  2. Hey guys! I've had my green card for about 4 years now. I know that I have to wait for 5 years and I can apply for citizenship. But I heard from a friend that since elections are coming up that USA is allowing people to get citizenship faster? I was wondering if this is true?

    People try to make the point that immigration processes are more difficult while republicans are in office. Likewise, it is said obtaining USC is easier now as democrats are up for re-election. Democrats would have an intrest in gathering as many new citizens as they can as new citizens are more likely to vote for them.

    True or not, there is no obvious difference in timeline and as the law is still the law someone who is not eligible can still not file for USC.

    The presidential election is only 3 months away so just count on not being able to vote in this election if you haven't filed yet.

  4. you can file married 90 days before the expire date yes.but you should allow 4 or 5 days an then send your file.

    Not in OP's case as date of marriage was within 3 months of receiving the GC. OP will have to wait till marriage is 3 years old. The 90 day in advance only applies to the date you became a PR, it does not apply to the time of marriage. One should file on or after the date the marriage is 3 years old.

  5. My husband has applied for Naturalization. Finger printing is complete ? My questions are:

    When will he be called for an interview?

    I read some place that there are some offices where after the interview they ask if you want to take an Oath the same day, right there! Does anyone have a clue which offices are those that offer the Oath ceremony right after the interview?

    Your help will be very much appreciated ?

    1) The fact that an office offers same day oath is not a guarantee you will have one.

    2) You can use timelines from other people that went through your office to have an idea how long the average application will take. This is also not a guaranteed timeframe for your husband's case.

  6. According to VJ & USCIS, it says to attach the following (note the OR):

    * Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

    * Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

    * An IRS tax return transcript for the last three years.

    To me, the 2nd and 3rd options are the same thing. I have our past 3 years partial copies (1040 & 40) in which we filed jointly. For option #1, I am not sure how many years of these forms the USCIS wants.

    It sounds like the 2nd/3rd are the same thing while the first may only be 1 year + other docs such as bank statements and mortgages? Would this be true? Searching the forums, it seems many others just included all 3 options, i.e., 3 years worth of the tax returns + bank statements + mortgages and so forth. The more the better...? Or not this case?

    As I said before, I went in with as little as 1 bank statement and 1 mortgage statement. Wasn't asked a darn thing in addition to this. So don't worry. You'll be fine with your 3 tax returns and last mortgage statement.

    If you want to be absolutely sure send in tax transcripts instead. Tax transcripts are the evidence you have filed these returns with the IRS. It ussualy doesn't take more than a week or so to receive them.

    I had applied for passport card also. As my first and middle name combined exceed 18 characters, they were not able to process my application further. They sent me a letter with the request to come up with a proposal for shortening my name or to drop the application for the pp-card. First and middle names can exceed 18 characters on the pp-book but it needs to match the name on the pp-card on which the name cannot exceed 18 characters.

    Anyway, I just had to fill out the line with my first and middle names and sent this letter back. My passport application is processed by the Tucson application center which is where I live. They should have gotten my reply within a week. Never heard from them since then. It definitely delayed my application, you could say.

    My wife on the other hand, whose passport was up for renewal, received a letter telling her that there was confusion about her DOB. Normaly you would only send your old passport when you apply for a new one but she was asked to send her CON in addition.

    They shouldn't need addional stuff if you had submitted everything but you could be asked to clear things up for them.

    I'm worried this would delay again the process...Is some sort of documents/Id's they requested from you?

    You should give them a call. They might be able to tell you what it is over the phone.

  8. Is this some kind of RFE? I applied my passport July 30th(routine service) and pay the expedite service yesterday because my flight is n Sept4th! I tried calling 3x a day because my payment is not showing up in my account. This is my status online! Is this normal or they need something from me?

    Yep, I would guess it is a sort of RFE or, as this isn't USCIS, perhaps a RFI. I never got this status update though when they sent me a letter. It means they started working on your passport at least.

  9. Yep. OK I think I know what it is. 8/30/12 I thought was them thinking 60 days not 90. But also that is our wedding anniversary. I thought it was ok to apply -90 days since you only have to be married >3 years at time of oath. But obviously not. You have to be married >3years at time of app too. This is true right? I just hadn't read it explicitly.

    Indeed, the date USCIS can start processing your case is always 3 years after your marriage or later. This of course only applies to people who are filing based on marriage to US citizen.

  10. I got my passport August 6th. Just checked the online tracker and it says my passport is in the final processing stages - so there you go!

