  1. Hey buddies!, I've been researching info regarding the work permit and hopefully someone could help me...

    When you enter the US with the K1 fiancé visa, do you get instant work permit? cause in some places thats what it says but other people say you gotta wait about 3 months????

    Im not sure if they still issue now...but back in 2008 when I first got here....my POE was @JFK and I was issued a temp EAD. But then it expired after 90 days.

    2 weeks after my arrival got my SS card and had a job. But ofcourse as soon as we got married I had to update everything and had my company update my status/file too.

  2. Hello Vj!!! What should I be expecting and prepare after I sent the I-130?

    I had my oath taking last Aug and filed for I-130 last week hoping my mom would be here by next year for my graduation =) (Went back to nursing school)

    I included the following when I sent the I-130

    1. I-130 form

    2.G-114 form

    3.Check for $420

    4.Copy of my birthcertificate

    5.Copy of my naturalization certificate & US passport data

    Mailed it through USPS and got a confirmation. Checked the bank today looks like the check has not been cleared yet.

    And also, since I am currently a student, (full time w/ no job) how should I file for the affidavit? Can my husband be the principal?(his annual income is more than enough to accommodate 3 household as per 2012 poverty guideline) Anyone can help me with this...pleaseeeeeee.......=)

  4. Hey! I just posted my questions on how to receive the greencard and the changing of my surname with SS! You are heaven sent! It's been a month since I arrived in the US. What do I do to obtain my greencard? I was told in SS that I should receive it first before I'd be able to change my surname to that of my husband's. I already received the welcome note from the USCIS, too. Should I just wait for the greencard, or must I do something to receive it?

    Hello...sorry for the late reply! Guess what.....the day we were heading to the social security I only had my welcome letter.....I told hubby theres no harm in trying to update my name since it was the best timing ( I was half day from work) and the SS was still open....I didnt know if they would let me change it or not....but hubby was tryn to tease me while driving and said to keep checking my folders....to my surprise...it was my greencard! Y

  5. In the I-130, and the G-325a biographical form, you are asked to enter ALL NAMES USED, including full maiden name and names used in previous marriages. Did you enter all applicable names she uses?

    For the NVC, it's important to have a correct BC, passport and marrriage cert, as well as police clearances. You need to make sure they are all consistent. The I-130 is not a legal document, but her IDs, BC and marriage certs and PCCs are. The info in them carry the greatest weight. In my BC, my mother's birthplace is different from the one I gave for her in my G-325a. The NVC folks shrugged that off and said it was no big deal.

    Now the question is, what is her name in the NOA2 and the NVC case?

    she has every thing including I-130 approval and NVC case with her mom s initial in her middle name

    and she is philippines can not get nbi or cenomar or cfo with her moms initial.

    i want to file her DS-230 but she can not get any papers in phil so i am stuck here.

    I dont know if my suggestion can help...but somehow i had different names in all my documents also when i was in the phillipines and my current passport......I was born abroad therefore my name was written in different way especially when I started school in the Philippines....I was born in Kuwait but my dad is lebanese and mom is Filipina....in my birthcertificate..I had my first name....my middle name (as my dad's first name)and my last name is ofcourse still my fathers last name.....

    However....when I studied in the philippines...since they have a family code something about using mothers initial, my papers got complicated. My NBI, TIN (i worked after I graduated), my College diploma, drivers lisence, used my Mothers initial....so what I did....I went to the embassy ( I was back in Kuwait when hubby started with the petion).....As for your wife,I think she can go to any public notary and ask to make her an affidavit of name....stating that she is the same person ( give her correct name in Birth Certificate) and the name your attorney listed......dont worry im sure she would be able to get all related documents according to her birthcretificate.......Make sure she brings the affidavit with her during the interview just incase they ask.

    GC Appprrroooveed!! hurraaay!! We waited for an hour and half and our interview lasted for only 10mins!!!! the officer verified only my 1-485!! And we thought he was gonna go through my file he had...I beleive those were the forms they had from day 1 hubby petitoned me..His first question was that if I committed any crime in and out of US or have supported any terrorist act.He also asked if I had visited US prior getting in through fiance visa....ofcourse all my answeres were no....

