I am currently working on a Family based visa for my father inlaw.

We are at the send DS-2032 to NVC along with the needed documents.

Obtaining a certified copy of the birth certificate is a small problem. So my questions are.

1. Does the NVC return the originals?

2. Anyone know of a way to find a Lawyer in Kizlyar Dagestan Russia so we can give Power Of Attorney to get the document.

I had always thought that you could not sponsor a visitor but then I came upon this.

To bump the old group, Alyona and I had our 1st anniversary on Saturday the 28th.

First no I551 stamp was issued.

2nd even after the green card is approved, the AP document would still be enough to get you back into the states. This exactly what my wife did with no problem.

So for the original question, it appears no one has had this happen.

with an approved greencard the AP document is null and void so it really should be a non issue

It is an issue because she was planning on traveling the week after her interview and hence does not have a green card yet. My wife did the exact same thing, interview on a Friday, return to visit family in Ukraine on the next Wednesday.

A friend has just had her interview, she was here on a tourist visa and then was married in October. At the interview they said she needed her to return the 2 AP documents before they could proceed with the Green card.

Anyone else ever have this happen?

Alyonas interview was April 10, her Green card arrived today.

Alyona had her interview on the 10th April, Nothing special, I did have to laugh at the questions about have you ever been evolved in drug trafficking ectera.

Got email notification today (first one of any of the 3) that Production was ordered on the 20th.

It would not make any discrepancy because it has the ratio of those who post versus thoughs who do not, has not changed.

However, they reported card received on the very same day, suggesting that the arrival of the card was indeed the first they knew about the approval.

They're evidently still working though cases but may not be emailing notices effectively.

The one EAD was from Augest and apears to be out of the norm. IF it was only an online delay , they would have started to apear again about the Febuarary 11. Assuming an 8 day delivery time per the average from those pages.

Also the delivery date and NOA date are the same making it look like a typo in the NOA date.

This is not about USCIS not updateing there online status. If you look at the VJ stats on AOS,AP,EAD normaly about 3 people a day file for these. But there has not been one new AP or EAD issued to anyone on VJ since Feb 3.2009. This is way outside of normal statistics so something is up at USCIS.

After your k1 expires in 90 days, and before your green card arrives, what is your legal status? I know in practical terms, but what law allows you to stay in country until the green card is issued?

Also look on the back of her I-94 (it is in her passport) if she entered the USA on JFK, it should have a stamp "Employment Athorized" this stamp and an SSN is valid for employment.

I went threw the same thing, I called the USCIS information, they told me that if the physical was conducted after July 1, then the TB test would have been performed. And hence we did not need another. The only thing we needed was to get a chicken pox vaccination and update the civil surgeon updated the report.

You could also apply for the AOS and request a waiver of the fee.

I have tried this twice, and failed. I was trying to have Alyonas father attend our wedding.

I have written the Embassy in Kiev quite often and my 2nd attempt included a senator inquiry. Here is what I have learned.

1. Showing support could hurt your cause.

2. All people who apply for a tourist visas from the Ukraine must be assumed to be immigrants. (per the embassy).

The person applying will have to PROVE that they will be returning back to the Ukraine, and hence not an immigrant.

If you have spent much time in the Ukraine, you already know how easy documents are to come by. So as the Embassy told me, documents are not worth a lot in the Ukraine. The 2nd interview was denied as soon as Victor answered the question , who will be paying for the trip. (I was).

It has become more difficult to get a tourist visa over the past 2 years.

If your MIL has traveled to other western countries, and returned to the Ukraine, your chances will be much better.

You success will be based on how well your MIL does at convincing the interviewer that she will be returning home.

Alyona and I met Oct 2 2007. There has never been a day where we have not spoke for at least 1 hour. On week ends we would spend 8 - 10 hours speaking via skype. We both wanted each other to be a part of the others lives every day.

I was also in a short term relationship that did not work out, It was night and day difference on her part. Alyona I could call at any time and she was very happy to hear from me, even if I woke her up.

So I would say lack of communication or rather not wanting to communicate show a lack of interest, and hence a huge red flag.
