  1. Hooray! My hubby got his EAD today! Only 55 days from filing! AND! The USCIS Case status online thing didn't update until today, even though the card was approved on 10/27. Very exciting! Hope you're all doing well!

    I have tried to do my research before asking another question, but I am a bit confused and can't seem to find an exact answer. Please advise...

    My I129F petition has been approved as of Oct 22nd. I am preparing for the next round.

    Am i only in need of an I-134 at this state in the game? (it is my understanding that I-864 is not needed until after my fiance arrives in the States)

    Here is my situation. I have been living in France for the majority of the past two years (Oct 2005-July2007). Therefore my recent tax returns show that I make below the poverty level. However, now that I have been in the States for the past year, my salary as of 2008 shows that I make well above the poverty level. I am very hesitant to ask for my parents to co-sponsor as my fiance and I are trying to avoid their involvement, but fear I may have to.

    My question is this....

    Is there a way to avoid having a co-sponsor without my 2006 and 2007 tax returns?

    If it is unavoidable, as co-sponsors, what forms do my parents need to fill out? Is it also just the I-134?

    My fiance and I were in a similar situation: He was a student in 2007, so he was not making enough. His salary as of 2008 is also well above the poverty level.

    We asked his dad to be a co-sponsor just to be on the safe side.

    As for my fiancee, he included...

    -A letter explaining the situation (He was a student in 2007. He is now employed by...)

    -Form I-134

    -Letter from his employer stating his position, his salary, his status as a permanent employee and since when he has been employed

    -Pay stubs

    -Bank Statements and letter from his bank

    His dad prepared...

    -Form I-134 (If he is married(not divorced), make sure that his wife also signs the form when they bring it to be notarized.)

    -Letter from his emplyer

    -Tax Return from year 2007

    -Bank statements

    I also included my bank statement since I was working and thought it would not be a trouble to show that I had enough money to support myself until I get a work permit.

    If you were working in France, it is a great idea to include documents to show that you were making money in France.

    My fiance's visa was approved today... and we are just wondering if he needs to bring his X-rays to the U.S. with him?? If he didn't bring them, would it be a problem?????

    Hello.

    Practically, your fiance needs to bring his X-ray only to the K1 interview.

    However, he may want to bring it with him to the U.S. since you will never know when he may be asked for it.

    Many people including myself struggled with this whole medical exam thing even after we entered the U.S. with K1 visa.

    So, my advice is bring whatever evidences and documents you can with you to the U.S.

    Please remember to put X-ray film in the suits case not in your carry-on.

    I was trying to make an infopass appointment at my local office, but the website says that my local office do not have an appointment available for this service at this moment....(I wanted to make an appointment to follow up on my A#. The U.S. embassy issued my visa with a wrong A#.) I chose "appointment for information and other services."

    Do you know if this means that they do not offer the specific service that I chose at my local office or if this means that all the available time are already filled?

    We sent on September 17th

    USCIS received on September 19th

    Notice Date is September 23

    Eric did his biometrics in San Antonio on October 18th.

    Our case is at the National Benefits Center. Eric is on an F-1 student visa from Mexico. We didn't submit an AP, only the 485, EAD, and I-130.

  7. Hey guys! just updating... I got my biometrics appointment letter today dated 10/10..

    Biometrics scheduled on 10/28/08 at 10:A.M at Dover,DE..yahoo!!! Hopefully after that there will be "touches" in my case.

    I wanna ask for those who had gone their biometrics... Is it just fine to bring my passport/visa in my maiden name as my ID? I have my SSN too.. I still don't have any valid ID in my married name yet aside from my SSN. Would that be ok? thanks a lot!

    Vida, just in case, you may want to bring your marriage certificate which should you both your maiden name and the new married name. The biometrics appointment took less than 15 minutes for me, and the staff was friendly and helpful. They just get your picture taken and your fingerprints scanned. Nothing to worry about. :star:

    No problem! I also read in this forum that other applicants have brought their marriage license to show the name change etc. Maybe they won't ask for it, but you can never be TOO prepared. :thumbs:

    Oh you absolutely do want to bring your marriage certificate with you! I didn't bring mine because it wasn't mentioned in the letter and I never even thought to bring it with me. And they would not help me without it. I had my SSN with my married name with me, but they wouldn't accept that. I even asked for a supervisor, but they set me back home to get the marriage certificate, which was 2 hour drive. So all in all it took me a whole day just for the 10 minutes it took to get my biometrics taken. So make sure you have your marriage certificate with you ^_^

    On a different note, I received an RFE on my AOS yesterday. They asked for additional tax forms :huh: So I guess we'll be sending those as soon as possible to avoid any further delays.

    I totally agree with bringing your marriage certificate. At my biometrics appointment, they did not let one lady to have her biometrics done because she did not bring her marriage certificate.

    Did you receive an actual letter in mail regarding where your case is? Did you receive an e-mail? Does the case information online tells us where your case is?

