The grandparents could probably legally adopt the kids.
I still hope somebody could direct me to a website where we can get some official information regarding this matter.

They can get the kids back on legal custody, easily. Adoption, not so easily.
The potential adopter is simply the grandmother of the kids.

That's fine, but the kids are 8 and 13 y/o.
They are underadged, so they need someone to take care of them.
That's why the parents believe it is best if the grandmother adopts the kids.
I think the parents are right. One year is a long time and they need to know that
if a sutuation occurs, the grandmother has the legal right to make a decition on
kids behalf.

How long will they need to complete their education ? It may be possible for them to do so and leave the children with the grandmother as a legal guardian.

Why is it so important for them to naturalise 2 years early?
It is not important for them to naturalize the kids.
They are afraid to leave the kids here while they are away, because the kids gained their
immigration status thru the parents. Plus, the parents are going to return to the USA after
they complete their education. So, they do not want for the children to be traveling with them
back to the homecountry and then again back to the USA.

I will try to explain why.
The parents of the kids used to participate in the Green Card Lottery for over ten years now.
Well, finally they are here,but meanwhile thier situation has changed.
They are supposed to graduate from an university. Therefore they would like to go back to their
country to compete their education. They want to leave the two school adged children here,
because the kids have been already enrolled in a local school here in USA. They are
concerned about the kids immigration status while they are going to be away. That's why the
grandmother would like to adopt them, so the kids maintain legal immigration status while the
parents are away.
I hope this says enough.

Here is the case:
A friend of mine just arrived in the USA. Her family (husband and three kids) won Green Card thru the Green Card Lottery.
Her mother-in-low is residing in the USA. She is a naturalized citizen for a few years now.
Here is the question:
Is it possible for the mother-in-low to adopt the three kids, so that they can gain citizenship earlier than the 5 years
waiting period?
Some details:
- the kids were born out of the USA, their adge is 3, 8 and 13 y/o
- no one of the kid's parents is a USA citizen (just Green Card holder)
- the grandmother of the kids is not USA born citizen
Is it true that an american citizen has to live together with the kids for three years prior to file for adoption?

Someone is lying to someone. The city/state will not give an tourist cash assistance to pay their hotel/room/lodging bill.
I thought the same until I got a call from the city's social service, asking me if their names are so and so, if they live at my
address, and telling me that my "friedns" applied for a finanacial emergency help and that the social services are going to
mail their rent check directly to me as I am their landlord..................
What now? Who is lying? Please, keep your expert comments for yourself. Are you having fun while someoine is struggling
to get their lives back to normal? That is really sick!

Just to clarify:
1. They are not illegals. They are here on a tourist visa.
2. They are not tenants, so I can't even get an eviction order.
I"ve spent a lot of time trying to find the right way to deal with the problem, but...........
The sad truth is: They won!!!!!!!!!!!!!
They have got their visa extended for another six months!!!!!!!!!!!!
They are going to get cash assistance from the city's social system to pay rent!!!!!!!!!!!!!!
They do not intend to look for a rental apartment. No. They want to pay rent to me???!!!!!!!! No way!
I wish I could laugh on that. It is such a shock to us! It seems we will have to take care of them until.......... eternity!
Believe it or not, that is the fact!
My husband and I now are considering the possibility of selling the house. That seems to be the most painless and
easy way to get rid of the "friends".

You cant change locks, turn off heat in NYC, turn off utilities, go on vacation and turn off utilities. No matter what the immigration situation of the unwanted guests, you cant commit crimes to get them out. If the OP takes any of that advice, you can bet NYPD will be hauling him to the clink.
He needs to go to housing court and get an eviction. She owns the home so there is no landlord to complain to. She has to do this herself and it will be successful as long as she does things by the book. Those "guests" could go and get an order of protection from the OP because of the advised harassment and then guess who would be sleeping in a hotel?.
NYPD do not care about immigration status unless a crime has been committed and working without authorization is not their jurisdiction.
You are absolutely right!
NYC's tenant law is different than any other city/state.

Talk about making a mountain out of a molehill.
Call their bluff, write a letter to ICE.
Give the full details, their names, the employers name, your address and contact details. Explain that whilst they are living with you you have no desire to host illegal aliens and will do everything to assist in their apprehension.
Explain they are working illegally in breach of their status.
Give them a copy.
I doubt you will have long to wait for them to leave.
Whether you mail the letter or not I will leave to you.

