  1. so we filed for my mother in law, did all the paperwork, everything.... she went for her interview, she took lots of proof,(none of which the man wanted to see, or would look at), he pulled her name up in the computer, and denied her on the spot, said she wasnt qualified for the visa..... she asked why, and he just kept repeating himself without giving her an explaination, and told her to move aside so he could help the next person. We pretty much do not know what to do or where to go from here. It cost her 200 american dollars just to get into the building, and the man that she had apparently is notorious for denying many of the applicants. ANY ADVICE?

  2. surprise surprise....still no movement for those of us who filed with vermont service center......i have a feeling our daughter will be here before her daddy gets his 10 yr green card.....ironic since i started these papers for her father a year after we met.....i was 18, 5 years into it...and we still dont have the 10 yr greencard in hand....but we are fortunate to have gotten this far. Congrats to all those who have been approved.... i will be checking in periodically to see the updates. LETS SEE THOSE VERMONT APPROVALS!

  3. it could be they found something during the review...that maybe you didnt even know about....you def need to find out exactly what questions were asked and what answers he provided and id you sent all the proof there is another reason they denied....you should have a heart to heart so that should u decide to refile for him in any capacity this obstacle wont be in the way again...however if its something else that they found out during the review....you also need to find that out.

    i agree with this, something...SOMETHING had to have come up during the interview to cause suspicion, if all that good hearty evidence was taken, thats enough to establish a relationship........either they were just having a bad day and decided to deny without cause...or maybe he said something he wasnt supposed to...or maybe there is something you dont know about and USCIS found out about it?.......

  4. I photocopy one of my ultrasound pics of the baby and send it to them with all the other things. have you thought about that?

    i second this, along with the loads of info and proof that we sent, i also sent a photocopy of my little squeaker on his/her ultrasound along with our supporting photos. We got our biometrics, so we havnt had a chance to be 'interviewed', 'questioned', or 'denied', but if you didnt do that, i would send that, along with maybe letters from maybe your wife's obgyn's stating that she has had 3 miscarriages and that you are actively participating in the appointments, or in the healing process, or maybe if your mom went with her your doctor can vouch for that, ....just ideas.

My sisters are attending to university, so they will bring letters from school, jobs (only one of them works), and proof that they are still depending on my father (he is a cardiologist). My parents brought the house property record, letters from their jobs (my mom is a doctor too), bank records, bill records in their name, i dont think they showed their taxes record, probably their last checks. The form for filling the tourist visa is pretty similar to the ds 260 we had to file for the k1, so the us embassy pretty much ask for every detail before the interview.

    She has to file online, and then go physically to the appointments, by the way, the form she has to file is in english, so you or your husband should help her with that .

    ok, where does she go to start the process? does she go to mexico city with all the paperwork and just walk in? or how does it work? does she need to call to make an appt to have them see her to prove her case THEN she gets an 'official appt'?

    got post happy, just saw the last of your post, sorry, she doesnt have a computer and doesnt know how to work one, my husband and i are here in the U.S.A, so i cant help her with the forms unless i physically go, i am the only one that knows english in the family.....

  6. @ P & A, does she physically go to the mexican consulate in mexico city to apply for these things or how does it work? Sorry we are step by step people, or at least i am, and the little town she is from, well no one will know how to help her since no1 from there has 'visited' the U.S ....legally that is....

  7. ummmm i am not sure about colombia, but i just sent a package to my mother in law in mexico today, just put her name, her address, and state, which is state of mexico, i have never had problems with the stuff getting there, in fact, mailing it ( i mailed 3 pages of pictures) cost me 2.22, it will probably be a little more expensive since it is going a bit further than mexico, but not by much, you can't get a verification of it arriving, but you can get it 'certified' i think thats what its called, and you can go online and check when it arrives, or where it is, as for putting your telephone number and such on there,..... i dont know why she would do that/need to, but maybe its a colonbian thing?

  8. It is illegal for a visitor to work. "Taking care of you" may be considered work since a US person could be hired to care for you. People have been denied visitor visas after disclosing they want to visit to help care for newborn grandchildren. Be very careful with this. Her purpose for wanting the visitor visa is to visit you and your husband. Her purpose should not include "taking care of you."

    i am having a hard time understanding why she would be denied based on the fact that she would be 'helping' ...'looking after'.....'witnessing the birth' of her grandchild and how that would be perceived as her 'working' getting a workers visa, or expecting to work when she gets here is NOT the point, the point is for her to see her grandchild being born....and i am NOT hiring her, ....... so 'hiring' a US person to take care of me is irrelevant.

    Hi! Congrats!!, Im doing the same for my sisters (i want them to be with me on my wedding day, so im helping them with their tourist visa, my parents already have theirs). The tourist visa can be issued in the consulate/embassy that is closer to your mother in law (My sisters will do it in mexico city). She will need to make an appointment for biometrics and another for the interview, usually you can make them with one day difference. Last time I checked, the waiting time for the appointments was 15 days, and I would say another 10 days for the consulate to send the visa via DHL. So total, about a month. As for the proofs, I would say, bank records, property records, etc.

    ty, please read over my previous post with the 'ties' and 'proof' to return to mexico that my mother in law could provide, do you think they are enough? What kind of 'ties' are your family members using?

