I assume your wife has sole custody on your son. Does she has documentation proving this?

Her son (my stepson) has been in the US since 2008. He came with her and his brother when he was 11 I think. She has divorce papers I will see if she has sole custody. I do remember her ex husband had to give her permission for her sons to leave Colombia. In Colombia her sons lived with her full time not with her exhusband. I will have to look at her divorce papers to see if it says sole custody. IF it does not say do we need to get her ex to fill out the DS 3053? seems a little stupid considering they have permanent resident cards now.

I always come back to the forum for the great information I get here. My wife was sucessfully sworn in last Friday November 30th. Now she is going to get her passport and has all the forms, etc. but our question is for her son. He is presently 15 came to the US with his mom and brother(he is 21 now)years back obviously on her I-129F fiance visa. Now that she is a citizen he automatically becomes one I believe as a "dirived" citizen. We want to get him his passport as well as proof of citizenship. I called the local post office which process passports and they said we needed the DS-11 application for both my wife and stepson but he would need to have both parents there since he did not have a US birth certificate. That seemed a little strange to me since he came to the US with his father permission on the I-129F visa so why would his father need to give permission for his passport? Can anyone help me with the procedure? They mentioned a DS-3053 form?

That is a very good point. Missing a day of school considering the importance of his mothers oath would be pretty insignificant. He will probably complain being 15 but when he is 30 he will probably grow to appreciate everything. Thanks for the help.

Thanks, the reason I was asking about her son going to the oath was because it was my wife that applied for citizenship not him so I assume she is the only one that participates. She did not file a N-400 or N-600 for him the same time just listed him on her application. The letter she got from the USCIS is kind of a form letter with check marks next to the things to bring. The wording was "If the naturalization application is on behalf of your child (children) bring your child (children). So I think that means for those that applied for their child under the childs name they would need to attend. Not sure but that is my thought. I am thinking she completes the oath and then her son becomes a citizen because he is a minor. Then then can both go to get a passport and if we want a certificate of citizenship for records we send the USCIS $600 for one for him. Am I correct do you think?

Hi guys I need some help. My wife entered along with her two children under a fiance visa quite awhile back. She has finally gotten to the point she is taking her oath on Friday this week. Nov. 30th. Her two children are 21 and 15. I know her oldest needs to apply personally because of his age for naturalization. In my wifes oath papers it says to bring any children that applied for naturalization. Since her youngest is still 15 and he came to the US under her visa does he need to go to the oath ceremony???

Approved on April 18th. Got letter in the mail today the 21st. Maybe things will start moving along with everyone. I am going to try to update the calendar but if not can someone do it for us.

So what do you VSC filers think about first how snail paced they have been and secondly the effect the budget crisis is having on speeding up their workload. I think not. They are probably all eating donuts and coffee all this week discussing whether they will be coming to work on Monday.

I am also waiting for something to happen. Seems like if we are luck the end of the month should give results. Of course if the government shuts down who knows with the baloney going on in the capital.

I agree seems strange. We filed with one check for fee and 3 bio's and no problems at all.

It is right that everyone is different as you can see by the November filers forum. We received ours fairly quickly about 10 days after our NOA1. Our bio is on Dec. 28th but others that filed have earlier bios? Makes no sense. Hang in there.

your situation sounds very similar to ours. Our daughter was 13 years old when my wife filed for ROC. our daughter never recieved a biometrics appointment. when we took her to my wife's biometric appointment, but they couldn't be taken since she hasn't scheduled an appointment. our daughter received her ten year green card about 3 months before her 14th birthday. when she turned 14, when filed an I-90 to have her green card replaced. we had to pay the biometrics fee, but not the application fee for the I-90.
Thanks for the information. Does that mean we have to file a I-90 when he turns 14? and pay the biometrics I guess again?

Just an FYI for everyone in Orlando area. My stepson went into the Orlando field office without his appointment paper but his number and they printed off a copy from the computer and took him to get his biometrics. His schedule was for Dec. 28 and he went Tuesday the 14th. They were very friendly he said. He is in Florida going to school and our biometrics for everyone was in Philadelphia. Just thought I would pass this on as information.

