    Hi everyone, if anyone knows about taxes please confirm we have this info correct....

    I'm sure this has been covered, but please bear with me :blush:

    -I am a U.S. Citizen.

    -My wife came to the U.S. in July 2008 on K1.

    -We were married in the U.S. in Sept 2008.

    -My wife now has her green card, but received it in 2009.

    -Incidentally, she has not worked worldwide in 2008

    My wife was considered a nonresident alien for 2008, but for tax purposes she can be considered a U.S resident and we can file a joint return as long as we include with our return a statement signed by both of us stating that we want her to be treated as a U.S resident for the 2008 tax year.

    Does this sound right? Thanks!

  3. *****Update***** My wife finally received her green card today!!! Thank you, thank you God, and Thank You USCIS!!!!!

    Can anyone please tell me if they have received their green card after the interview WITHOUT ever getting an online update or approval notice online from the USCIS website?

    We were verbally approved last week and told to look for the geencard in the mail in about 10 days, but our online case status has never changed....still "pending". I just hope my wifes GC shows up in the mail any day now.....

If you decide to get a tax transcript from the IRS instead of making copies of your tax return I do not think they will fax your transcript back to you, but remember, you can fax or call your request to the IRS, this will be faster then mailing the request. Once they get the request they will mail the transcript to you in a couple of weeks or so. Just get on the IRS website and search for obtaining a tax transcript. Its pretty painless.

  6. From what I have read, you can include a copy of your tax return that you filed with the IRS, (this is a photocopy). If you do this they also want copies of your W2 from employer(s) and copies of any form 1099.

    Your other option is to get a tax transcript from the IRS for the most recent tax return year or for the last 3 most recent tax years to be more thorough. If you get a tax transcript then the I-864 instructions state you do not need to include copies of W2 and 1099 forms.

    All of this info is contained in the I-864, that can be downloaded from the uscis website.

    Getting a tax transcript is pretty easy and takes about two weeks or so. Just go the the IRS website and search ordering a tax transcript form 4506-T. To make the process as fast possible, you can fax your transcript request to the IRS, and you will get a transcript in two weeks or so. It may take longer now, since its tax season.

    YES....PHOTOCOPY=COPY

    If you filed a 1040 to the IRS then thats what you copy. If you do this then you must also send a copy of your W2. Also, if you received a 1099, (for example, from a bank for the interest you made) then send a copy of that too. This is all explained well in the intructions attached to the USCIS form

  8. Hi all, so we made it through our AOS interview!!!! Yaaaahhhhhh :dance:

    A couple questions.....

    The interviewer kept our appointment letter, which I guess is not a big deal, but I wish I made a copy to keep for our records. Has anyone else had there USCIS AOS interview letter kept by the interviewer??

    Our AOS case on the USCIS website has not been updated. Actually, It still says "receipt notice sent, fingerprint fee accepted, case pending." It never changed status or got a touch for the interview date....Has anyone had their status change on the website once the interview letter was sent? I wonder if it will change status now that we had the interview?

  9. I'm confused.....we sent our vaccination report from the civil surgeon in a sealed envelope along with our AOS application. I don't think we need to bring another sealed envelope from the civil surgeon with the vaccination information if it was sent in our AOS application??? :wacko:

    its been over a year since your last medical exam.. you should contact your local civil surgeon and schedule for a new one.. after you complete the medical exam the civil surgeon will give you a sealed envelope you should take to your interview.
  10. Can anyone tell me what we should be preparing to bring to the interview for AOS from a K1. My fiancee submitted her AOS and has done biometrics already. So...what should we be thinking of bringing to the interview when it is time? Is there a thread somewhere for this?

    Will we need to bring proof of our relationship and other sorts of documents....ect ect....?

  11. Hi all, I'm trying to get prepared for tax season.....

    From what I have researched it looks like I can treat my nonresident spouse as a US resident for tax purposes for 2007 while we are doing AOS.

    (from IRS website)Nonresident Spouse Treated as a Resident:

    If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a resident alien and the other spouse is a nonresident alien, you can choose to treat the nonresident spouse as a U.S. resident. This includes situations in which one spouse is a nonresident alien at the beginning of the tax year, but a resident alien at the end of the year, and the other spouse is a nonresident alien at the end of the year.

    My question is, have any of you US citizen spouses here on VJ changed their W4 at work once they were married to their nonresident alien spouses??? I was going to change mine to reflect that I am married, but I see that it says to leave the box as single if your spouse is a nonresident alien, but seeing that I can actually treat her like a resident for tax purposes, I wonder if I should change my W4 to married now?

  12. Hi, we sent our AOS and work authorization application together about a week ago to the Chicago lockbox and the check is now cashed for the 1010.00 and I received a NOA letter, but its for receipt of the work authorization only??

    Why did we not get a NOA letter for the receipt of the AOS application?? I hope there is no problem. Anyone have this happen? Thanks for any advice....

  13. Yes, I tried to book online with PAL once and when I tried to pay it locked up on me and gave me an error. I logged back in and cancelled the booking. I then called PAL customer service and got a quote over the phone. They told me I should not of cancelled the online booking since they may of been able to reteive it on their system.

    It might be better to try to book over the phone with PAL...

  14. My fiancee also decided to get her SS# before the marriage, since it is requested on the marriage application. I read somewhere that technically a SS# is needed for all US states for marriage, but I could be wrong. We just felt better having her SS# to place on the application. I think my fiancee brought her passport/visa, and I-94 to the SS office when she applied. She got the card in about a week.

    Better to wait a couple weeks after entering the US, but don't wait too long, becasue the SS office may not issue the SS# if your visa is about to expire.
