  2. great news! after over a month of not hearing anything from USCIS if we were approve or not, we finally got a touch yesterday... and today i received email from CRIS that card production is ordered... so i guess that means we are approve... what a great way to celebrate thanksgiving...thank you so much VJ for all the help...

  4. Hello !! I don't know if somebody has gone through with this situation, but I feel so frustrated because I am no a citizen yet, but my husban is. I had my baby in february and I invited My mom and My dad, however My dad passed away on 10th february so My mom didn't want to apply for the visa after that and before either because she took care of him. My Mom applied for her tourist visa finally but she got denied , I sent an invitation letter with my name and my husband with our phone numbers. She is no retired she took the court to the Institution which doesn't want to give her retirement to her...anyway I support my mom and what the Consul said.....She doesn't have money because she depends of me, however she owns her house , she doesnt' have granchildren in Peru and i have only one brother in there, but she needs ties.....she has her mother in there, sister, nieces, nephews so My mother in law wants to sponsor her with my father in law, i don't know if i could change....i am concerned because my mom is widowed , she has only one son and i don't know if you could suggest me something else and then she can take the papers from the Court so she needs to be in my country as well....Ideas pleaseeeee!

    sorry about your mom's visa denial... it can be very frustrating... my mom got denied for a tourist visa 4 times even though we showed enogh evidence that she's going back to the philippines... it got my mom so depressed that she didn't want to apply for a visa again... after i got my citizenship, i petitioned her and she was approved for the immigrant visa...

    your mom can try and try and try again for the tourist visa until she gets approve (if money is not a problem) or you can petition for her after you get your citizenship...

    Pre screener - I was jst asked - So your daughter will just follow? and I said, yes.... no more follow up on that....

    Final Interview - asked those common questions for K1..then... The CO ( window 29, i think early 30's, Lady CO) continued...

    "so, your daughter, from your past relationship? ex bf?" Instead of just confirming her assumption, not to deceive them, I just replied, She's been my dependant since she was one month old, then was asked, Legal adoption? I said, informal adoption. Then she told me, "do you know that you cannot bring a child w/o legal adoptions? " I replied, we plan to legalize everything later and that we just included her on the petition so she won't be unknown later. She just replied, "ok".

    Then, after scanning my papers again, she told me the GREATEST line I've ever heard from her....

    " Okay, your visa is approved! wait outside and your name will be called again." I replied, thank you and she closed it with "Goodluck!"

    To all who got married, been wondering of this:

    did u change your handwriiten signature? In my hand written siganture, my last name is really readable. When i get married, should i change it to accommodate my husband's last name?Should i do that change when i sign in the marriage cert? and By the way, in the marriage license we got in Maryland, there's no space there so couple will sign after their marrriage. It is just the officiant whose signature is asked. Is this the way it should be?

    i didn't change my last name to that of my husband so my signature didn't change... i guess if you're taking your husband's last name then your signature would change too...

    where in maryland are you?

  7. so my husband had his aos interview on october 22... the officer didn't doubt our marriage coz she said it's not like were not married coz we have two kids... and my husband and i have been married for almost 6yrs now... but on the day of interview, the officer didn't approve us... she said she will review our paperwork more and will send us a letter in the mail... to this date, we haven't heard anything from them... it's been almost a month... anybody have any experience like ours? were you guys approve in the end? how long did it take? when should we g for an infopass appointment to follow up?

    timeline please....

    april 2008 - we submitted our aos packet

    may 6 2008- biometrics appointment

    june 2008-- received ead card

    oct 22 2008-- aos interview

    So it's been a month since your AOS interview, and you haven't received anything in the mail, nor have you heard anything... Well, that appears to be strange to me too. You should def call customer service or schedule an InfoPass to get the status on your case. That's what I would do.

I received my appointment letter on november 10, 2008, and I have my interview date on December 12, 2008, and I plan to have my medical exam on SLEC tommorow friday..i have a problem about my vaccination history? i didnt know if I already done of all the vaccination when I was a child..what if I have no vaccination records, will it be a delay or they will continue the examination..hope someone will give me advise coz i want to have my medical as soon as possible..

  11. My fiance included my daughter on his petition and we got approval, decided to just follow to join. I just passed my medical exams but had to admit that my precious Angelie is not my own, that I never gave birth, never been married with the fear that if I told them I gave birth, they would know through my physical examination that it's a lie. She is my cousin's daughter, given to us when she was only a month old w/o any documents. I didnt even think the responsibilities I am taking when I decided to have her registered under my name w/o a father on her Birth Certificate. Since then we never had contacts with her real mother whom we're really not that close to them, not until last year when my uncle who brought Angel to us died. When my family went to his burial, I let Angel to go with them to meet her real family, her real mom and other sisters. They were very happy that Angel is lucky to have us as her family since we can give everything she needs, educations, good health, etc.... Btw, she is 6 yrs old now.

    Now, I'm really worried coz the embassy would know the real deal with my so called documented daughter :crying:

    I'm hoping that the consul that will interview me has a BIG heart and would understand my situation... Am I being paranoid about this?

    My fiance adviced me that if the consul will ask if He knows about this, he told me to say NO... what the heck! We had argument about it, told him it's ridiculous, he said, it's kidnapping.... :bonk: coz she isnt really mine, but mine... isnt it so confusing? That he'll try to bring my so called daughter to the US....grrrrrrrrrr.... still worried about it... but I decided to tell the truth during the interview if i will be asked about it....