    He then asked hubby 1 question.....if he still works for the same employer.....

    Then he took hubby's ID/drivers lisence, my EAD card and passports (I have dual citizenship) and asked to wait.By the way...he removed my I-94 before heading to the photocopy machine....

    He then came back with the copies and handed back our Ids. He had an extra paper and while he was about to sit in his chair..he said...Ok...I'm approving your temporary permanent residence and make sure to follow the instructions....he had a note on the paper and made sure hubby reads it...it was the instruction to remove condition and make sure to file 90 days before the expiry date.....he also mentioned that I would be getting the temporary greencard in the mail within 2 weeks....=)

    Im sure you can imagine the smile on our faces....I wanted to giggle but made sure to hold myself.....its like I had butterflies in my stomach!

    He said we're all good and asked if we had any questions...I asked if he will return my EAD card he said NO...and that i no longer needed it......he then said that my greencard will be my "ticket to all"!

    And he reminded us about removing condition and said that "we MAY or MAY NOt ask for the evidences after 2 years and explained that they sometimes remotely approve the 10 yr card.....I asked him if he wanted to see our pictures or any evidences we brought ( we had 2 heavy bags loaded with all our proofs!!) he said that it wont be necessary now...he said to keep it for next time!

    Hubby asked if its ok we go to DMV the same day coz we planned for me to take the written test and studied the whole week for it...but he told us that it would be useless to go today since they wont entertain us....just wait for your GC......and he said not to travel until I get the card....then I remembered my AP...I asked him if I still needed those...he said..." Oh yeah....u can give those back to me" and so I handed it to him... LOL me and my big mouth!

    He escorted us on our way to the exit and gave me a handshake....congratulated me and hubby =)

    I secretly wanted to ask him how to get a job in INS! their work seems to be very intresting....and its line with what I had completed in college.......oh boy im sure il be approving all my vj members if I get that job! hahaha...thank u all peeps......ill be still around....goodluck to all!! loveee you VJ!!

  8. hello anyone here who had civil wedding and applied before to get ssn? in our case, the day after i arrive i already filled up form and got ssn number after two weeks, on my ssn card my single/never married name would appear..on 29th we got married in civil, then today i went to social security office to change name/my single name to married name..but they didnt allowed me to change name yet, instead they told to go to nearest immigration..my question would be does the rule change for changing name?, i saw here in visa journey that after getting married i should change name ssn? and thats what im trying to do. anyway i went to immigration also today they give me forms which to be filled up..anyone here who had already change their names after civil wedding? what do u guys do? please help me..

    You only need to change the SSN record if you plan to use the married name for work and tax purposes. Otherwise you can continue to use your maiden name.

    How long have you been in the U.S.? If you have been here less than 76 days go back to the office and ask to speak with a manager if they don't accept the application.

    Tell the manager to look at this.

    When an alien applies for an SSN card, presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

    D. Examples of Legal Name Changes

    4. Name Change to a Name Different From Name on Immigration Document

    Monica Mumma Stottlemyer applies for a replacement SSN card in her married name. She:

    -- Completes an SS-5 showing her first name as Monica, her middle name as Mumma, and her last name as Smith;

    -- Completes the other names used field, showing that name as “Monica (first name), Mumma Stottlemyer (last name);”

    -- Signs the SS-5 as “Monica M. Smith;”

    -- Submits a U.S. marriage document showing Monica Mumma Stottlemyer and John Smith married last week (the marriage document shows the dates of birth for Monica and John);

    -- Submits a driver's license with her photograph that shows the name Monica M. Smith; and

    -- Submits a DHS employment authorization card with her photograph and showing her name as “Mumma Stottlemyer, Monica.”

    The U.S. marriage document supports the legal name change and is acceptable evidence of identity in both the old name and the new name because it shows biographical data (date of birth) that can be compared to the Numident record. Further, the name to be shown on the SSN card agrees with the name on the additional identity document in the new legal name (the driver's license).

