  1. Aug. 14 2009 at 2:45 San Francisco. We had our interview. The interview was simple, less then 15 min. My wife will receive 2 years conditional GC in the mail within 2-3 weeks.

    Thank God! We finally received the letter for the interview. August 14 2009. Still no status at USCIS website.

    I filed my wife AOS in March 2009. It's now almost the end of June 2009, We haven't gotten notice for the interview. No update at USCIS website. What takes them so long?

  2. I guess I put my whole question in the title!

    My husband and I are filing all the AOS papers simultaneously, the I-485, the I-765, and the I-131. Of course we need to submit 2 passport photos for the I-485, but does he need additional passport photos for the other forms if they are all being filed together?

    Even if all the paperwork is being filed together (we are almost complete the AOS process), follow the directions and the necesities for each one. so for the I-485, if two are required, but in two with that group, and if any more are required for the other groups, put them in, even though they are filing them together, they ask for the pictures for a reason, (the reason why i said if they ask, is because i cant remember if the ask for photos for the I-765, and I-131, for that reason, read over what your supposed to include, and put it in. hope this helps.

  3. We got our card today, expected a 2 year card, since we did K1 Visa, and they sent us a 10 year Card. We got the notice on Jul 29 that the card production was ordered, and it said 10 year at the bottom, but I figured it was a mistake, and just a form letter. We get the card today 8/01, and it is a 10 year card! No more USCIS until citizenship!!

    So that's two K-1's in a row who received a 10-year green card (marcelapeu too). Is this a new trend? If so, I like it!

    I know, that is a GREAT new trend, no more USCIS until citizenship, that would be a dream come true. Thats great for those those who got the ten yr card, send some of your luck to those who are still waiting on their cards. lets hope ours says ten year green card too. :thumbs:

  4. Well this is unbelievable.....i sent my RFE on july 15th, and i was tracking my RFE online. The days passed and nothing. So after a week, I called USPS (the post office) and they told me they were sorry, THEY LOST MY LETTER!!!!! So I had to call USCIS to see if I could send copies of what i sent (the I-797 plus the RFE and the form) so the lady suggested me to write a letter saying that the post office lost my papers and it could take WEEKS to find them. SO I sent again the RFE yesterday so let's see what happen this time....hopefully USCIS will receive it by monday or tuesday <_<

    I would have been soooo mad, out of all the mail that goes through there, they have to lose something so important, AND SO LIFE CHANGING!!! I mean, think of it,if you hadnt noticed that nothing was changing, thinking everything had panned out, and your papers had passed the 45 day mark that the RFE has to be in by, your papers would have been concidered 'abandoned'!!!!

  5. I-864A is if the joint sponsor is a member of your household. If they live elsewhere, it's an I-864 just like your primary sponsor (spuse) fills out. If you use an official tax transcript from the IRS, it could be enough proof. With a tax return photocopy (make sure it's signed) and W2 statement, I would include one other proof like pay stubs or a letter from employer just to make it very clear to them and avoid any RFE questions.

    So pretty much just make sure my joint sponsor signs his tax return photocopy and w2 copies and include some recent pay stubs, and that should be enough? Because getting an employee letter would be difficult because the heart of his branch is in minneanapolis, and all the joint sponsor has access to is supervisors,

    The directions doesnt say that a employees letter is required, but as long as he shows tax returns, w2s, and a couple of recent pay stubs including the most recent, i think that would be good enough. right?????

  6. Besides The actual I-864, this years most recent tax info and the accompaning W2, and the birth certificate showing that the joint sponsor is an american citizen, is there anything else that is required? soooo...

    1) I-864 form signed and filled out

    2) This year tax info and W2

    3) Birth certificate proving citizenship

    Is anything else required besides the above? It says that you can put in aletter from your employer, but it doesnt say it is required, and the joint sponsor makes more than enough above the 125% poverty line.

    I'm sure you will need to give 3 years tax info too and make sure the I-864 is fully signed and i-864-A. We just helped my sister for a joint affidavit of support and so far she is here now 2 weeks ago.

    You dont need the last three years, it says on the paperwork in item 25, (a box thatyou check) 'I have filed a federal tax return for each of the three most recent years. I have attached the required photocopy or transcript of my federal tax return FOR ONLY THE MOST RECENT TAX YEAR'

    And what is an I-864-A?

  9. we got ANOTHER frickin RFE for alfredo's I-485....AGAIN!!! why couldnt they have requested ALL of what they wanted at the same time, instead of wasting our time and their own!!! How ridiculous!!! First they wanted alfredo's 797 from his fiance visa approval, (p.s, i sent it, they just lost it or it got seperated...thus making it MY problem again!), now what the heck could they possibly want!!!???

