  1. Hello everyone,

     

    I wasn't able to find anything regarding this question, but here is the situation my father in law currently is in:

     

    He applied for his daugther (over 21) with the F2b visa application and, fingers crossed, the application is due to be approved sometime in the next few months hopefully. She is in Pakistan and he is currently a Permanent Resident in the U.S. and is due to apply for his citenzship this year in April (it will be 5 years). My question is that if he applies for his citizenship, will that affect his daughters visa application? If he becomes a citizen before her interview, will her case status be affected because he is no longer a permanent resident, but a citizen?

  2. Hello everyone,

    So we filed an I-130 application for my wifes father and just got notice that the petition was approved and forwarded to the NVC. On the NOA we received, there are no futher instructions. It just says that the NVC will contact the benificiary for further processing. I know we here have to file the I-864. So my question is when do we do that? Do we wait for the NVC to contact us? I'm sort of confused on that part. If I remember from my wifes I-129 process, I started gathering all the information and documents for her affidavit of support and I am doing the same now.

    Any help will be highly appreciated.

  3. Hi everyone. Just wondering if I could get some help. We are applying for AOS for my wife. I read that medical records are not required if she has had a medical exam done for the K-1 Visa. However, the vaccination supplement is required. Now, when she had her medical exam done she did not have to get any vaccinations. So I was wondering what do we need to submit with the AOS application? Immigration kept all of the documents that we had including the medical reports.

    Any help would be greatly appreciated. Thanks.

  4. I tried calling the local CBP office and they told me to either contact New York (our POE) or the USCIS. On the form I-102 (form for replacement I-94) it states that for I-94 forms issued by the US Customs or Border Patrol at a point of entry, contact the CBP. So...I'm going to try calling CBP, then the POE at New York and see what happens.

    By the way I got a response from the USCIS asking me to enclose the $320 fee. Is it really that hard to obtain a simple I-94? Wow...I would think that they just need to look up the info, print out the sheet of paper and that's it.

  5. Hello everyone. Hope that all of you are doing well.

    So I have seem to misplaced my fiancee's I-94 form. I actually think that it was never stapled to her passport because I never saw it. So I know that I need to replace that form by filling out the I-102. I have submitted the form I-102 but I didn't realize that there was a $320 fee associated with it. It's been almost 2 weeks since I sent in the form and no receipt from the USCIS and I've tried calling the office and can't seem to get through to a live person.

    Anyway, so the bottom line is this. We need the I-94 to start the AOS process. I realize that there is an expiration date on the I-94 and that getting a new I-94 can take a couple of months. Is there a certain deadline that I need to start the AOS process? The K-1 visa expires 3 months after date of entry as you all know. We already got married so that should not be an issue, right?

    I'm confused about this whole thing...so sorry if I sound unclear. Any help would be greatly appreciated.

    So what I've gathered is that an attested translation of the ID card is NOT compulsory.

    Our new concern is the marriage certificate. We have an original Nikkah nama in Urdu, AND in English (got two of them, for the visa). We sent the English version when filing the petition. Now I just read here that

    The marriage certificate for Muslims, the Nikah Nama, is registered with a Nikah Registrar, who is appointed by the municipality, Panchayat committee, cantonment board or union council. The original is always in Urdu, although attested translations may be provided. Because of frequent marriage fraud, many foreign embassies require wedding photographs in addition to the nikah nama or other certificate as proof of marriage.

    We're thinking of getting a translation of the Urdu nikkah nama just in case, but who has to attest that? Who attested the translated version of your nikkah nama?

    Yes, a copy of the ID card is NOT required. Sorry for the confusion guys. I can't help you on the nikkah nama because our paperwork was for the Fiancee visa.

    Regarding the vaccination shots. I am not sure which ones are required. I have heard that they are not needed at the time of the medical because those can be given here in the US when you apply for AOS. I think if you go to the website of the Islamabad Embassy, they have some information regarding vaccinations under their visa services section.

  7. One more question about the translation of the NIC. I went to the NADRA office to ask if they do these, and they said it takes up to 15-30 days!

    Is it OK if I translate the NIC myself and just get this translation certified by the ministry of foreign affairs? How did your fiancee get the translation?

    Yup my fiancee, and I mean my fiancee in Pakistan, had to attach a copy of her Identification card AND a translated version of it with Packet 3. It was on the instructions she received for Packet 3.

    I'll have to ask her and find out. I'll let you know in a little while.

    A question about the police certificate...

    - is there a form/format the embassy gives to obtain that certificate? I mean, how does it go?

    - I, the beneficiary, have lived in other countries from the time of birth to the age of 16. Do I have to obtain certificates from ALL of those countries? That's quite impossible!

