  2. thank you so much for the fast responses am I suppose to fill out an intent to mary again because I sent one with the original package and if so does it have to be notirazed i know he is suppose to take one for himself not signed but unsure if I also sent one for me one more question he is suppose to take the orginal paper sumitted with the 129-f right plus all the proof of relationship and also include new and updated proof of relationship oh sorry forgot one more are we also suppose to sent the ds-157 because he is a male applicant ok i think thats all well for right now

    Yes to the Ds-157, and i sent my husband with MY intent to marry letter, it wasnt notarized, but then again, he didnt need it, they didnt ask for it.

  3. Hello I have a question on ds-156 on the last part where it asks if someone else prepared the form on the applicants behaf do I put myself the fiance as that person because i am filling out all forms for him and he is not present

    I think you can if you want, but it doesn't matter either way. I filled out the forms too, but I didn't put my name as the preparer. They aren't going to know or probably even look at it anyway. Good luck! :thumbs:

    I filled my husbands stuff out, and didnt fill that section in, believe me, they arnt going to be checking up on something as small as that. You are filling it out for him, and you have his best interests at heart, i think its more for someone like a lawyer or something, someone outside of your relationship. Dont worry.

  4. Finally I was able to check online about My Husband AP online. I checked yesterday was not there anything but..Gueesss!..I try put in our case no to USCIS website & that's worked...

    Its Approval on 28th April..only AP was sent..

    But waiting for our EAD too ..No status on EAD yet hopefully both at same time..

  5. Filed March 9th. Got notice in the mail yesterday that our interview has been scheduled for June 5th in Santa Ana.

    No word on EAD or AP. I hope we get the EAD soon, as the SS office won't let my wife change her name without it and I've been holding off adding her to my bank account, credit cards, etc until her new name is on her SS card. I previously tried to check status online and it wouldn't take any of our case numbers. I'll try again tonight.

    You could still add your wife using her maiden name. Most of my papers are still in my maiden name: insurances, bank accounts, credit cards. We could not use my married name since the IDs i have are all in my maiden name.

    If i would have my interview ahead of receiving my EAD. I would bring all these papers reflecting my maiden name as evidences of our marriage.

    But once i get my EAD, i would my change all my papers to my married name. That would be lots of paperworks. :(

    Its probably not that he 'can't' but her maiden name on the bank accounts and credit cards its just that it is a big hassle to put it into her maiden name, and then change it once she gets it changed. That is probably why he is waiting. I know i a doing the same thing with adding my husbands name to my own until summer once i am breaking from college, so i can have all of that stuff changed in college and banks and cards and everything. its just a pain.

    I've been incomunicado for a while as we adjust to our new life together here in the U.S. We are getting married on July 3rd, which will be just short of 90 days after her entry. When do we start the AOS process and what are the first steps? Any help would be greatly appreciated. Are there any other threads out there that I should be looking at for more information?

    Even though you arnt going to be getting married for awhile, you can start your paperwork right away. I-485, I-131, I-765 are probably what you are going to want, and most of what they require as far as paperwork and proof is stuff that either you used for the fiance visa interview as proof, or you got the info when you crossed the boarder like I-94 and copies of your fiance's passport info page and her k-1 visa and that kind of stuff. You are 'technically' supposed to have your AOS paperwork submitted BEFORE the 90's run out, so you might want to try to do that. I have never heard of people getting penalyzed for not doing it, but it is 'frowned' upon, an may cause complications apparently. Good luck.

The Swine flu thing is really scarying me !!! :unsure: This morning my fiance read that there are 6 cases already found in Juarez about the swine flu. :reading: He has also been hearing rumors that the consulate will be closing during the whole week :crying: . I'd advice anyone who is getting ready to attend the K-1 interview to call before making the arrangements or just keep posted on news, It would be horrible to come from a far away place just for nothing. Of course all of this is just rumors, things we've heard but have not been confirmed. Hopefully things will clear up soon and we won't have to worry about anything.

    Well I hope your right epifreak and this whole issue with the swine flu clears up soon because I wouldn't want to make arrangements for nothing. My question is for people who have already gotten their visa. From what I read which has been really helpful is. Is it safe to say that you will have to wait one day after the interview to obtain the visa unless your lucky and get it that same day? Also, if the interview is on a Friday is it very likely you will have to wait until Monday?

    i agree with buggylifer, make plans to stay the second day. My husband was in the consulate for a full 12 HOURS!!!!! but he did end up leaving with the visa, some people get a slip though, and are told to come back the next day for their approved visa, so it really depends on how crowded it is, and if you get a slip or not. I would say go prepared for the extra day in juarez. With the 'rumored' cases in juaerz too, i dnt know, i would consider wearing 1 of those stupid looking masks, caughing, sneezing, stay away from people who are doing that, and wash your hands, better yet, carry sanitizer, and use it frequently. do not touch your face, or that of your SO without washing it well.