    Any suggestions? or opinions?

    best option for you is to tell the truth... if you won't and US embassy finds out (I know they have ways of finding out), you could be charged with human smuggling and carries I think a lifetime ban... it could ruin your chances of ever going to the US...

    in the philippines, simulation of birth, no matter how honorable the intentions are, also carries a punishment... i think a fine of P50,000 - P100,000 or imprisonment up to 12 years or both... but being in the philippines, there are ways to get around it... i suggest you consult a lawyer who has experience on cases like these.... i have consulted a lawyer before and he told me it can cost P200,000 maybe more just to adopt the minor child and erase the simulation of birth record... that is if you have intentions of adopting the child and bringing her to the US...

    to adopt the child, USCIS has their own requirements too.... you must adopt the child before the child's 16th birthday... you must live with that child for at least two years after legal custody has been granted to you (count 2 years after the court adoption decree)... they have other requirements but these two are the ones that come to mind... only after you've satisfied it, then that's when you can petition for that adopted child

    also, if there is a way to cancel that child's petition before your interview then that would be better... i don't know if it can be done though... it's just a thought...

  14. Hi! I apologize that this has probably been answered 5 gazillion times, but I really do appreciate any help on this topic. I am a U.S. citizen, and my brother currently lives with my husband and I in the country. He has overstayed his visitor's visa though, but we want to somehow get him legalized. Am I able to sponsor him? How would I go about getting help for him? We want to get him working as soon as possible. Thanks ahead of time for your help! If this has already been addressed, could I kindly be pointed to the correct threads? I did do a search using keywords, but didn't come up with anything useful.

    Yes, you can sponser your brother for a family based visa in the F4 category. Click the "Guides" button at the top of this page. The process takes about 12 years. It's even longer for siblings from the Philippines who have to wait for 22 years in the F4 category.

    You cannot legalize your brother while he is here. He has to go home. USCIS will not allow you or him to circumvent the wait that everyone else is subject to. If he has overstayed his visa by 181 days, he is subject to a 3 years ban from returning to the US. If he has overstayed his visa by one year, he is subject to a 10 years ban.

    the fastest way to legalize your brother is if he marries a US citizen and the spouse petitions him...and his overstay will be forgiven...

    you can petition your brother, petition might get approved but during interview, most likely your brother will be denied because of his overstay... you, as the petitioner, cannot file a waiver for him because only a US citizen spouse and parents are qualified to file a waiver... he has to be subjected to a 3/10yr ban. after the ban, then thats when you can file for a petition.

    if you have paid the AOS fee and the status is paid, usually the automated message does not change... call NVC number and talk to an operator, ask if AOS has been generated... it usually is if the status is paid... once operator says it's been generated, download forms from their website and submit it together with other documentation... don't wait for NVC... it takes NVC weeks to send you the forms..

    also once the AOS fee is paid, you will be able to print the barcoded cover sheet from the same site... print the barcoded cover sheet and submit it together with your affidavit of support and documentation... good luck

    when it comes to NVC, the email notification on USCIS web is not reliable...USCIS doen't update it once the case goes to NVC... my mom is already here in US on an immigrant visa, and the USCIS web still says they already sent notification on how her case will be processed...

  18. Just wondering what they will ask my mom on the interview.

    when my mom went for her visa interview at manila embassy, during the prescreening, my mom was asked for pictures of us together... she was also asked why she was the only one being petitioned.... when the immigration officer interviewed her, she was asked who is the petitioner, if the petitioner is working and where.... that's it.... she was approved...

  19. I'm going to petition for my Mom in the Philippines but my birth certificate has an error which is the birth order. I'm afraid that this will affect my petition.

    Does anyone has the same experience?

    Don't you think the birth order error can take affect my petition?

    Do I need to get this corrected before I can petition my Mom?

    i really don't have any idea if it would matter...i think all USCIS or NVC looks at is that in your birth cert she is listed as your mother...

    my mom's name in my birth cert has a different spelling... in my birth cert her name has only one R, but in her birth cert it has two R and that's what she's been using ever since ... i didn't have the spelling of my mom's name on my birth cert corrected... i just submitted it and if i get an rfe, then that's the time i will take action to have it corrected... never got an rfe for it... on mom's interview, i told her to prepare two affidavits of disinterested persons regarding that different spelling on our birth cert... just in case it would come up...the issue never came up... i don't know if they just didn't see the different spelling or they just didn't care...

    so it's really up to you if you want to just go ahead and petition and hope for the best or correct it now...

    personally, i would go ahead and file...

  20. :unsure: I recently married my wife who is an American citizen. I have a son, 11 years old, who is living in Venezuela with his mother. My American wife and I would like to bring my son to live in the United States. We have permission from his mother. Does my wife have to legally adopt my son even though I am his natural father? What we are trying to do are two things at once. Get my son and myself permanent residence here in the United States at the same time. But I already live here and he doesn't. Would we have to fill out special forms aside from I-130 for him. I already know the forms that I need for myself. We would like to know which forms we need for him specifically. Thank you for any help you are able to give us.

    your son doesn't have to be legally adopted by your american wife... your wife can petition your son as her stepson since the marriage took palce before your son is 18... as to how it's done, i don't really know... search the forum about petitioning stepson, i know others have done it before...

  21. The e-mail template indicated "Beneficiaries Name"...

    Does it mean both of my parents can send one single e-mail for DS-3032 to NVC by putting both names on this e-mail template? or each of them must send a separate e-mail to NVC?

    Since I filed I-130s for my parents and younger brother, does it mean they all will have the same NVC Case Number?

    i don't know if you only send one email for your parents and brother....

    if it were me i would send three separate emails to show that it came from each of them(the parents and the brother).... and since separate I-130's were filed for the parents and the brother, my guess is each of them would have separate NVC numbers... just my thought...don't take my word for it...