    1. The embassy does not give you a specific form for the police certificate. You have to go to your local police station (or is it called the DIG Office, I'm not sure?) and ask them to give you a record of your history. You will need a couple of passport style photos for this as well. They will make you a certificate and sign it.

    2. If I'm correct, they ask for your criminal history for all the places you have lived SINCE the age of 16. So if you've been in Pakistan since the age of 16, then you do not need to get records from other countries.

  10. Congratulations for getting your case sent to Isb finally. Our case was also recently sent to Isb so I'm sort of in the same boat as you.

    You should definitely contact the embassy this monday and ask about your case. In my experience calling isn't very helpful, just email them including your full name and the case number (the one starting with ISL), you should email at the following address: pakivquery@state.gov

    As I have still not gotten the Packet 3 (hope to get it after Eid) I can't really tell you exactly what's in it. If anyone knows here it would be great if you could tell us. As far as I know there will be some forms in it such as DS 230, DS 156, DS 156K, DS 157 (maybe), and a set of instructions I suppose.

    As far as doing any homework, I've tried to get the following ready:

    Police certificates

    Birth certificate (also got two copies certified from the Foreign ministry, with a letter from Health ministry saying foreign ministry certifies birth certificates)

    Photocopies of all relevant documents such as passport

    Recent 2*2 pictures of self

    Vaccinations

    Organizing everything for the interview into respective folders such as our filing history, relevant documents for myself and spouse, and proof of relationship

    For the matter of your husband living in Pakistan for the past year, since he's still employed by a US firm I dont see they should have a problem. They might ask you where you plan to live exactly when you move to US, so be ready to give them an address. Maybe booking a flight and showing them evidence of that might help also at the interview.

    We found out yesterday that Alhamdulillah, our case (I-129F) has been sent to the Islamabad embassy (was sent on September 25). Since our case had been in a limbo for over two years, we had almost given up hope and didn't do any "homework" of keeping updated about the processes that take place at the embassy. Here are some of our questions.

    • What is the next step? Should we call the US embassy and inquire if they've received the case?
    • Is email a better method of communicating with the embassy?
    • When will they send us "Packet 3"? What are the contents of that packet? What's packet 3.5 and 4? If you could give us a list of documents we need, we'd really appreciate it.
    • My husband (the USC) has been in Pakistan for almost a year now. His current employers are in the US, his bank account is in the US, he pays taxes to the US govt... all that. His employer allowed him to work from Pakistan until his wife's (my!) visa issue got sorted out. Do you think he needs to go back now (now that we are at the embassy/interview stage)? I am just concerned about my AP now. I am scared if he goes back and I get stuck in the AP/AR (I've read it goes from 3 months to a year!!!), it'll make things extremely difficult for me. On the other hand, if he plans to wait till I actually get a passport stamped with the visa, I am concerned whoever interviews me would think we're not really planning to go to the US and may deny the visa. I don't know... what do you all think?

    -Make sure you have atleast 2 extra copies of your whole packet just in case. Packet 3 includes forms DS-156, DS-156K, DS-157, and DS-230. Get started on getting your police report, because this is probably the most difficult to obtain.

    -Also, when you respond to Packet 3, your fiance will need to include a copy of his/her ID card. Most likely it will be in Urdu so it needs to be translated.

    -Have a few passport photos handy. I think you need to send 2 with Packet 3, and then 2 more for the Medical.

    -When you respond to Packet 3, you need to send your affidavit of support (Form I-134) and all supporting documents in as well. Again, make sure you have multiple copies of the form and the supporting docs, because they may ask to see them again during the interview.

    That's all I can remember for now. The most important thing to remember is that you must keep everything organized. It's always easier when you're organized. Also, triple check all forms you fill out and send back to the embassy.

    As far as contacting them, I found it that emailing them was not very helpful for me. I must have sent them 8-10 emails and they responded once. However, each time I called I was able to get through. It's really just hit and miss when you try to contact them. One last thing...you need to have a lot of patience. You'll get tired of hearing the same "You're documents are still being reviewed..." sentence over and over again. Just keep a cool mind and everything will be OK.

  11. I've got some good news everyone. I just checked the Embassy's website and here is what it said:

    September 26, 2008

    This Warden Notice is to notify American citizens that the Consular Section will re-open to the public on Monday, September 29. Note that the Embassy will be closed to the public for the Eid Holiday from October 1 through October 3. Here is additional information regarding the re-scheduling of consular service appointments that were scheduled for September 25 and 26:

  12. So I just read that the Embassy has been shut down for Thursday the 25th and Friday the 26th of September due to threats. Visa services have been suspended temporarily and will be rescheduled by the consulate. My fiancee's interview is supposed to be on Monday the 29th.

    So I really don't know what the hell is gonna happen now. I'm pretty freakin pissed off right now. What to do? Guess I just gotta keep faith and pray that insha'Allah... everything will be ok.
