What if you had a J1 visa, and then after the J1 expired got a B1/B2 tourist visa? Does this still apply?
The DS-2019 (formerly known as the "IAP-66") would have a notation saying "subject to 212 (e)", which is the foreign residency requirement. If you are not able to locate that, your visa should also say "bearer is subject to 212 (e), two year rule does apply. If it does, you will have to have that requirement waived. If it doesn't say that, you are fine. See here for further information:http://travel.state.gov/visa/temp/types/types_1267.html
I am currently on a J-1 and am subject to the rule, as shown by my signature. Feel free to PM me.

Here is a quote from: http://travel.state.gov/visa/immigrants/info/info_3743.html
Applicants who were previously issued J1 visas and studied, worked, or lived in the United States as exchange visitors (and those who are currently in the U.S. as exchange visitors) should be aware that the two-year foreign residence requirement may apply to them. Section 212(e) of the Immigration and Naturalization Act (INA) provides that certain aliens admitted to the U.S. under INA 101(a)(15)(J) are subject to a two-year foreign residence and physical presence. The requirement also applies to spouses and children of the J1 visa holders if they entered the U.S. under the exchange visitor program. What does this mean? Are they referring to previous J1 holders or current J1 holders entering the U.S on a J1. Does this have anything to do with marriage visas?
Thanks!

Ok thanks, what else? Weren't there specific forms that had to be signed as well?
I spoke with an NVC officer who said an interview has been appointed and the letter is on the way. He said you shouldn't have to wait for the interview letter in hand in order to proceed with the medical exams. Can anyone add to this?Furthermore, what forms must be brought to the medical exam?
Thanks for any input!

I got the RFE letter today it says in my DS -230 I have either Skipped the ITEM 20 or provided incomplete information .
And asked for police clearance Certificates ...I will put complete information in Item 20 this time
but I have already summited my PCC with previous DS -230 .
my PCC covers only
* MY name my husband name
* Address
* My passport No . Date of Issue.
* Statement that there is no criminal record against me
but it does not Cover the entire period of the my residence in this area
I think i should go to police station tomorrow and request them to add the entire period of my stay in my PCC
Please reply your PCC covers the entire period of your stay as well .
I received the same RFE.
as for #20, just make sure you leave no gaps in time greater than 6 months.
As for the police certificate. They are not really asking for you to give it to them. They are just giving you instructions on getting it if you have already not. If you already have provided a police certificate previously then you should be fine.
I got the same letter, and the NVC said that they do not check the police certificates until the DS-230 is complete. If you have it already then don't worry about it.
I hope this helps,
Good luck!

Call the NVC, they should be able to tell you exactly what is missing. Then you can mail them along with your IV Bar code cover sheet.
Write at the bottom (checklist response letter) and instead of attn: CMR, do attn:DR
Good luck!
Yes that is RFE. You can wait for the mail or do as I did and talk to an operator, they should tell you what you are missing.Hi
I am applicant
so if the missing docs are ready , can i just delivery directly to NVC without mail from NVC? and without through the agent???
-
congrats, great to hear
congratsThat was fast!
-
yes, they will send you an auto email immediately after emailing NVCInquiry@state.gov. Then within a week or see they will send you a confirmation email saying it has been placed into the system.
does NVC send you an auto email after emailing ds-3032? -
I have mailed it to:
National Visa Center
Attn. CMR
32 Rochester Avenue
Portsmouth, NH 038012909
When I received my first RFE it said to send to:
Attn. DR
Will it be an issue if I already sent it as Attn. CMR
I have mailed the docs to the given address in the envelop, so mail it to the address given, this is the address which i mailed to, my DS 230 RFE -
I sent the DS-230 RFE with the bar code coversheet saying attn CMR instead of DR. Will this cause a delay? On the bottom I still did put (checklist letter response)

