My grandma is 78 years old she is from Dominican Republic and has been permanent resident for more than 15 years. Know she want to apply for American Citizen but she can’t write or read Spanish or English. Now is very hard for her learn to write and read, first for her age and second because she has myopia.

Can she become an American Citizen without take a civics test. Can she apply for the form N-648? What can I do for help her??

Good news for me- I-129F left for Costa Rica today! I'm going to see if I can go ahead and schedule the interview. Not sure if the papers have to be there to schedule or not.

Without the case I don't think you can schedule the interview. Also, I think the Consulate will schedule the interview and after that is when you can try to change it so it can be in a early date.

But you won't loose anything trying now, so call them :-)

On another note, I called NVC this morning and teh lovely rep told me my case was under final review...allow more time for completion, also I couldn't log on to the NVC paymnt system, it had a message that NVC was no longer processing that case...and GS told me this happend to her the day before her case was completed, so I'm static!!!!!!!!!!!!!

You can count on that. I have the same situation on monday morning and called NVC to know the status of the case and it was under review then I called again around 7:00 P.M. and the case was complete. So, you can say you are almost done with NVC. Congrats!!!

Hey JAVC, nice to see my fellow NVC buddy! Any word yet on the switch? Wishing u luck!

Nothing yet but I have good feeling that it will happen. What about you? I see that you've already got your interview date, congrats to you. In my case If I'm not able to do the switch I will need to wait until july or august to get an interview date because the USEMB at DR has a long waiting list and it take about 3 months to get an interview but hopefully I won't need it.

QUE, congratulations!!! Glad to see that everything when well for you and your wife.

If both the I-129F and the I-130 are approved, just ignore the package 3 for the K3, and take your time responding to the paperwork for the CR1. The I-130 approval is good for one year, so you can stall at least that long.

As Reba said, your I-130 will expire in a year from approval date. So you still have like 8 months (save time) before continuing the NVC process. To delay the process, you just need to do... nothing hehehe sounds rear but is true. From now on everything is almost on you. The embassy will send your hubby the package 3 with instruction so you just ignore it, also NVC (National Visa Center) will send you a letter asking you to pay the Affidavit of Support bill again just ignore it but remmeber to keep everything in a safe place for the future.

i sended my case on nov 11,2009 they got it on nov 13 then transfered to csc on jan 11 then i sended i-129 have feb 5 and uscis got it feb 13 and i havent heard anything from them still pending im worried please someone help

So, you marked "no" on the I-130, and "yes" on the 129f? What "copy" did you send with the I-129f?

It sounds like the worst that will happen is you will get an "RFE"( request for further evidence) on it. If you do, its nothing to freak out about. Just follow their instructions and send whatever it is they want.

Or, they may just let it slide.

You can call USCIS and follow the prompts to "if you believe there is a problem with your case" or something like that.... y

ou will get an officer and you can explain the situation to them and ask if it will be a problem.

I don't think it will be a problem. Since you have your US passport they will be able to find it. You don't need to worry about that. And like "Y's_habibitk" said the worst thing it could happend is only an RFE.

I was wondering if my wife's previous multiple denials for a student visa to the United States will affect her K3 visa application. She was denied multiple times at the Beijing Embassy. We both decided we were too young to marry at that time (2 years ago). and i did not finish my college degree. we only wanted to go to the same University together while we date. Now we are married and she is a college student in canada and i will graduate next month. So we decided to get married. However im afraid of her previous attempts at a visa and denials will result in the CO grilling her. any thoughts? thanks

I am almost in the final stages and hoping for a case complete tomorrow. I am no longer able to sign into the online NVC payment site which is typically the case when the case is about to be wrapped up at NVC I was told tonite that both my DS 230 and AOS have been accepted with no RFEs WOOHOO hubby and I can breathe a little now...we were driving ourselves crazy with stress throughout this bumpy NVC ride!! So much for it being a smooth ride! Can't wait till we're out of there!

WOOOHOOO!!! Congratulations!!!

Now you just need to sit and relax (If you can, hehehe) and wait for the Case Complete. I'm in the same step, waiting them to accept the DS-230 and giving me the CASE COMPLETE, as today the AVR only said they received the documents from me (for last week RFE) and need to wait 6-8 weeks so they can process the info. Hopefully I will hear from them this week too.

GOD HAD A PLAN FOR US AFTER ALL....

Our K3 got to NVC on March 6th and was stuck in AP on March 10th. It was just sent to embassy today, which means we were in AP for 34 days total.

This is bitter sweet news to us since we had decided to follow CR1 but today found out our CR1 is also stuck in AP Stupid AP Anyways, my hubby and I will follow whichever one gets us reunited faster cz we are so freakin' tired of this separation and nerve-wrecking wait!!! So we shall see where that leads us...We are now hoping to secure a May interview for K3 and be able to flip to CR1. I still beleive things happen for a reason. NVC closed the May interviews yesterday so maybe this happened in our favor seeing as how we can still get a May interview and possibly flip our K3 to a CR1 interview ...Still keeping the faith

Ohhhh , so sorry to hear that you are in AP. Remmember to never loose your hope, you will see that you willl be out of AP very soon and will be able to switch the K3 visa interview by that time.

Really, I don't know how this %$#&$ system works (if you can called a SYSTEM). You've just got out of AP for your K3 and now they want to do they same thing on the CR/IR. It think this is ridiculous. It is only a waist of money on their end but more important a waist of you and your hubby time. Do they know that they are separating people??

If you only overstayed 45 days, you will not need a waiver.

Waivers are only necessary when you overstay by 180 days or more. There is no ban for immigrant visas until then. If she had been applying for a non-immigrant visa (tourist visa etc. . .) it would be difficult to prove non-immigrant intent. With an immigrant visa you obviously are intending to immigrate they go directly by the guidelines in the INA which start at 180 days.

The information Bobby posted explains this part. . .on non-immigrant visas your visa is cancelled after any overstay but you are eligible to re-apply (more difficult to get approved) but you don't have a ban, you just don't have a valid visa. . .

What happen if you overstayed your visitor visa and then travel again to US and enter without any issues at POE? Do you break any law?
