  2. They are so picky about expidited request. I have a hard lump in one of my breast. They denied me for an expidited request. I was told that I would qualify for one if I get a mammogram and it proves cancerous. The problem is, I have no family left (they are all diseased) other than my husband and I am too petrified to go for a mammogram due the possibility of it being cancer. There is a history of breast cancer in my family. I need my husband here with me for emotional support in the event that I find out it is cancer. I have no other support other than him.
  3. I completely agree with this 100%. Entering on a non-immigrant visa with the intent to stay and file for adjustment of status is fraud and it could get you both in serious trouble. You can possibly overcome doing that, but it would be very hard to prove that she did not misrepresent her intentions for entering the country. Just get married while she's here and have her go back to China and start consular processing. Fire that attorney. You are definitely going to need an attorney since she's part of CCP. Call around to several different attorneys and get their advice. There are quite a few that will give you a free over the phone consultation. Do not hire any attorney that tells you to marry and then adjust status.
  4. Ignore what the case tracker says. It is wonky, especially if it tells you 2 weeks if you just filed a couple of months ago. Right now, they seem to be taking about 11 to 14 months to process I-130's. They are mostly focused on asylum seekers/ refugee work permits and granting citizenship so they can crank out as many new voters as they can. It's election year after all. Hopefully after the election is over with USCIS will start prioritizing I-130's.
  5. Depending on how long you are staying and how much money you bring, it very well may be necessary to say "boyfriend ". The first time my husband came to visit me, he brought $400 in cash plus an additional $800 on his card. Initially he told them he was staying with "a friend". Due to the length of his stay (almost 3 months), they did not believe he had significant money to support himself for the duration of the stay. He was taken into a room for additional screening. They would not let him use his phone to contact me while I was standing there in the airport, waiting for him in arrivals. He finally snuck out his other phone and texted me to let me know "They won't let me in" while the officer was out of the room. I was freaking out, he was freaking out. Finally 30 minutes later, the officer called me and started asking me questions. I told them he was my boyfriend and he was staying with me and that I had him covered financially. 10 minutes later, they let him in. They had him detained for an hour and a half. He is from a low-risk country as well. The second time he came here, when we were getting married, he told them he was here to visit his girlfriend. He had NO problems getting in.
  6. When they ask her what her reason is for coming to the states, all she has to tell them is that she is visiting her boyfriend. There is no need to offer up additional information. if she is coming here for a longer period of time, like 80 or 90 days, then they might take her in for another screening. If the visit is about 5 weeks, she should be able to pass right on through. As long as she goes back after the marriage and you go through consular processing, getting married on a ESTA is perfectly legal. My husband and I got married on his ESTA and I spoke with several attorneys before doing this.
  7. Texas DPS is always booked out months in advanced. I ended up having to go to a different county and driving 45 minutes each way just to change my last name on my driver's license. There was a 4 month wait at the offices closest to me.
  8. I have titanium pins and plates in my ankle without really any issues. No need to have a DR note. I had the metal detector go off only once in London. If need be, they can just pat you down.
  9. Joe Biden and the Democrats are flooding our country with illegal immigrants as they view them as future voters for the Democrat Party. If you go to the USCIS website, they have their goal processing times for each form. You can also view how long it is taking them process each form. Most forms are 6 months. The form for Application for Certificate of Citizenship is form N-400. Look at their current time for N-400. The cycle goal to complete N-400 cases is 6 months. This year, it is taking them only 4.9 months to complete those cases. Last year, it was 6.1 months. It's election year so they are trying to crank out as many new voters as they can. Bidens campaign and the Democrats are probably sitting right outside of where they hold the ceremony, handing out fliers to vote for him and the democrats. After all, it is thanks to him/them that they are now citizens. Hopefully they will speed up after November 5th.
  10. No, that would not be grounds for an expidited request. I submitted an expidited request back in March as I have an unknown mass in my breast. The tier 1 officer sent me an email stating that I do meet the minimum requirements for an expidited request, however it is now July and an officer still has not even been assigned to look my expidited request. I stayed on USCIS for 2 months before getting frustrated enough just to give up. Nothing but a headache that got me absolutely nowhere. Just because you qualify or meet the requirements for the request, doesn't mean that they will bother to look at it.
