my mom never held a job here in the US...she filed income tax the first time she came here eventhough she didn't have income but it was returned coz of an error when she filled it out...never refiled it coz by that time, she was back in the philippines...and my mom lives with me so no proof of lease...all she has is a joint savings and checking acct.

my mom holds an immigrant visa...if she would stay in the philipines for more than 6 months but less than one year (say 9 months), is there a chance she can still come back in the US? or would she be turned away at the port of entry? my mom's been here in the US twice and stayed only 7 months each time... your thoughts please...sayang talaga if my mom would just abandon her immigrant visa after all the time, effort and money to get her here...i don't know how to convince her to come back earlier...

has anyboy tried coming back to the US after being away for more than 6 months but less than one year while holding an immigrant visa(no reentry permit)? Were you able to get in or were you sent away?

has anbody tried applying for a reentry permit? how long does it usually take? my mom holds a permanent resident card and she wants to go back to the philippines to settle some stuff (retirement, house and lot etc)... it might take eight months or more.... does it usually asks for biometrics? mom already had it done when she applied for the green card...
anybody with any info regarding this matter, pls share...thanks...

Hello! We are looking into purchasing tickets online for a tourist visa roundtrip for two (lets say expedia or travelocity) but would like to ask what all other fees are included or not included on the purchased ticket? Our concern is we purchase ticket for our parents online so they already have it handy when they leave but what all fees do they need to pay when they get to the airport.
Some here in VJ say that they didn't have to pay travel tax, some said they did. Now from research, most said that if tickets were purchased thru travel agency, they usually include the travel tax (1620), another one mentioned that she purchased tix thru travelocity online and was not asked to pay the 1620 when she went to the airport but the date for that reply was Nov 2008. Is there anybody out there who had a recent experience with travelocity and if they needed to pay the PTA (traveltax) during booking or at the airport?
I also understand that there are terminal fees that needs to be paid upon departure from NAIA. Now my question is since this is a roundtrip, how many times do they have to pay fees since it's roundtrip?

filipino citizens leaving the philippines will pay international teminal fee amounting to P750 and travel tax amounting to P1620...they don't have to pay terminal fee or travel tax on their return to PI... they will only pay domestic terminal fee (P200) if they have a connecting flight to another province (say cebu).... tickets bought online does not include the airport terminal fee or travel tax... i don't know with tickets bought from an agency....

terminal fee for domestic flights is P200.... terminal fee for international flights is P750... i don't know if you also pay travel tax (usually filipinos going out of the philippines pay this) but it costs P1625. this was the fee in june 2009 when i was there...

Right! Isipin mo muna kung paano ka makakawala sa tarantado mong asawa. Tutal naman, meron kang 2 years para ayusin ang buhay mo. For divorce, meron ka namang matinding ground.
By the way, kung saan ka man sa US, dapat alam mong contact numbers pati place na malapit sa yo na pwede mong lapitan kapag nagkaproblema ka sa asawa. Just in case, doon ka tumuloy sa kanya habang naghahanap ka ng masisilungan.
i don't think she really has grounds for divorce... it's all a case of he said, she said.... she's not in the US yet .... unless she taped all their conversations when he asked all those perverted things... he can deny everything... and she will come out as the girl who is just after the green card.... after the green card is on hand, she will divorce the husband... just my two cents...

try to find if there's any volunteer work in the nursing home you're working... that way she'll be busy and she'll be with you ...until such time she can find paid work for herself.... i don't think volunteer work needs an EAD... or does it?

i'm not sure what episode of citizen pinoy it was or when it was aired but i heard atty michael gurfinkel say that if the mom is a US citizen and wasn't able to pass that citizenship to the daughter because of not fulfilling the years the mom lives in the US, the daughter can obtain citizenship by way of the grandparents.... i'm not really sure how it's done or what's the requirement but it certainly is worth exploring into.... i suggest a consultation with a good immigration lawyer.... your fiance may be a US citizen and she might not need to apply a visa anymore....
a good example of someone obtaining US citizenship through a grandparent is Christopher de Leon's son...

based on the visa bulletin, they're processing petitions on or before june 1 2004 for philippines... yours was filed 2005 so you still have some ways to go... check the visa bulletin every month... they update it every month... go here www.travel.state.gov/visa then click on visa bulletin

My wife is a US citizen now living in the US, and her son, who is currently 23 yrs old and born in the UK, would like to immigrate from the UK.
My wife didn't know about registering his birth at the embassy before he was 18.
He is not able to get a US passport because my wife does not meet the US residency requirements.
I have read about the child citizenship act - if his grandfather can meet the residency requirements, will this help ?
Unless he is able to get the US passport, we will have to petition to get him a US visa using I-130, but there is an 18 month wait. He is not able to get an immediate visa because he is over 21.
Would he be able to live and work in the US at all while he waits for the visa ?
Any answers greatly appreciated.

