    wanna bring my mother from costa rica to estates and before i submit  the I-130 i need advice im uscitizen ' uscis in the form need my and moms birth certificate and mine .  do i need to translate the birth certicate   .??? Also in costa rica rica the law is no matter when u request the birth certificate xpires in 3 months so if i use in costa rica after the the birth cer.....expire is not valid  so we need to issue a new one .also do my birth certicate can be apostile from costa rica or just normal and pay for a certified company here to translate it ..in english please advised god bless .also i live in seattle 'where do i sudmit  the info to seattle uscis 'or nebraska'texas'california 'vernon and how long take from the begining of process to the the last step visa approve

  2. is funny when i see people replied without living in that roof ,my dad and mom told me never be in between a couple no matter who is it, looking all you listen just 1 side of the history, nobody heard mine  ,is ok maybe nobody will see this respond  after 10 years  here in USA . now read carefully ignorants . is gonna be short .IM US CITIZEN ,   before i came  i got my job  for 8 years ,my family we were happy 

    .for reasons of life  i broke up with my ex girlfriend  a friday . told god i dont wanna  deal this anymore too much drama .look the sky  and i said Lord let me meet sobody else .i never though in a million year is gonna happen but did.wait for her 1 year and half. i got fired bcause people was jealouse  of me thinking i have money , i alway survive i dont care if i need to eat grass  thats my strengh. i left my ties ,my family, everything  ,i cry in silence  i was sociable  here i learn to b alone thats another strengh  i learn to be humilliate ,call wet back,illegal, all you can imagine ,glad i took taewondo in high school that bring me some discipline till now. anyway .i dont care what everybody said ,taye and me we never did nothing wrong was new for us ,i  try everything for 1.5 years nobody know sh.....t i did and always she try to intimidate me with the cops and im sorry im not a pet after a year and half my love change  i star feeling cold ,no love here,no family  she took me to a bar.that was Bobbies borthday  i got a beer  i was the only hispanic everybody was caucasian, she was looking at me and a ramdon guy walk to me took my beer and dump it in the garbage  at the same time push me out of the bar  so i stay out  bobbie came out after 30 minuts shake hands i said is all good brother happy birthday , in that point i got my own car cost me $1800  honda accord 94,i left the bar she didnt sayd anything but she saw the dude trowing my bottle  i left listen my salsa music  stop in a light and got bit up with a baseball bat  i know is destiny i never blame on anybody ,drove home she look at my and she start laughing  for 30 minuts  next day she left to miami  for 2 weeks   that was my call.after she said i deserved for bother some one else girlfriend even when is not true so im  done  not cares wherever humilliation ,  did a police report, continued with my life  i start asking people i said i left everything for her is not working we 2 different people we just need to go  to  the highway  different ways so i learn that i need to proof  that i was married in good faith , she did everything right and me too we just 2 different people is sad  but i love my family too and she also didnt care for my mom either thats in another context o book .......see when u know all the facts together you will understand where i comming from  but lets do this ...

    i have my girlfriend now and sometimes i miss her when you marry somebody is forever but sometimes the circunstances,and diferences is more powerfull than the love thats the way it is, we use to fight like cats and dogs, USCIS they know i marry her in good faith ,thats what you need to do

    dont blame your husband make an appointment with USCIS tell the true whats going on they will bring you a little idea, take all your documents even the last paper when he bring you here beacause you are the wife is a marry and you have the same rights if you forget at least one he will againts you and kick your butt back and immigration , leave the house file separation agreemant

    then you have 30 days to find the documents or proof of marry in good faith,

    I believe it deppends on how old is your brother..

    if he is very young like a child you wanna petition for your mom first and when she becomes a legal resident she will be able to petition for him as sibling under 21 ...now if your brother is older or almost an adult you should file I 130 for him

  6. Yes, but you'll probably have some explaining to do during ROC. Just keep records of all your travels to see each other, means of communication, family trips together, etc. You should be fine.

    Edited to add that 1.) I don't think you were referring to me when you suggested someone seemed to know everything ;) 2.) I've never been through ROC, so maybe someone else can confirm what I've said, and 3.) my husband and I lived apart after marriage for work reasons and didn't even see each other for over two years BEFORE we went through AOS, and our AOS went smoothly.

    no way after 30 days you live your wife is consider fake . you guys need to have proof of mail addres , insurenses, properties, taxes, ,if you guys are gonna live apart and the end of the 2 years before your green card expire

    like i said ,you need to have proof and then go to the interview with USCIS , or Homeland Security so i think you try to be smart and i n the end you gonna paid the consecuences beacouse to me that looks fake

    How are you doing? My name is Sunshine from Kuwait. I'm seeking for advice about filing a waiver. I am hoping that you might can give me an instruction on my next step of completing my residency. More details below;

    This month would be my schedule to file I-751 but my husband walked away and not willing to provide any kind of documents to file jointly. We are both serving in US Army Contructor outside United States.Since, my husband is not cooperating of anything I was thinking to file a waiver base on extreme cruetly and hardship. My question, what documents do I need to submit? The documents that on my hand are company benefits with his name on beneficiary, LOA, two people affidavits and my company contract. Do you thing these documents are enough? and what is the best explanation to write for the extreme cruetly and hardship? Thanks in advance.

