I am helping a relative fill out paper starting with I-130. I am kinda stuck on how to answer Question 15 which ask about the present employer and when this employment began. My relative does not work any more so I will put "none" for present employer. Do I still put down when my relative started this job even though he/she is no longer working?

So my wife lives in the philippines and I live in the usa. We thought about doing the papers for a k3 , but have yet to decide where we want to live.

Is it possible that she could just get a tourist visa and come to the usa for a while and then return to the philippines? She has a good job there , but would like to visit me here.

Some of her friends have got tourist visas from there to come to the usa, so i know its possible.

But, will being married to me, an american have any effect on that?

Well, that will not be entire correct. USEM thinks that a person, spouse of USC, applying for a tourist visa has the intention to immigrate to the US. It is very difficul to get approved for a tourist visa because it is very difficul to proof ties in a foreign country when your USC spouse lives and works in the US. I will recommend to try getting the IR-1 or K-3 visa instead of the tourist visa.

This is my update...

As today, NVC has reviewed and accepted my AOS but false RFE was generated (DS-230 has not been received by NVC). I am still waiting for the IV bill to be shown as generated on their system. Hoping tomorrow will be day when I can continue this process...

This is unI can’t believe what is happening with my IV bill. Don’t know if you remember last week I was trying to confirm that NVC had actually generated the IV bill since I had the access to make the payment thru the online system. Well, on Saturday night I got an e-mail from NVC with the IV bill. WOOOOWWW!!!! I was so happy because though that now everything will go faster since was only matters of making the payment and sending the DS-230 form but something inside me make me wait and confirm it with NVC today. Well, just to be sure today I called NVC to confirm with an operator that they had actually generated my IV bill. Well, guess what, nothing yet. The e-mail that they sent to me on Saturday is not in their system so they can’t confirm it.

Yes, I know what you are thinking right now… and yes I do have the IV bill in my e-mail.

I spoke with a NVC’s supervisor and she told me that don’t have any idea, how I have the e-mail with the IV bill. She said that normally they are having problems with people that have access thru the online payment system but never with the system that generate the bills. She told me that will request the generation of my IV bill again but that it can happen between today and a week because the system works with an order and she can’t do anything about that.

So again here I am just waiting for them to generate the IV bill AGAIN!!!!!!

Don't worry, USPS will redelivery on monday morning. This happended because the office was close. They only work from Monday thru Friday.

So for ur AOS u got the email but for IV bill so far u haven't? Correct

Is that what u mean by not generated? Yes

If u get the email instructing u to pay, does it mean it's been generated? Yes

And what do u mean u have access? I was trying to say that I'm able to pay the bill online. In your case since they sent you both bills at the same time you were able to select/pay both bills but in my case I was only able to pay the AOS bill. Only after the NVC processed my DS-3032 was when I had the "access/option" to select/pay the IV bill.

Do u mean u have ur Invoice number for ur IV bill and can log on but waiting for the bill to be generated (via email) so u can go ahead and pay it? That's correct.

Am I confusing u and myself trying to find answers? Don't worry, nobody understand this process. If you check the timeline of 10 diferent people here in VJ, you will find that no one is exactly the same. Some will have to wait 90 days for the %$#$% NVC to actually receive there cases. Others will have to wait for NVC to generate an e-mail with an IV bill, because they NEED to confirm that is TRUE what the online system said. Others will have to wait for NVC to do a 2nd, 3rd, 4th and a final review in his/her cases in order to be completed. As you can see there isn't one similar cases. Well, the only common thing in all cases is the BS that the operators tell you.

JAVC did u ever get an email from them insructing u to pay with the invoice number in it?? I am now freaking out. Q said not to since I have a lawyer things might be different for me...please advise if u got said email

I only received one e-mail but was for the AOS bill. Nothing yet about the IV bill

Glad it all worked out. The golden rule of getting through NVC: Don't pay or send anything to NVC unless asked to do so by NVC.

I called NVC a few minutes ago to see if they generated the IV bill because (I've already explained this in a previous post) I'm waiting for them to confirm that I can pay the IV bill online because I have the access to do it. Well, I've just found that my I-864 package has a RFE. The automatic system say that they send me a letter explaining what information was missed or incompleted so now what??