Just wondering why you would assume that she only recently became a U.S. citizen? Many people who are born elsewhere, but are U.S. citizens, come to find this out later or, as in this case, never get around to or never realize they have to register the birth of their children - if in fact it is even that easy, some are not eligible to do this - all depends on the date the child was born and the laws in effect at that time.
there certainly is a difference by the way a sentence is read... i just presumed it from when i was reading his sentence...'My wife is a US citizen now living in the US...' i had read it this way 'My wife is a US citizen now (pause) living in the US....' if I had read it this this way, "My wife is a US citizen (pause) now living in the US...' then it brings a whole different meaning to the sentence...sorry if i didn't read it the right way...

do you really want a hotel? my mom just stayed in a pension house since she was only there for two days... pension house is cheaper... she stayed at mabini pension....it's clean, nice and cheaper... you can a get an airconed room for i think a thousand... they also have fan room for less than that... it's near slec, us embassy, mall of asia and robinson's mall... it's owned by a foreigner, australian i think...

I sent in the forms for my Mum to come and live over here, these were sent beginning of December the case has been touched several times since,(sent to Chicargo) the other day we received another receipt saying the case has been transferred into California service centre. Has anyone else had this done? I see that its a 6 month wait for california on that form, but the site hasn't been updated since September 2008. Am I right in presuming that once it comes out of California it will be sent to London? Should she be collecting information yet such as a police report and injections?
based on what i read in two immigration sites and experiences of my friends, being transferred to california service center from vermont is a good sign... that means an approval will be next....once approved, the case will be sent to NVC....once the case is complete ( meaning all forms are submitted and fees paid for at nvc stage and everything is in order), that's when it is forwarded to the US embassy in London where your mom will await interview appointment...she would have a medical exam from an approved clinic of US embassy and there she will be receive immunization shots that she needs prior to going to the interview...she should start gathering documents needed for her application such as birth and marriage certificate, police clearance etc so that it's ready to be submitted when it's needed at NVC stage...
just an idea...when i petitioned my mom it only took 7 months from the time petition was filed to getting a visa, others said it will take a year or more.... but every case is different...

i dont have my xray result with me ,,,i mean the black result that usually give by the dr. after the result? what i have with me is only the cd fr st.lukes medical.is this valid for my tb result? i mean i am skin test tb possitive.i cant undergo onother chest xray bcoz i am pregnant. can i show my cd report ? just this surgeon realease my med report?
st luke's is not giving out the xray film anymore as they put the result in the cd.... so if you're worried about not getting the xray film, then don't ... the cd is fine... as far as USCIS asking for more result or info because your skin test was positive, i don't know.... what did st luke's tell you? do you have to take any medications? if they didn't, and your chest xray is negative, sputum culture is negative, then you're probably fine....

to all pinay na gumagamit ng yasmine..anong side effect sa inyo?it was my first time to take birth control pills and my ob gave me yasmine..its my 2nd day of taking it but i feel so defferent...masakit ang ulo ko..tapos masakit ang tiyan ko..dinatnan ako..i read a link about yasmine they say its normal and i will just wait for a couple of month..natatakot lang ako kasi may iba na ang side effect sa kanila dumadami taghiyawat..ayaw ko mangyari yong tsaka swing mood...

yeah that is normal... mawawala din yan headache after ma used to na ang katawan mo... magiging regular din ang menstruation mo...inom ka lang ng tylenol for the headache... as for taghiyawat, i guess depende yan sa kada tao... wala ako tighiyawat nung uminom ako nyan...