Have her print the ds-230 form online:
http://www.state.gov/documents/organization/81807.pdf
Have her sign it and send it back to you. Then you can fill it out and hold on to it until you are ready to send it to them. I would suggest (something i should have done) have her print a few copies of the form and sign all of them (but not date) and send them to you so you can have backups of the empty form with her signature. This way if you ever make a mistake you will have a new form ready to fill out with her signature. You will no longer need to mail back and forth between China. This will save time and money.
Is the DS230 form something we should have sign well before the NVC seds it out? My wife is in China and this will take some time. I mean I can fax there but if it needs her signiture that takes a little while. -
Hopefully not! You do not want an RFE (request for evidence) due to incomplete questions. You want to take your time and read the form 100 times before sending it out. I made a stupid mistake costing me lots of shipping costs
I wife is in China is this something I should get done while I wait to get my approval from vermont service center? -
Did anyone end up emailing an RFE for incomplete questions on the DS-230 and succeed?
-
They said to print a new DS-230, fill it out and sign it again. I am not waiting for the letter from the NVC.
Hello FiliricansThanks
but unfortunately i have paid Visa fee by cashier check so i m unable to print bar corded sheet , i have to wait for the NVC letter ,i have no other option . i m totally struck ..my Husband wants me to think positive God will definitely help us.
Take care

Yea, i guess you are right. I called the 4th time and this time they asked their supervisor. She said the benificiary does have to sign it!
Its all up to you my friend. I just share what we did for our RFE and it works & accepted. Others sends corrected DS-230 forms containing answers for RFE thru fax, the same time/day the said corrections of RFE's entered into NVC's computer system. Try to PM marjorie or may be u can check this thread wherein she posted something about the subject. http://www.visajourney.com/forums/index.php?showtopic=138229All the best.

I called again. They said it doesnt have to be signed since they have the original one which is signed. They also said #20 is incomplete because there is a GAP in the dates. I left those gaps on purpose because they were gaps Less then 6 months in time. Maybe I have to fill in every date even if less then 6 months in time even though it states "List below all places you have lived for at least six months since reaching the age of 16, including places in your country of nationality. Begin
with your present residence."
Let the principal beneficiary signed again the corrected DS-230 Part I. Nothing to lose. That's how we do it. Good luck! -
#11 is incomplete because i left it blank even though it says you should if its not different from #10.
#20 incomplete because i went as far back from her birth date when you should only go as far back as her 16th birthday.
I called the NVC 2 times. The operator told me to send it back signed. The second time i called the operator told me you don't have to sign it since they already have the first DS-230 form signed.
Having it signed is a big hassle since we are not in the same country. What do you think? Should the second DS-230 RFE form be signed?
-
Use it, should be fine. She also told me not to use it but I did it and it went through the next day.
got it...third times a charm...but the lady said dont use the online pay system...? -
I'm a K-3 filer, but also pursuing CR1. I called NVC this morning to get my NVC number details and my IIN so I can pay online. The lady put me on hold for 3 minutes to check and see if he online option is still available. She came back and said that they had too many issues with the online system and has discontinued it
It appears that if you are going to the CR1 route, you will be reverted to old fashion snail mail for payment. Just thought I'd share the info.
Try calling at different times throughout the day.. My best option call after 9 pm at night and do not mention that you want to pay the bill online, that's why you need IIN... There are some agents who will give the INN right away and some are not giving..
Good Luck for your NVC process..
The same thing happened with me last month. They said online payments were discontinued however she still gave me my IIN. I went online and paid, and they next day it went through and I was able to print my AOS bar code sheet online. Get your IIN and try paying online anyway.

Hello. On DS-230 form, Question 3 & 28 - Full Name in Native Alphabat (If Roman letters not used)
What does it mean or can we just write N/A? Thanks
Hello,
Write your full name in your native alphabet. If its Chinese write it in Chinese, if its Arabic then write it in Arabic, if it is in Russian then write it in Russian, etc...
-
DS-230 is not applicant specific.
You download it here:
http://www.state.gov/documents/organization/81807.pdf
Just make sure that you send it along with your bar code sheet.

If you are already married, the U.S citizen can petition for I-130. Once you get the I-130 receipt in the mail, you can send the 1-129F along with the receipt (with no fees). The i-129F can grant entry to the beneficiary to the U.S on a non-immigrant visa while the I-130 is still pending. This way you both can wait in the U.S. together for the entire CR-1 process.

Congratulations!
I'm waiting to hear the questions asked during the interview
