when did you submit the waiver to the consulate? it took a month for my wife's waiver to get from Bogota to Panama. I think I could have walked there faster. the receipt notice was dated two weeks after the date they said they received it on.
Because processing times are taking so long in ES you might want to consider sending it to the lockbox instead. Foreign filed waivers will be transferred to the Nebraska Service Center if they get to your US application first. Currently ES is at 10+ months while the lockbox is supposed to take somewhere around 3.
If You Already Filed a Form I-601 in Person at a USCIS International Field OfficeIf you already filed a Form I-601 at a USCIS international office, you do not need to file a new Form I-601 at the Lockbox facility. However, if you choose to file a new Form I-601 at the Lockbox facility and you still have a Form I-601 pending with a USCIS international field office, USCIS will transfer the application pending with the international office to the Nebraska Service Center (NSC). The NSC will combine the two applications and process them. Filing a new application with the Lockbox will not necessarily result in faster processing for an application that is pending with an international office.
If you file duplicate applications with a USCIS international field office and the Lockbox facility USCIS will transfer the application pending with the international office to the Nebraska Service Center, where the two applications will be combined for processing.

Thank you everyone for your thoughts, the charge was dropped and closed. I have paid all my application fees. He went to his first interview, seems like things there in the consular are rushed and thrown, just rude, he wasn't told anything they just took pictures,fingerprints, his forms requested on pack 4. It has been almost three months now, I have not heard anything. I know that when they call for the final interview they'll denied based on grounds of inadmissibility.
If all documentation was presented there will not be a second interview in ES. They stopped doing two interviews in Sept 2011. If he went to his interview they should of given him a yellow paper saying he is not eligible for a visa but can file a waiver. Otherwise if he was missing documents they give out a piece of paper denoting 221g and you mail that in. After that they'll usually call to tell him to file the waiver and e-mail the instructions.

If you have not yet filed the I-601 abroad and have not been cleared to submit it next week then you will probably be using the new I-601 lockbox filing going into effect June 4, 2012

Your I-129F was approved. Have you paid the NVC fees, sent in the packets (DS230 & I-864), and received a visa interview?

You'll probably have to register on ustraveldocs.com. Seems the appointments are being scheduled for late May and early June.

More than likely no. Unless they specifically call you in for an interview which rarely happens. I went with my husband but had to wait outside.

She already paid it. The fees are went down for some visas and so the amount is different.

An I601 is an application for Waiver of Grounds of Inadmissability. Some people are ineligible for a Visa to the US and will be denied at interview if so, but some are eligible to complete a waiver packet (and pay a fee) to ask for an exception.
There are many bans that are imposed and can be waived with a waiver. My husband for exampled entered the US without inspection. In order to adjust status he had to consular process (leave the country). We did I-130 & NVC while he was in the US but in order to get the visa he had to leave. When he left he triggered a 10 year ban (for illegal presence over 1 year in the US). In order to overcome this 10 year ban he has to apply for a waiver (I-601 form) and wait for its processing. Current wait times for the processing in El Salvador is an estimated 10 months.
There is also a 3 year ban for more than 180 days but less than a year of illegal presence. I-601 is also used to overcome other inadmissibilites, listed on the instructions.

I do know of one person where they delayed the visa interview in ES until after the birth of the child. A DNA test was required. It might of been because of the age difference. Hope you don't get extra scrutiny.

Im hoping there is someone here with some kind of idea or suggestion I feel like I have exhausted every option. My husband voluntarily left the U.S. for El Salvador in November of 2010 and had his visa interviews in April. He has been in administrative processing for a year and we have heard absolutely nothing. But I (his wife) have stage 2 Cancer and am worried about who will care for our 2 small children if something shall happen to me but absolutely cannot get ahold of anyone. I know its pretty much impossible. But does anyone have ANY ideas or suggestions? It would be greatly appreciated
You say he left voluntarily. How long was he in the US before he left? How did he enter?

You filed for a CR1 visa not a K3 visa. Unless you also filled out the I-129f.

It is standard procedure to be placed in AP for ES embassy. Can be anywhere from 2 weeks, 2 months, to 2 years. Really hoping for 2 weeks, with realistic expectations of two months (average). Its only been one week and we won't know we're out of AP until DHS sends notice they received the waiver. The wait is hard, the days are going by slowly and there is no way to check status. Hoping everyone survives this torture.

USCIS is "department of homeland security" the application is where it should be.
I would though send an email to the USCIS office in El Salvador to confirm they have your application. If its been a year since you filed you might want to supplement your evidence as well.
DHS is who processes the waiver and gives the decision. Usually ES puts applicants in AP (administrative processing) after submitting the waiver....this usually takes two months and then its sent to DHS who then adjudicates the waiver. Not sure if you have received a decision but they seem to be going a lot faster these days.

We submitted our waiver on 11/29. The orders isn't specific....just make sure you have:
1) the sheet they gave you giving instructions on the waiver, notes your inadmissibilities.
2) I-601 form (the application has two copies)
3) G325a
4) Payment - cash or credit card

I'm sorry to hear this. The reason he was granted TPS is because he had not incurred the 5 year ban yet. The ban does not come into effect until he tries to apply for a visa:
Department of State - Skipped an immigration court hearing in the US. INA 212(a)(6)(B) - 5-year ban with no waiver
"(B) Failure to attend removal proceeding.-Any alien who without reasonable cause fails or refuses to attend or remain in attendance at a proceeding to determine the alien's inadmissibility or deportability and who seeks admission to the United States within 5 years of such alien's subsequent departure or removal is inadmissible."
He had to seek admission (apply for visa) and depart/be removed from the US.

Even if it were a 3 or 10 year ban, they may qualify for a I-601 waiver. If it was only a catch and release she wouldnt have documentation would she? So long as it was a catch and release it should be fine. If it were a formal removal then I would have the documents - request them via FOIA.

The medical exams in ES seem to range from 250-400 USD. Dont recommend Dr. Rivera on the list of doctors.

Yes that is your packet 3&4. Your appointment letter is what you need for the medical exam.

Have you called NVC to see if your case is complete? If it is complete give it a few weeks and you should receive the date soon.
