  1. June 'case complete' and we are still waiting to hear something, but expecting to this week or next. However, am nervous that because of the Thanksgiving holiday there will be less interview dates given. And since we completed on June 30th and hoping we don't end up waiting till December for ours.

    Are they still only scheduling on Fridays?

  2. Ok, well I just called DoS and spoke with a very friendly gentleman (to my surprise lol) and he informed me that packet 4 now contains information on how to schedule an appointment. They are no longer sending a specific date. Also included will be info on completing your medical, Fees that will have to be paid and, if applicable, a request/info on any incomplete or missing forms from your application that you will need to bring with you to your interview.

    I inquired about my application and he told me that my P4 had been prepared on Sept 9 but he didn't have access to info on when/if it has been sent yet. He did say that he didn't think it should take more than 2 weeks to send it at the longest which would be Sept 23... So ANY DAY NOW!! YAY! Hope; finally hope!

    I just hope they don't send out too many all at once and get the interview line backed up... It's great that they will be scheduling interviews again but I hope that I don't get my letter too late and get told they are all booked up until the new year or something....

    Yes, kimberlyk21, could you let us know what visa you are and when your NVC complete date was? Thanks!

  3. I do not consider engagements any less important - my frustration is directed toward the way this system is set up, NOT at the K-1's on here. You guys are the lucky ones as far as a quicker process.

    We thought of going K-1, but my husband's kids live in Victoria and he picks them up every two weeks for a 2 day visit. With the K-1 he couldn't have seen them for maybe 3 months until AP was approved. His ex would never have taken the time to bring them to him here. His daughter is disabled with a seizure disorder, so it's important that one of her parents be with her and it would have been difficult for me to pick them up on Friday's in Canada after work at the ferry and make the 8 hour round trip on Sunday's to take the kids home crossing the border and taking the ferry to the island and back.

    We knew and understood the IR1/CR1 process would take a year to do and I have no problem with that but I just don't see why it's so much longer than the K-1 process - that's all.

  4. Would be nice if they could just get caught up in scheduling and give everybody a date who has been waiting. If we at least knew the date the waiting wouldn't be quite so bad. It's the not knowing. I'd be fine with a November date (I told myself this process would take a year and if it was finished sooner then that would be great) - just hope it's before the end of the year!

  6. I think the April completes got lucky with their quick interview dates (we would have been one of those if we hadn't gotten the RFE). Looking at the history, is seems the average wait for an interview date is 3 months so I wasn't expecting to hear anything until September with an interview date in October. That being said, if we don't get an October date, I will be joining the ranting!

  7. I wasn't expecing an interview until October, but was at least hoping the date would be assigned this month. It is frustrating that Vancouver is processing the K1 visas so much faster and everytime I see an interview date assigned or interview completed for a K1 visa I just sigh. And the fact that they can just call in to check on their paperwork and get an interview date during the call....I don't even know what to say about that. If Vancouver is so efficient, why don't they take on some of the CR1-IR1 visas? Lighten the load in Montreal and get some visa's processed faster. A rhetorical question I know.

    (And yes, we knew beforehand that the K1 visas processed faster, but we had to go this route in order for my husband to pick up and return his kids to Victoria, BC every two weeks. He needs the ability to travel back and forth to Canada straight away after POE and not have to wait for AP.)

So I just called the DOS just to make sure they at least had our file at Montreal since it's been 5 weeks that our case was approved at the NVC, and the guy on the phone said they dont' have it yet! That it's taking an average of 5 weeks to receive and log the files right now. Now it's funny that he said it's taking 5 weeks when I said we were approved 5 weeks ago..... tried to call back and have someone else check it, but the line just rang and rang.

    This is so frustrating. If we hadn't had the RFE on the military records and my tax transcript for last year (for whatever reason they wouldn't accept my W-2 and copy of the completed 1040 form), we would have been finished in April and maybe had our interview date already like some others from the same month. Grrrrrr.

    Have the rest of you who had case complete in May - June - July called to see if your file has been received in Montreal yet?

  9. In the state of Washington, whenever we hire a new employee we have to fill out a Form I-9, Employment Eligibility Verification asking for proof of US citizenship or authorization to work in the US. ALL new employees must fill this out, regardless of anything.

    On a side note, it turns out the woman who had this position before me had immigrated from the Netherlands years ago and had never gotten her citizenship or renewed her green card properly. Only found this out after she left and yet she has gotten another job here in the area working for the city! Obviously they either didn't check or just didn't care.

