There was a GC approval for June today, NOA Issued on June 1, so it looks like we'll start getting approvals in 1 month. Look out Karri, you're up first!
-
Another quick question. I was wondering if I would be allowed to travel to the USA for a quick visit during the k-3 process? Or am I not allowed to travel until the visa is issued.
(CR-1)...
It can be difficult, but the good news is since your POE is technically in Ireland if you get turned away you've not flown all the way over for nothing! You have to show "substantial proof" that you are returning to Ireland after your visit. As much as possible, as it can be difficult. A letter from your boss, enrollment for the next school term, apartment lease, things like that.
Alternatively, if it's for a short visit, you could just not say anything about being married... My husband did that once with no trouble.
-
I'm not sure if this will work in Vegas but when we got married we took in the signed paperwork ourselves right after the wedding, watched the woman enter our info, and then asked for 5 certified copies right then and there. The place you get married at might not be ok with that, so make sure you ask. The court may not take kindly to that either, since they have to process so many. But it's definitely a possibility. I would just make a few phone calls to the appropriate personnel.
The reason you need certified copies is for your AOS from K-1 to permanent resident, amongst other things... so whatever you do don't leave Vegas without those cert. copies IN HAND!
-
Also, regarding the K-1 visa, you could do it, and the timing would be right for May. My Irish husband and I filed his K-1 on Sep. 8, 2008 and he was approved in March 2009. And he didn't exactly rush to get everything done, so it's definitely an option for you as well.
-
I agree that CR-1 could work for you definitely, but have you thought of just getting married and staying here while you process an Adjustment of Status? Someone else would know better than I do if this will work for your J-1 visa. I would at least check into it. That way you could go through the process together, rather than spending a year apart while your CR-1 is being processed.
There's more info on AOS from J-1 here http://www.visajourney.com/forums/index.ph...p;page=otheraos
Looks like you may need to keep your J-1 status while your AOS was pending... maybe that won't work for you... anyway, just a thought. Good luck!

This is strange. We just got a biometric appointment notice today for my 9 year old daughter on her AOS from K-2 visa. I thought under 14 years old did not have to complete the biomentrics. I wouldn't care except it's time off from work/school. Any ideas?
Scott
Scott,
This might seem like a silly question, but did you only file AOS for her? Or did you file EAD as well?
If you didn't file for an EAD for her, which I assume is the case:
I think you should call USCIS first, and see if you can get anywhere with them. They may just cancel the appointment, but I doubt it. Since not appearing at a bio appt is considered abandonment of application, I would say just go anyway unless USCIS says otherwise, they might need her photo for her GC and won't take fingerprints, or something equally as silly. Or you could show up and they'll see she's a child and inform USCIS in some special tin can communication process they have. I'm not sure about the K-2 AOS process so I could be wrong here, but I think that's the steps I would take, and from reading other posts on VJ as well. Always better to be safe than sorry!
Edited to add - also see above, Poprocks' K2 also has a bio appt.

I worry about getting an RFE for my son's medical...all I did was send the vacc supp, but he was required to get another Hep B shot since that medical, which he did, but it's not on there...I worry they'll return it....worst case, i'll have to get it transcribed and updated....even if it does delay my GC by about a month...no biggie....we are still together...so I don't worry lol
Just in case...does anyone have the contact info of that Surgeon General in Texas?
I'm pretty sure you're only required to start the vaccines out of the country, it's your own responsibility to finish them here, so you should be ok as far as his shots go.
But just in case, here's Dr. Arnold's info:
Dr. L. E. Arnold
4534 Westgate Boulevard, Suite 106
Austin, TX 78745
Tel: (512) 444-3131
Fax: (512) 447-4699
You have to call and leave a voicemail, they don't usually answer the phone.
-
Well a week later the RFE has at last arrived in the mail. I put my shades on to shield my eyes from the bright yellow paper (####### is that about?) and it turns out they want something you guys (or most of you) have already done an I - 693 (Medical)
So of to the docs on Tues morning then hopefully back on track.
Good luck to everyone.
We did not send in form I-693. Only the vaccination supplement (DS-something). We haven't received an RFE yet. I was assuming if we did, it would be after his bio. appointment, but it looks like you got an RFE shortly after you got your NOAs. Crossing my fingers that we don't get one!
ooo hey Bio on Thursday, let us Clevelanders know how it goes and where you park!
-
As I know it, if your medical is less that 1 year old, and you have your vaccination supp, you are ok..... now anything unique or outside of this I cannot comment, but I know many people in the Canadian forum that had just the vacc supp on a medical less than 1 year old, and had no issues.
I really hope I filed my forms ok.... I pride myself on the work I did lol.... I will be impressed if I get a GC issued and a smooth process
I have seen cases that only send DS-3025 go both ways, some have gotten RFE's, some have not. Most people risk it and see what happens and they're ok. But I have definitely heard of people getting RFE's so don't be shocked... But I hope all goes smooth for those of you who didn't bother with the I-693!
In our case my husband didn't know to get his DS-3025 and the doctor was a moron so we didn't have one. Had to go get the full medical anyway ($170). I think it was worth it, rather be safe than sorry personally.