A tenant must inform the landlords of the name of any occupant within 30 days after the occupant has moved into the apartment or within 30 days of a landlord's request for this information. If the tenant named in the lease moves out, the remaining occupant has no right to continue in occupancy without the landlord's express consent. Landlords may limit the total number of people living in an apartment to comply with legal overcrowding standards. Real Property Law § 235-f.
This is New york state law - work with your landlord, I am sure they are not interested in letting ppl live free of charge on their property and under over crowding act also they could be evicted.
My husband and I own the house. No landlord is involved here.

Can I ask from what country they are? Seems if they were from the EU they would be better off living there than here, unless there is more to the story.
They are coming from European country, which is not a member of EU.

Yep here is your chance, call ICE and report them. If you can find number of your local ICE office that would be more effective compared to calling their central number.
Or you can complain at both and that would be even better.
That is what I need, the number of my local ICE office. I would go there in person and talk to
some officer and tell the entire story. I do not want to do this over the telephone, somehow
it doesn't seem to me very serious. I need to talk to somebody in person.
Anybody knows the NYC ICE phone number?

I just don't get it, why the OP seems unable to remove this couple out of his house?
Because they refuse to go. They say they have no place to go, because nobody is going to rent
them an apartment or a room, because of the baby........because of lack of credit history etc........
reasons and reasons, that dont make any sense to me.
Everytime I start a talk about them leaving my house, they call police and complain that I am
harassing them, which affects the baby, as the mother is getting stressed and nervous
I am speachless, because every time I have to promisse to the cops, taht I am not going to
disturb them in any way . Unbvelievable, unheard of. Lately I find myself wondering if the
cops are for real, if that situation in my home is for real...... Just hoping one morning I will wake
up and none of this nightmare will be here around.... I am indeed discouraged by these cops,
who are supposed to protect me and not this adventurers, who are eating my and your piece
of bread.

Well this was very well planned, they came in when she was 3- 4 month preg and might have not raised a flag at POE nor with airline as they would let someone fly who is 3 months preg.

She was 8th month pregnant when they came here.
I am wondering how did she get admitted on the airplane......on the POE?
And Yes, no doubt they had a plan to stay here and live on government expense.
They are not ashamed that they are eating my money, your money, our taxpayers money......
They look happy that they got the chance to screw up the system.
They act as someone here is obligated to do things for them just because thier baby is a US citizen.
It did sicken me when I realized they are looking for a ways to receive more benefits from the
government without ever paying even one dollar in taxes.

common people don't be sarcastic give them a chance to settle their immigration problem, why did you get married to a US citizen just to settle your immigration status here in the United states even though you are not 100 percent sure that your spouse loves you,common look back where you came from people...everybody is accountable through their own actions.
You just dont know if they are waiting their Priority Date of their petition and still they are eligible to adjust their status check section of 245i.
I think you should read the thread before commenting on it.

They have no morals or principals and because of people like them, other good hard working immigrants have to go through a tougher and more strenuous immigration process than what it once was. I hate the fact that they put a child into this situation.
I absolutely agree with you.
I am working hard and paying my taxes and I never had any government assistance. While they came three months ago and they already got a food stapms (because of the
baby US citizen), they owe many thousands of dollars to hospitals (which they do not intend to pay). He is working illigally and does not pay any taxes. And on the top of all, the
police defends them and asking me to do things, that I have no obligation to do (like keeping the temperature in the house above 72 degrees because of the baby and many more
ridiculous demands that my "friends" have).
I still can't believe the police is taking their side? That makes me feel like I am guilty by a presumption. It is me who is paying taxes, which is the source of the police salaries,
right?
Thank you all for your inputs. You all helped me to gain the necessary confidence that I have no other choice, but report them to ICE.

Sounds like you need a locksmith.
The problem is that they will call police again. In their plan they are away ahead of me.
Last time they called police the "friend" asked the officer what happens if I change the lock.
Guess what? I do not have the right to do that That is what the police ofiicer told them.

So the real problem is that you have an unwelcome house guest.
That is right.
As I said, at first they were coming just for a month as a tourist and that is why I decided I can give them a shelter.
But now I see that they had a plan, that I did not know about. I need to get them out of my house, that is a must.

Sorry I forgot to update my timeline. I already removed the conditions,
but still this does not mean I am safe to shelter individuals that are violating the immigration law.
I did tell them several times that I want for them to leave my home and this is when they started
calling police on me.
How do I report them to ICE?
