  1. My husband came here on a K3 visa and left me and his daughter shortly 3 months after his arrival. He did not adjust his status (he applied but only got as far as taking biometrics). USCIS told me to withdraw the I-130 and I-485. Is there a way to fix this if my husband comes back and we work our marriage out?

    If you don't withdraw he could get his GC without an interview. If you don't get back together you will be financially responsible for him up to 10 years.

    The withdrawal notice has been sent in to USCIS.

    I am asking if we patched our marriage up and if he came back to me after he left me and his daughter behind, is there a way to re apply and fix his status?

  2. Get the Letter of withdrawing the I-864 notarized. Also file for divorce.

    K-3 and K-4 visa holders will have their status automatically terminated 30 days after the following of:

    Denial or revocation of Form I-130, Petition for Alien Relative;

    Denial or revocation of Form I-485, Application to Register Permanent Residence or Adjust Status;

    The K-3’s divorce from the United States citizen;

    The K-4’s marriage; or

    Expiration of the visa without requesting an extension of stay.

    Hey, quick question?

    Do I send the letter of withdrawal to the same service center that we mailed our I-129 and I-130's to? It was the California service center. I do not have the AOS information on where my husband send the application in to, but I do have my old NOA's for the I-129 and I-130. Let me know if that sounds right?

  3. Yes, even before the divorce contact USCIS and tell them that you are withdrawing the I-864 Affidavit of Support. If they approve his AOS application with the I-864 still attached you will be financially liable to the US Government if he uses any type of means-tested funding whether you are divorced or not. If you withdraw the I-864 he will not be allowed to adjust status and the AOS will be denied. He will be required to leave the country when the K-3 expires and will not be allowed to adjust status.

    Send a written letter to the same address you sent the AOS package, but also send another copy of the letter to your local USCIS office and then call them and ask them if you need to do anything more. If you can manage it, you could also make an Infopass appointment at your local office and hand deliver your request to withdraw the Affidavit of Support in person. That way you know they have it. Don't rely on just one avenue of contacting them because you do want to make sure the I-864 is withdrawn. Canceling the Affidavit of Support makes it impossible to get his green card so do that first.

  4. You can send them a certified letter and explain the situation, but I would start with the div and child support process ASAP. Remember all is not lost, you will survive out of this.

    Sadly I am broke and cant afford lawyers or any thing at the moment.

    Its sick how someone will go so far and have a child with someone just to get a visa!

    Divorce comes to mind.

    What ever you do - do it in writing (vs over the telephone).

  8. Simple answer ~ you can't get them sent home but you can divorce and status will terminate 30 days thereafter.
    I would like to know how to get a spouse sent home who has arrived in the USA on a K3 visa but has not adjusted status? USC no longer wishes to be married to immigrant.

    how to get a divorce if we married in a country outside the usa>?

    also what if he does not agree to the divorce?

    Im not sure if this is the proper forum. I am having a lot of problems with my fiance. It has come to the point of considering cancelling her fiance visa. A couple of examples, she did not call me to wish me happy birthday or taking trips without telling me and being out of communication. She has a plane ticket for February 17th. What is the process to cancel her visa. Thank you.

    Call ICE and USCIS and tell them you want to cancel it. Only call ICE if she is in the USA already.
