  1. So, we definitely didn't file it online and my attorney said they mailed it to the NBC. Our receipt numbers are all IOE and it came from the USCIS office in MO. I can track the statuses of my application in myUSCIS under 'Progress' and it is very similar to what the OP were saying.In my case, the step 1 is 'Completed' and Step 2 is 'Biometrics completed' for my I-765. I have also seen some posts about MSC and IOE and never understood it. Could it be that MSC is being phased out?

  4. What if the I-130 and I-485 are filed together when already in an authorized stay?
  5. would that include someone awaiting decision on a pending application and on authorized stay? They are someone who are without any legal status.
  6. As someone said, refused does not mean denied. You probably got a 221(g)? lately if you are not aware already, they are asking applicants for their social media handles to be made public. So it could be that. It's a hassle but not impossible to overcome. It will be approved once he submits all the documents. I have seen some posts here where people from certain countries (like Russia) go through additional vetting. So it's entirely possible that's what is happening in your case.

  8. Recently, USCIS has been issuing NTAs to individuals who were laid off from H-1B positions. Interestingly, they don’t seem to care if the employee had already filed for a new H-1B transfer with a different employer within the 60-day grace period. It appears that USCIS has been taking advantage of every opportunity to kick people out without adhering to their own policies. I’m curious to know if anyone has experienced this situation or if you know someone who has. Specifically, I’m wondering if anyone has been issued an NTA when an AOS was filed after their work visa or any underlying non-immigrant visa had already expired. If so, I’d appreciate any advice on how to avoid receiving an NTA or guidance on what to do if one does receive an NTA.
  9. A H-1B extension application receipt notice is not listed on Virginia DMV's list. Thanks for the response! This is the document the DMV people use and I have also seen it first hand. I also linked this document [https://www.dmv.virginia.gov/sites/default/files/documents/accept_doc_status.pdf] in my post. It's much more detail and clarifies a lot of things - like I797 approval or receipt notice. It's straight from the DMV website (https://www.dmv.virginia.gov/licenses-ids/id-cards/legal-presence). You'll see in there that it mentions I-129 (H-1B) receipt as one of the acceptable documents. That's how I renewed my license the last time around and they extended it for a year, but as of now the H-1B extension is still pending, and I don't know if I could use the same document for renewal again. I read somewhere that it has to be a new petition. That's correct, I was just saying that my I-140 is already filed through my employer and I might be able to file a H-1B extension based on the I-140 approval. Thank you for this info. Are you talking from personal experience that the I-765s are taking a long time? I do agree that I could just use the I-485 receipt as a proof to renew.
  10. Hi all, To give you all a background, I most recently renewed my Virginia's DL based on the I-797 receipt of my H-1B extension application. The petition for 1 year extension which was filed last year, is still pending. My I-140 is also pending, but looks like I can't use the receipt for renewal? What are my options other than waiting for I-140 to get approved and use the receipt from filing H-1B extension? I will be getting married to a US citizen soon, and will be filing for GC. Would the receipt of that application (AOS) be enough to get a renewal? I will be filing AOS as a bundle which also includes I-765. Based on the documents listed here https://www.dmv.virginia.gov/sites/default/files/documents/accept_doc_status.pdf, it seems like that'd be enough along with a I-485 receipt notice? Did I understand that correctly? Can anyone with similar experience offer their thoughts?