Separate I-130s have to be filled for each beneficiary.
oh ok i thought it's only one I-130 coz the son is her husband's son too....

american citizen...i was born in the united states...i did not grow up in the US...i grew in the philippines. my mom was
working in new york when she had me but decided to live in the philippines when i was still an infant.
i never gave up my american citizenship and i never got filipino citizenship. so basically i was an american growing up
in the philippines. i only spent vacations, holidays and summers in america while i was growing up.
i am married to a pakistani...we met in the philippines ( he is on a student visa). i gave birth to our son last 2007 in the
philippines. i tried to get CRBA and a US passport for him because i am am american citizen and I am his biological
mother. but the consular in the us embassy in manila, philippines said my son can not claim his us citizenship because i
have not been present in the united states for 5 years prior to his birth...she adviced that i should petition my son if he
wanted to come to the united states with me, meaning he should get a filipino/pakistani passport for his immigrant visa.
well, my family and i decided for me to come to america first and establish domicile here. so i left my husband and son
back in the philippines. i got a job and i have been away and living here for 7 months now. and i want to petition my
husband and son.
i know that i have to file separate I 130's for each, one for my son and one for my husband...the thing that worried me
the most is that my son's will probably take only a couple of months and his visa will be ready much earlier than his
fathers...after all my son is only a child...and i researched that it would not even take more than 5 months for my son
to get his immigrant visa. and when he does get his immigrant visa, and enters the US it will not be very hard to get his
citizenship because he will be in my custody (USC parent custody). of course i want my family here but i am working...i
work at hospitals and if my son's visa comes earlier than his fathers...how can i take care of him (a 1 year old) alone
and go to work. i wanted my husband to come first and maybe after 3 months my son...so i will see if my husband can
get a job here too and so we can manage out finances before my son comes...of course we want a place well establish
for my son when he enters the U.s.
I am assembling our package and i have most documents with me already. but i am torn about whether i should
already do my son's with my husbands I 130...im sure my husbands will be a longer journey because he might run into
some A.P. (administrative processing) and i dont want him to be left behind. i tried asking some immigration lawyers
but they did not give me an good answer...most of them just commercializing for me to hire their law firm...
i asked that if my send both I 130s at the same time...would my son's affect his fathers by maybe speeding up the
process? or what if i send my husbands now and my son's 2 -3 months later so their visa will be issued together?

Son's name, (place)--don't know yet because im still sending the initial I 130's for each, both of their I 130's going together...(date...the date when i signed their I 130;s??)

Mother entered the USA legally.
Son (Must be US Citizen and NOT an in-law) can file I-130+I-485 for mother and adjust her status in the USA.

so you mean to say that the overstay of the mom is forgiven because her son is a citizen and she entered US legally? no need for a waiver? wow, that's good... i thought the mom who overstayed her visa in the US couldn't adjust her status... that's new info for me and a good one at that...

I am an permanent resident who lived in US about 5 years now, and I am preparing my N-400 Application for Naturalization form, the problem is that my wife's B2 visa expired couple of years ago. So now I am trying to figure out what should I enter in field "Spouse's Immigration Status"; should I say entered on B1 visa or should I say that the visa is expired ?
Is there a chance that this issue could cause problems for my citizenship path ?

just put B2 overstay... like you, i was also scared on what to put there coz i thought it might jeopardize my hubby's stay here... hubby came in with h1b visa but overstayed... but lying on your N400 application will create more trouble for you and possibly your wife... based on my experience, i put there h1b overstay for my hubby's status... come interview for citizenship, the officer knew about it but didn't question me about it... i am now a naturalized citizen and my hubby is now a 10-yr green card holder...
and correct me if i'm wrong, but i think being married to an illegal alien is not harboring an illegal alien... i think they have a specific definition on what harboring an illegal alien means....

your husband can petition your children under IR2-child of USC. my cousin was petitioned by her step mother. no need for your husband to live with your children. but in the USEM when my cousin was inetrviewed they asked for the pictures of her together with step mom who had her vacation here. maybe as a proof that there is a communication between the two.
Thank you so much for ur enlightenment. One more question, what are the requirements or forms and where will i be able to get these forms, is there a website that i could read to download the forms? what are the papers that my husband needs to send along with the I-130? Is this process 100% guaranteed that they will not be denied if the papers are complete? sorry im just down and i got phobia in denials at USEM . I was denied twice too with my tourist visa before. how sure is this "stepsons" process compared to me filing for them, im the mom and a permanent resident but i know if i do it would take 4-5 years and my eldest so would be 22 but that time. so is this stepson process is really sure? thank u so much for sharing your knowledge about this coz i dont really know anything about this . go to www.uscis.gov ... click under immigration forms and print form I-130... print also the instructions on filling up the form... the fee is $355 for each son... your husband should file the petition as he is a US citizen... it will be faster that way compared to you filing for them as an LPR... processing could take 7months ( at least it was that way for my mom)... but you can help make it a little faster if you follow the jame's shortcut (search it here on vj)... good luck...