  9. Hello, I still am kinda new to the Visa Jorney website. I have found this to be very helpful, My fiances case was fowarded to the Consolate in Ciudad juarez on april 7th, It was delyaed at the NVC for 49 days for additional Processing!! GRR!! Am i suppose to call Juarez now or when? are they going to send a letter or a package or soemthing? I am not too sure. THanks!

    NVC will send you a letter saying that an approved fiance visa on you your behalf is being sent to ciudad juarez to be further processed or something like that. That is when you know that it eventually will be there (and wait a bit before you call so you give it time to get there). They will send you guys a fiance packet, which has the directins of what to do next and what papers you will need for the ciudad juarez interview. DO NOT RELY JUST ON THE PAPERWORK THEY SEND YOU FOR COMPLETE INSTRUCTIONS!!!!!!!!!!!!!!!!!!!!!!!!!!! Alot of the info is missing, so look at the guides or double check with somebody on visajourney before you go to make sure you have everything that you need.

  10. DAMIEN AND KELLY my husband just got off the phone with USCIS, and tried to get information about the case. They pretty much only told him that they DID RECEIVE the RFE paperwork that i sent in, and that all of his papers are processing, They also laughed when he wanted to know when we would be getting information because they said 'we havnt been waiting for even a month yet, and that there are people that are still waiting for 6+ months without any word......" :blink: She also wanted to know where alfredo had his biometrics done, he said PHILADELPHIA and she was like yah,,, thats one of the reasons why.... she said that the philly office is processing things very slowly, more so than what is normal.

    She also said that with the cut back on workers (which is what several of the people at the philly office were talking to my husband about when he went), and the SUDDEN INFLUX of cases being sent in and in need of processing, the cases are slowing down, ALOT and people are waiting a long time, in general AND ESPECIALLY FROM PHILLY. I hope that this is a little helpful damien and kelly, although a bit disappointing, and also hopefully it will give future philly people a heads up.

    As for those who are getting approved, congrats, but it sounds like it may not last much longer, however i hope it does. :bonk:

  11. Nvm I got to talk to the USCIS and they said they have no update and they don't know when they will update the case only due the huge backlog that they still have.

    She said I should keep waiting and they will contact me by mail if they need something else.

    Has been 23 since my biometrics and I haven't heard from them :(

    What do you mean backlog? Thats all the 'overload' with cases that they have right?? Because although you have been waiting a little bit longer than i have, it will be 2 weeks for me soon after the biometrics and i havnt recieved anything and i have been checking the website everyday hoping, but still nothing...

  12. OKAY GUYS U HAVE TO BE SMARTER THAN THE SYSTEM AND BEAT IT! LOL! JUST EITHER CALL YOUR SO ON 3-WAY OR JUST PRETEND TO HAVE A MAN'S VOICE...I DID IT AND HAD NO PROBLEM. PLEASE I AM THE PETITIONER AND I PAID THE MONEY AND THEY WON'T LET ME KNOW THE STATUS...YEAH RIGHT! WE CALLED YESTERDAY, AND GOT ESCALATED HIGHER UP AND OFFICER DANIELS TOLD ME THAT THEY HAVE RECIEVED THE BIOMETRICS AND THAT SHE SHOULD PUT IN A REQUEST WITH THE HELP DESK TO GET OUR STATUS PUSHED ONLINE FOR US TO VIEW. SHE WAS SWEET! GOOD LUCK!

    I dont have 3 way, the woman who wouldnt let me know the status suggested that. And i think the same way you do. NO DAMN WAY I AM LETTING SOM1 TELL ME I CANT KNOW THE STATUS OF MY HUSBANDS PAPERWORK THAT I DID AND COMPLETED FOR HIM!!!! but i think i would totally blow it if i did the fake voice thing. I mght just have alfredo call if it rains 1 day at landscaping, but i am worried he wont know what he is doing. I know he does....but when it comes to important things like his papers....hahah i would rather i did it. :blush:

  13. A question about case status updates online. I received my NOA1. In the letter it gives instructions on where to go to check the status of my case. But when I go to the USCIS website it says my case can not be found. And it has been a couple of weeks already. I called their customer help phone number and the rep said it may never show up online. Is this something that i should dig deeper in to or let it be and remain blind until they send me a notice by mail? I would hate to upset some people by calling about this. Maybe it will show up down the road.. *shrug*

    The receipt number begins with a WAC and is processing through the California processing center.