    My case still does not show up when I use the USCIS case search engine. I have biometrics appointment today, so I am hoping that I can access to my case information online soon.

    if you receipt # starts with MSC, then your case is at MSC/NBC..

    with CSC they will notify you if they trans your case to california..

    did u register at the USCIS site for your case?

    if not then register then add you case to your portfoilio..

    My wife and I applied for her social security number on Sept.30 ( she arrived in US on K-1 visa and we are in RI), but we haven't received it yet. Can we apply for her I-485 without the SSN?

    Hi drl.

    Your SSN as well as temporary card, which is just a A4 size print out with your SSN on it, should have been available to you right when your application was approved at your local social security administration office.... I am sorry but I am not sure whether the AOS application can be filed without SSN.

    If you need SSN to apply, you may want to try to visit your local office again with your SSN application approval receipt and obtain a temporary card.

    I just want to share what I heard at my biometrics appointment today with you.

    An officer did not let one lady to take her fingerprints and picture taken because she did not bring a marriage certificate with her.

    I guess if you changed your family name, you must bring an ID which shows your new family name.

    If you do not have an ID with your new family name, I guess you are required to bring a marriage certificate

    with you to the appointment as well as an ID with the maiden name.

    I am not sure if it is just the case with the office that I went to, which is Van Nuys, CA.

    But to be on the safe side, you may want to bring your marriage certificate with you to your interview if you

    changed your family name and do only have ID with your maiden name to show.

  11. Yes, my wife did. She got a letter about (2) weeks after biometrics that they were rejected by the FBI and to go in for a 2nd set. Then we didn't hear anything. About 3 months later I called the FBI fingerprint check line to see if the second set was good. The FBI fingerprint check line is 304-625-5590. They can tell you on the phone, with your A number, if the fingerprints were rejected or not. They told me that hers were rejected the 2nd time 2 days after they were taken.

    So, luckily, I found out that my wife's prints were rejected twice. They don't take a 3rd set, instead, if they are rejected twice, you are guaranteed an interview (read the USCIS Field Adjudicators manual and it tells you what the classifications are for interview)

    So we scheduled an infopass appointment to see what we were supposed to do. What they made us do is go to the local police station and get a police certificate (I'm not kidding, we had to go to police headquarters in Houston, get a $3 certificate saying that my wife had no record for the 5 whole months she was in the US and that $3 certificate replaced the entire fingerprint analysis of DHS and FBI). We brought the police certificate to our interview and were approved same-day.

    Hope that helps. If you do not have the certificate at the interview, they give you an on-the-spot RFE and you have to go get one.

    I will call the number you gave me for sure. It is great that they can tell us whether finger prints are accepted or not.

    It is such a hassle to go to the police headquarters to get a certificate..... Since Houston is a big city, I bet there was a long wait for you.... I live in L.A., so if I have to go to LAPD, I may have to spend an entire day waiting in line there.... :wacko:

    But, it is great to know that the police certificate can replace poor quality finger prints after the second trial. :star:

    I have jut come back home from my biometrics appointment.

    The person was having such a hard time to get finger prints of my pinkies.... :wacko:

    He said that some people's finger prints are harder to read because they get worn out.

    Also, he told me that some people genetically have finger prints that are hard to read. :blink:

    They did their best, so I just have to hope that my finger prints meet FBI requirements.

    I guess if they cannot read them, they will send me a letter and make me go and get my finger prints taken again.... :crying:

    I am wondering whether anyone have received a letter explaining that since they could not read finger prints, you

    had to go and have your finger prints taken again? Also, if you did, could you please tell me how long it took for you

    to receive the letter after your biometrics?

    I really really hope that they can read them.....

  14. Same A#, and if you had SSN before you wont need to reapply for one if you still have the old card.

    SSA issues a number to a person for LIFE.

    Yep. As YuAndDan told you, you are issued and keep only one SSN for life.

    As I was an international student in the U.S. and have worked on campus before I applied for K1 visa, I also already had a SSN.

    Just put down the SSN which you already have on the necessary forms.

    Nope. I was not asked for sputum....

    Though I was told that I can go for further examination at local health center, I did not want to do that because it will just be waste of time.

    So, as it turned out for others with positive TST result, I will be classified as TB latent. Oh well....

    But, as the new requirements state, only the people with "class A TB disease" must complete the treatment before USCIS approve their application for AOS. So, I am not too worried about it.

    I have heard from my friend that many British people take BCG as well as Japanese. It always causes so much trouble when one culture believes in one thing and another does not. Yea. I have two scars on my arm from BCG, too. Some people who had only one BCG when they were babies may not have positive result to TST, but if you had it when you were older, I guess there are greater chance that your TST comes out positive. I had second shot when I was in middle school, which is only about 11 years ago, so I obviously got positive result.

    Anyway, wow, so you are allergic to penicillin and 95%of non-penicillin based antibiotics. I bet CS will struggle a lot. lol

    Just make sure that they do not make you pay so much just to find out the treatment that works for you......
