  1. I am on F-1 student visa here in the US, and I married my wife who is a citizen. Neways from my research on this page and after asking numerous people on this board, I had checked on A. I was filing I-130 and I-485 together. But I believe that if you have allready filed I-130 and you got that approved then you would tick on B. I had also checked on the last option, I believe it was H and I explained my current visa status and situation since they leave you room in that option to explain. Hope this helps.

    Thanks. I think I'll tick the 'other' box and write in that I'm an H1B adjusting, it's weird that there isn't a box for such a purpose. Hopefully be filing this week!

  2. File for your AOS before you finish working for your employer, that way you will not be out of status. Once you have filled the AOS your Status will be AOS pending and you are allowed to remain here in the US until a desission has been made. Make sure you file for the EAD along with the AOS so that you can look for work once it has been approved.

    Thanks. I was planning on visiting home for xmas (UK), would I still be covered under the H1B, or should I forgo the trip? Nothing is booked yet, just in the planning stages.

    I'm here in the US on an H1B visa and will be marrying in the fall (to a US citizen). So far I've figured out that I need him to fill in a I-130 petition on my behalf, but what about me working? I'm thinking my current visa is going to run out before I get anything approved, and since the H1B is employer specific, do I need to fill another form in? I had a look at I-765 but that doesn't look like the right one.

    Help is appreciated!

    Just wonder if anyone has been in a similar situation to me and either has some suggestions or solutions? I came to the US on a H1-B visa (employment based), and met my boy...so I'm looking at my visa expiring in a year's time...can't find another employer sponsor so we're considering marriage..

    My question is has anyone done it this way (I assume I can get married and file the paperwork whilst on my original visa?) And how long does it take? And what happens if my H1b visa expires before the new one is issued? Can I still work?

    Or am I better off leaving at the end of the year and filing a K1?

    We're just exploring our options at this stage and some advice would be very welcome. I'm here in the US on an H1b valid until early 2009. However I've been job searching as I would like to move from academic research to industry research. I've found this to be next to impossible as I would need a new H1b visa, and wouldn't be able to start a new job until October, not a very attractive proposal for an employer!

    So we're looking into K-1/K-3 visas. Can I transfer to a K1/K3 while I'm here on my H1b? Could I start the application process whilst I'm still here or would I have to go home for a while? And what happens about working once I get a K1/K3? Do they expect you to live on fresh air until they approve everything? I already have a SSN, can I keep it and use it on a new visa?

    Thanks so much, it's all very confusing at the moment!
