I’m 9 months out of status, my family back home have recently had bad news regarding their health so I am very tempted to simply hop on a plane to be with them now however I haven’t even submitted any of the AOS documentation yet. I know if I leave the USA then I’ll be denied reentry however would I still be eligible to file for perhaps the CR1 visa later on after a few months of me being in my homeland? Because I know the reentry permit I-131 would take about 180 days to receive and I haven’t even filed that nor any other forms yet plus I don’t want to delay seeing my family. Any advice?

  6. I let my legal status lapse due to the time it’s taking to complete the paperwork and due to the fact that we decided to marry a day before my flight home after being here for 88 days. So I’m out of status and haven’t submitted the AOS package yet. Would my case be denied due to being out of status for 9 months? If a police officer pulled my husband over while driving me somewhere could I be deported?
  7. Am I right in the assumption that if the AOS process is abandoned by the applicant travelling back to their home country after overstaying their ESTA by many months, if the applicant tried to reenter the USA would they be denied entry?
  8. My lawyer said it’d only take a couple of months to process my travel reentry permit however the USCIS website processing time said 14 months which is an insanely long time. What’s a realistic timeframe for this document? I’d be submitting it with my AOS package

Thank you this is very helpful, I just got back from part one of my medical check and the flu shot wasn’t available at the clinic so I didn’t get it however she said I must visit cvs to get it before part two of the medical check. I wonder if since it wasn’t available at the clinic would I be able to avoid getting it at cvs? Or would I be able to delay part two of my medical check till we’re out of flu season? It’s just since I received quite a few at the clinic today I’d like to avoid this one if possible since I have had the flu already

  11. I am adjusting status and looked through the vaccine schedule for immigration. The only one I haven’t had is the varicella vaccine however I caught the chickenpox virus as a child so that would make this vaccine unnecessary. I’ve also already recently received my third hpv vaccine so I don’t want to get any more if it’s not necessary. I’m asking what should I do since my plan is to receive any vaccines at cvs before I take my immigration medical check just since the vaccine will be covered by my insurance if I do it at cvs first. I dont even think I visited my family doctor when I had the chickenpox at 7yrs old so it wouldn’t be in my medical record. I’m unsure what to do.

I phoned my insurance company yesterday to ask if there’s a civil surgeon I can see for an immigration medical check, and I don’t know if it was my accent but she thought I was looking for a surgeon who implants RFDI microchips for tracking purposes and asked why I would want that and that it’s not covered as it’s a new tech, I explained a few times that no it’s a medical check for immigrants but I had no success so I take it that it’s most definitely not covered by my insurance

  14. I am adjusting status and need to do a medical check with a civil surgeon but so far I’ve only found ones who I have to pay out of pocket for. I’m wondering if there are any out there that my Aetna insurance will cover? Should this be a question I contact my insurance company about? I’m still learning to navigate the health system.