I'm calling the NVC right now to speak with an operator... I'll update later...

Ask for a supervisor to see what the RFE is for? Is it the False RFE which asks for the DS-230 which you haven't submitted yet?

Thanks Que for the link. About the RFE :dance: well, I just confirmed twice!. Is a false RFE. They are asking for the IV bill but since they haven't generated the IV bill I will need to wait until they do it. I've just spoke with the nicest operator, she said that NVC is only waiting for me to pay the IV bill but she explained to me that I shouldn't pay the IV bill online until the IV bill is generated. She said that they are working with this "new system" and it has a lot of problems and they are getting a lot of queries from people that payed the IV bill a soon as they have the online access to do it. She explain to me that if I pay before the bill is generated it will make a mess on my file and it can take WEEKS!!! to resolve it. So now what? Just enjoy the company of all of my VJ's friends until a get drunk!! because of cource I will bring some PRESIDENTE (beer) to the weekend party!!! heheheh

Can you explain what exactly happended to you? I know you explained it before but I can't find where exactly.

This is my problem... Today I checked the NVC payment center (online account) and it shows the IV bill as NOT PAYED. So in other words I need to pay it. I remmember something that you said about confirm it with NVC before paying it so, following the advise I called the NVC and they told me that the bill wasn't ready yet. I don't understand why they give you the option to pay the bill online when it actually is not ready yet.

Javc, you have to confirm that the IV Bill has been generated. Once the DS-3032 is accepted the first system shows the status as not paid, but the second system has not sent out the bill yet. IF you cannot confirm that the bill has been generated and sent, DO NOT pay the bill, you will end up with your payment status showing as paid in one system and not paid in another. The two systems are separate but synch up, if they don't synch up you will have to get a supervisor involved.

Q and JAVC did you guys both get the email letting you know the bills are ready? I got the combo email which I think came from the new system, so I think they are doing things differently now, as opposed to paying the two bills separately now they are both comined. But I am thinking maybe this only applies to me since I have a lawyer and can therefore skip the whole DS 3032 step. You should call NVC and find out what the deal is. I think I will call them right now just to make sure about this whole 2 system thing.

What about u Aruba? Did u ever get an email letting u know ur bill was ready to be paid before this whole mess began for you?

In my case I didn't receive the e-mail. I did receive the e-mail for the AOS bill but not for the IV bill. Hopefully tomorrow I will get that e-mail.

Guess what guys? Something told me to check our online account to see if the bill was reflected as paid and IT WAS!! WOW I can't believe how fast things start moving with the new NVC online system. I am loving it!! I love being able to check the account online. Now we wait for hubby to mail us the required docs and for the lawyer to get the packet ready to send. I hope he moves fast and doesn't ask me to be patient!!! cz then I won't be too happy abt it I am hoping all of our docs will be mailed out to NVC by next Friday! I am giving myself a week to get everything out. Let's see if it works.......

My husband and I filed through direct consular filing in the Philippines. So I got to stay with him through the whole entire process except during his interview when I flew back to the states about 3 weeks before. What I showed as proof of my domicile was: copies of my passports showing that I traveled to the United States back and forth, my unexpired driver's license, pics of me holding latest newspapers with teh date visible, my plane tickets and boarding passes. I can't remember if we submitted more things. good luck!

my sister loves to take photos. so she acutally got the headline and date in the picture with me. by the way, the consulate in the Philippines did ask my husband for documented proof that I was in the states. If you look on the Manila US embassy website, it is actually one of the things that they might ask to prove domicile. hehe I flew into seattle two days after the elections. so i took pics with newspapers with President Obama on them.

i forgot to add, I took pics of me in places around Seattle too. The space needle, seattle public library and the United States Post Office.

OK, I understand but next time you should specify that it was proof of presence in the US and not for living in the US. LOL!!!

Can someone help me understand this, I received the email approval notice for my I-130 last friday Mar. 13, then when I checked USCIS website today it was touched again on the 16th. What do ya'll think happened?

Normally after they approved your petition they "touched" again but only to send it out to NVC. So be happy you are out of USCIS!!! Give them like 2 o 3 days and start calling the NVC at (603) 334-0700 and ask if they received your petition, use the USCIS receipt number find out the status.
