificate and he checked my previous F1(student) visa in computer he said i dont see any immigration proceddings in your case and even he said that he is not sure. But i know i dont have any immigration procedings in US and then he checked our I 130 and G-325A marked with red pen and collected all our documents and he said your petition is approved! :thumbs: Then he gave us the packet 3.5 by hand and he told us to read it carefully and send all papers to VFS address. now the thing is in those papers are asking me the case number which I dont have.....IM BIG TIME CONFUSED... :help: ..my paperwork is all ready and ready to send but doesnt have case number ... :help:

  10. I am a 22 year old American citizen living in India for the last 3 months and need to get a visa for my husband who I met in the United States in December of 2007. My husband was on a student visa in 2007 and due to family issues had to return to India just a few short months after our marriage. I came to India on August 23 2008 and didn't realize my husband would have so many problems getting back to the United States. We wen to the United States Embassy 3 times to retrieve Information on what we should do. They told me to stay 3 months and establish residency and then I could apply the petition for my Husband. We have a daughter waiting in the United States and need to return quickly please if anyone has information please reply as soon as possbile.

  11. My wife is a US citizen and we are already married in US. I got married on F1 Visa. Due to some circumstances I went back to India now after 6 months my wife came to India to take me back to USA. We also got married in India too. We been told by embassy in new delhi that my wife has to stay here for 90 days and then she can apply for I-130. Iam just confused that which marriage we should show to embassy to apply for K3 visa US or Indian marriage. Please help me about this???