    The documents you have are not enough.

    A waiver based on extreme cruelty requires evidence of marriage in good faith, and evidence of abuse. Having him as a beneficiary on your company benefits is one piece of evidence of marriage in good faith, as are the affidavits. The LOA and company contract aren't likely to be of any use. Evidence of abuse is things like police reports, physician reports documenting injuries, reports from counselors/psychologists/psychiatrists documenting mental abuse, etc.

    A waiver based on hardship requires evidence of extreme hardship far beyond what a typical immigrant would suffer if they were deported, and which is based on circumstances that occurred AFTER you became a legal resident. An example would be if you acquired a severe illness that could not be treated in your home country, or if war broke out in your home country. Financial hardship is almost never sufficient for this waiver. I'd also add that hardship waivers are rarely granted.

    If you can get a divorce then you can filed based on good faith marriage alone, but you still need more documentation for this. Proof of having lived together, joint bank accounts, joint assets and debts, etc. You also can't file based on divorce until you have the final divorce decree. Since you are working outside the US you have a valid justification for a late filing waiver.

    I-751 waiver approved on 15th of this month. Some of you already know me because I am a silent and active observer of this forum. To cut the long story short, I arrived here in 2006 after marying USC. Received 2 yr conditional GC ending in middle of 2008. After 6 months since I arrived in USA my marriage was about to collapse. Eventually we had to separate. Separated in the middle of 2007. In my state there is a 1 year separation requirement to file for the divorce and unfortunately my CGC expiration date was before even I complete 1 year separation. Hired an attorney. Filed for removal of conditions based on "removal of me from USA will result in extreme hardship to me". Got 1 year of extension and in the meantime Filed for the divorce and got divorced in the end of 2008. Withdrew previous petition and refiled based on good faith marriage with final divorce decree in the end of Jan,2009. (evidence- no joint tax returns, no joint bank accounts, no joint lease because the house was my x-wife's brothers name, I had-pictures, joint health insurance, copy of e-mails, MANY affidavits from her relatives,statement by one counselor). I have received interview invitation 2 weeks ago. Went with my attorney and a lady called me in. She asked my current address and biographic(basic) info about me and my x-wife. Briefly asked the reason for the divorce and approved my petition because of genuine nature of marriage.

    So please guys, don't be scarred too much if you divorce. If your marriage was real then you will get your GC for sure, sooneer or later. Remember, prayers always helps.

    3inch packets? Yikes, I wasn't planning on that much at all.

    Here's a list of what I was thinking of sending, would appreciate your feedback on what you guys think:

    - last 2 yrs of taxes

    - employer provided health insurance info (stating both names, and indicating "spousal coverage"

    - beneficiary info for life insurance

    - beneficiary info for 401k

    - copies of car insurance cards stating both names, dates for the 2 yr period

    - copy of joint checking acct statemements for 2yrs

    - copy of savings account indicating joint acct

    - copy of cell phone bill showing the same 2 lines from the time my spouse (then fiance) came to the US [although only my USC name shown on bill/address]

    - copy of itinerary and boarding passes from trip to Europe this yr

    - pictures from trip together

    - copy of loan info for car we purchased this yr

    - pictures, about 10-15 during the 2yr period

    You guys think this is enough? I sure hope so! Hopefully I'll get this all together by the end of the week and send of next Monday and add myself to the list.

    Here is a list of what I submitted ..

    • Copies of my wife and daughter's passports, permanent resident cards, and social security cards.

    • Originals of the USCIS reminder letters for both

    • Copies of our drivers licenses showing the same home address.

    • A brochure for the non-profit country music jam and dance that our family started in May 2008 and have hosted weekly on Fridays ever since.

    • Copies of our Food Service Sanitation Certifications issued by the Illinois Department of Public Health which we use for preparing food at our weekly jam and dance.

    • Two sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.

    • Our 2007 and 2008 joint US tax returns.

    • Our 2008 IRS Economic Stimulus Payment statement dated May 9, 2008.

    • Bank statements from our joint account showing payroll deposits from both of our workplaces.

    • 2 voided checks from our joint account with our family picture and both of our names on them.

    • A copy of my wife's employers life insurance statements naming me as beneficiary.

    • An original form establishing life insurance on my wife and daughter thru my work.

    • A copy of health, dental, vision, and life insurance coverage on all family members.

    • Copies of health insurance statements for my wife and daughter's doctor visits.

    • Various vehicle insurance statements, cards, and declaration pages.

    • Copies of our visa and master cards from joint accounts.

    • Copy of our Sam's Club cards on a joint account.

