  3. Hi all, I have recently received an RFE for my "joint sponsor's" i-864, and I want to ask some final questions before I submit a response. I have found a new joint sponsor, the petitioner's sibling, who does not live with us. The joint sponsor makes about 65k per year, and the total household size is just 2, so well above the 125% poverty line. The questions are as follows: In Part 6, item 7, the 'current individual income' is higher than the Part 6, item 16a, 'Total income section for the most recent tax year 2024'. By about $3000, I am not sure why that is, but would this be an issue? Note that I got that value directly from the Tax Return Transcript "Total Income" line. I have filled out values for each of the 3 most recent tax years in Part 6, item 16a. I will be attaching the Form 1040 Tax Return Transcript directly from the IRS website for the most recent year, 2024. Do I also need to include the other 2 years, 2023 and 2022? The RFE does not say that I should, but should I also include the I-864 for the petitioner again? Or just the new Joint sponsor? Are Tax return transcripts for the year 2024 enough, or should I be including other documents (W2, etc.)? I will also be including the last 6 months' pay stubs to prove current income. I want to really make sure I get this right to avoid any denials or other RFEs. Cannot afford that at this stage. Your help will be much appreciated.
  4. Hi All, I recently received an RFE for my Form I-864 from my joint sponsor. There were some issues with pay stubs, etc., so I decided to find a different joint sponsor to avoid a denial in my application. Here are the main points: - My wife (US citizen) does not meet the financial requirements, so we needed a joint sponsor - Her brother (LPR), who lives in a different state, is going to be our new joint sponsor. I was filling in the I-864 form, and it was quite straightforward for me until I realised his tax returns had "Married taxpayer filing jointly". His spouse does not work My question is, now that I know he is filing jointly, does this mean that his spouse has to provide a Form I-864a? Or can I submit just his I-864 alone, as he meets the requirements and has no additional income from his spouse?

He is also self employed along side being full time employed. “that total income for 2024 in Part 6, Item 16.a appears negative due to a one time business depreciation expense for the company that I own and run in addition to, and separate from, my employment” he makes close to 300k each year from his employment alone, which is absurd to me, but he’s doing well for himself. Which is why I’m shying away from using someone else.
  6. Thank you all, I will likely upload to the portal as it says I can do that on the letter. quick question, if I’m not able to get another sponsor. Would 6 months pay stubs be enough as current employment and a cover letter explaining why the last year tax return was negative. only asking as it will be hard and timely to get another sponsor. But I will do it if the 6 month pay stubs alone are not good enough as proof of current income.

I think I will have to find a different sponsor, he can provide 6 months stubs but not a letter from the employer as he said it will take some time. with the new sponsor should I include 6 months pay stubs too? and finally should I respond by mail or through the online portal?
  8. Thanks @Crazy Cat, yes indeed. I realised now that no current income proof was submitted. He’s able to provide the last 6 months pay stubs (would this be enough for current income proof), would getting a letter from his employer help? also as @Crazy Cat stated, would the house as an asset complicate things or would it assist. I don’t want to make this more complicated than it needs to be if the last 6 months pay is enough.

  10. Good afternoon, all, I have recently submitted my AOS documents (April 3rd) and had my biometrics done on May 1st. Still waiting on my EAD. While waiting, today I received an RFE for the form I-864 of my Joint sponsor. I need some help understanding both what has gone wrong with his paperwork and what is the best way to move forward. I have attached the RFE (with redacted sensitive info) and the initial I-864 submission for my joint sponsor. Here are the key points: I am the beneficiary, and my wife is the petitioner. She has not found work yet, so we need a Joint sponsor Her distant relative was okay with being our joint sponsor (we are currently living with him). We have 2 kids, so we are a family of 4 The joint sponsor lives with his wife and 26-year-old daughter has sponsored someone else 1.5 years ago and is still responsible for them has a current income (combined employment and self-employed) of approximately 400k per year In 2024 had a negative total income of (-56k) due to business depreciations of some sort. My questions are as follows: Could the RFE be due to having a negative total income in 2024? Despite having an overall positive income in 2025 (even though he didn't submit 2025 taxes as they were at the time not due. To combat this, does adding his assets help? Such as his home, which he has a mortgage for and is close to paying off? Is there anything else from the document that seems to have been incorrectly written? Specifically, the household size, the number of years for tax returns, and the physical document of tax returns he submitted as evidence (which is the Tax Returns transcript) He is a U.S citizen, and he also only submitted a passport copy as proof of Citizenship. I am assuming this is enough. Furthermore, would it help to provide pay stubs for the last 6 months? Also, which years of taxes should he be providing? In case he submitted the incorrect ones. If I get this RFE response incorrect, would they send me another RFE, or would it be a straight denial? I am considering using a different Joint sponsor in that case; however, if the assets will cover the negative, then I prefer not to change the sponsor. Is it better to submit the RFE online to my USCIS account or by post? Would really appreciate any help or clarification. Thank you!

  12. Hi, I’m almost there with completing my concurrent filing (I-130 and I-485) for my husband of UK origin. I have 2 questions. I currently do not work as I am in the process of looking for a job. I haven’t had any income while living abroad for the last 4 years since we had our kids I have been a stay at home mum. So for my I-864 I will be showing zero income and no tax returns. I am attaching a letter explaining why I have not filed my taxes over the last years. we have a joint sponsor, who is a friend of my fathers, who we (myself, husband and 2 kids) are currently staying with in the US. As he is not related to us we will be using him as a joint sponsor. The question I have is for my I-864, my household size is 4. but for his, because he already is a family of 3, (himself, his wife and daughter) does he put his household size as 7 to include all of us, just my husband to make it 5 or just his family? my brain is leaning towards 7 based on what I’ve read everywhere. But I just want to be sure before committing. any help would be much appreciated.
  13. Yeh thanks a lot for the advice and clarifications. We had to do the i693 stuff here as I hadn’t anticipated staying and applying for his green card. He just had his medical early this week and titer test to check for vaccines. hopefully all goes smoothly.
  14. No not at all, it was a routine visit to the US, we come every year with our kids to spend Eid with our family. And we decided to adjust his status and stay.