WOOOHOOO! Just got email notification for a CSC transfer! They transfered it today Aug 3rd, both myself and my son!!!!!
I really hope this means no interview!!!!! And to think that I was studying all your timelines and thought that if I was getting a CSC trans I would find out in the next couple of days....I had just checked my on line status an hour before!!!!
Does this mean they have already reviewed our file? I wonder if we can still get an RFE? I'm curious to know if I filed our forms ok lol..
Holy, I hope they are going as fast as they have.....CSC transfers have been getting card productions in 6-9 weeks!
Such great news!
Congrats!!
You can still get an RFE after a transfer to CSC unfortunately.

mine too on 30th!!!!! I cant wait for the biometrics..
Good stuff Abe, why don't you add yourself to the spreadsheet so others can see your progress.
Hi! This is Verito.. heheheee

Just got the "Case is pending at CSC" email.
Just got the e-mail today that our case was transferred to CSC on July 30th.
When I checked on USCIS website for the processing times, it says the last processed I-485 was January 2009. But then it says that the classification for that I-485 was employment based adjustment of status. Does anyone know if this would also pertain to I-485 that were filed based on K-1's? Just curious, because if so, it might me a year before we receive the green card.
Thanks
A lot of people from April and May 2009 and even a couple from June have already received Green Card production notices, so I doubt it'll be a full year before you get it, but it's always possible!

Just got the "Case is pending at CSC" email.

just my update,my Transferred notice arrived in mail today.
Me too, looks like we're on the same schedule
-
Congrats! Now don't forget what I told you about your DS-3025 from the doctor (make sure it's in your hand when you leave)! And start hunting down your police report and getting your forms ready. Gather up all your evidence and put everything into a well organized binder for your interview.
And PM me if you have questions.
Take a deep breath, you're nearly finished

I agree with FutureAmerican. You are much more likely to be considered for a job if you appear face to face. Also you can try emailing personnel in the company directly, rather than using one of those sites. I've never had luck with online job sites, but gotten good results from face to face and direct email, including my current job

Our check was cashed yesterday so I'll be following this thread
On the back of the check is a 10 digit number, I suppose that's our case number.. but it doesn't have the 3 character code so I can't add it to our portfolio yet
The number should start with MSC, if it doesn't it's probably the wrong number. All AOS's go through MSC first.
Edited to add - Even if you can get the correct number off the check chances are slim you'll be able to add/track it. I wouldn't worry about it until you get your NOA at least.
-
I think I'm waiting for the 30 day mark, and then if nothing, call. I guess?
From what I've found elsewhere on VJ if you call them they'll generate it for you. I don't know if there's a requisite 30 day wait or anything like that though. The few cases I found where there was no letter they called post 30-day.
There was one that was post 60-day!
In my opinion definitely don't wait much beyond the 30 day mark.

im starting to worry bout my bio appt..until now i havent receive it..
i stopped comparing,its too depressing..
how come others have it even if i filed my AOS a week b4 them..??
My guess is your local biometrics office is quite busy, being Las Vegas after all... loads of marriages, loads of people, probably a lot of immigrants there, like NYC. Just a guess though! You'll hear something sooner or later!
-
So, I got this e-mail from CRIS, stating that they tried to send me my NOA1's, and they were returned. Stupid people at the post office did not put the NOA1's in my mail box, because my mail box was on my husband's name, and even if we do have the same last name, this is not something they care about. At least they didn't return my Biometrics Appointment Letter !!!
In the state of Colorado, no NOA1 for I-485, means no Driving License, yet. Also, I already have a job (got EAD card as I entered though JFK), and my boss keeps asking me about my ID. And I keep telling him "hey, it's up to USCIS to send me my papers"...so one day he'll start assuming I was illegal !!!
P.S. I have receipt number for AOS and EAD, they are being touched pretty often. But no word on the AP !! Btw, my cases are at the Missouri Service Center. The ones that are not transfered to CSC, are they all in Missouri ??
And what is with this interview a few months after applying for AOS ? I thought the only interview we will have will be the one for conditions removal...
The AOS cases that are not transferred to CSC will be transferred to your local office for adjudication. They all will eventually leave Missouri. Then you'll have an interview at your local office.
As for the interview, USCIS interviews most people applying for AOS to ensure the marriage is legitimate. The interviews are typically anywhere from 4-8 months after filing, although of course there are more extreme cases of 2 months or 2 years. They usually ask the same kinds of questions asked at a K1 interview. K1s sometimes get transferred to the CSC, which means they don't have to have an interview. My own personal reasoning is if a case has few or no "red flags" (see my prior post on red flags), the file looks fairly complete, and the K1 already had an interview overseas, they may be transferred to CSC, not requiring an interview. My own calculations from the past 3 months averages out to roughly 25% of cases being transferred to CSC.
Edited to add - Just to clarify EAD and AP are adjudicated in Missouri so they wouldn't leave, AOS is adjudicated at either CSC or local office.

Exactly, paypal is the way to go for sure. Just beware, my Irish hubby got super pissed off because he was trying to create an account using his Irish bank account, for some reason they wouldn't authenticate his account without all sorts of documentation. Probably not much easier in NI.

My I-131 is already approved and it takes only 1 week....sooooo happy!!!
I thought It will take a month before it get approved even U expedite it...but yeah!!Its only 1 week and its already approved!!
Wait, did you do Biometrics already? How did you get I-131 approval without bio? and after just a week too.... strange.
Just to add my two cents. You don't need a bio for AP, it's only needed for your green card and work authorization portions of your case. Check your appt letter, it lists them on the top.

Actually I searched more than once and didn't find that post, but I also find VJ's search system... lacking. Sorry poprocks