    • Copy of our family membership cards at a recreation center

    • Copies of credit card transaction details for hotel room purchases for our 2008 and 2009 vacations.

    • Copy of my leave of absence insurance paid for with my wife's credit card.

    • Various pictures of our family together over the past 2 years.

    I tried to include more than what was required but not so much that the individual reviewing the packet would have a hard time finding the information that he/she considers relevant in establishing that our marriage is genuine and that we live as a happy family unit. My wife was pretty insistent that we also provide documentation that would show that she has never been a burden to society (welfare, etc.), and actually included documentation that proved that our volunteer efforts as a family have benefited our community overall.

    I probably did overdo it a bit .. HOPEFULLY NOT TOO MUCH .. :)

  12. do every body need the time line

    Hi, my application was received in Vermont on March 6th 09. It was transfered to Local office in Late August. I inquired and was told it was too early to decide on my case. It has passed the six months window. The local office has six m onths window too. So do i start counting the six months from the day it arrived in the local office again?. This is what i sent to vermont;

    1. My Gc both pages.

    2. Our car insuarance card copy.

    3. Copy of a paper [/b]showing we own the house (Which i later realised was not the title deed but had both of our names and the house address it was for insuaranace.)

    4. Bank statements from when we were married even before but i did not print for every month i kinda skipped some months but had almost 6 for every year upto this yea[/size]r.[/u] ( We were married in '04, filed in 'late '04, we were called for interview but my husband was incacerated, i went alone that was in '05 but nothing happened. We moved to another city once he was out and got an attorney who realized that his divorce decree had not been finalized although we had the decree, we did not know how a decree looked liked. So we remarried again in '06, went thro DORA and had the interview where we were separated, got green card in May '07.) This explains why i had bankstatements from even before our marriage.

    5. Copy of health insuarance card with his name under mine.

    6. Some old pictures.

    7. Utilities under both our names.

    8. Jury letter with his name.

    And others i can not remember.

    My question is if they call us for an interview, i did not copy the paperwork. I can get the evidence but not the application form. (I did not make a copy) What should i do to prepare myself for an interview, also should i make another infopass or just wait and hope for the best. What does one need to prove it is a bonifade marriage as they call it.

    Honesty is still, and always will be, the best policy.

    You don't have to show that you are currently a happily married couple. Though that would help, it is not what they are looking for. You only need to show that you entered into the marriage in "good faith" and did not, or are not, commiting marriage fraud.

    It is up to the USCIS to prove otherwise.

    There is actually a case of a person over here that they were in divorce proceedings and they disclose it and even so she got approved.

    I think the best policy is that you two are through rough times but you still care for each other, that says a lot.

    Be natural...and my advice is never give more than necessary but you must be natural, so if you feel that in the case it might get the impression that you are "covering up" the appearances, to say that you two are having a rough time and have spend to time in separation status...but still care for each other, I don't see major problem BUT you know it will really depends on the adjudicator that you will get.

    " also vote for pinning this! I wish I had known before sending my packet. One thing I kept hearing about was sending utilities and other things addressed to both of us. It was time consuming to dig all that stuff up out of the basement, and it turns out it was unnecessary!

    I wouldn't say that's for sure. The guy may be the boss but I doubt if all of his IOs go by what he thinks.

    I still go by "The more ammo the better"

    I may add he has been at this for 27 years and worked in several local offices. He is currently in charge of the department that handles I-751s among other things. He never said these kinds of things were BAD or not acceptable, I hope I was clear enough on that. He said they are not soild evidence. In conjunction with other things, I agree, the more the better.

    I asked about children more for my own interest as we have two that I consider "ours" and will not consider them otherwise and I am very involved with their lives now, the father is AWOL and has been for many years, Many legitimate couples do not have children at all, so this kind of evidence is not always available for everyone and they get approved without issue.

    He said what he always looked for was evidence of commitment, mostly financial, that two people had mingled their financial lives. The theory is if the marriage is a scam, you aren't going to risk your savings or let someone run up your credit cards and "do a runner". Seems reasonable to me. He also said that he, personally, had never asked what he called "stupid questions" like "what color is her toothbrush". His reason? "Hell, I don't know the color of MY wife's toothbrush!" However they DID ask people, separately, to draw diagrams of their apartment or houseand things more detailed that married people SHOULD know.

    Likewise with children. If the marriage is fraudulent, what woman is going to involve the guy in a child's life? Whether she is the immigrant or the USC. It is a commitment to family life together that is hard to dispute. Letters, cards affidavits from family? Fine, but how easy would it be to fake those? Again, all is a body of evidence. He never suggested taking anything off the table.

    He mentioned, in fact, that not everyone goes by what he thinks, but I think his input is invaluable. Of ocurse there are IOs all over the country and he cannot tell you what each one thinks or considers. I will have some other comments under the K-1 forum specifically about what other IOs and adjudicators do and how to avoid some problems and RFEs.