Need to use a cashier or personal check as mentioned and using another form of payment will just have your application returned. If you are not in Australia too long then wait till you get back. Much easier than having your app. returned and resending. If it is going to be a long time before you return to the US or your are not wanting to wait do you have someone that could mail you a cashier check so you can file? Make sure you make it out to US Homeland Security also. Would even be better if someone could mail you one of personal checks but that may not be possible.

1. I read in another forum that the reason children under 14 do not need biometrics (even though we pay for them) is because at the age of 14 they have to have new pictures for their 10 year green card. Anyone know about this?
2. I posted earlier about my 13 year old stepson not receiving a biometrics (my 19 year old stepson did) and it appears that is normal so I will not worry. Some suggest bringing him to the biometrics just in case but I really do not want to pull him from school if not necessary. Any thoughts?
3. When my wife received her one year extension letter it was only for her not her two sons I assume this is normal since she came on a K-2 and they came on her visa? Thanks for any information guys on my worries.

Your information is correct. Under 14 will not receive a biometrics (but some cases might be different) although the fee is required. Just make sure you are clear on what you need to do when your child turns 14 - you should ask about that although he might be approved before then. I think there is a requirement for every LPR-child who turns 14 to submit something to get fingerprinted.

He will not be 14 till next November so everything should be approved by then. So I guess no need to call USCIS and wait on hold for hours to get the explanation?

A question. I applied for I-751 my wife and stepson who is 19 received their biometric appointment letter but we have not received anything for my other stepson who is 13. I read somewhere that if the child is less than 14 they may not need a biometric even though we have to pay for it. Do you think this is what is going on and I should not worry about it or should I inquire further. The appointment is on Dec. 28th. for both my older stepson and wife. Thanks for any input.

Ok so everyone gets new info. I received my biometric letter's today. I will update my timeline on November filers. Thanks for info from everyone but now I have experience to pass on.

They do not care at all about how you met. At church, internet, a friend, etc. The only thing they care about is if you are actually wanting to get married for real. Not to cheat immigration rules. Trust me tell them the truth on all things. Just make sure you collecting evidence about your relationship. Even emails on the internet are considered proof of a relationship.

Okay so i made a lil error...when we were living with my mother in 2008 i used her address for USCIS...a few months after that we moved into our own place but did not receive mail at the new house so i never notified of an adress change and kept getting our mail at my mother's house. We recently moved into our second house and i just made the address change online.
Will i get in trouble for not reporting our first move?
No you are good on this too. You have already changed your address on line so you are good to go. Start making sure you have bills in both your names, leases, insurance, etc. etc. for the next couple of years for your I-751 filing.

No you should have no problems. It is good you changed your address on line now and they usually use the address on your applications to them anyways. You should be fine.

Once you have your biometric letter in hand you can always try to walk in. As mentioned if they are not in a bad mood or busy they probably will take you. Tell them the 27th is not a good day for you which it probably isn't for most people because of the holidays.

Ours is not available online either, and this is a pretty common problem. It's because their online system is wonky. The receipt number on your NOA is correct. Re biometrics letter: we haven't gotten ours yet, but I remember from AOS that the date on the letter was only two weeks before my husband's appointment. I think this varies a bit depending on the local office and how backed up they are. People with NOA1s around the same time as yours are just starting to get biometric appointment letters, so even assuming your local office is one of the faster ones, it's not too surprising that you have not gotten your biometrics letter.
You are probably right. Plus looks like they got a lot of apps. on the 22nd and then Thanksgiving. I hope to see something next week. Will keep you posted.

Do not sweat it. You do not need the passport for the I-751 just your green card. You still have the problem of not knowing where it is though. Apply for another at the embassy and report the other lost or misplaced.

My stepson just turned 15 November 8, 2012. We are going to try to bring the divorce papers and his green card along with his mother and her certificate to get his passport. I guess we will see what they do.