    SSA can process the name change request. Process the SS-5 to have the name “Monica (first name) Mumma (middle name) Smith (last name) to be shown in the card and enter “Monica (first name) Mumma Stottlemyer (compound surname) as an “other name used.” The compound surname must be entered the same way it is shown on the immigration document. Advise the NH to also contact DHS to change her surname to “Smith” with that agency.

    Make sure you point out it says advise to report the name change to immigration, not must report it before SSN record can be changed.

    Plus if SAVE verifies with your maiden name and you provide the marriage certificate and are changing the SSN record to your married name the application can be processed without further verification.

    hi there, today i went to 2 social security office. one office gave me a letter to give to immigration office saying that they need to put a new stamp on my passport..my stamp was k1 since we did k1. the employee that is on window tells me to go immigration office to change the stamp to k3..i showed the link that u gave me i also printed it but he ignored.. he then look at my requirements my single name ss number but still he dont know what to do yet.. i told to call for manager but he said manager is not there. after that i decided to go to another ss office and this what happened, i talk to girl and she told she cant process it since she told me that she cant change my name on ssn and she cant do it, i ask her if she can call for manager to clear up things regarding my questions what to do since she dont do it..she suggested me to go back to lakewood to ask the supervisor regarding change of name and she mention also that she think that the supervisor in that place should give me letter about whats going on to my request..

    how can it be so hard to change single name to married nme? i showed visa, the immigration stamp of k1, marriage certificate and the social security number with single name.. i need help what to do next since they dont allow me.. whats the best i can do?? im getting worried.. :crying::unsure::wacko::dance: where did you file for social security number and change of name? i file mine on lakewood ca..any help would be appreaciated.. hope u reply soon.

    why are u worried? You can change your SSN after your GC interview. I suggest if you can file for AOS asap that would be better.....I am in a similar situation where I applied for SSN 2 weeks after my arrival in Dec08. We got married Feb09. till this day I have no problem with my social security (single name) and some of our co vj suggested to change it after my interview.....One more thing....whenever you submit you AOS...u can start using your married name...I got my EAD card and AP with married name...just make sure to include copies of your marriege certificate...

    Anyone here with a recent experience of POE being at JFK ???? I have read conflicting stories about whether or not the X-Ray of a fiancee' must be presented to the USCIS officer at the POE.

    Question is, do I need to have it available with me along with my fiancee's brown sealed envelope or can I pack it on my suite case since it's a huge X-Ray envelope (almost as big as my largest suite case)?

  10. Our interview is coming up soon. And according to the checklist. they require the i-693 OR vaccination supplement (sealed package)

    1) I only have D230 (Ivw sent a copy of this along with the AOS application) when I had my medical before my interview way back in October 2008. DO I still need to transfer my D230 to I-693?? or will the D230 still be acceptable?

    2) They asked for a goverment issued ID. I guess this will be used when I enter the bldg. but I do not have any ID's except for my passport. Will they require me to leave an ID at the security or something? What should I do if I dont have one yet?

    3) Do I have to go and change SSN now with my married name or can I do this after the interview?

    If your DS3025 is complete for all vaccinations then it may be acceptable to the person conducting your interview. If you did not get all immunizations prior to your visa medical exam, then you would have to get the remaining required

    shots in the US and have the immunization section of the I-693 completed by a Civil Surgeon in the US. My husband got his GC issued recently with only DS3025, but his immunizations were all complete and listed on that form.

    Photo id is to get in the door. A passport meets those requirements. You don't need anything else.

    Your social security card does not have to be in your married name. I don't think it plays any role in the GC interview. After you get the green card, you can go change your name and have the restriction about working only with DHS authorization removed and a new card issued.

    Thanks for the clarifications....yes all my immunizations are complete. Do I have to bring my xray on our interview? hehehe well im bringin it just incase.....

    Transfer it to I-693.

    If you want to get an state ID you can get one at DMV. I had one now. I only showed my passport, SS Card with the present address (or any utility bills which your address is state in) and marriage certificate, told them to used my married name and that's it. I don't have to bring my passport.

    In my case, I applied for SSN on my single name and after we got married I want to change it to married name but the person who assist me told me to go to Immigration and extend the I-94 because it was expired. She said there is no problem because I already had my SS number. I need to change it when I had the green card or the EAD.

