YES!!!! Not an approval, but i'm estatic anyways. it must be just around the corner.

  2. Do you have to be living there for 30 days or something before you can use that address? its too late for me now, but i was thinking, what if i had just rented a shitty apartment somewhere in the west so my application went to the CSC instead of the VSC? and then just changed my address after a month or two. would it get transferred back to VSC? if not, icould just leave it till i got my approval, and then change my address when it went to the NVC.

something to think about for people who are planning on sending out their packets.

  3. what if you lost your job? i send my wife 100 dollars bi-weekly, and i was recently laid off. she depends on that money because she really doesnt mae much at her job(3rd world country pay? like 200 a month..) can i apply for financial hardship now because i'm eventually going to be broke? i have joint sponsers for NVC so i dont have a problem there...

  4. She lives in Para but needs to travel to TO, they told her the standard time is 30 days. They might be faster or slower but they told her 30 days :crying: It doesnt matter at this point, I doubt she will be here before 2009 anyway so im not going to try to rush things. VSC is setting a pace of atleast 10 months for the I 130 as it is now, so they are really 10-12 months just for the I 130. If i get approved in November which is 1 year from when I filed there is no way to have everything done before 2009, i will be lucky to be done with NVC in Jan of 2009.

its one year from the day you get it, so if she got it tomm, it'd be valid until 05-27-09. you'll definitely need it before then so might as well get it. you never know when you might get a surprise approval.

  5. I am feeling a very bittersweet moment now....

Another Nepal VJer, madhuandnatalia, just completed her fiance's interview(approved). Don't get me wrong, I am very happy for her, but if you look at her timeline you will see that she sent her 129-F on January 28, 2008, and I sent mine on January 10th. I looked at her profile thinking probably she went through CSC, but no, she went through pokey ol' VSC!!!!!!! Un-be-f***inglievable!!!!!! Her case has sailed through the embassy in 4 MONTHS from date of filing, and I haven't had even a F%%%ing touch!!!!!!! This is simply not right that fiance visas should be given priority - I knew that going I-130 only would be slower but I had no idea how much slower.... I am coming back fully expecting that we are going to be separated another year...

Madhuandnatalia - CONGRATS, you know my anger has nothing to do with you but I am really PI$$ED OFF AT VSC!!!!!!!! :protest::ranting::protest::ranting::protest::ranting:

we have almost the same timeline.. i completely agree with you. i'm happy for everyone who's getting a speedy approval, but this is bullshit.

  6. The only part of the K3 that was faster was the NVC stage, that is where you would save those 2 months, but now with the online system up there is not a big difference. Before July both the I-129f and the I-130 would be approved at about the same time, you can ask your lawyer about it and I am sure he will tell you the same thing, I didnt use a lawyer for mine but i called a ton of them before i filed to get a good idea of what is what. If you are ready for the NVC part of things you could expect to be done with NVC in about a month. The only thing that stops me from being ready is my wifes police reports, in Brazil they are only good for 3 months and take 1 month to get. Since I am on month 6 of waiting I cant really say that I will be done with USCIS in the next 4 months. So I lose a month even when my petition is approved because I cant ask her to get her police reports now to have them ready because i fear that USCIS VSC is not making any progress. Ive pretty much given up on America though, my wife is getting ready to open her own Pharmacy and I agreed that it was a good idea so if she gets everything in order I will be moving there within the next 4 months or so.

i'm not sure if this varies from country to country, but in Dominican republic, even though the police reports say they're valid for only 3 months, for immigration purposes(sent to NVC), they're valid for 1 year. i'm pretty sure i need to take a second recent one with me to the interview, but the one i mail in could have been taken out anytime from a year ago to today. might wanna check up and see if thats the case for other countries as well. i thought it was 3 months only also cause i just sent my wife to get hers.

A validity period assigned by the country issuing a police report has not meaning. The US Dept. of State is only concerned with the criminal status on the date of issue. They use their own standards for how recent the report needs to be.

thats what i thought, so if the NVC told me one year, then its one year for all countries then, no? someone else might want to try calling and see if they get the same answer.

  7. Well I beg to differ. I dont think it was appropriate to use her case with the wording and dialogue you originally stated. I think she would be very hurt by that.

Doesn't really matter if YOU think using her case as an example was wrong. Or what you think might be appropriate words or not. Look, hurt about what? What do you think about approving Iraqis automatically? How can you think a through background check can be done on a person from halfway around the world in 11 days... or 42? huh? You tell me! Protect our borders? I think?

Besides all this.... Realistically... what would a 45 yr. old woman from South Carolina be doing marrying a man from Iraqi in the middle of a war zone??? Look, I don't know. That is not a question being asked by USCIS? It should be. Or maybe she flew to Iraq to marry him after meeting on the internet or something like this who knows.

Hey, I am married to Colombian woman and you know what... the US GOV wants to make damn sure that she is not married me just for a visa. And with good reason! Because this is what so many others do yes? Fraud their way into US illegally.

Colombia is a very dangerous place to be too. Ever been there? mmm... They have the FARC and narco-traficants and paramilitaries, groups of terrorists to worry about. 2 bombs went off in Cali just last week. How do I know? I am here to know!

If they US GOV can THOROUGHLY check a Colombian... they can thoroughly check out Iraqis all the more I think. Period. Now fight amungst yourselves on this, I'm finished.

right, because Colombians are being hunted down for marrying Americans, right? the situation in Colombia is SO much like the situation in Iraq. why didn't i see it sooner?

as for the background check issue, it doesn't take that long to perform a background check. you think your being held up because of a 5 month long background check? i cant honestly see a background check taking longer than 2 hours.

BTW, its Iraq, not Irac. good try though.

    SUBJECT: I-129F/K1 priority over 1-130?

"Hi, My name is Daniel, and i'm a U.S. citizen with a currently pending I-130 Petition at the Vermont Service center. I've read your reports on the USCIS and I had a question maybe you could answer for me.

I've been waiting for over 5 months for ANY information about my case, and I've noticed that I-129F/K1 filers seem to get approvals SO much faster than I-130 filers, sometimes within a month.. which seems a bit funny to me, as an I-130 would constitute a an existing family, and a I-129F/K1 filer is people who haven't even married yet. Is there a reason they give Fiance Visa's more attention than Marriage Visas?

Someone called the Vermont center, and the agent actually confirmed that I-130's are given the least priority, even among Tourist and Work Related Visas. That blows my mind.. These are families waiting to be together, and TOURISTS are given more priority? why??

Thank you for your time, i hope i get a reply..

BTW, my case number is **blanked out*** if that helps any.."

if you guys want do the same. i'm probably not as educated as you guys are on the subject, but i hope i got some of the point across..

  10. Hello everyone,

I hope this is the right place to post, if not mods are welcome to move.

I am living in virginia and have a CR1 visa. My adjustment of status is november 2009. I am moving back to the netherlands next month, and my husband will join me there in january next year.

Will i lose my greencard? What will i have to do to keep it? We do not know if we will move back eventually or not.

    Thanks in advance!

why spend all that time trying to get to america only to move back in a couple of months? i'd wait until you got citizenship in 2 years and change before moving back. then you can come and go as you please.
