  1. What if you had a J1 visa, and then after the J1 expired got a B1/B2 tourist visa? Does this still apply?

    The DS-2019 (formerly known as the "IAP-66") would have a notation saying "subject to 212 (e)", which is the foreign residency requirement. If you are not able to locate that, your visa should also say "bearer is subject to 212 (e), two year rule does apply. If it does, you will have to have that requirement waived. If it doesn't say that, you are fine. See here for further information:

    yes it still applies. It doesn't matter what visa you get after J1, you still have to complete 2 years of home residency before you are eligible to apply for immigrant visa. I personally had F1 visa after completing only 6 months of home residency. I got married in the USA and couldn't apply for GC over there. So i'm now back home waiting for my I-130 to be approved.

    And of course you can apply for a waiver. It depends who sponsored you when you studying on J1. If it's a US goverment, then it will be very hard to obtain a waiver. If it was other sources then it shouldn't be that hard.

    What does this mean? Are they referring to previous J1 holders or current J1 holders entering the U.S on a J1. Does this have anything to do with marriage visas?

  4. Ok thanks, what else? Weren't there specific forms that had to be signed as well?

    I spoke with an NVC officer who said an interview has been appointed and the letter is on the way. He said you shouldn't have to wait for the interview letter in hand in order to proceed with the medical exams. Can anyone add to this?

    Furthermore, what forms must be brought to the medical exam?

  5. I got the RFE letter today it says in my DS -230 I have either Skipped the ITEM 20 or provided incomplete information .

    And asked for police clearance Certificates ...I will put complete information in Item 20 this time

    but I have already summited my PCC with previous DS -230 .

    my PCC covers only

    * MY name my husband name

    * Address

    * My passport No . Date of Issue.

    * Statement that there is no criminal record against me

    but it does not Cover the entire period of the my residence in this area

    I think i should go to police station tomorrow and request them to add the entire period of my stay in my PCC

    Please reply your PCC covers the entire period of your stay as well .

    I received the same RFE.

    as for #20, just make sure you leave no gaps in time greater than 6 months.

    As for the police certificate. They are not really asking for you to give it to them. They are just giving you instructions on getting it if you have already not. If you already have provided a police certificate previously then you should be fine.

    I got the same letter, and the NVC said that they do not check the police certificates until the DS-230 is complete. If you have it already then don't worry about it.

  6. Call the NVC, they should be able to tell you exactly what is missing. Then you can mail them along with your IV Bar code cover sheet.

    Write at the bottom (checklist response letter) and instead of attn: CMR, do attn:DR

    Yes that is RFE. You can wait for the mail or do as I did and talk to an operator, they should tell you what you are missing.

    When I received my first RFE it said to send to:

    Will it be an issue if I already sent it as Attn. CMR

    I have mailed the docs to the given address in the envelop, so mail it to the address given, this is the address which i mailed to, my DS 230 RFE
  8. Have her print the ds-230 form online:

    Have her sign it and send it back to you. Then you can fill it out and hold on to it until you are ready to send it to them. I would suggest (something i should have done) have her print a few copies of the form and sign all of them (but not date) and send them to you so you can have backups of the empty form with her signature. This way if you ever make a mistake you will have a new form ready to fill out with her signature. You will no longer need to mail back and forth between China. This will save time and money.

    Is the DS230 form something we should have sign well before the NVC seds it out? My wife is in China and this will take some time. I mean I can fax there but if it needs her signiture that takes a little while.
  9. Yea, i guess you are right. I called the 4th time and this time they asked their supervisor. She said the benificiary does have to sign it!

    Its all up to you my friend. I just share what we did for our RFE and it works & accepted. Others sends corrected DS-230 forms containing answers for RFE thru fax, the same time/day the said corrections of RFE's entered into NVC's computer system.   10. I called again. They said it doesnt have to be signed since they have the original one which is signed. They also said #20 is incomplete because there is a GAP in the dates. I left those gaps on purpose because they were gaps Less then 6 months in time. Maybe I have to fill in every date even if less then 6 months in time even though it states "List below all places you have lived for at least six months since reaching the age of 16, including places in your country of nationality. Begin

    with your present residence."

    Let the principal beneficiary signed again the corrected DS-230 Part I. Nothing to lose. That's how we do it. Good luck!
  11. #11 is incomplete because i left it blank even though it says you should if its not different from #10.

    #20 incomplete because i went as far back from her birth date when you should only go as far back as her 16th birthday.

    I called the NVC 2 times. The operator told me to send it back signed. The second time i called the operator told me you don't have to sign it since they already have the first DS-230 form signed.

    Having it signed is a big hassle since we are not in the same country. What do you think? Should the second DS-230 RFE form be signed?

  12. I'm a K-3 filer, but also pursuing CR1. I called NVC this morning to get my NVC number details and my IIN so I can pay online. The lady put me on hold for 3 minutes to check and see if he online option is still available. She came back and said that they had too many issues with the online system and has discontinued it

    It appears that if you are going to the CR1 route, you will be reverted to old fashion snail mail for payment. Just thought I'd share the info.

    Try calling at different times throughout the day.. My best option call after 9 pm at night and do not mention that you want to pay the bill online, that's why you need IIN... There are some agents who will give the INN right away and some are not giving..

    The same thing happened with me last month. They said online payments were discontinued however she still gave me my IIN. I went online and paid, and they next day it went through and I was able to print my AOS bar code sheet online. Get your IIN and try paying online anyway.

  13. If you are already married, the U.S citizen can petition for I-130. Once you get the I-130 receipt in the mail, you can send the 1-129F along with the receipt (with no fees). The i-129F can grant entry to the beneficiary to the U.S on a non-immigrant visa while the I-130 is still pending. This way you both can wait in the U.S. together for the entire CR-1 process.