  9. wow thats crazy! i didn't realize that they could DENY somebody for stating that they wanted to 'take care' of a family member! She can't say that she wants to see the birth of her grandchild?

    the only 'ties' she has is her house/and her land, also her mentally challenged daughter that is dependent on her, well she is not completely handicaped, she knows her schedule and can do alot of stuff, but she lives at home, and still relies on her mother to tell her what to do and stuff, but while my mother in law is here, my other sister in law will be living in the home, and she can step in and help yadira (the mentally challenged one), so the only thing that i can really think of is to get a letter from her employer stating that she is working and has a job, take yadira to the doctors to show that she is mentally challenged and is dependent on her mother's care, since she is the primary care giver of yadira, that she will be fine for a month, but that she will need my mother in law to return promptly, and show that she has the house and the land, but the thing is, its not in her name, in fact it isnt even in her husbands name, it is in her husbands FATHER's name who has passed away atleast 10 years ago, see in mexico, its not really that important to change that stuff over, if it happens it happens, if not, it doesnt. but other than that, that is the only thing that i can think of that would show her 'ties' in mexico. Maybe if she had bills in her name and stuff that could be included, but they dont do taxes in mexico, so she doesnt have any of that......

So my husband and i are interested in bringing my mother-in-law to the U.S (as she has expressed her dire need to 'take care of me' during my last month of pregnancy :P ) How would we go about doing this? She is mexican, born and raised, and has NEVER left the country. What kind of proof would my husband and i need to show? How long do these kinds of visa's usually take (as i am about 4 months pregnant now), and does anybody have any experience bringing a MEXICAN CITIZEN for a visit to the U.S? Would she have to go to Mexico City for the papers/interview or w/e is necessary or would she have to go to Ciudad juarez like my husband had to do for the K-1?

  11. im getting a little anxious that our bio apt letter hasnt come yet. Due to the hurricane or something crazy everyone in my area has been getting the wrong mail, i got letters that were NOT addressed to me or my husband and in fact from states like MO, ####### is that stuff doing in MY mailbox? I just hope that they dont send our bio letter to someone else! What if they arent as curtious as me and they dont put it back in the mail box?! ~*~think positive thoughts*~* :unsure:

  12. ty! yeah we might go back to mexico on our early month long trip, but i will be around 7 months pregnant so we will have to see. But i just wanted to try to avoid problems and back up as far as having to explain and show all this stuff that could cause us to miss our flight or something, b/c sometimes leaving mexico bound for the U.S can be a little difficult and time consuming, whereas entering into the U.S is ALOT easier.

  13. Question: The NOA1 says 'Your conditional residence status is extended for a period of one year. During the one-year extension you are authorized employment and travel. Soooo hypothetically speaking if my husband and i go to mexico this december, and his green card has already 'expired' and his papers are still being processed, should he just take this NOA1 with him? will they really let him back into the US with just this sheet and an expired greencard even tho these papers are being processed?

Sent ours August 17th, received August 18th, and got out first NOA1 August 22nd, ....the only problem so far is the receipt number for our case doesnt work in the system, says it doesnt exist, anybody else having this problem? i think i might have had this problem in the past but it goes away with some time, it registers in the system and i can add it to my portfolio.

  16. Ok, i have come to realize that i filed my husbands papers too early, instead of filing 90 days early, i filed 120 days early..... ooops. I guess i just confused myself and thought it was 6 months ahead of time. Ok, so based on what i read on here with the guides and such that if you file early, they will simply just send you the stuff back...... but based on what i read in a previous post by another person.... the same happened to them, and this is what they recieved back... (we have yet to receive anything back since it arrived on July 22nd).......please see copied and pasted post from 2 other members below..... (if we get the packet back, we can just send it back off right?)

    Hello, Everybody!

    My permanent residency expires on 04/08/2010. We have gathered all the required documents and sent our I-751 along with payment with money order to USCIS on 01/04/2010. the packege was delivered to vermount service center on the 01/06/2010.

    Few days ago we have recieved the entire package back from USCIS along with the payment and everything. They have included the blue cover sheet that says: We are returning your I-751 joint petition and any relating fees as your I-751 joint petition was received prior to the 90 day pediod immediately preceding the second anniversary of the date on which the alien obtained permanent residence".

    I guess we have messed up on those dates and sent it too early. Today is 01/18/2010.

    If we send it out tomorrow it will be recieved in the right period of time, right?

    Also, wanted to get advice from those who have been in that situation. USCIS sent all the papers holepunched for filing and they made notes on the actual I-751 form. also they have stamped the back of the money order already.

    Should we just mail them that same package again with their stamps? Or do we have to reprint everything and date it within 90 days before my residency expires? If any one can please give me an advice I will be very thankfull. if we send it back the same way all the documents are dated 01/04/2010. Is ok with USCIS as long as they recieve it whithin90 days?

    My guess, it is ok to resend the same documents - they actually spent some time on it so I don't think they mind getting back what they started. All they care about is when they receive the package is the date they receive it is within the 90 day window.

    Wait and see if others might provide you with a different answer.

    Is the blue sheet you are talking about the only document that reflects the early receipt or is there somewhere else that notes that?