    Hahaha, I kind of figured this website was complete BS. Thanks for letting me know it is has no value.

    It'll be 6 weeks next week so I'll just give them a call at that point. Mainly because I'll be traveling 2nd week of September.

  11. First of all thanks everybody at VJ for great help with my journey, it wasn't smooth but at least I'm almost there.

    Anyway got the N-445, oath at the LAC on 23rd.

    What I am confused is that in addition to the green card and the letter to bring to the oath, the letter also mentioned to bring "any immigration related documents" and "re-entry permits" to the oath. Does that include my passport, all the NOAs I received and what-not?

    I'm so excited, it's almost over.

    It actually pertains to valid immigration related docs that have been issued to you by the US government. To most people this means they have to bring their current Green Card. It is also recommended to bring your state ID or driver's license. If nothing have changed since the interview the oath letter is the only additional thing to bring. Otherwise, bring documents related to this change also.

    Letters (except your oath letter) and expired Green cards, EAD etc. do not need to be taken to the interview. You have no obligation to bring your current passport. If you do, USCIS will not take it from you like others have said.

  12. State dept. tracking site is completely worthless. Did my passport application 5 weeks ago. Was able to track my application after about a week which gave me a record number and the standard processing times etc.

    Even though I had received a letter from them more than two weeks ago, which must have interupted my case for at least a week, no change on the status. They probably don't update you on these kind of events. Makes me even wonder if they're gonna update me on shipping.

    What is your guy's experience with their status updates?

  13. Hey everyone. This is the US citizen spouse of a former K1 visa holder. My wife is now trying to get citizenship. Based on the VJ guides and document checklist provided by, there seems to be a lot of things that we can send. I was wondering if this is enough:

    1) 2011 Income Tax Return (or should I provide 2011, 2010, and 2009 aka 3 years worth?)

    2) Our most recent mortgage statement (or should I provide a few months worth?)

    Do we need to provide banking accounts? There is some sensitive information on 2 of my checking accounts, i.e., account balances that I wasn't sure if I should include them or not. But then again, the IRS statements probably show more than enough info already. We have no children so thus birth certificates for them are out of the question. I was thinking maybe just 3 years worth of income tax return alone should suffice?

    I didn't even sent tax information with my N-400 application (3-year rule + former K1 immigrant) as tax information is optional in conjunction with a mortgage statement. Items on this line are separated with 'OR'.

    I ended up sending a print of the last mortgage statement and another bank statement which we jointly own. If you have a tax return ready, you can submit that instead of the bank statement. I did however take tax transcripts of last three years to the interview but was not asked to show them.

    My motto has always been. Give them what they ask for but not more than that as the more stuff you supply the more work comes with it.

  14. I got my name change but I need to update my driver license. Do I have to updat my ss first

    SS is not always ready to process your citizenship status. It can take up to three weeks for them to be able to verify your citizenship status. Go get a driver's license as you can't drive with a license that doesn't have your correct name on it.

  15. I have been reading contradictory posts on VJ and would like some input from members with concrete knowledge on the issue. I received a ticket for talking on a cell phone while driving about 3 years ago. Ofcourse I paid it off within a week. I got the impression from posts here that such minor offenses are not to be mentioned and thus ticked "NO" to all such questions during the ROC. Everything went well and I did the same when filing for N400. Now I have come across posts where members are talking about ticking "Yes" to questions where it says if a crime/offense has been committed without arrest. If that is true, I may have made mistakes on my application and what should my next course of action be? I know, these petty offenses don't carry any weight, but I don't want to be held for lying, which was never my intention. Your advice and experience would be appreciated.

    You're fine but do mention it to the IO at interview so the IO can correct it on your application. It's not uncommon people forget about a ticket. Just tell the IO you had forgotten about this incident and you would like to add it to your application. If you still have the ticket, bring it together with proof of payment.

  16. Hi Congrats on your citizenship. And need some help

    I am going to apply for my citizenship soon. Just to be proactive I have been looking at the N-400 Appln form. Everything looks pretty simple straight forward questions and I answered all the questions. This was till I came to the Part 10 .. Section D..Good Moral Character...I don't know if I should answer Yes or No for questions 15, 16, 17 and 18.

    Here is what I am confused about.

    I have one Parking Ticket, think 2 speeding tickets.

    Cop had pulled me over and given tickets for these violations. Paid the fines right away. No Court nothing was involved. And all these 3 fines were less than $500.00.

