  1. I'm sorry to say, but all this talk of revoke this, contact this, report this...blah blah blah...is all pretty much useless and he will stay in the states and be granted all he wishes to be granted. There are a million ways he will make the system work in his favor. My ex-husband did this to me. We were together, he came to the states, and shortly thereafter he met up with other Nigerians and they all advised him on how he could beat the system and he did. He started an argument with me one day over a phone call and before I knew it ..he was leaving. I cried and begged for him not to leave, but he just kept going. I had no idea where he was staying, he changed his phone number, didnt reply to my emails, etc. I went to homeland security 2 weeks later and reported him gone and told them i suspected fraud. After all this...I found out he said I thru him out of the house, treated him bad, etc. He was granted ALL that he wished for and my name was dragged thru the mud just to save himself. If anyone at the USCIS or any of these places had a brain, they wud reason that why would someone go thru ALLLLL I had to go thru to have him come here, just to throw him out? I mean get real. I was the best wife anyone could be to someone, but they dont even contact you to get your side of the story. They protected him as if he was some victim !!! So please dont waste your time and energy trying to fight anything or get him deported or anything. LET HIM GO. Just move on with your life and put all this behind you. You've spent a LONGGG time going thru the process of having him be there with you...dont waste anymore of your life now trying to undo the process....bcuz in the end, it wont work anyways!! The man I am with now, said something to me, that I will now say to you: This guy you were with and all he did to you..."one day he will surely be paid with the same coin that he spent".

The withdrawl of sponsorship is not necessarely gonna lead to this guys' deportation but will protect the OP from financial liabililty for this guy in the next ten years. The chance of this guy not to be deported makes revoking support actually a priority. The others are absolutely right with their advice.

  2. Post Decision Activity

On May 9, 2012, the supervisor review of your case was completed. We will mail you a notice once a final decision has been made. Please wait to receive the notice before you contact USCIS.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations

this is the message i got when i checked my status online. can someone tells me what that means im cofused thakns for ur help

It basically means nothing besides that USCIS has made a decision. You'll receive a notice with the verdict shortly.

  3. Thank you so much ManuFred for your reply!

I got my parking ticket on 5/4 (Fri), my interview on 5/7 (Mon). Honestly I didn't think it was a big deal...

The internet payment system did not reflect my ticket as of 5/10 (Thu) so I went directly to the court to pay for it. As it happened before the interview, it shouldn't be even noted in the questionnaire,.. but better be safe than sorry.... So I will be going with my receipt in hand and see how it goes...

You're most welcome. Glad it worked out! Yeah, nobody is gonna do anything to you with that receipt on you.

  4. I assume you took care of it same day to get your car back so you actually knew this at interview. You probably should have mentioned it unless you didn't know the outcome at that time.

It is not uncommon a traffic violation is processed in the days/weeks after the incident so that people find out about it in the weeks after the incident. This is what happens if you run a red light on a photo enforced intersection for instance. Was it me who was flashed or the guy behind me? You're not always sure, right?

You probably can get away with it by mentioning it in the oath letter but not to go into the specifics about being towed etc. Just use the correct date and call it "traffic violation ($50)". It would be the truth afterall.

    Updating....

I've received the oath letter.... but on 05/04, which is 3 days before my interview, i got a parking ticket and got my car towed... I took care of it and paid the $50 fine.

My questions is that on the oath letter, on the reverse side, there is bunch of questions with one question that says have you had any 'traffic violation' since the interview... I guess I have to answer 'yes' (even though the incident happened before the interview), but would this affect negatively my oath ceremony?

    :(

  5. well.. that goes to say.. I still have to deal with this stuff as I now have to request documents in order to keep my Dutch citizenship as well and that's not exactly the easiest either lol

Congrats. I was wondering the paperwork you would have to file to keep your Dutch citizenship. My understanding was you don't have to do anything. You either lose it if you do not meet the Dutch dual citizenship criteria when you become USC or you get to keep it. All I know is that I have to bring my wife's naturalization certificate for my next passport renewal.