  11. It's election year and they only have 4 more months to crank out new voters so they have been prioritizing N-400s. The goal processing times for them is 6 months just like it is for I-130s but it's only taking them 8 months to complete those. 😒 Hopefully for all our sakes, they speed up after the election.
  12. I'm a fellow December 2023 filer too. My attorney told me the process would take 18 to 24 months. And like you, my petition has been under review too since January. Sadly, there is really nothing you can do to speed the process up. I filed for an expidited request due to medical issues and was told that I do meet the minimum requirements for an expidited request, however they still haven't assigned an officer to bother looking at the expidited request and it's been 4 months now since I submitted it. This administration and USCIS don't care about us. It is election year so they have been prioritizing N-400 petitions so they can crank out as many new voters as possible. Hopefully after the election, they will speed up.
  13. Do you rent or own your home? If you rent, you could always add your spouse to your lease. My husband is on my lease. Also, you could put her as an authorized user on your credit card. No SSN needed as an Authorized User. Capital One Venture is a really good card for this as there is no forigen transaction fees. It would be easy to prove combined finances as there would be transactions made in both the Philippines and USA.
  14. You can not get a Tier 2 officer on the phone when you call USCIS. Speak to a Tier 1 and put in a request for an officer to give you a call back as you are outside the USCIS processing times. They will put you in a que to recieve the call but it might take awhile. I know this as I have been battling them over an expidited request that I had put in over a month ago for a medical issue. Also reach out to your senator, as well the CIS Ombudsman. Good luck and don't give up or let up.
  15. I'm a fellow December 2023 filer too. My processing time went from 6 months-5 months-4 months-3 months (it stayed at 3 months for 2 months) and now it is at 7 months. I wouldn't pay any attention to how long it says on USCIS because all you are gonna do is get excited and become disappointed when they add more time.
  16. Even if you file an expidited request, don't expect anyone at USCIS to look at it in a timely manner. I filed one over a month ago due to medical issues and they haven't even assigned an officer to look at the request yet. USCIS truly doesn't care about us.
  17. There is no 90 day rule. Just go back to your home country before your visa waver or visa expires and then have your fiance file the I-130 petition.
  18. When they ask what your intentions are in the United States, they do not need a play by play of everything you are doing. As long as you marry and then go back to your own country afterwards, telling them you are "visiting my boyfriend " is enough. There is nothing illegal about getting married while you are a visitor and it won't bite you in the butt later. Now if you come here with the intentions of getting married, staying in this country and trying to adjust status then yes, you misrepresented your intentions upon entering. Honestly, all CBP cares about is that you will be returning to your home country. I'd you volunteer the fact that you are getting married, they will be paranoid that you are going to try to stay in the country instead of going home. I talked to 3 different immigration attorney before I married my husband and they all said that it is perfectly legal to marry and him return to his home country afterwards.
  19. All documents not in English need to be translated by a certified translator. This includes her birth certificate. Make sure to send the translations in with your I-130 petition.

  22. I actually really like RFK Jr. After going to his presidential site and reading his plans how he would help the country, he will definitely get my vote provided he is on the ballot in Texas. He has detailed how he'd fix almost every issue our country is already facing. His border plan is actually pretty good. Definitely a much better solution that Biden or Trump have come up with. One thing is for sure, Biden won't get my vote.
  23. Be honest about the nature of your visit and who you are visiting. Have a return ticket home and proof of ties to your home country. Make sure you don't plan to stay too long or they will question you, with or without an I-130 pending. Learned that the first time my husband came to visit when we arranged for him to stay for something like 84 days. They almost denied him entry. Last time he came, he stayed 5 weeks and no problems.
  24. Oh I submitted a lot of pictures of us together that included mutual friends and family in them. A couple were from Christmas 2022 with my family.