All your medical information is enclosed in the brown envelope which was handed in at the POE. (this is what I had in mind) The envelope is then forwarded on to USCIS where it will be consolidated with the I-485 submission, once received. If you received a copy of the Vaccination Documentation Worksheet (Form DS-3025) from your Panel Physician, you may include a copy of that form in your AOS submission in place of Form I-693.

    "Q: Do I need to complete another full medical to adjust status?

    Per Section 1245.5 in the Code of Federal Regulations, a medical examination shall not be required of an applicant for adjustment of status who entered the United States as a non-immigrant spouse, fiancée, or fiancée of a United States citizen or the child of such an alien as defined in section 101(a)(15)(K) of the Act and §214.2(k) of 8 CFR chapter I if the applicant was medically examined prior to, and as a condition of, the issuance of the non-immigrant visa; provided that the medical examination occurred not more than 1 year prior to the date of application for adjustment of status."

    My medical is definetly not more than 1 yr and no RFE's. I just got my biometrics then interview letter tight away.

    sorry yes i meant ds3025 i had included a copy of that form singed by the physician during my medical 6 months ago.i thought they had evrrything in that brown packet

  13. Our interview is coming up soon. And according to the checklist. they require the i-693 OR vaccination supplement (sealed package)

    1) I only have D230 (Ivw sent a copy of this along with the AOS application) when I had my medical before my interview way back in October 2008. DO I still need to transfer my D230 to I-693?? or will the D230 still be acceptable?

Ok as you guys can see my timeline....We submitted my AOS/AP & EAD just last month....Im had my biometrics 2 weeks ago April 10...and yesterday, we got our NOA-2 (or the interview notice) our Interview is scheduled on June 1st week! I cant believe how quick things turned out. Im just glad we didnt have any RFE's. Im really greatful for being part of VJ. But since our interview is soon approaching, Im very sure I have more questions while on the process of gathering all the required documents...........my hubby and I are very excited for the interview....but ofcourse part of me is still nervous....=P

  15. He can obtain a temporary work permit from his POE.(Mine was stamped at JFK). But this is good for 90 days only( it expires when his I-94 expire)You have to research if his POE will give him temp EAD.NOT ALL POINT OF ENTRY stamps you an EAD.

    After that, he can apply for SSN exactly 2 weeks after his arrival.(to make sure his name is already in the system)

    The above is no longer correct. A K1 visa holder is no longer work authorized for the 90 days that the I-94 is valid. The new requirements for completig the I-9 that every new employee has to do no longer allows a K1 to work with a temp EAD stamp on the I-94. This now only applies to people with a work visa where a specific employer is named.

    As others have said he will need to wait until after the marriage and then file for EAD along with the AOS.

    Really???? LOL and I was never updated! Sorry TayRivers....I guess you have to wait until you get your EAD along with your AOS.

  16. I have a few questions regarding the K-1 process and working in the United States once its dealt with.

    Does the K-1 VISA allow the fiancee to work within the United States once he/she is accepted? Were both unsure if you need to actually file for a work visa or not or if the K-1 is a kind of two in one thing.

    I would like to be able to have my fiancee work once he comes over here, but were not sure if he needs to apply for a work VISA prior to the acceptance of the K-1 or not, or if we need to wait until were both married? Weve done a bit of reading on it mainly on this site but we can't figure out a definate answer. :hehe:

    If someone could explain that part of the process to me in detail I would appreciate it

  17. Can I apply for my CA state ID? or Drivers lisence? I recieved my notice for AOS.EAD & AP yetesterday in our mail....Its really a hassle carrying my passport, copy of mrge cert and noa wherever I go. My 1-94 has been expired for a month now. So do you guuys this its possible?

    Not certain about Ca. ID/DL regulations - but as an FYI - even if you do obtain an ID/DL you're still required to carry proof of legal status in the US. :thumbs:

    Ok...im like going around in circiles here....I was aware that they wont let me apply for drivers lcs until I have valid (more than 60 days) 1-94.....I was just assuming that NOA will help....LOL.....sorry
