  1. Been in DS-5535 processing for 6 months. Filed a WOM and the government has filed a motion to dismiss. Super frustrating. We are now trying to strategize if we should fight it or accept it. Really hoping the processing takes under a year than more than a year.
  2. According to the declaration by Carson Wu, the choice of whether we are getting the DS 5535 form is determined by the system. There is a flagging that comes up with maybe a name match or some sort of a trigger in their database, which causes them to give us the form. Once that flag comes, and they give us the form the consular officer cannot do anything on our file until the state department does not finish their administrative processing. Once the processing is over, they send the file back to the consular officer at the consulate and re-adjudicate.
  3. Im happy you have been getting some sort of responses. I have emailed them three times since December and have not received any response. I only received one response from them in early December. My last date change was on December 18, 2023.

  5. I keep up with a DS5535 fb page with individuals from around the world. I am noticing a few people posting updates that they have received a request for their passport around the 8 month mark. I honestly wonder what causes them to have a faster processing time versus individuals from Montreal.
  6. Hello everyone we have a new blog update from Red Eagle Law that speaks to a reduction in the amount of cases in AP DS-5535 since January 2024. I am attaching a link for the blog, and there is also a new declaration that has been made by the department of state that provides more information on the administrative process and what goes on behind-the-scenes.   7. All the positive news in the forum is making me feel hopeful. The government has until the end of the week to respond to my WOM. Hoping for some positive news. My lawyer has a call scheduled with the US attorney this week. Another WOM being handled by my lawyer recently got approved two weeks ago.
  8. I’m hoping someone can shed light on this if you file a WOM and the government does not respond within 60 days. What happens then? I read somewhere on Reddit that if they do not respond within 60 days, the judge can just take action based off of your request. Is this true because the government only has about five days left to respond to my WOM I have still not received anything. When reviewing other peoples timelines, I am noticing that the government has been responding within a couple of weeks.
  9. It is both comforting and heartbreaking to know that I have found a community of people experiencing the same emotions as my husband and I. This process is taking a toll on our mental health and marriage. Its scary because it seems like there is no end in sight. We just want to start our lives together. It angers me that the US government has no sympathy for individuals trying to legally immigrate with NO criminal record. My biggest sin is that I chose to fly back and forth throughout dating and marriage to see my husband. If i had never visited him then i would be questioned on the authenticity of our marriage. Either way we were going to be screwed. I am just praying for some positive news or change that will clear this backlog and issue me a visa.
  10. I am currently waiting for a response from them after filing my WOM as well and we are nearing the 60 days on April 5 and have not heard anything and no updates on CEAC either.
  11. I just saw a post from red eagle law on Twitter from earlier today that the gov has announced 2024 to be the “Year of the Immigrant Visa”. They will be rolling out some measures to help reduce the back log. Praying this will shine through to us and bring positive news.
  12. There’s a lot of people from last year that have not updated the spreadsheet. I’m curious if they got approved and have just not come back or are they just waiting and we just haven’t heard from them.

  14. This is just an automated email. It’s almost like an acknowledgement that your email has been received by them. It doesn’t mean anything specific to your situation and everyone that emailed that email address receives it as bounce back.

Based on what I’ve read in the declaration that was made by the acting Director, Carson Wu the decision of whether you’re going to be put into administrative processing is something the system decides and is not something that the consular officer decides. My interview went really well and the individual was typing notes into the system, and all of a sudden her face changed and I could tell something was wrong and that’s when she presented me the letter for 221(g). Also, regardless of whether you change your passport or not, you will need to provide a 15 year travel history so you will have to dig back. I would highly advise against that because they will find out, and the last thing you want to do is be denied for lying.
  16. The first time I emailed them was the beginning of December and they responded within two weeks. The status update changed December 18 as a result of responding to my email. I emailed them again on January 31 and have yet to hear back from them. So I’m not really too sure what their protocol is in regards to answering emails because this would just be my second time inquiring
  17. But then we can also say the same about people who had a bad experience with a WOM, in comparison to the ones that had a good experience with it. They also have a bias as well.

  19. The constant scrolling around this is definitely not good for anyone’s mental health, and I find myself in the same boat as well. Today I saw a post on a Facebook group around the DS 5535 and someone from the Paris consulate said that they have been waiting for clearance for 17 months now. When you hear of news like that, it obviously does not make you feel any better, but we just have to be hopeful, and have some faith that it will all work out in the end.
  20. The government just got served our WOM last week. I’m just curious to know with some of you that have filed a WOM how quickly the government responded?
  21. I sent an email to the consulate on January 30 and never received a response back. Its been over two weeks. I don’t know if thats a good thing or bad thing. I did send an email in early December and they did end up responding to that within 10 days. Havent had a case update since December 18. Interview was Nov 28, 2023.
  22. I recommend all of you to check out Curtis Morrison’s (Red Eagle Law Attorney) video episode 63. He goes over the latest declaration from Carson Wu in regards to the DS-5535 process. I found it very informative. You can find it on youtube. One thing that I found that stuck out for me from the declaration was that it is not a first come first serve basis for this process. We are all just in a pool, and anyone’s process can take shorter or longer than others. They are also possibly looking to move this process over to NVC for immigrant visa at some point in 2024. Hopefully this will help with the backlog. Our file is also sent over to DC and does not stay with the consulate. He also goes over in the video of why we got flagged and asked to provide this form.
  23. It’s interesting that folks from Montreal are not hearing anything. However, those that are stuck in this processing from other countries are hearing back within like 45 days. Maybe they should just hire a separate team for the Montreal folks at this point since there’s so many of us stuck in this