    So now

    Question 15: Have you ever committed a crime or offense for which you were NOT arrested

    Speeding and Parking ticket is not a crime but an offense. And I was not arrested for this minor traffic offense.

    So should I answer YES for this question?

    Question 16: Have you ever been arrested, detained or Cited by an law enforcement officer for any reason?

    I have never been arrested. But getting those 2 speeding tickets means I was cited by cop (law enforcement officer)and in order to issue those tickets he had to pull me over, run my plates and what not. So is pulling over for a traffic violation being detained?

    Since I was cited (issued speeding ticket by a cop)

    Should I answer YES for this question?

    Question 17: Have you ever been charged with committing any crime or Offense?

    Again I have not committed any crime. But traffic violation is a traffic offense. Cop did charge me with that speeding

    offense.

    Should I answer YES for this question?

    Question 18: Have you ever been convicted of a crime or offense?

    Again I have not committed any crime so never been convicted of any crime. But cop did say I was speeding and issued me tickets and I paid the fines. Does it mean the cop issuing those tickets and me paying those tickets mean I was convicted of speeding? Convicted seems like a word not appropriate for a traffic offense?

    Should I answer YES for this question?

    Also from what I have read online parking tickets dont matter at all. So should I even mention about that offense on the form?

    You have been cited so you want to answer question 16 with yes. The rest doesn't apply to ordinary traffic incidents. In the explanation box you could write something like, speeding ticket and an indication how much you went over, if it wasn't much. I got a ticket for doing less than 10 miles over so I wrote <10MPH and the approximate $ amount of the ticket.

    Parking ticket is only to be mentioned if written out in your name or on a license plate of a vehicle you own. If so, just write down the approximate dollar amount so there is some understandig what you're talking about.

    Generally, you won't be questioned on minor (<$500) incidents. The instructions say you will not have to submit proof of those. Do however take proof of payment to the interview as some IO's do ask.

  17. Invalid advice - No you cannot - they specifically tell you at the oath ceremony not to try and travel without first getting a US passport. You cannot use your citizneship certificate to reenter the US.

    For a fact, there are other options to enter Canada and re-enter US from there then passport/GC. In some bordering states they offer enhanced DL for instance which allow you to travel between Canada and US. I think Tahoma is right although it would be nice if his explanation regarding re-entry could also be verified by a US source, preferably the US border agency.

    Nevertheless, it is just easier to carry a passport(card) instead of your CON.

    At oath ceremony they just put out a generic statement as lot of people think that as US citizens they are free to go wherever they want, especially if they become dual citizens. As you will have re-entry trouble in most cases they advice you not to leave the US until you have your passport. It doesn't mean that exceptions don't apply.

  18. My husband took his oath three days ago and was told to notify Social Security so they could update his status. He already has a SS#, but needs to be updated in the system and must receive a new card.

    He went to the Social Security office today with his naturalization certificate and was told that USCIS had not yet input his his naturalization information into the system and thus he could not update his status with Social Security. He was told to come back next week. Is this typical? At the oath ceremony, they implied that everyone should go to Social Security to update asap. Thank you.

    This is indeed normal. In fact, the instructions that I received with my CON actually told me to go after at least 10 days. Didn't matter anyway as I had more interest in a passport due to travel next month. Will make a stop at the SSO and DMV after my CON is returned to me in mail.

  19. I need help answering this question:

    Are you a male who lived in the United States at anytime between your 18th and 26th birthdays in any status except as a lawful nonimmigrant?

    My husband became permanent resident on 11/30/2009 and at this time he was already 27 years old. He also had a fiance visa from April 2009 to October 2009 . He's been in US illegally since 2000. So do I answer yes or no.

    And if I answer yes how do I explain that he was not registered with Selective Service because honestly he didn't know. Which illegal would register anyway?

    The time he was illegal does not need to be counted as he was not in "any (immigration) status" at that time. K1 is officialy a non-immigrant VISA so you would go with the resident since date on the GC.

    Bear in mind he will most likely be questioned about his illegal presence which could turn out to be very uncomfortable, especially if that issue hasn't been addressed before. I'm actually not sure if if it is such a good idea to apply for citizenship after just 3 years with his background. You might wanna wait till the last decision (condition removal) as at this point USCIS has the option of researching the prior decision to grant him the Green Card and turn it around which they won't have after 5 years.

