  1. I totally hear you! We haven't even filed our AOS & EAD yet, cuz we're waiting on getting paperwork together, but it's tough with only one income!!! I know that once we get our paperwork sent in, then we will be anxious to get our EAD as well ! Did you have any problem qualifying for support with only one income? I hope I don't run into that... Will be SO much easier once we have a double income and things are normal!

    Hang in there... at least it's on it's way!

    Just keep in mind that there are people out there that have been waiting for their green card for 2 years or more, not counting the 3+ EAD cards that have had to pay in the process. You just applied on late January, and it's been just 2 months of waiting. Cool down and relax at least you are with your spouse and not far away from each other anymore.

    Mine took 3 months to arrive and we didn't even worry, give time to time.

    He had a DUI about 13 yrs ago and then an assault charge from a fight about the same time. Would we need a waiver for either of those??? We are doing an AOS... don't we need the criminal check from Canada for him to send in with our packets??? I'm getting confused here.

    is this for an interview?

    if so you can get one form a Canadian consulate..

    Im not sure about the waiver.. I had criminal charges but they were not serious and I passed my K-1 interview..

I'm more a little car kinda gal. And getting used to American service. It's aight, I can be a good b1tch just like the rest of them.

    And while he's at work I've to start doing the drive to San Francisco to house hunt on a weekly basis with our realtor. Housing has gone down everywhere in the USA except for San Francisco. Nuts! What a bad time to buy! But I love SF houses, remind me of Full House. But I do look forward to shopping at Whole Foods. We don't have Whole Foods in Vancouver (the closest one is a half hour drive).

    But it's ok, SF is only a two-hour flight away, and a 14-hour drive away. We're both on the west coast, and have wonderful restaurants. We're both very physically fit and active cities. We're both environmentally conscious and intellectual. I always feel SF is just a bigger Vancouver. So, it won't be that bad. I keep telling myself that.

    So I've had so many good bye parties people are surprised to see me in Vancouver still. Haha. But tonight is the last one.

    Just curious if you are just filing AOS from the US or are you guys going the K-3 or CR-1 route? I am trying to find others in our same situation... my Canadian husband is here in the US with me... he came as a visitor and we got married (totally not planned). Now we are wanting to just file AOS while he's here instead of him going back and filing the K-3 and waiting so long to be together again.

  7. yes if one came to the USA with NO intent of staying then ended up staying, its fine!! But to play devils advocate, how does one prove that? And yes some couples do that! each their own!! keep in mind, that he should not leave until the AOS process is over!! leaving actually isnt the problem, the problem may be returning to the USA! So if he has a death in the family etc, he/she may not be able to return!! best of luck!!

    He really did not plan on staying. It was my great idea to get married right away, and now look what we're facing... I'm sure we'll be fine. We are getting a notorized letter from our minister stating that we contacted her on a Thursday to arrange for a private ceremony that weekend. We had no guests and strangers as witnesses. Hopefully that will be convincing enough? His family is in Canada so anything he needs done or sent can be done without returning for now. If he had a death in the family that would definitely suck though.... we will have to cross our fingers! I still have not heard from anyone else on here that is going this route :(

    Thank you! Geez... it's all so intimidating right now! I am scurrying to get copies of everything that is required. Do you know how we go about getting the police records from Canada? He had a really old stupid offense that is on there somewhere, so I need to know who we contact to get a copy of that.

  9. We got married one weekend and a few days later started the cr-1 process. many people go this route!!

    We would like for him to remain in the US and just Adjust Status here, rather than going back and going the CR-1 route. I was told that as long as he did not come down with the intent to marry and stay then it would not be a problem to just do the I-130 to adjust status while he is here.

  10. Did you come in with the intent to get married? If so, no AOS. If not, you can adjust status from within, but you cannot leave the US until your AOS is resolved.

    No, he came down just to visit... It was my great idea to go get married a week and a half after he had been here :innocent: Now I'm worried about what we got ourselves into as far as immigration :wacko: Was hoping that there were others on VJ that were in the same position.

  11. Hello all! I have been in the USA since 2002 on an F-1 visa, I have read the guides on AOS for my situation and feel pretty confident my fiancee and I can do it. My F-1 visa expires in May and we would be getting married soon. I would just like to hear or see other peoples' experiences or timelines that have filed for AOS while in the USA on a visa other than K-1 or K-3. How long do you have after the F-1 visa expires and the AOS package needs to be sent in?

    I just wanted to say hello... I am a US Citizen and my boyfriend from Canada came to visit me on a B-2 visitor visa on Feb 20. A few days after he got here I convinced him that we should get married :) Now we are looking at all the fun stuff involved in doing a AOS so that he can stay here. I'd love to hear details of how things are going with your AOS.

    A standard I-485 is taking about 4-6 mos. I don't know how much time it adds with the concurrent I-130 petition filing. The work authorization is the I-765 application which is filed at the same time as the other applications and typically is adjudicated in 60-90 days.

    I am not an attorney but I did sleep at a Holiday Inn Express last night

    You would be wise to begin by reading the Guides here. Just click on the word "Guides" at the top of any page and look for the one appropriate to your circumstances.

    Be aware this is serious business. If he stays to adjust status, that means he stays until his status is adjusted. If he has affairs to settle in Canada in the meantime, he'll need the assistance of somebody in Canada. If he has no affairs to settle in Canada, you're going to have a very difficult time convincing anybody the marriage intention occurred after his arrival.

    Can anyone here give me some ideas of how we convince the USCIS that our plan was not for him to stay in the US and to get married? He only had a one way ticket down here, cuz we weren't sure how long he would stay visiting. He is working for a Canadian based company, but it is all done via the internet, so it's not like he had a physical "job" to go back to Canada too. He still has his bank account in Canada and his investments are there as well. All of his family and friends are up there as well. I'm just afraid that they aren't going to believe us.

  13. Does he have any intention of going back to Canada any time soon? The reason I ask is that if he leaves he might not be let back in. He should also file for Advance Parole if there's any chance he will visit Canada while adjusting status.

    He doesn't really need to go back to Canada anytime soon. It would be nice for him to be able to get a SSN so he can work though soon.

    He is still here. He came down to visit and a week later we went away for the weekend and decided to get married.

    Since he is here then you don't need a visa unless he wants to go home to close out his personal affairs. If he just wants to stay the what you need is for him to be granted "status". This can be done with an I-130 & I-485 application. If he wants to work then an I-765 would be submitted as well. If you choose this route then make sure he can stay for the duration of the adjudication process..... Be prepared to be quizzed on the one week after entry to marriage.

    If the bolded above is a true statement of the chronology of events, and he's still here, he doesn't need a visa. There are no US Consulates in the USA, so DCF from the USA is not possible.

    If he's still here, he can stay and adjust status. If he left, you'll need a CR1 or K3 visa for him to immigrate to the US.

    He is still here. What is his status now since we are married. And what forms are filed to adjust the status of whatever he is right now. Where do we go about filing as well?