  6. But it wasn't refiled, the IRS never got the first copy and when we prepared another copy for them that is when my accountant and I realized the mistake - so its like I am filing for the first time however the copy that IRS never received is what was sent to the USCIS with the I-751 form. My accountant is willing to prepare a letter indicating that an error was made with the numbers.

I doubt they will look into the details of your return and of course, you can tell them this too if you're asked. Important thing is you have filed your return, which you did. You might have the option not to file tax information and take tax information (preferably transcripts) to the interview instead, like I did. IO asked me if I filed but didn't need to see proof so he never got to see my 2011 return which I wouldn't have mind in case he would have wanted to see it.

  7. So I received my appointment letter today, While I was reading the letter it says that the proceeding will take about TWO HOURS!!! WHY? I have read here ppl experiences that it only took 15 or 20 minutes? is the whole process TWO hours?

They tell you to reserve two hours of your time so they have a little bit of flexibility in case interviews take longer than expected. It ussualy takes 15-30 minutes once you are called in.

  8. Well just passed my interview and civic test. My oath is in approximatly in 15min at 1:30Pm

    It was in Centennual colorado.

Came in at 10:45AM my interview was scheduled for 11:15AM. Waited till 12:30Pm to be called in. I was sworn in then the IO proceeded to review the application with me. I was worried since I applied 4 days before my 3months since I moved to Colorado in November. I was certain I would be denied for that. But turns out it was a non issue 2 days early(per NOA). He looked for our daughter's BC he couldn't find it in the folder so he asked me for my original and once made a copy of it and opened the folder again there was the copy I had sent in. He laughed and said "well now I have 2".

Then we prixeeded to do the civic test. Not necessarily in that order...

Who is the Governor of your state?

Where is the statue of liberty?

Who is the first president of the US?

What movement tried to end racial discrimination?

What is the supreme law of the Land?

What is one promess u make whn becoming a CitiZen?

The Question I read was "Who lives in the White House?"

The line I had to write "The president lives in the White House."

Then the officer told me I passed and that there was a ceremony at 1:30PM and if I was wanting to take that one... Of course I said I'll take it lol.

Okay they are calling us to go take the Oath Ceremony now. Good luck to anyone waiting or having their interview... I'll keep u posted on the Oath but I'm sure it is about the same as evry other ones.

Awesome! You're questions were the same ones I was asked last Wednesday as well as the read/write sentence.

  9. I doubt they will ask as the signature on the application is not the "official" one. When they complete your interview, they will ask you to sign it again and that's the official signature.

I agree with the previous posters that the travel dates, certain anniversaries are more likely to be asked. I remember in my interview that the IO asked me about if I still live at the address I listed as current and if I work at the company that I listed current. No address, just verified it they are still valid.

Indeed, IO's can be very thorough but I can't see them asking the exact application date as it is the least relevant information on the complete form. Well, the date is used in determining your eligibility but there is no reason you should engrave this date in your memory.

The IO who I was interviewing with even told me I was to literal in answering the question about trips and days outside the US in last five years. According to him I would have been fine leaving the first 1.5 years out as my application was marriage based. It's funny as I'm the kind of person who has a tendency to interpret question (something people shouldn't do with the USCIS)

  10. I just want to know info about this details

If you marry someone you will have permenant resident card. After 6 month usually. But after it what is the best way to get citizenship?

And how long it take to get it at least?

    Regards,

You can apply once married for at least three years with a USC and you have lived in compliance with GC residency requirements. These and other requirements are listed on the n-400 instruction form.

  11. If you are talking about your driving record, you need to contact the agency that gave you the parking tickets, and get proof (abstract of judgement) from them that the tickets were paid. You then take that to your state's department of motor vehicles, to have them removed from your record.

As far as the USCIS is concerned, there may be an issue if wants or warrants were issued for failure to appear. You would need similar proof if indeed it does become an issue. Normally, traffic tickets less than $500 where you were not arrested or involved drugs and alcohol do not need to be disclosed. However, I think an arrest warrant would be a big red flag.