    Same thing with us. Filed AOS march 12th, i have called numerous times, had a service request done, still nothing, just got a $hitty email saying that the I-765 is being reviewed and we will have a responce shortly.... no $hit.

So we finally called USCIS last week and they are going to issue alfredo a temporary EAD b/c his ead processing is outside of the processing timeframe window, she said that someone would be calling me before or on the 23rd, (umm today) and ask me a few questions and then have the temporary EAD in the works, thank god.

    But guess what, i talked to her about the AP, which is also outside of the 3 month processing timewindow, and she was like let me look at what we have... 'pause' .... your right, it is outside of processing time, which is the 3 months, :blink: ..,... (well duh!) but then she was like, it wont let me put in a 'service request' for it. (i might not have the 'technical term' down, but the way she explained it to me, is a 'service request' is something that they request when a paperwork is out of processing time, they have some1 call you, or even get right on your case right away, its pretty much like a red light, 'your taking to long on these papers' kinda thing.) the reason why she said she couldnt do the 'service request' for the AP like she did for the EAD was because even though they are both outside of the 3 month time frame window, she said that for some reason the AP 'says' it still has 45 days, and for that reason she cant put in a service request for it. But after the 45 days, ill be calling again about the AP.

    She transfered me to this woman to 'clarify' why she couldnt do 'service request' on the AP, and the woman she transfered me to was sooo absolutely rude. she started off with a frickin attitude, talked over me, ignored what i was saying, and when she talked to my husband, gave him the same frickin attitude. She speaks english and spanish, and i am sooo mad that i didnt write down her employee number, i wanted to reach through the phone and punch her. if i get her again i am soo reporting her. BTW she didnt clarify ANYTHING that the first woman didnt already tell me, all she did was piss both me and my husband off with her shitzzzy attitude. For those who speak spanish or have a SO that do, keep an ear out for this woman, REPORT HER, i know i will next time i get her.

    Hi we had an rfe too for my son's aos.Just wondering if you get a touch right away upon their receipt or have the status changed right away after they received the response..thank you

    Our status was updated based on the arrival of the RFE, but keep in mind that the touches are iffy and usually dont show up, for example, even though our portfolio status was updated, it hasnt changed since 4/30, and we are past the 'time frame window', so dont worry if you dont get a touch,

  14. My fiance arrived here on a K-1 April 22 and we will be married on July 1. Her visa expires on July 20. Do I have to apply for AOS [ I-485 ] before this or is there a grace period ?

    It is highly recommended that you do. you are 'supposed to' anyway, nothing 'horrible' will happen to you or your fiance if you dont, but your fiance will be 'out of status' during the time period you send the AOS paperwork and you guys get your first NOA1 for your AOS paperwork. For example, if you send the AOS July 21st, it arrives July 23rd, and you dont get your NOA1 until August 1st, during that whole period, between July 21st (any date after July 20th) and August 1, your fiance will be 'out of status'. That means, she wont have proof that she sent in the AOS paperwork, or anything to show the police if she gets stopped. You cant make a copy of an NOA1, to protect your fiance 'if' she gets stopped by the police, if you dont have it yet. That is why it is in you guys 'best' interest to send it ASAP. hope this helps.

  15. when you get your AOS i know you can. for your EAD and stuff i know you can, but for a k-1 i dont think you can. When you get the green card, or EAD, (permission to work), you can go to the SS office and pretty much show the paperwork as to 'why'/ what qualifies you for a SS#, and your pretty much home free, but a k-1, even though you are halfway through the process, you still dont have the green card, and i dont think you can get the SS#, until you get a greencard or EAD, which is when you complete the k-1 stuff and send in your AOS.

  16. even if it is 'technically' past the 30 days or 60 days allowed, i cant remember which it is, i still used the photos and never had any problems. the reason why they want recent photos is so that nothing major changes in your physical appearence, any new scars, scruffy beards, longer bangs, eye color changes, gaining or losing weight, if you look the same, and the pic. isnt stamped with a date, use it, they wont know. we never had any problems,

  17. I think that is fine. When you travel and have since changed your name, but your passport still has your old one, just take marriage certificate or w/e reason as to 'why' you changed your name, if you had your name changed on your SS card or something, that could help, license, but marriage certificate is the 'why' your name was changed, You should be absolutely fine. After all, for people who get married and still have time on their passport 'validation', what is the sense in paying for a new 1 when you dont have to. Marriage certificate is fine.

  18. No, i highly doubt it. For my husbands I-485, it said it wanted a copy of his passport identification page, so i sent that, and i copied all of the relevent stamps, like for your husbands passport, if on the cover it says american passport or w/e i dont know, copy that, and then his identification page, and then any stamps that you think would be relevent, b/c it wouldnt make sense to copy pages that are blank. hope this helps.