    I believe it is. And if the police are pulling someone over or are involved for some other reason and the person does not speak english and cannot provide the proper id, then their immigration status should be questioned. Also, did you know that in the state of Virginia, police have been allowed to check immigration status for some time already. They are only making such a huge deal about this in Arizone because it's on the Mexico border.

    That is totally true and a huge part of the problem.

    There are so few countries in this world that are "easy" to live in. Many of the illegals do work like dogs for low wages because they need the money to send back home. Do you know how much money is sent OUT of this country every year to immigrants home countries? It's in the billions. There will never be an easy solution to immigration. It is because of the long process it takes to do it legally that people come here ilegally. I have sympathy for what it must be like to live in alot of the other countries around the world but at some point this country will be no better under the weight of supporting so many illegal immigrants who do not pay their way in taxes and medical care. And those billions of dollars being sent out of this country are not being spent in supporting this country.

    And I totally agree with whoever said it would be nicer to hear the good stories about legal immigration and how to fix the system than it is to hear about the illegals all the time. My husband immigrated from Capetown, South Africa to B.C., Canada 13 years ago (and is a Canadian citizen) and now to the States and has done it the right way both times and is proud of that.

  11. We met on eHarmony. I joined the same month his subscription was ending and he wasn't going to renew it. Talk about timing! We emailed and chatted for about a month before talking on the phone for 3 weeks then meeting. He drove 10 hours down to southern Oregon to see me and it was a great first weekend. So he did it again 2 weeks later, then me 3 weeks later up to BC and then we each made the trip every other month. After a year of that I made the move up to northern WA - as close to the Canadian border as I could get.

  12. We had to send in the I-864 twice because they never received the first one. Talked to a supervisor and were advised to send it again. They got it the 2nd time.

    Unfortunately on the DS-230, we got an RFE on my husbands military record from the South African Navy. He has requested it a 3rd time as of this morning and was told to wait another 3 weeks for it...

  13. NO, you don't have to declare, you are going to get married! One simply must answer truthfully the questions the POE officer asks!! KISS = keep it simple silly (or stupid,etc etc ) lol Its not illegal to get married in the USA, many including myself went this route and then started the k3 or cr-1. I answered the POE officers questions truthfuly, he never asked!!

    Its all comes down to ones INTENTIONS, when u enter the usa and then stay! If one had NO intentions of staying, then out of the blue decided too, thats ok! BUT if one had the intention all along, well thats illegal!

    I agree, you don't have to declare you are getting married. In fact, I wouldn't do so because it will only complicate things and you may not get in. Just be honest about where you are going, when you are leaving, and that the purpose of your trip is to visit friends/family.

    Oh, and I would highly recommend getting all your paperwork ready for filing the I-130 so you can mail it as soon as you have the marriage certificate!

  14. Finally got our RFE email today requesting the Official Military Record and 2009 Tax Transcript. Hubby ordered the military record last night from South Africa and they said it would take just 1-2 weeks, so that's faster than we thought. For mine, I did submit the W-9 and 2 recent paycheck stubs to show work for 2009-10 (hadn't filed 2009 taxes when I submitted the I864) but this is what the checklist for missing items said:

    Supporting Documents missing or incomplete

    [x] A written statement/explanation is required if you are/have been unemployed, retired or dependent as to why

    tax returns were not filed.

    [x] The listed income tax documents/IRS statements for the years marked below are missing/incomplete (if you

    have lost any of the requested tax information, contact your local IRS office to obtain a copy) (Only Federal

    returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto Rico.)

    • Federal income tax returns, literal printouts from the IRS (RTFTP) or a Letter 1722 issued by IRS

    are missing/incomplete for the year(s): [x] 2009 [ ] 2007 [ ] 2006 [ ] 2005.

    [x] You have not enclosed an explanation of why you were not required to file income taxes under

    Federal tax laws for any/all of the 3 most recent tax years. Residence outside of the U.S. or retirement

    does not exempt a U.S. Citizen or LPR from filing a Federal tax return. Individuals who were required to

    file Federal returns but failed to do so are advised to file late returns.

    I wasn't unemployed at all last year and I did file taxes, just after filing the I864. So I'm guessing just submitting the 2009 tax transcript from the IRS will answer all 3 of the questions above? And it stated earlier in the letter that I have to re-fill out and submit the I864 form. I wonder why that is - all the information will be the same...