Well, my understanding was you would mention tickets of less than 500 dollars but you won't have to submit evidence with your application. Depending on the IO you might have to show evidence of payment at interview.

  12. No - don't send every blessed thig you've sent before, but yes send what is necessary to prove continued financial co-mingling and marriage.

Tax transcripts are neater and tidier then trying to send your tax return - they're free and you just call the IRS - they mail them to you.

Items such as joint bank account statements, bills showing your shared address, birth certs of your children together, mortgage with both your names on it, loans showing both your names etc...

Do not send every electric bill or bank statement since you were married ;) If you wish send 1-2 from each year which shows your continued marriage and co-residence at the same address.

Photocopy both spouses state id/ drivers which show the same address. Perhaps a few pictures togetehr (but honestly those are secondary evidence)

Be sensible and send quality over quantity

I agree with what you're saying. Do send the required info but don't overdo it. I was approved by sending in copies of one bank statement and a mortgage statement. That's it. Sending more might be more convincing but might also add to the workload.

  13. I recently found out I have some old parking tickets which for some reason although I have paid them they show on my driver license record.

I will go take care of them first thing in the morning but since I am past my biometrics, would these tickets show up on my record as unpaid?

Should i take the reciepts with me at the interview?

Do you evidence of payment? If so, you should bring those to the interview. If not, take care of them and get evidence of payment.

  14. IS it good idea to resend ALL supporting materials used for condition removal ?

Or USCIS already has /kept all past sent materials?

They do keep those items on file so yes, they have those. However, for citizenship proof of marriage in good faith is just part of the process but not the emphasis like it was before, few items is ussualy enough. if you choose to submit tax documents (recommended but not required) transcripts work best. You will be asked to bring those to the interview as well so order 2 copies of each transcripts in that case.

You could also send some other strong evidence in like a mortgage statement and an additional piece of marital bond.

  15. Thanks but now it have been over a month and our online status is still saying request for evidence :bonk:

Yeah, it might take some time especially since your case is now reviewed locally. I would keep an eye on the status for maybe a week longer or so and call them in case you don't hear from them.

  16. This is a new one to me, so are you advising even with the five year to continue to file joint tax returns and to bring those taxes in? I could guess that either he was too nervous or too over-confident at his interview. Can't be neither.

According to our tax law, only required to save your tax returns for three years, unless you are called in for an audit, then you must provide tax returns for five years.

One option for you is to contact your senators office. We also have friends where the USCIS wanted both spouses to attend a second interview where details like this were worked out. But never heard about this for the five year.

Many government agencies give certification, view the USCIS in the same way, you do get a certificate that implies certification. But the USCIS is the only agency where this certification is the result of meeting with only one person. Every other agency, you meet with a board. And there is always one guy that always votes no.

Tax returns are actually not required for filing N-400, even if filing based on 3-year rule. However, USCIS might always ask for proof of correct filing at interview, this also applies to 5-year rule applicants. It could indeed have something to do with what the applicant said during the interview or documentation submitted with this application or previous immigration applications. That's why I think it is not good to send in too much information either, just stick with the requirements and maybe a little more if you think that is necessary but don't overdo it.

I think leecindygroo did the right thing by submitting the letter from IRS with the 3 transcripts. This shows one has tried and might convince USCIS to drop the evidence requirements for the first two years.

  17. Done with interview here in Tucson. Came in 15 minutes early and was called 20 minutes later. No busy waiting room actually, just few other people.

IO was a very nice guy who didn't mind chitchatting in between the official things that needed to be taken care off. No difficulties came up and no problems with couple of changes I had to make. Recommended for approval was the verdict so I'm happy.

All the best with your interviews guys!

  18. So, I was approved last thursday and my USCIS status is still "interview". How long will it take to change to Oath?

Depends on your office. Try to look up their ceremony schedule and perhaps some of the timelines from people who have filed through your office. This might give you an idea how long it takes to get the oath done.