    Any advice is appreciated. Thank you.

    ALOT of people are having problems accessing their case status, it seems helpless and not worth your time to keep checking. It may show up along the road, but then again, just like the rep said and many of us are/have experienced it may not... i would say if you dont get another NOA or the paperwork that you are supposed to get within the specified time aloited like the usual 90 days, i would call in and check with the rep on the status of your case.

Yesterday when I called the lady said she sent out an inquiry to get me a Biometrics appointment set up. Who knows if they actually did anything, but I will just wait and see.

    Did you call the number on the NOA or some other number? When I call the 1-800-375-5283 on the NOA I get nowhere cause it doesn't recognize any of my receipt numbers.

    Don't put in the receipt number got through option 1 (Get forms), and then use the one where you don't know what form it is, and it will get you to an operator.

    Does the beneficiary have to call?? aka my husband (since he is the 1 who is getting the green card) or can i call? because there was a BIG problem with that before, the stupid woman wouldnt let me find out anything b/c i wasnt my husband and he wasnt present. I even offered to read out numbers and social security numbers and birthdays, and it still didnt work. So did any petitioners call about the status of their AOS on behalf of their SO who was not present????? AND HAVE LUCK??? if so,.... im gna call too to see whats up with my case.

    You can ask about it, but when they get to the part about verifying the information on the escalated call, they will ask to speak to your husband, and get his name, DOB, and ask if he is giving them permission to speak to you.

    Yah thats the part that sucks. I am 3 hours away from my husband going to college, and the only time i see him is on weekends, (USCIS isnt open then) so ima have to wait until it rains 1 day so my husband doesnt go to landscaping and i can call sometime after i finish out this semester. WHAT A PAIN IN THE A&&!!!!

  16. GueraKristina - I will keep you updated, once we're updated ourselves. Even tho I heard that the USCIS site doesn't keep them up to date well I wish our case was entered into the system just for piece of mind. Also did you guys send the I-693?

    Also I don't think the CR/IR folks have to do AOS, maybe I'm wrong but I thought that process was for green card, and they have to remove conditions? maybe I misunderstood it.

    We did sent the I-693, but the form pretty much just had the vaccines put on it, because alfredo had his medical done in mexico, and he brought his vaccine records over to the U.S so the doctor just put the vaccines onto the I-693 form, and put it in the 'do not open' envelope, and we sent that with the AOS paperwork. Why did you guys not send it???

  17. This wait is more frustrating then the K-1. everyone is getting transferred, I want to hear something or at least be able to see our case on USCIS. But nothing.. 11 days since Bio.

    We're on a very similar time line, and the same local office.. just hoping it's not Philly that's casing the problem here.

    DAMIAN&KELLY because we are on such a similar timeline, please let me know when you guys hear something about your case and i will be sure to do the same for you guys. I want to be able to compare my progress or lack thereof with someone who is from the same local office as i am, and what a coincidence, ..... haha. Keep me updated. :thumbs:

    I have a friend (23 yrs old) that entered the US illeagally when she was 5 years old. About two years ago she was granted a U visa which from my understanding was granted becuase she was the daughter of an alien abuse victim. She was also granted a work permit and a SSN. When she got the U visa she was told by an attorney that she could marry and adjust her status. She has since married and now the attorney is telling her that she can't adjust her status from the U visa. Her husband is a permanent resident. I have looked at sever pages online that say a U Visa holder can adjust status after three years but I found no page that says that privelage is lost if one marries.

    Does anyone have any experience with this type of situation?

    The U Visa is a relatively new and very complicated thing. It was established by law years before it actually came into existence. Because of this, she might want to talk to another lawyer, if she can find one with experience. A good place to look would be a legal clinic that deals with women's issues.

    Notice that she is probably not eligible to adjust status by virtue of her U visa, since it has not been three years. Also note that her spouse is not a citizen. I think only the immediate relatives of citizens can adjust status if there are problems (overstays, etc.) in their background, and she probably has such problems. Lastly, note that she entered the US illegally - that may also be a problem.

    Do you know why the lawyer said she could not adjust?

    I dont think she can adjust strictly based on the fact that she married a resident because she has to marry a citizen, citizens can change her status, but until her husband becomes one, i dont think he will have much of an impact on her changing status.
