2. By the deliberate refusal to give support to the other spouse, or their common children
B. Presumptive Death
The absence of the spouse for 2 or 4 years, depending on the circumstances, may be enough to ask the court for a declaration of presumptive death of the absent spouse, in which case the petitioner may again re-marry.
Ofcourse, since th wife doesn't know where his husband is...where will the summons be served? She will have it published in the newspaper of general circulation for 28 days (I am not sure).

well from what i have seen anyone from ur country that gets the PINK slip means that u passed the interview
i know its hard to wait but u have the hardest part done u passed the interview and got the pink slip just keep praying and maybe have or s/o call and see if they can push it a little bit?..........good luck to u

Hi Ria! I know how it feels to wait and wait for something to happen. I waited ten days for my visa and believe me, it drove me to madness waiting for Delbros. My then fiance told me that if your visa is denied by the embassy, they will let you know. Since you haven't heard from them, I guess your visa was just delayed. Darating din yun.
That makes sense.

Ive been waiting for 1 month and 3 days now...still waiting....
I did not get pink or while slip after my interview, was told that we are approved just need to verify the documents that I submitted...
Last September 8, 2008 they sent me a letter. I got the letter around September 16,2008. It was a white sheet with the check in "Wait until you hear from us" and with a handwritten docx1.
NO word from them yet...

Sometimes, I regret going thru this K1 process. Before, when missing my fiancee was so unbearable, I jump in the plane and head to Florida to visit him. It may be costly but at least it made me happy. But right now, I hate it when I feel so helpless... I've been missing Stephen so much! It has been a week and a half since he left. And it gets harder and harder each time we say goodbye
... Even my son is missing him too, always asking me where his Tito Stephen is. Thank you guys for listening to me. Trust me, I dont really like posting something that is soooo sad. I hope to post something really happy next time.
NEXT TIME YOU WILL BE POSTING.....DELBROS TEXTED ME!! THEY WILL DELIVER THE VISA!!!!

Ria, GOD IS GOOD, and GOD will make a way to all of us who is been waiting for our VISA. i know this is frustrating this is more frustrating rather than waiting for our NOA2, ohh boy, this is too much now. aside from missing our love ones i know everybody want to get there vosa now, before our plane ticket will get too much high. huhuhu... we are broke not by account but also with our heart. so please USEM realease our VISA'S... we all here are waiting.

It saddens me that you seem to want to give up on this. I would say that you are still fortunate and would encourage to keep your chin up. I know how it is to wait....and wait....and wait....and wait....but in the end, thing will go your way. You need to be strong not only for yourself but for your son and Steph as well. It has only been 4 week....others have taken longer, as I think you know. It will come...I know it will.

Hi steph. I understand the feeling of waiting but don't lose hope. I have a friend of mine who is waiting for 3 mos till her visa arrived. Remember that Good things happen to those who wait. Just pray and have faith..
Really? 3months? Wow! How did she do it? I mean how was she able to keep her sanity?

So yes, we basically struggled throughout the K1 process. At first, it seemed so easy. After all, the relationship is true and we have nothing to hide- ( no criminal record, annulment papers, had always acted in good faith with my tourist visa) And now, it feels like Im being punished for being a law abiding person...
I just want to start the K1 journey all over again... this time hoping that everything will be smooth and hopefully, I will get lucky and get a consul with a good heart...

I will never forget BAGUIO!!! It was my fiancee's favorite among all (Subic, Pagsanjan, Boracay, Corregidor)! That's where we celebrated my birthday. We rented a cottage at Baguio Country Club, had a barbecue and told stories infront of the fireplace. NICE!!!
(We still had a romantic time eventhoug we are with the whole family. lol!)

She will be fine. Take it easy. If she was approved for K3, I don't think they will reverse the decision.

If you still can't get your sister's affidavit of support, I think the worst thing that could happen is you get a white paper asking you for additional document, which is this affidavit of support.

Okay, I will be serious this time. If you haven'r read my previous post... here is my case.
After my annulment of marriage was granted, my fiancee filed for a K1 petition for me. After getting an approval, I prepared for my interview so I got a CENOMAR from NSO. In my CENOMAR, it says there that I got married to two men. Yes, I know the person but I am very sure that I did not get married to him. Ofcourse, there was an argument between my fiancee and me but that's a long story. The annulment that I got was the second marriage. So ofcourse, the first marriage was the valid one. We were thinking of cancelling the approved petition but I was thinking that if I can prove my innocence, then it would mean its as if it never existed. Believe me it wasn't easy. I had to ask help from NBI and private investigator. These were my evidences... Certification from the owner of the alleged place where we got married that there was no wedding that time. Certification that my signature was fake and the hallelujiah of all- the "reverend" who solemnized the marriage is in National Bilibid Prison (Muntinlupa). Apparently, this is his "modus operandi' and I wasn't the only victim.
After three months, it was declared "null and void ab initio" meaning it never existed.
During my interview, I was grilled but mostly about other issues. Ofcourse, they asked me about this fake marriage. Well, towards the end of my interview they told me that, technically I am not eligible for the visa because I was married when it was apporved. But since it is null and void ab inito, it means it never existed. So they said, they will just verify my annulment papers or my documents and if they are all true, I will be getting my visa in three weeks. Ive been waiting for a month and 5 days now. COULD IT BE THAT THEY CHANGED THEIR MINDS????????
Oh no! Moral of the story... its a 50-50 chance. Its a case to case basis. But the fact is, I am not yet at the end of torture.