    Maybe you should give this a thought before you apply.

  20. Hi sorry to jump since I have the same question as OP and just want to be I understand correctly. My wife came here as a K1 in Sept 13, 2009. We had our marriage license in Sept 29, 2009. Dec 22, 2009 her I-485 approved (see my signature for more details). When can she apply for N-400? Does it start count from 9/29/2009 or 12/22/2009? Seem like it start from marriage date? thx

    It is the "PR since" date on her GC that determines the day from which you can start counting. This is probably 12/22/2009 but check her GC to make sure.

    If there are no gaps in her residence (she did not leave the US in the first 90 days of becoming a PR and did not leave for extended periods of time afterwards) you would be able to apply earlier than 12/22/2009. In your guys' case this would then be your wedding date as she got approved within 3 months of marriage. Otherwise you need to determine the 3 year residence date using the worksheets others have pointed out.

  21. I had my interview last Monday based on the 3 years, married with a U.S citizen. (I've been a permanent residence since 05-2009). After I took the oath to tell the truth, the IO asked for my driver's license, and my green card, I gave it to her and she started asking my name, dob, if a wanted to change my name (I said no), and then she was asking questions about my wife, her name, where does she work? How much do we pay the rent per month? how many hours does she work? how do we met? where?, how is my relationship with her son? (he is 22), if he is leaving with us? I answered every thing, then she said you have a many bank accounts (we have 2 checking accounts in 2 different banks but with both names on it) and I said the more we got in both names is the best right?, and she didn't say anything, then she was looking the bunch of papers that she got from me, just passing the papers looking for something or just passing them, then she started with the civic questions, and I answered good the first 6, she told me to read a sentence and in another paper write the answer, all that, was a piece of cake. She took my D'L and my green card and said I'm going to make a copy, that she'll be back soon, she came back after 30 seconds, and made sign the n400. She made me sign a separate paper about if my information on the paper saying my name, DOB was correct because that will be for the certification of naturalization, and I said yes, is correct. I remember I signed twice in the 400 form, then she handed me the paper that it says that you pass the civic questions pretty good, but that a decision can not be made at that time. She said if I need something I'll let you know. I was so frustrated that day, because I saw other people getting their oaths the same day. After 2 days I received an update on my email, saying that they sent me a letter for lack of evidence. I received a letter from the IO, the next day, asking me for more evidence basically from my wife: like her last 2 pay-stubs, 3 affidavits from friends or family, that our marriage is real, even a affidavit from my wife that how do we met the first time, copies of certification of birth from both of us, pictures with date and and the events, and the more strange evidence that it says on the letter, it's the Form G325B Biographic Information for both of them. I checked that form and there are 2 parts. the first part is about personal information, name, places where you live and work and something like that, but on the second part looks like for military purposes if we were working in the navy or military before, and we don't know how to do that part or if we have lo leave it blank. I google it that form and usually is for people that are working or used to work in the military navy, marines, and me and my wife we never work for them. I didn't know my application had red flags, but for us is not a problem to get the evidence that they are asking (we have all of them) but the form g325b the second part we need some help, I think we have to leave it in blank, but the weird think about that form is that they don't ask for signatures.

    The IO looks like her 22-26, very young, and I'm not an expert in people but I can say, she has no many experience, or maybe I’m wrong about that. She looked like she didn't review my huge stack of evidence before (almost 5 inches) she was educate, professional and polite too.

    It looks like this IO was in I-751 mode a little too much or your file did not contain enough evidence of marriage indeed. Did you go through the I-751 process as well or did you obtain the GC through another route and got married around the same time? I can imagine they need more information if you didn't have to go through I-751 and apply for citizenship based on marriage three years later.

  22. I received a letter from de DOS this Saturday that my passport application was placed on hold. My first and middle names combined exceed 18 characters for which is no space available on the passport card. The name on the book and card need to match. The DOS is giving me two options:

    1) withdraw my application for the passport card and receive a book with names written in full.

    2) come up with a shorter version of my name within the spacing requirements.

    If I choose for option 2 the names on my passport documents will match my SS-card (which by coincidence was already shortend to middle initials) but not my CON and my drivers license as those documents have my name written in full.

    The passport card benefits me as I live in Arizona where border patrol posts are common and it makes travel to Canada easier too. Maybe I just miss the good old GC which easily fits in a wallet.

    I have no problem shortening my name middle names to their initials but I was wondering if anyone has negative experiences as a result of such change??
