Hi everyone, I’m in the process of bringing my fiancée to the U.S. on a K-1 visa and need help determining the correct household size for the I-134 (Declaration of Financial Support) and later the I-864 (Affidavit of Support) once we’re married. Here’s my situation: I earn $22.55/hr from my main job and just started a 1099 side gig that brings in about $500/week. Last year, I had surgery and was off for a month, so my income was around $38K. This year, I expect to make significantly more. I have two children from a prior relationship. I pay child support, but they live in another state, and I don’t get to see them currently. I don’t claim them as dependents on my taxes, and we were never married. My fiancée has a son, but he is not immigrating with her. He’ll remain with family in her home country. We plan to bring him once she has her green card and we can jointly sponsor him. Boundless Immigration told me my household size is just 2 (me + my fiancée), but I’m not sure that’s correct given the child support and her child abroad. So my questions are: 1. What is my correct household size for the I-134 (while applying for the K-1 visa)? 2. What will it be for the I-864 after we marry? 3. Do I need to include: My two children I pay child support for? My fiancée’s child, even though he’s not coming now? Any guidance or experience would be greatly appreciated. I want to make sure I’m doing this right and avoid delays. Thanks in advance!
  3. My fiancee name was misspelled on our NVC welcome letter and at first I didn't think it was be a big deal because we filled out the I-129F correctly everything processed smoothly. We did our DS-160 and have her biometrics,medical and interview already scheduled. With things getting more strict, a bunch of new stuff has come out from the medical center wanting a lot of additional documentation for the medical exam as well as for the interview and biometrics. I'm wondering if we should do something about this? Her name is Nita and the put Rita on the welcome letter. NOA 2 is correct is there anything that we should do at this point? What if Saint Luke's medical center denies her medical exam because of the misspelling? I assume it's too late for the NVC to fix it since our case is already at the consulate/embassy?
  4. Yes I'm currently working and I anticipate my income for this year to be higher than last year's.
  5. Okay, that's interesting...I luckily live in a very low cost of living area in Kentucky, the apartment I currently rent is only 655 a month. My total monthly expenses aren't more than 1600 Dollars presently. My fiance is from the Philippines.
  6. Her son would not be considered? Since he isn't immigrating right away? Would this calculation be the same for changing of her status once we get married? I only ask because my income was 40k and the minimum according to 125% of the federal poverty line is 39k for a family of 4. The lawyer said that if it was 2 cents over we were good but I worry with it being so close to that line.

  8. I'm really hoping someone could provide me with some clarification on this situation as we've been getting mixed information and we aren't really sure who's correct. I am going to be petitioning my fiance via the K1 visa but while going through the process we discovered that the income requirements varies greatly depending on your household size,our situation is a little complicated... I have two children from a prior relationship (unmarried) they live in another state now and I don't claim them on my taxes, but I do pay child support. My fiance also has a child but they will be staying with family in her home country until they are ready to start school in the United States (3-4 years from now) I had an immigration attorney during a consultation tell my our household size would be 4 (me, my fiance and my two kids that I pay child support for) I had a conversation with a representative from boundless tell me this was incorrect, since they are not included on my taxes and they don't reside with me then it would just be me and my fiance on the application. We're trying to make sure we do everything correctly, due to my health circumstances (recovering from cancer) my income is a little less than I would like. I only made 40k last year as shown on my tax return. Any clarification anyone can provide here would be so helpful we plan to submit our K1 visa packet within the next month.