  19. Tell that to the people who got lost in the system and have waited over a year...

I agree that rescheduling is never prefered and it could potentially add months to your application. However, in my opinion it is worth rescheduling if you happen to be somewhere else for a good reason which a wedding of a close friend (not just anybody) would be. I would have done the exact same thing for people who are close to me.

Getting lost in the system could happen to all of us also to the ones who did not postpone the process. Trying to obtain a passport at the last minute involves a similar risk. Something could go wrong there too.

  20. I applied for n400 in jan 2012 , got a yellow letter on march 6 telling me what to bring to interview etc, it was not a interview letter just a letter that I guess everybody gets in the mail , on April 9 th I received an email that I am in line to be scheduled for interview, it's been three weeks already I have not heard anything is that normal , I applied in Los Angeles

Unfortunately, it is not uncommon that status remains "scheduled for interview" for some time. Doesn't this message say that you can contact them after 30 days after this update?

  21. I called USCIS before I sent back the N445 form, and they told me that it is fine to reschedule the oath ceremony.

Hopefully I will get a new date as soon as possible.

See, no problem at all. I don't see the fuss that people are making about attending the oath. What does it matter if you'll be sworn in a few months later. You still have your GC up to then.

  22. Even though I'm pro solar, this article is total BS. It talks about leasing solar panels. No wonder the upfront costs are less than few thousand dollars. It better be less than that since you're not buying the equipment. It's like telling someone the upfront costs of renting a half a million dollar house is only a few hundred dollars. Sure it's not yours.

I'm sorry but most people won't experience a financial benefit from leasing them. Buying solar could potentially save you some money but that is not certain at this point. I expect solar prices to go down and energy prices to go up over the next 5 years. By that time solar might be an excellent replacement for current energy sources, financially speaking.

  23. 90 day earlier is when the window opens. You cannot be approved until the 3 year anniversary though so most people advise waiting a couple of weeks before filing so you're not having your paperwork sitting around waiting for your 3 year anniversary.

It looks like you can apply in January next year but start applying in February to be on the safe side. Losing 700 dollars for being few days too early is not worth it.

  24. For our I-751 when the IRS was sending us those joint labels they don't do anymore, actually got by, by just overlapping the three years of tax returns we had at that time and making a single sheet copy with those three joint IRS label appearing.

Wife didn't get by with that at her citizenship interview, her IO wanted to see our complete tax returns, but she had them, was a bit upset about this, because she has no damned business looking at our income, but oh, well. But with a fresh toner cartridge in my copying machine, did submit full copies of our tax returns with the N-400, but ended up wishing I submitted tax transcripts instead.

Really doubt if these IO's can even read a tax return, but get no further than the names on that 1040, feel tax transcripts are a necessity now since the IRS for about the last three years, don't send you anything anymore. If you don't have a computer and on the internet, can't even do your taxes, the state is the same way. We do have an IRS office in town, maybe with one or two forms, but nothing even close to the 1,015 forms the IRS has to offer.

Just call that I-800 number and get those transcripts. Basically a single sheet that 99.9% of the people don't understand, but it shows both of your names on it. Make copies of those and submit those with your application. Return the three originals into their respective envelops and have your spouse bring those in for the interview. You should be fine.

Indeed, don't be impressed with an IO looking at your return. They are not qualified tax professionals working for the IRS so they won't go into details. As long as it shows you have filed together, they should be happy. The rest of the contents is not there business unless it is very obvious the return is a bunch of #######. Try to explain bringing in a 6 figure W2 and submitting a return showing a 4 figure gross income. That of course is not gonna fly. The IRS generally detects these kind of returns so you most likely would have them on your case if you would do such a thing.

Remember that USCIS is supposed to look at things (i.e. more work) you submit, not at things you don't submit so only submit things like W2's if you're asked to submit them is what I would say. USCIS is generally not gonna ask you for tax details unless they suspect wrongdoing. My bet is that they would leave these cases to the IRS and might deny USC.
