    3. Evidence of U.S. citizenship which may include any of the following:

    A. A copy of your birth certificate issued by a U.S. civil authority;

    B. A copy of your original Certificate of Naturalization;

    C. A copy of your original Certificate of Citizenship;

    D. A copy of your Form FS-240, Report of Birth Abroad of a Citizen of the United States;

    E. A copy of your valid, unexpired U.S. passport or passport card issued with a validity period of at least five years; or F. A statement executed by a U.S. consular officer certifying that you are a U.S. citizen and the bearer of a currently valid U.S. passport.  (Instructions for K1-Visa)

    I am submitting a copy of my U.S. Passport with my K1-Visa Application (petitioner).  The complete name on my passport is John Lee Smith whereas my Naturalization Certificate and Social Security name is Lee Smith.

    I have never submitted a name change request, but just added a given name of John Lee Smith when applying for my U.S. Naturalization and U.S. Passport.

    My Naturalization certificate is Lee Smith and my U.S. Passport is my full name John Lee Smith.   The rest of my legal documents(i.e. Driver's License) are John Lee Smith or I just use John Smith for my credit cards, bills, etc.

    Questions:

    - On my K1 Application, I have filled in my A-Number, but left blank the section for Other Names Used. Should I fill in (John Smith) for Other Names Used and would this trigger a RFE for Name Change as I don't have one?

    - Am I required to provide a copy of my U.S. Naturalization Certificate if I filled in my A-Number?

    Your advice is greatly appreciated.

  2. Something doesn't make sense here. On the tips for filling : https://www.uscis.gov/sites/default/files/document/forms/i-129finstr.pdf

    On page 5, it states that, "...Select the box to indicate whether your beneficiary has ever been in the United States. "

    Item Numbers 37. - 38.h. Form I-94 Arrival-Departure Record. Select the box to indicate whether your beneficiary has ever been in the United States. Provide the date of your beneficiary’s most recent entry in the United States, his or her I-94 Arrival-Departure Record Number, if available, and his or her immigration status at the time of arrival (for example, student, tourist, temporary worker, without inspection). Provide the expiration date and identification numbers on the I-94 or I-95 Arrival-Departure Records, travel documents, and or passports. See the What Evidence Should You Submit section of these Instructions for additional information.

    On page 6 of the I-129f form, it states that, "If your beneficiary is currently in the United States, complete Item numbers 38.a.-38.h.

    According to the filling tips, I should provide the this information. But, the form is asking for is my beneficiary is currently in the United States.

    Which is which?

  3. My beneficiary is from Taiwan. The  PDF fillable field for address has a character limit.  I can put this in manually, but if others have experience with this and can utilize other fields to input this?

    Beneficiary address (sample):

    1F., No. 1-1, Aly. 1, Ln. 111, Sec. 1, Amazon E. Rd.

    In the address field, I can only get it down to:

    NO1.1 ALY1 LN111 SEC1 AM (character limit reach)

    but not here now

    if USCIS thinks she is here by adding US address or USCIS office , it will cost u over $400 to do I 824 to have the case sent to her country US embassy

    Happened to others on here and it also delays the case again by several months

    there will be a question later in form(s) about her past visa and time in US

    you can put her SS #

    Thank you, this is very helpful.  I would put her past VISA info in later forms and not i-129F correct?

    what the form/instructions say should be followed over whatever a guide says. It clearly states if they are **currently** in the US. You clearly know she is not, the question is not 'has she ever visited?'.
    Fill in based on instructions on the form or from supplementary info and if you have questions, look at a guide. Do NOT follow a guide over what the instructions are clearly asking of you. Is she in US currently is a simple Yes/No question, there's no trick you're missing.

    Noted and much appreciated AndiB

  6. hi JeanneAdil,

    Appreciate your feedback.  I had mixed and conflicting information from online videos and others sources. Some say to fill-in as much info as you have available and others state to keep it as simple as you can.

    Specifically, I was referring to the time on this YouTube Video and section.  YouTube K1 i-129f form

    Reading back, I will follow the script and follow questions 38.a.-38.h. as presented. Even though my fiance has been in the US before in with a Student Visa, would I leave this information out?

  8. I am applying for my fiance as a beneficiary.   My fiance was in the US a few years ago on a I-20 Student Visa but is not currently residing in the US now.

    On form i-129f Edition 03/21/2022 it states that,

    Quote

    If your beneficiary is currently in the United States, complete Item Numbers 38.a. - 38.h.

    Questions:

    38. He or she last entered as a (for example, visitor, student, exchange alien, crewman, stowaway, temporary worker, without inspection):

    38.e. Passport Number:

    38.g. Country of Issuance for Passport or Travel Document:

    38.h. Expiration Date for Passport or Travel Document (mm/dd/yyyy):

    My fiance is not currently in the United States, do I leave blank Item Numbers 38.a.-38.h.? My fiance was in the US on a Student Visa before (I-20) and I do have passport information.

    Yes, put it in the Other Names Used.

    How come?

    Thank you, I was leaning towards this as well.  I was given a common romanize name to be easier to pronounce here in the States.  I don't believe it was formally legalized, its been 20 plus years now since.

    Would it be beneficial to include a copy of my Naturalization certificate or would that cause more confusion?

  10. I am petitioning for my fiance and noticed my name is different on my Certificate of Naturalization.   The name I used on my Certificate of Naturalization is now used as my middle name.  For example,  my Naturalization Certificate shows  "John Smith Lee" where Lee is my Family Name.  For my passports and my driver license, I use my given name "Michael" John Smith Lee.  Should I fill out section 7.a. & 7.b. under Other Names Used with the same exact name on my Certificate of Naturalization?

    TLDR:

    My family name is : Lee
    Name on my Certificate of Naturalization is John Smith Lee

    Name on my Passport and Driver License is Michael John Smith Lee

    Would I need to fill the section as Other Names Used? (7.a. & 7.b.)  - I have not used this name in any other legal documents.  All my documents are either Michael Lee or Michael John Smith Lee (Passport & Driver Licenese)

    The full name that I wrote on my i-129f is:

    Family Name: Lee

    GIven Name: Michael

    Middle Name: John Smith

    Thank you first!
